Minutes of a regular.. meeting of the Common Council of the City
�I of Rochester, Minnesota, held in the Council. Chambers, in the City Hall, in
said City at 2: 00 o'clock P.M.J. on June 2nd,1930$
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, 8dllman, Hicks,
Miller, Vihstadt.. Absent: Rommel.
President Liddle announced this as being, the time and place
fixed fora, hearing on the petition for the vacation .of the alley running
North and South across Block 8, in Williams,Healy & Cornfort h's Add iti on,
r and of the alley running East and West across said Block 8, and asked if
there was any person -present who wished to be heard concerning the vacation .
of the alleys described.
There was no person present who wished to be heard concerning
the vacation of the alleys above described.

was any person present who wished to be heard relative to the construction
of curb and gutter on Third Avenue Southwest, as above described.
There was no person present who wished to'be heard concerning
the said improvement,

President Liddle announced this as being the time and place
fixed for a hearing on.the proposed widening of Fourth Street Southwest
from the Best curb line of Broadway Street South to the East curb line of
Second Avenue Southwest to •a width of 60 feet,•'the paving of the strip

between the old paving and the new curb and the construction of curb along
both sides_ofthe paving so widened, and asked if there was any person -present who
wished to be heard concerning this improvement.
George Wentink opposed this improvement if it is to be done by special
assessments but aeed to. if It is to be done by General Taxation.

President Liddle announced this as being the time and place fixed for a
hearing .on the proposed widening of the paving on Center Street East and West from
the East curb line of First., Avenue Northeast an& lfirat Avenue Southeast to the East

line, of the alley running North and South across Blocks 31 and 38 in Original Plat
to a width of 58 feet,
that the strip between the present paving and the new curb
be paved with 7 inch one course concrete; and that a cement concrete curb be con
structed along the both sides of the paving so widened, and asked if there was any

President Liddle announced this as being the time and place fixed for a
hearing on the widening of the paving on First Street Southeast and First Street
Southwest s from the Teuth, aurb line of First Aveme Southdast, to the East curb
line of Third Avenue Soutkwests to a width of 50 feet, `the paving of the strip
between the t paving and the new curb with 7 inch one course concrete, and
present
that a cement concrete curb be constructed along the both sides of the paving so
widened., and asked if there was any person present who wished to be heard relative
t o this improvement.
There was no person present who wished to be heard concerning the
widening of the paving on First Street Southeast, andd-First Street Southwest, as
above described except that the above mentioned Chicago Great Western Railroad
,R, Company protest carried reference to this improvement also

year from and after the passage and approval and publication of this

An ordinance licensing and -regulating selling, peddling,
canvassing and soliciting ordezAnfor goods, wares or merchandise in the
City of Rochester, was given its third.and final reading.
Upon motion by hickb, seoond by Dallman,'L that the said ordin-
ance be adopted as read, and all voting in favor: thereof, except Alderman
Romnel, who voted "Nay,�President Liddle declared the.said ordinance duly
passed and adopted.
Upon motion by Hic ka , second .by `Vihstadt -, the matter of the
installation of an oil burner and fuel 01_1 ,storage 'tank .at the .new Central
Fire Station was referred to the Fire .Department :Committee Sor .the it . .

A report from the Sanitary Inspector as .t o his inspect ions

made during May,1930, was read, and President Liddle ordered that the same
be placed on file.
Erwin L. Br iese, Comme,nder Of the, local American Legion Post, -
oppened the granting efidtAssuance of the above mentioned permit for the
exhibition of an embalmed whale on the grounds that it would detract from
the receipts for the exhibition of a whale at the Morris .& Castle shows which
are coMing here under the auspices of the American Legion during the,
week of June 16th,1930.
The application of Helma Mecham for .a solicitor's license was

Upon motion by Vihstadt , second by Amundsen, the City Clerk was instructed 40
in future advertisements for bids on public work and improvements, to specify that a
surety bond written 'Bgrtthe full amount of the contract, by a surety company author-
ized.to do business in the State of Minnesota, will be required with the contract
and that personal bonds will not be accepted.
The official bond of Charles' H. Ellison, as Patrolman, with the Fideliey
and Casualty Company of New York, as surety thereon in the amount' of $600.00, was
read, and upon motion by Hicks, second by Rommel, the said surety was accepted, the
said bond was approved, and it was. ordered that the same ;be placed on file.
Aldebman Hicks introduced a resolution vacating Ninth Avenue Southwest, be-
tween the South line of Tenth Street Southwest, and the north line of Eleventh Street
Southwest, which was read,
Upon motion by Rommel, second by Dallman, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution vacating the alley running North
and South across Block 8, in Wk1liams, Healy N Cornforthts Addition, and the Alley
running East and West $cross said Block 8, which was read.
Upon motion by Vihstadt, second by Hicks, itathevsaid. resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
The following applications for permits to place and maintain signs were
each read, and upon motion by Hicks, second by Dallman, permits were granted:

Estimate No. 4 prepared by Charles. H. Armstrong, City Engineer,
in favor of Feller Brothers, showing $2237.71, as being due the said
contractors on contract for construction and equipping of a preliminary
sedimentation tank at the Sewage Disposal Plant, was read, and President
Liddle ordered that the same be placed on file.
The recommendations of H, H. Onstad of St:Paul Park, Minnesota,
and of E. M. Phillips, Director of High Schools, of the State of Minnesota,
Department of Education, that E. A. Hanson of Fotmtat'a, .Minnesota, be
appointed Plumbing Inspector for the.City of Rochester,'Minnesota, were
read, and President Liddle ordered that the same be placed on file,
Upon motion by Hicks, second by Diller, the City Vlerk was
instructed to inform Mr. E. A, Hanson of Fountain, Minnesota, that there is
no opening for appointment as Plumbing Inspector and that if there were it
would be given toga resident of the City of Rochester, Minnesota.
The application of Jose Bosley, Visiting Nurse, for a ten day
vacation", June 23rd, 1930, to July 2nd,1930, was read, and upon motion by
Hicks, second by Rommel, the vacation requested was granted.
The objections of the Rent-A-Car Company, to paying for
telegrams to and from Jamestown, North Dakota, in connection with the
recover$ of one of their rented automobiles, was read, and upon motion by
Vihstadt, second by Rommel, the said change of $3.28 against the Rent-A-
Car Company was cancelled.
The;,�rec cmmendat ion of the Sewer Committee , that a sanitary
sewer be constructed in Eighth Avenue Northwest, from the Center line of
Fifth Street Northwest, to a point 130 feet South, was read, and President
Liddle ordered that the same be placed on file.
Communications from Burns and McDonnell of Kansas City, Missouri,
and from Carl RWhompson, Secretary of the Public Ownership League of
Ameriea;Zhidago, Illinois, relative to A:.., valuation report on the local
gas company property, were each read, and President Liddle ordered tkat
the same be placed on file.
Alderman Miller introduced a resolution authorizing the
& Fuel
Public Utility Board to enter into contract with the Dodge Muoer/Company
of Rocheste;, Minnesota, for the furnishing of 4000 to 7000 tons of
screenings in accordance with their above quoted request, and fixing the
amount of the bond to be given by the said contractor at the sum of
$36070,00, which was read. {

for labor during the weeks ending May 23rd,1930, and May 30th,1930, which was read.
Upon motion by Hicks, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Rommel. introduced a resolution appropriating $2237,71 from the

Alderman Dallman introduced a resolution appropriating

construction, equipping and furnishing of the new Central Fire Station,
which was read.

Alderman Amundsen introduced the following resolution,which
was read:

AND DELIVERY OF THE SAID BONDS.
Be it resolved by the Common Council of the City of Rochester,
as follows:
Section 1. It is deemed to be necessary and for the best
interests of this City, that there shall bp, ,at this time, issued and sold
thirty-five thousand dollars ($35,000.00) par value, being th1rty-€3Vee ('35Q
bonds, of $1,000,00 each, of the fifty thousand dollars ($50,000.00)
Improvement bonds, authorized by the voters thereof Jaunary 7th,1930, being

Bonds, all bearing the date of February 1st,1930, and that the City Clerk

The Common Council of the City of Rochester, Minnesota, will meet at its
Council Chambers, in the City Hall, in said City on the 23rd day of June, 1930, at
7:30 o'clock P.M. to open and consider sealed bids for thirty five thousand dollars
($35,000.00) of the City. of -Rochester, Minnesota, (4j%) four and one-half per cent
Improvement Bonds, then to.be issued and sold, being part of the issue of fifty
thousand dollars ($50,000.00) of the said bonds authorized by the electors of the
said City to be used for the. purpose of constructing, equipping and furnishing of a
new Central Fire Station, upon that tract of land in the City of Rochester, Olmsted
County, Minnesota. -described as ,follows, to -wit:, Upon that part of Block 102 in
Willson's Addition to the City of Rochester, Minnesota, which lies East of the -Mill
Race, and except that part- of ;the West forty-four (44) feet of Lot six (6) in said
Block one hundred two (102) whi ch lies East of the said Mill Race, and for the
wrecking and removal of the .present Central Fire Station. All of said bonds will be
of the denomination of one thousand .dollars...($1000.00) each, dated February lat.,
1930, and maturing as follows; three (3) thereof on December lat, in each of the
years, 1931, 19320 1933, 19341, and 1935, and four (4) thereof on December lst , in each
of the years 1936, 19379J838, 1939, and 1940, with interest until paid at the rate of
four and onehalf per cent (4j%) :per annum payablesemi-annually upon the first day of
June and December of each $sear. (all coupons maturing on or before June 13,1030 will be
detached and cancelled). Both principal and interest on these bonds will be made
payable at the office of the City Treasurer at the City of Rochester, Minnesota. All
bids must be addressed to the undersigned City Clerk of Rochester, Minnesota, and be
accompanied by. a duly certified check for two (2) per cent .of the principal of the
bonds bid for, payable, without any condition, to the order of the City Treasurer of
the City of Rochester, Minnesota, which two (2) per cent will, if the bid is accepted,
be applied to the purchase price of the bonds, otherwise to be returned to the
unsuccessful bidder or bidders. The successful bidder will be required to accept
delivery and pay for the said bonds immediately upon his or their bid being accepted,
and no bids will be accepted for less than par and accrued interest from June 1,1930,
The said Common Council reserves the right to reject azW and all bids. "
Upon motion by Rommel, second by Vihstadt, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.,
Alderman Hicks introduced a resolution fixing 7:30 o'clock P.M., June 23rd,
10309 as the time for a hearing on the oonstruction.of a sanitary sewer described:
Commencing at the center line of Fifth Street Northwest, ,and 'running Southerly along
the center line of Eighth Avenue Northwest; for a distance of 130 feet, which was
read.
Upon motion by Hicks, second by Miller, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
The .City Engineer submitted plans, profiles, speeificationsand estimate
of cost for the construction of a curb and gutter on Seventh Avenue Southwest,, from
Sixth Street Southwest, to Eleventh Street Southwest, said estimate of cost being
$5434,80.
Alderman Amundsen introduced the following resolut ion, which was read:
"WHEREAS, The Common Council of the City .of Rochester, Minnesota, at a
meeting thereof,held on May .7th,1930,after due notice given and hearing had as. pro-
vided by law,did duly pass and adopt a resolution ordering that curb and gutter be
made and done in said City as follows:

The construction of a combined concrete curb and gutter along
both sides of Seventh Avenue Southwest, between' the South line of Sixth
Street "Southwest, and the North line of Eleventh Street Southwest, which
said concrete gutter is to be 36 inches wide, the -said curb to be 6 inches
wide and set to a distance of 40 feet between ;the inside faces, of the
curbing between the South line of Sixth Street Southwest and the North line
of Seventh Street Southwest, and said concrete gutter to be. 36 inches wide,
the said curb to be 6 inches wide, and set to a distance of 30 feet between
the inside faces of the eurbir�g between the South line .of Seventh Street
Southwest and the North line VP Eleventh Street.Southwest, and in said
resolution directed the City Engineer of said city to prepare and file in
the office of the City Clerk, detailed plans, profiles and specifications
for the said curb and gutter, andto make and report .to said Common Council
an estimate of the cost and expense of the said curb and gutter, and said
City Engineer pursuant to said dirgetione did on May. Slst ,1930, file In
the office of the City Clerk of said City, plans, profiles and ,specifica-
tions for the said curb and gutter and did report" to*the said Common Coun-=

THEREFORE, Be it and it is hereby resolved by the Common
Council of the City of Rochester, Minnesota:
That the' plans, profiles and specifications for the said'Fcurb
and gutter so filed by said City. Engineer in the office of the City "Clerk,
be and the same are hereby adopted as the plans, profiles and spec if ica-
tions for the said curb and gutter, and that t$e-ssid estimate of cost of
the said curb and' gutter reported to said Common'�Couneil"�be and the same
is hereby accepted and ordered f iled in t be - office of the City Clerk;
Be it further resolved by the said Common Council:
That . the whole cost and expense ' .of the said curb. and gutter
shall be assessed, as provided by law,:against each lot, piece and parcel
of land benefited by the improvement, to -wit: -•Against ,each and every lot,
piece .and parcel of land abutting upon the said curb and gutter without
regard to cash valuation, ratably and In proportion to the special benefits
conferred by the said curb and gutter respective ly, upon each said lot,
piece and parcel of land;
Be it further resolved by the - said Common Council: That a
meeting of the said Common Council will be held at 7:30 o'clock P,M., on
June 23rd,1930, 'in the Council Chambers, In the City Hall, In said City,
at which meeting all persons interested in the said: curb and gutter may
appear and be heard before said Common Council in relation to the said
curb and gutter or to the mode of the assessment, for. the cost and expense
thereof, or any other matter or objection relating to the said curb and
gutter upon which they may desire to be heard;
Be it further resolved by said Common Council: That the Cfty
Clerk is hereby ordered and directed to prepare a list. which will contain
a description of each and all of the properties abutting upon the said
curb and gutter above described, and the names of the owners of the said
properties so far as the same are known, which list, t agether with a notice
of the time, place and purpose of said meeting and hearing above mentioned,
he shall cause to be published .once in the official newspaper of said City
at least ten days prior to the date of said meeting and hearing;

to prepare plans, profiles, specifications and estimate of cost. for the resurfacing

In connection with the above permit for the exhibition of an embalmed
;whale, the City Attorney ruled that the Common Council hhs �no authority for the
s, licensing of such an exhibition as there are no ordinances providing for it., and
emotion by Hicks, second by Rommel, carried that the action talUen relative to the
issuance of the permit, for the exhibition, be res6iiiddd.
Upon motion by Hicks, second by Vihstadt, the Common Council addourned
