Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, at 7:30 0clock P.M., on March 31st ,1930. i 14eeting called to order by President Liddle. Roll Call, Present: Liddle, Erickson, Hicks, Miller, Rommel, 80hroeder, Vihstadt, Absent: None. IIpon motion by Rommel, second by Hicks, the minutes of the meetings held on. March 12th,1930, March 17th,1930, and March 27th,1930, were each approved. President Liddle announegd this as being the time and place fixed for a hearing on the sprinkling or treating of streets and avenues during the season of the year 1930, being the period April lst, 1930, to November 1st,1930, and asked if there was any person present who wished to be heard caneerning the said sprinkling or treating. S. 0. Sanderson and George Alseth were present and opposed the proposed sprinkling of Fourteenth Avenue Southwest between Sixth Street and Seventh Street, and upon motion by Erickson, second by Hicks, it was I ordered that the sprinkling of Fourteenth Avenue Southwest, between Sixth Street and Seventh Streetlbe stricken out from the 1930 sprinkling i proceedings. Alderman Schroeder introduced a resolution ordering that the ;' streets,avenues and' alleys and parts thereof described in the said resolu- tion be sprinkled with water or treated with calcium chloride or any other approved dust preventive during the period April lst,1930, and continuing untiil Novenb er 1st ,1930, and ordering that the City EJhg1heer secure the necessary horses, teams, labor, water and materials and do the said sprinkling or treating in accordance with the specifications for the same,and ordering that the cost and expense thereof 'shall be assessed upon and against the properties benefitted, as provided for by the resolution passed and adopted by this Common Council on March 17th,1930, and that funds realized from the balance of the cost thereof shall be paid for from/general taxation as provided for in the said resolution of March 17th,1930, which said resolution,introduced by Alderman Schroeder, was read. Upon motion by Rommel, second by Erickson, that the said resolution. be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. i This being the time and place fixed' for the opening of proposals for the .furnishing of 120 to 200 tons calcium chloride, the proposals of the Dodge Lumber and Fuel Company, Rochester Ici;and Fuel Company, and the Columbia Products Company, L. R. Boyce,represenT,ative, were opened and read; each ofthe said proposals being $29,25 per ton, containers included, F.O.B.cars Rochester, Minnesota, freight prepaid, with a discount of one per cent for cash in ten days from the works price of 122.75 per ton, otherwise 30 days net. I j For an expression of o15inion as to the award of the calcium chloride j contract, motion by Schroeder, second by Rommel, carried that the contract be i awarded to E. R. Boyce, as representative of the Columbia Products Company, all voting in favor thereof except Alderman Vihstadt, who voted "Nay". George T. Trenholm, asked for a renewal of the ordinance authorizing. the I �j Rochester Bus Line to operate jitney bus lines within the City of Rochester, Iinnesota, and stated that he will operate for five cent fare regardless of what competition between taxicab firms does to the rates for transportation. Alderman Erickson introduced an ordinance authorizing the Rochester II Bus Line, its successors and assigns to establish, conduct, maintain and operate jitney bus line;Oor jitney bus lines, through, over, upon and along the streets and avenues in the City of Rochester, Olmsted County, Minnesota, which was given its first reading. Upon motion by Hicks, second by Rommel, the rules were suspended and the said ordinance was given its second reading. Upon motion by Erickson, second by Miller, the rules were suspended and the said ordinance was given `its third and final reading. Upon motion by Rommel, second by Vihstadt, that the said ordinance be adopted as read, and all voting in favor thereof, President Liddle declared the sadd ordinance duly passed and adopted. Alderman Miller introduced a resolution accepting the proposal of the I Columbia Products Company for the furnishing 120 to 200 tons of calcium chloride I and fixing the amoufit of the bond to be given by the said contractor at the sum of �585 0.00, which was read. Upon motion by Hicks, second by Rommel, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolu-1 Lion duly passed and adopted. Upon motion by Erickson, second by Schroeder, it was ordered that the certified checks of the unsuccessful bidders for the furnishing of calcium chloride oe teturned to them. I' 40 mrs. Mark Christensen made complaint that Wm. R. Jones, City Scavenger, had made scavenger service charges against the Mrs. Herman Smith, estate, property, when there were no services furnished, and Presi- k dent, Liddle referred the matter to the City Attorney. I Kris Neilson was before the Common Council under instructions of the Street and Alley Committee for his appearance in connection with his unauthorized excavation in and removal of dirt from Fourteenth Street Northeast, along his cement block factory, and upon motion by Vihstadt, second by Erickson, it was ordered that he be required to replace the dirt and fill the excavation to the satisfaction of the City Engineer, within twenty-four hours. Alderman Rommel called attention to the condition created alongthe North side of Fourteenth Street Northeast, by the spring stream ii which comes from the hills north of the intersection of Eleventh Avenue i Northeast and Fourteenth Street Northeast, and President Liddle referred this li iimatter to the Street and Alley Committee with instructions that they !confer with the Commissioners of Olmsted County as to some remedy for the s ituat ion. Two warranty deeds given by Wm. A. Fitzgerald dnd wife, to the City of Rochester, Minnesota, covering lands for an extension and ;widening of Sixth Street Southeast, between First Avenue Southwest and ,Broadway Street South, and lands for an extension of First Avenue. •:Southwest, were read, and upon;.motion by Hicks, second by Vihstadt, the !;said warranty deeds were accepted, and it was ordered that the saute be "placed on file. Dear Sir: Re: Location of Trunk Highway No. 5,9-City of Rochester. i Replying to your letter of Marcji 25th 1 wish to ad- vise that we have just completed arrapgements.whereby we are to obtain the necessary rAght of way from the Chicago and Great Western Railway Company. It will, therefore, be possible for us to build the bridge in the location desired by the City of Rochester and on that account I do not see any reason why you c-.n not proceed at once with the erection of your fire -hall on the site as origin- ally planned. Miller, architect, presented ,plans, profiles, specifications and estimate of cost for the donalritftion, furnishing and equipment of a new central fire station and the wreaking and removal of the present fire station, which were considered by the Common Council, Alderman Hicks introduced the following resolution, which was read: `"WHEREAS,, The voters of the City of Rochester, Minnesota, at a Special Election bald on January 7th,1930, approved the construction, furnishing and equipment of a new central fire station and the wrecking and removal of the present fire station and ratified $503,000.00 bond issue for these purposes, and WHEREAS, John McG. Miller, has been duly appointed and selected as an architect for the said improvement., and 1 WN?.REAS, the said John MeG. Miller, has prepared and submitted plans, profiles, specifications and estimate of cost for the said construction, equipping, and furnishing of a new central fire station and the wrecking and removal of the present fire station; SO i -TIEREPORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said plans, prof.ilesand specifications be adipted for the above mentioned improvements, and it is hereby ordered that the same be placed on file in the office of the City Clerk of said City, and the said estimate of cost is hereby accepted and it is ordered that the same be placed on file in � the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That a new central f ire stht ion be constructed, equipped, and furnished in said City, on that part of Block 102, il. Willson's Addition to the City of Rochester, Minnesota, which lies 'East of the Mill Race, and except that part of the W. 44 feet of Lot 69 in said Block 102, which lies East of the said Mill -Race, and that the present central fire station be wrecked and removed, all of which shall be done in accordance with the above mentioned Aland, profiles and specifications, and Be it further resolved by the said Common Council: That the City Clerk 1� of said City be and he is hereby authorized and directed to advertise for sealed i proposals for the construction, equipping and furnishing of a, new central fire station and the wrtckin5 and removal of the present central fire station, in it accordance with the above mentioned plans, profiles and specifications, which said [!sealed proposals will be feceiv6d and opened at a public meeting of this Common Council, which is to be held in the Council Chambers, in the City Hall, in said City, at, 7:30 ii6 clock P.M., on April 16th,1930. A separate proposal shall be rmade'for the general contract, for the plumbing and hea4ing contract and for the electric wiring contract as specified for the' construction, equipping, and furnishing of a new central + i !!fire station and a Be parate, proposal shall be made for the wrecking and removal of the present central fire station, and each bid shall be accompanied by a certified , check for at least ten per cent of the amount of the bid, drawn upon some reputable bank payable to the Mayor of the City of Rochester, Minnesota, which check and the j ", it j amount of money specified thereln shall be forfeited to the City of Rochester, Minnesota., as liquidated damages, if the bidder upon the letting of the contract to him, shall fail to enter into the contrast so let; the said Common Council reserving the right to ro ject any and all bids." Upon motion by Erickson, second by Rommel, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Rommel, second by Miller, the City Clerk was instructed to colleQIt $10,00 for each set of general contract plans and specifications, 12.00 for?:e6oh set of heating and plumbing plans and specifications, and $2,00 for each set of electric wiring plans and specifications, and to furnish the wrecking and removal specifications free, with the understanding that rerundment of. �16.00 will be made for each set of general contract plans returned in good condition 01,66 and specifications returned in good condition for each set of plumbing and heating plans/and 11.00 for each set of electric wiring plans and specifications returned in good condition; which said instruction as to charges for refundment shall be incorporated in the advertisement .for bids. Geo. Garbisch called attention to the danger from broken planking en the Fourth Street Southeast bridge over the Zumbro River and President Wddle .referred it to the Street and Alley Committee for their attention, The report of the Clerk of the Municipal Court for the week ending March 24th,1930, showing criminal fines collected �60,00, civil i fEes received Sv7.00, Olmsted County payment of $36.35, for February ;! 1930 municipal court fees, Court costs charged to Olmsted County 014.50, and fines collected due to ®lmsted'County44.60, was read, and President Liddle referred the same to the City Attorney, Upon motion by Hicks, second by Erickson, the sum of $44060 I� ;i was appropriated from the General Fund and it was ordered that the same i i be paid to Olmsted County, Minnesota, .for local Municipal Court fines collected due to Olmsted County, Minnesota. General balance sheet, trial balance , fund statement, t unexpended budget statements, etc., prepared by the City Clerk,, as. of R j� February 28th,1930, were laid before the Common Council and President Liddle ordered that the same be placed on file. Balance sheet, income statements, etc., of the Public Utility Departments, prepared by the Secretary of the Public Utility Board, as of February 28th,1930, were laid before the Common Council, and President R� 'u Y: 385 --- ------- Qi I Liddle ordered that the same be placed on file; the said inccne statements showing a net profit, in the Light Department for the month of February,19301 of 120116.019 and a net profit in the Light, Department for the eleven months of this fiscal year of $166529,05, a net profit in the Water Department, for the month of February 1930 of A2698.66, and a net profit, in the Water Department for the eleven months of this fiscal year of 145767,36, a net profit in the Steam Heating Department for the month of February 1930 of 11046,34, and for the eleven months of this fiscal hear of $599807. Trenholm,doing business as the Rochester Bus Line, Ii as to ownership, outstanding indebtedness, operation profits, etc., for the period I{ 17t h ; December 19238, to December 31st,1929, was read, and President I,iddle ordered that the same be placed on file. The petition of H. S. Plummer for the vacation of Ninth. Avenue Southwest, between the South line of Tenth Street Southwest and the North line of i Eleventh Street Southwest, and the petition of H, S. Plummer for the vacation of the alley running North and South across Block 8, i.n Williams, Healy Cornforth's i Addition, and for the vaeat inn of the alley running East and West through the said I Block 8, were each read, and upon motion by Miller, second by Erickson, it was ordered that the City Clerk prepare vacation proceedings for the said part of Ninth Avenue Southwest and for the alleys mentioned, for action thereon at the next, meeting of this Common Council; the publication costs for the vacation pro- ceedings to be paid for by Dr. H, S. Plummer. A petition for the construction of curb and gutter on Seventh Avenue Southwest, from the South line of Sixth Street Southwest to the North line of i Eleventh Street Southwest; the curbing faces to be thirty feet apart except in the block between Sixth Street and Seventj Street where it will be forty feet, with payment to be made in two installments, one in 1931 and one in 1932, for those who 4 wish to pay alongg, with teal estate taxes, with interest effective as usual for assessments, was read and President T-jiddle referred this petition to the Street and Alley Committee. g Alderman Erickson introduced the following resolution, which was read: "W.TTRFAS., theCommissioner of Highways of the State of. We are constructing this sewer for the discharge of condensing water from our station, and request your permission for its connection to the storm sewer on Second Street S.W. The water discharged through this sewer is the excess water which can not be used in our domestic hot water systems and is free of contamination of any kind. Re; The Oronoco Power Dam Development. 1390 �r "Q _. f The Directors of the Rochester Commercial Club feeling grave concern over the growing need and demand for electrical power in the city of Rochester and having given consideration to the problem of providing for the future electrical needs of the city prepared a statment of facts concerning the Oronoco Dam Power Development Project, and mailed it to every member of the orgaAization. A ballot' was inclosed requesting the members to express their opinion of the project. Of the 290 ballots ' mailed out 194 were returned of wM.ch 148 were in favor of the project and 41 were opossed to the plan. Thus showing; a majority i; Of 32 to 1 in favor of the Oronoco Power Dam Project., i At the last meeting of t,he•Board of Directors at, which time a report of the ballot was made the officers of the Club endorsed the Oronoco Power Dam Project, We offer this information with the hope that it will be of some assistance to you. The following recommendations were read, and upon motion by icks, second by Rommel,the City Clerk was instructed to make the various dit ions t the values of the lands and properties mentioned and that he depreciation charges in accordance with the salad recommendations: "Rochester, Minnesota, March 31st, 1930. Honorable Mayor and Common Council, Rochester, Minnespta. Gentlemen: We, the Public Grounds Committee of said City, Respectfully recommend that the valuation of the public hitching grounds which is that part of Block 102 in Willson's Addition which lies East of the Mill Race, be raised from 391 '"10,000.00 to A20,000,00; that $13,000.00 be added to the valuation of Soldier Field land and buildings for the value of the club house and fence, and that the value of Kutzky. Park land be raised to 82500. 00. Gentlemen: We, the Street and Alley Committee, and the City Engineer, have. to report as follows: Relative 'to the petition for the grading of Ninth Street Northeast between First Avenue and Second Avenue, we will say that this has been taken care of by the improvement of the drainage there; As to the petition for the change from diagonal parking tp parallel parking on Second Avenue Southwest between Third Street and Fourth Street, we recommend that the diagonal parking remain in force for the time being; bridge Relative to the petition for the new . on Tenth Street Southeast over Bear Creek, we agree to the need of a new bridge for the near future when funds are available and when the right of way has been secured for the new creek ehaunel; As to the petition for the opening of Third Place Southeast, between Thirteenth Avenue and Fourteenth Avenue, we recommend that this petition be not granted as the cost of moving the buildings, etc., for the opening of trd.s extension would eonfisicate the property which would have to be assessed for the damages; In regard to the request for permission to install an oil storage tank in the boulevard in front of or in the alley in the rear of the Grand Cafeteria, we have to say that such permission cannot be granted; In regard to the petition for the paving of the alley in Block 25 in Head and McMahon's Addition we recommend that it be not granted as the withdrawal of Dr. Dixon from this petition .leaves less than a majority of the property owners petitioning for the (1 improvement, and that, no fprther oonsideratjon be taken of a petition for this improvement until such time as the property owners concerned agree edong themselves as to the grade line for this paving.
