of the City of Rochester, Minnesota, held in the Council Chambexs, in the
City Hall, in. said City at 7:30 o'clock P.M., on April 28th,1930, m
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Dallman, Trucks, Miller, Rommel,
Vihstadt. Absent: E ickson; Alderman Erickso:a being absent on account of
the illness of himself.
Upon motion by Miller, second by Vihstadt, the minutes of the
meetings held April 7th,1930, April 14th,1930, April 16th,1930, April
18th.,1930, and April 21st,1930, were each approved.
President Liddle announced this was the time and place fixed
for a hearing on the construction of .a sanitary sewer commencing at the
center of the intersection of Tenth Street Southeast and Fifth Avenue
Southeast, and .gunning Southerly along the center line of Fifth Avenue
Southeast to the center of the intersection of Eleventh Street Southeast
and Fifth Avenue Southeast, and the laying of a water main in the said
part of Fifth Avenue Southeast, and asked if there was any person present
who wished to be heard concerning either of the said improvements.
There was no person present who wished to be heard relative
!!'to either of the said improvements.
Upon motion by Rommel, second by Dallman, the rules were
suspended and an ordinance to amend Section 2 of an ordinance passed by
the Common
Council
of
the
City of Rochester, Minnesota, entitled "An
Ordinance
granting;
to
the
Wisconsin, Minnesota and Pacific Railroad Couiy;any
the right to construct, maintain, and. operate a railroad across certain
streets and alleys in the City of Rochester" was given its second reading.
The following Committee reports were read, and President Liddle
ordered that the same be placed on file:

Gentlemen:
In the matter of the petition for the construction
of a sanitary sewer and laying of a water main in Sixth Street
Southeast, we recommend that a sanitary sewer be constructed in
Sixth Street Southeast, commencing at the center of the intersec-
tion of Tenth Avenue Southeast and Sixth Street Southeast., and
running Easterly along the center line of Sixth Street Southeast
to a point 80 feet West of the East line of Eleventh Avenue
Southeast, and that a water main be laid in the said part of Sixth
Street Southeast.

Upon motion by Vihstsdt, second by Miller, the City Clerk was inatructed
to prepare proceedings for a hearing on the construction of a sanitary sewer and the
laying of a water main in part of Sixth Street Southeast, as above described.
Dr. H.- H. Bowing, read the following communication, and President Liddle
ordered that the same be placed on file:

,Ay purpose in appearing; before you is to ask your approval of the
petition of the Utility Board to complete or cover the water tank in my
neighborhood according to the plan submitted by :vir. wliller, their architect. j
.We appreciate the necessity of having such a structure placed somewhere
in the city, and the Board deemed it advisable to place it in its present
location, which happens to be across the street from my residence. At best
the tank is unsightly and to permit it to remain unfinished would be undesir-
able from any point of view.
I am confident you will agree with the following statement. Provided
this water tank was near the property of any home -loving citizen of Rochester,
he would expect you to support the proposition. and thus make it possible to
complete the task immediately.

A petition of Dr. Edward Starr Judd and Mrs. Helen B. Judd, for annexa-
tion to the City of Rochester of Lots 97, 98, 99, and 100, in Belmont Addition, was
read, . and President Liddle ordered that the same be placed on file.
Upon motion by Hicks,, second by Vihstadt, the City Clerk was instructed
to prepare an ordinance for the annexation of the above mentioned four lots with
the provision that Dr. Judd shall make a payment of %00, 00 for the annexation of
these lots in accordance with local ordinance pertaining to annexations.

!! John J. Kerr presented a plat of Holm's Sub -Division of a part of
Lot 46 in State Sub -Division -of Section 36;107-14, and President Liddle referred the
same to the City Engineer.
The report of the Clerk of the Municipal Court for the week ending
April 21st,1930, showing criminal fines collected in the amount of <' 72.60, court
costs charged to Olmsted County `S24.30, and fines collected due to the State of
Minnesota and remitted direct, to the State Treasurer in the amount of
1,30.00, was read., and President Liddle referred the same to the City
Attorney.
The applications of S. H. Arthur West, for two soft drink
dealer licenses were reRd, and upon motion by Miller, second by Vihstadt,.
t)xe licenses were granted.
A petition that a sidewalk be constructed on the East side of
T!leventh Avenue Northeast, from Ninth Street Northeast to Tenth Street
Northeast., was read., and upon motionbyHicks, second by Ro,-mel, the said
petition was referred to the Street and Alley Committee, and the City
Enfrineer, wit.h instructionsthat they make report there6h at the next
meeting of this Common Council,
The following emergency authorization was read, and President
Liddle ordered that the same be placed on file:

It having been made to appear that there is iiimiediate
need of having many thousands yards of dirt moved and graded on
Soldiers' Field and that in order to have grass grown on the
newly graded wor`-J, it will be impossible to take the tine to
advertise, for bids for the coin of said wor4 and that the delay
occasioned by compliance with the Charter of the City of El,*ochester
relative to the doing of such work will cause ;rent damage to the
public and that the cost of doing the same will be in the neighbor-
hood of fifteen. hundred or two thousand dollars I., the undersigned

Warranty deed given by Otto W. Riess and Augusta Riess his
wife, to the City of Rochester ,Minnesota, releasing the roadway privilege
across the City Dumping Grounds, was read and upon motion by Hicks
second by Vihstadt, the said deed was accepted and it was ordered that
the same be placed on record and the sum of 1150.00 was appropriated
from the General Fund in payment for the said warranty deed,

The written permission of J. Gelfand that W. T. Dziewanowski be allowed
to solicit on the sidewalk in front of the store at, 313 First Avenue Northwest, was
read, and upon moth -On by Hicks, second by Vihstadt, the City Clerk was instructed
to inform Mr. Pziewanowski that this Common Council will not allow this location ! !

to be added to his present solicitor's license, and that the only way he can get
this new location to be,adopted will be to make a new application for a solicitor's i
license to which shall be attached permits for all of the locations at which he wishes
to solicit, which application shall be accompanied by his present solicitor's license

submitted for revocation. I
The official bond of Jose Bosley as Visiting; Nurse, with !-:Rrs. F.H.
gimbert, and Mrs. Alfred Ward, as sureties thereon each in the amount of �500.00,
and the official bond of George F, St/rifert as Sanitary Inspector, with E.C.Roth,
and John 11. Towey, as sureties thereon each in the amount of `fi500,00, were each
read, and upon motion by Vihstadt, second by Miller, the said sureties were accepted,;
the said bonds were approved, and it was ordered that the same be placed on file.
The continuation certificate in favor of 0. S. Cuumens, covering his
electrician's license, April lst,1930, to April 15th,l')31, issued by the Central
Surety and Insurance Corporatioai, was read, and upon motion by Hicks, second by
Rommel, the said continuation certificate was accepted and it was ordered that the

Gentlemen: '
The Mayor and Members of the Common Council together with the
City Engineer and myself visited the sight of the new Fire Station Building
Thursday April 24, The Proposition of raising the established grade 6" was
discussed and it was decided by all present that the established grade shall
remain 18" above the sidewalk as specified.
The Mayor and Council members agreed however that the ceiling height
in the basement may be redveed 3" in height providing that a ramp 12' in
length with a 3" fall 'be placed on the inside of the building at the rear
outside basement doors.
Where the rock is firm.and solid no concrete footings
will be necessary. The rock under all pier footings shall be +
excavated unless otherwise advised after inspection by the Architects. i t A channel shall be cut into the rock not less than 3" deep the width i t
Of all walls.
Due to the fact that the wall footings are to be omitted
where walls rest on rock and that there is a possibility of the
omission of pier footings it will be necessary for the Common Council
to have your cubic yard price for all footings. t�rindly present this

Policeman for duty upon the property of the Union National Bank, he to
serve without, pe.y and to hold office until the second Monday in April,1930,

A communication from the Pxeeut,ive Secretary of the League of
Minnesota Municipalities, asking for a selection of delegates to the conven-
tion which is to be held in Duluth,Minnesota, June llth,12th, and 13th, 1930,
:was Vead, and upon motion by Hicks, second by Rommel, the Mayor, the
';Aldermen, the City Clerk, the City Engineer, the City Attorney, and the
'Superintendent of Parks, were appointed as delegates to this convention.

The following communication was read, and upon motion by Hicks, second
Iby Vihstadt, the City Clerk was instructed to engage the County Auditor for the
making of a new property record book in accordance with his quotation:

after they have copied the book, and while it is hard to tell just what
the cost of this would be, I should think it wouldn't cost more than
175.00.

Upon motion by Miller, second by Hicks, the City Assessor was instructed
to r,iwove the com_nleted Assessor field cards from the office of the County Auditor.
Upon motion'by Hicks, second by Vihstadt, the Chair was requested to
appoint a (.11ommittee for conference with the Cowmissioners of Olmsted County, Minne-
sota' VclatiAre to the paving of Second Street Southwest, between Sixteenth Avenue
Southwest ar_d the new route for Trunk Highway N0.20, and accordingly the Chair
appointed the Street and Alley Committee, the City Engineer, and the City Attorney
as such Coiiunittee, and Pequested that the r,4ayor also accompany this Committee.
The claim of Broan-Knopp Agency 122.20 for public liability and property
damage insurance on the Dodge Truck used by the Street and Alley Department, was

read, and President Liddle referred the same to the Insurance Committee.
Upon -motion by Hicks, second by Miller, the sum of �ft5.00 was appropr iated I
from the General Fund and it was ordered that the same be paid to D. L. Williams,
Postmaster, for n10.00 stamps for use of City Clerk, and 1'35,00 for stamps for use of
City Attorney.
Upon motion by Rommel, second by Vihstadt, it was ordered that the City
depository bonds of the Olmsted County Bank & Trust Corhpany which were in effect for
the past official year, be released to them in order that they may get the proper
premium refund in that the present depository bond overlaps the period covered by

the previous bonds.

placed on file in the office of the City Clerk of said City; said bond
being submitted, accepted, approved and ordered filed under and in accord-
ance with the proposal of the said First State Bank &.Trust Company, dated
April 3rd,1930, and the designation by this Common Council under date of
April 7th,1930, of the said First State Bank & Trust Company as a City
depository, with the whole thereof to be governed by Sections 47 to 54
:,inclusive, of the Charter of said City, and such other sections or parts
,thereof of the said Charter as may be relative to City Depositories.
