I-Ainutes of an adjourned regular meeting of the Common Council of the

;City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
I City, at 7:30 o'clock P.M., on April 14th,1930.
Meeting called to order by President Liddle.
II Roll Call, Present: Liddle, Dallman, Erickson, Hicks, Miller,
adt. Absent: Rommel.
Upon motioni;by Erickson, second by Dallman, the minutes of the meeting
ld on March 3ldt,,1930, were approved.
President Liddle announced this as being the time and place fixed for
a hearing; on the construction of a sanitary sewer, the laying of a water main, and
the laying and c cnstruction of laterals described as follows: Commencing at the
center of the intersection of Tenth Street Southwest and Eighth Avenue Southwest.
and running West alonrr the center line of Tenth Street Southwest 300 feet, thence
North 550 West 615 fQet through Plummer's Replat "A", thence North 180, West 300
feet, t,heiice North 450 West 250 feet to the West line of the City limits, to consist
of an 6" sanitary sewer with 6" lateral connections to the property line, and a 4"
class B cast iron water main with 1" lead connections to the property line, with
corporation cocks and curb stops; curb boxes not to be furnished, and asked if there
was any person present who wished to be heard concerning the said sanitary sewer,
water main .or laterals.
There was no person present who wished to be heard relative to either or
any of the above described improvements.
Irs . Lester Travis, accompanied by _nrs . Don E. Postier, asked permission
that the Ladies Auxiliary of the Veterans of Foreign Wars be allowed to sell Buddy
poppies on the streets of the City of Rochester, sinnesota, May 34th,19;50, and upon
:notion by iUller, second by Vihstadt, such permission was granted.
Mrs. Waterman W. Hendricks, for the American Legion Ladies Auxiliary,
asked for permission that they be allowed to sell Poppies upon the streets of the
City of Rochester, Minnesota, May 24th,1930, and upon motion by Vihstadt, second
by Erickson, such permission was granted.
Alderman Rommel came in at this time and took his Chair.
Lester J. Piegel, for the Board of Education of School District No.8,
to them
asked that -the City of Rochester, Minnesota, deed/the so-called "School Block" which
lies between Sixth Street Southwest and Seventh Street Southwest, and Fifteenth
Avenue Southwest and Sixteenth Avenue Southwest, whidh has been heretofore deeded to
the City of Rochester, Minnesota, for public school purposes, and upon motion by

Hicks, second by Erickson, the City Attorney was instructed to draw a warranty deed

j in favor of Independent, School District N0*8, and by the same motion
authorized the Mayor and City Clerk to execute the said warranty deed, which
said warranty deed shall carry provision that the said Independent School
'District No. 8 shall pay the grading assessment against this property for

"the grading of Sixth Street Southwest. ;
The matter of the award of the contract for the official City
;printing and publications during -the ensuing official year, having been
Adjourned and continued to this hour and date the subject was discussed and

the Rochester Post -Bulletin submitted the following amendoment, to their
bid made April 7th,1930:

Alderman Hicks introduced the following resolut ion,which
was read:
"Be it resolved by the Common Council of the City of

That the "Rochester Post -Bulletin" be and the said newspaper
is hereby designated asthe official newspaper of the City of Rochester,
Minnesota) for and during the ensuing official year; and the Mayor and
;City Clerk are -authorized and directed to execute a contract in accordance
iwith their ,amended proposal of April 14, 1930."
Upon motion by Erickson, second by Dallman, that the said
resolution be adopted as read, and all voting in favor tbereof, President
,Liddle declared the said resolution duly passed and adopted.
The request of Glenn B. Sanberg for permission to construct
,curb and gutter along h1s property at 116 Sixteenth Avenue Southwest, was �

Ireferred the same to the City Attorney.

The report of the Building and Electrical Inspector for the month of
"Aarch,1930, shovririg building inspection fees collected in the amount of `�82.00, and
electrical, inspection fees collected in the amount of 111.75, was read, P,nd President.
Liddle referred the same to the Finance Committee.
Balance sheet, income statements,etc., of the Public Utility Departments,
prepared by the Secretary of the Public Utility Board, as at March 31st,1930, were
laid before the Conmon Council, and President Liddle ordered that the same be placed
on file ; the said income statements showing a net profit in the Li, Department
for J'Aare h, l9j O, of :1711089.15 , and a net profit for the two -i_ve months of . tho fiscal
year of -,?1177615.20, and a net profit in the Water Department for the month of March,
1960 of �' 8094.21, and a net profit for the twelve months of the :fiscal year of
g53861.57� and a net profit in the Steam Heating Department for the month of larch
1930) of <G1193.11, and for the. twelve months 'of the fiscal year of 117197.0$, which
said division carried a note�.'.that plant labor and depreciation on steam, generating
equipment cost has not been charged against these profits.
The annual report of the Public Utility Board was laid before the Common
Council, and President Liddle ordered that the same be placed on file; each of the
Aldermen bein,_ furnished with a copy thereof.

The petition of the Rochester Ice and Fuel Company that calcium chloride
ibe placed on Eighth Avenue Northwest, from about 100 feet South of its intersection
with Fifth Street Northwest and running North to the Witte Transfer- warehouse end

.which the City of Rochester, Minnesota, is making for the plans, profiles and
specifications for the new Central Fire Station, was read, and President, Liddle
ordered that the same be placed on file.
The application of Man-sel M. Beal for permission to place a fuel oil
tank under ground adjacent to his building and in Fifth Street Southeast about
60 feet East from the East line of Broadway Street South, was read, and President

That the sureties on the City Depository bond of the Rochester Loan & '
;('Trust Compai-�y of Rochester, ?Minnesota, for double the sum of 4�60,000,00 dated April
14th,1930.1 be and the said sureties on the said bond are hereby accepted and the said
bond is here*.;y approved and ordered placed on file in the office of the City Clerk of
said City; said bond being submitted, accepted, approved acid ordered filed under and
iri accordance -Jith the proposal of the said Rochester Loan & Trust Company, dated

were made in that stock record entry made in February 1930, was not
considered; in that the adjusting entry for Cold Patch was not taken into
consideration in the above mentioned resolution; in that the .8,565,88
charge for 125 drums of Stanolind filler disbursed in February,1930 was

Judc;ing from a conversation with J.McG.Miller, the architect
on the new Central Fire Station work, there seems to be some question
in the minds of some of the prospective bidders on the new Central
Fire Station regarding the applicability of the two ordinances recently
passed by the Common Council setting the scale of wages to be paid on
public work sand providing that only bonafide .residents of the City of Roches-
ter shall be employed thereon.
In order that all of the contractors and bidders may come in
on an equal footing and in order to clear up and differences of opinion
there might bF; regarding these ordinances and their application to ,the
Central Fire Station job, you are advised that the bidders on the new
Central Fire Station ore to ignore completely all of the provisions of
the two ordinances above mentioned. This opinion is based upon the fact
that the Coiamon Council of •the City of Rochester at a meeting on the
31st day of, ?.,fareh,1 30, approved and adopted the plan-- and specifications for
the new Central Fire Station as they were submitted by J: ,Accl.Miller, the
city's architect, and at that, time, inasinuch as neither of the two ordin-
ances above mentioned were'in force, the specifications or plans did not
contain any of the provisions relating to them and s inoe the ordinances
were not passed until after the acceptance, adoption and approval of the
plans and specifications, it' is' obvious that, they would have,no application
to the said work.
I might suggest that your office mail out such information to
prospective bidders.

1-'he City Clerk reported ttLat due to the short time before proposals
would be submitted, he h-.d furnished each of the contractors who were figuring on
the general contract, the plumbing and heating contract,andthe electric wiring
contract ,for the new central fire station, with a copy of the above quoted ruling
by the City Attorney, and upon motion by Hicks, second by Erickson, the City Clerk's
actions in putting out these copies to the contractors concerned was approved.
Power Company, were laid before the Common Council, and President Liddle
ordered that the same be placed on file, 'and that the City Clerk
acknowledge receipt, of the -same.
The claim of Kruse Insurance Agency 135.67, got fire,
lightning, transportation, tornadgr, cyclone, wind storm, hail, tb.eft,
property damage, and personal injury insurance, on the Ford truck owned
by +:he Department of Parks, was read, and President, Li.ddle refurred the
same to the Insurance Committee.
The following claims were read, and upon motion by Hicks,
second by Miller, the same were allowed and the -Mayor and the City
Clerk were authorized and directed to draw warrants upon the City

Upon motion by Miller, second by Hicks, the City Engineer was authorized
to make tie necessary strapping at the gravel pit and to employ E. R. Boyce to make a
cross sect ion survey for computation of the gravel taken from the Waldron pit.
Upon motion by Ro2imel, second by Vihstadt, the four acres of the
Sewage Disposal Plant lands which are not used for that purpose at this time,
