M14tes of an adjourned regular meeting of the Common Council ofth- City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, at 7:30 o'clock P.M., on June 9th,1930. E Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Hicks, Miller, Rommel, j t Vihstadt. Absent: Dallman. Upon motion by Rommel, second by Vihstadt, the minutes of the n meeting held on May 26th,1930, were approved. Alderman Dallman came, in at this time and t oo4 his Chair. President Liddle announced this as being the time and place fixed for a hearing on the construction of a sanitary sewer described: i Commencing at the center of the intersection of Sixth.Street Southeast and Tenth Avenue Southeast, and running easterly along the center line of Sixth Street Southeast to a point 37 feet West of the West line of Eleventh Avenue Southeast, and asked if there was any person present who t wished to be heard eoncerAigg the said sanitary sewer There was no person present who wished to be heard regarding this improvement. I This being the time and place fixed for the opening of propo- sals for the furnishing of all labor, materials, equipment, etc., necessary for the construction of a sanitary sewer in Sixth Street Southeast, as above described, the following proposals were opened and read. Martin Paulson: 8" vitrified pipe sewer $.80 per ft., 6" on 8" ,Y connections $1.00 each, manholes $50.00 each, loose rock excavation $2.75 i'jper cubic yard, solid rodk.$6.00; Wm. C. Fraser & Son: 8" vitrified pipe sewer $,98 per ft., 6" on 8" Y connections 91,00 each, manholes 850,00 each, loose rock excavation 03.00 per cubic yard, sand rock $5.00, solid rock 168.Q0. Upon motion by Rommel, second by Vihstadt, the proposals above c;uoted were referred to the City Engineer for tabulation. The matter of sidewalk crossings on the intersection of Second Street Southeast and Thirteenth Avenue Southeast, was, by ;President Liddle, referred to the Street and Alley Committee and the City �! ;Engineer. The report of the City Treasurer for the month ending May 31, 11930, showing $286989,44 as being on hand, was read, and President Liddle 'i jordered that the same be placed on file. 1' 1I :1- r - ji The report of the City Engineer for the month of May,1930, showing expenditures from the General Fund for labor in the amount of y$580.48, from the � I 1' Street and Alley Fund A1796,49, and from the Sewer Fund $326.43, was read, and ' President Liddle ordered that the same be placed on file. Y i The report of the Milk Inspector for the month of May,1930, was read, and President Liddle ordered that the same be .p]a ced on file. 1 The report of the City Weighmaster for the month of May,1930, showing j I �j weighing inspection fees collected in the amount of,18.50, was read, and as Alderman i Hicks, Chairman of the Finance Committee, , reported that this account had been I checked and found to be correct, President Liddle ordered that the said report be i' s II placed on file. The report of the Building and Electrical Inspector for the month of May, 1930, showIng building inspection fees collected in the amount of$56.00, and y I electrical inspection fees collected in the amount of $21.75, was read, and President I I' Liddle referred the same to the Finance Committee. j li The report of the Clerk of the Municipal Court - for the week ending May • 26t h,19;3 0, showing criminal fines collected $172.55, civil fees received $2.00, Olmsted County $86.30 check received for April Municipal Court fees,%9.60 court costs . charged to Olmsted County, and $5.85 Municipal Court fines collected due to Olmsted County; the' report for the week ending June 2nd,1930, showing criminal fines collected $82 .00, civil fees received $8.85, and court costs charged to Olmsted County $3.85; j and the report for the week ending June 9th,1930, showing criminal fined collected $101,10 and court costs charged to Olmsted County $.35, were each read, and President,, i, Liddle referred the same to the City Attorney. Upon motion by Rommel,, second, by Vihstadt , the sum of 05.85 was appro- priated from the General Fund and it was ordered that the same be paid to Olmsted I i County, Minnesota, for Municipal Court fines collected due to Olmsted County. The report of the Health Off car for the City Farm for the month of May, , I 1930, showing receipts in the amount of 81391.40, disbursements in the amount of I t I i $908.10, and a balance on hand in the amount of $1526,12, was read, and President Liddle ordered that the same be placed on file. Alderman Vihstadt introduced a resolution appropriating $480,50 from the I i Park Improverent Fund and ordering payment made to the Jewell Nursery Company of Lake City, Minnesota, for the furnishing of 300 American Elm trees $375.00 and for thei furnishing of miscellaneous shrubs, perennials, etc., in accordance with statement made under date of April 23rd,1930, which was read, Upon motion by Miller, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced a resolution appropriating $229,28 from the Park Improvement Fund and ordering payment made to the Olmsted County Oil Company for gasoline furnished during May,1930, which was read. Upon motion by Dallman, second by Hicks, that the said resolution be !adopted as read, and all voting in favor thereof, President Liddle declared the said �Ilresolution duly passed and adopted. ! Alderman Dallman introduced the following resolution, which was read: I. "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Public Utility Board'of said City be and the said Board is hereby authorized to appropriate the following sums from the Public Utility'Fund of said City lto the Interest Fund of said City in the amounts and for the purposes mentioned: r $11250,00 for interest due July 1,1930 on City of Rochester, Minnesota, 5% !!Electric Light Bonds dated July lst,1917, and numbered 201 to 650 inclusive; $3037,50 for interest due July 1st,1930, on City of Rochester,Minnesota, d4-�;� Water Works Bonds dated July lst,1916, and numbered 41 to 175 inclusive." Alderman Amundsen introduced the following resolution., which was read: '! "Be it resolved by the Common Council of the City of Rochester, Minnesota: j That the Public Utility Board of said City, be and the said Board is hereby! authorized to appropriate the following .sums: ii 810 000,00 from the Public Utility Fund for the July 1st 1930 maturit > f f y of City of Rochester, Minnesota, 5% Electric Light Bonds dated July 2nd,1917, and numbered 201 to 210 inclusive; 1 I� 'j $5,000.00 from the Public Utility Fund for the July 1st, 1930, maturity of City of Rochester 4Y Water Works Bonds dated July 1st, 1916, and numbered 41 to 45 inclusive." Upon motion by Vihstadt, second by Amundsen, that the :'said resolution be adopted as read, and all voting in favor thereof, 'President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution accepting the bid and proposal of Mattin Paulson ,for the construction of a sanitary sewer in part of Sixth Street Southeast, as above described, and quoted, and fixing the amount of the bond to be given by the sattl contractor at the sum of 1600.00, which was read. Upon mot iOm by Miller, second by Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Vihstadt, second by Amundsen, it was ordered that the certified check of the unsuccessful bidder for the construction of the above described sewer in Sixth Street Southeast, be returned. Alderman Vihstadt introduced the following resolution, which iwas read: "Be it resolved by the Common Council of the City of .Rochester, Minnesota: That the resolution heretofore passed and adopted by said Common Council authorizing the Public Utility Board of said City to purchase 'what is commonly known as the south line of the Olmsted County Power Company, for the sum of Three thousand ($3000.00) Dollars, be and the same is hereby ,;repealed." Upon motion by Amundsen, second by Vihstadt, that the said resolution be adopted as read, the vote was: Ayes: Amundsen, Dallman, Vihstadt IlNays: Hicks, Miller. (i The City Attorney ruled that it required a majority of seven !members of the Common Council or four votes in favor to carry and adopt such a resolution, and accordingly President Liddle declared the motion to ;adopt lost. ;! Alderman Miller introduced the following resolution,which ;iwas read: i "Be it resolved by the Common Council of the City of Rochester, :;Minnesota: That the sidewalk on the south side of Thirteenth Street 'Northwest from Broadway Street North to Second Avenue Northwest in said City be and the s^.me is hereby ordered to be constructed so that the Northern edge of .the said sidewalk shall be eleven (11) feet North of the South side of said .Thirteenth Street Northwest. This change of location of the said sidewalk is made on the petition of the property owners abutting upon the said south side of Thirteenth Street Northwest, which said petition is on file in the office of the City Clerk of said City of Rochester, Minnesota." Upon motion by Millerpsecond by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddl a declared the said resolution duly passed and adopted. Alderman Hicks introduced the following resolution, which was read: "WHEREAS, Wm, A. Fitzgerald, being the owner of more than three -fourths of the property abutting on the lines of the streets and alleys hereinafter. described has presented his petitionto the Common Council, praying for the vacation of the parts of the streets and alleys described as follows: All of Eighth Street Southwest, between First .Avenue Southwest and Broadway Street South; Ail of Seventh Street Southwest, between First Avenue Southwest and Broadway Street South; All of the alley running North and South through Block 103, in Willson's Addition to the City of Rochester,, Minnesota; I' All of the alley running North and South through Block 104 in Willson's I' Addition to the City of Rochester, Minnesota; I. 'All of the alley running North and south through Block 105 in Willson's Aa,l it ion, and WHEREAS, It is deemed expedient that the mattek be proceeded with; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said petition be filed of record with the City Clerk of said City, 4hd that the said Common Council will hear and consider the same in the Council Chambers, in the City Hall, in said City on Monday, August 4th,1930, at 2:00 o'clock P.M., and that the City Clerk of said City be and h.e is hereby authorized and directed to give published notice thereof as required by the Charter of this City." Upon motion by Hicks., second by Vihstadt , that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced the following resolution, which was read: "WHEREAS, The Common Council of the City of Rochester, Minnesota, at a meeting thereof held on May 19th,1930, duly passed and adopted a resolution declaring it expedient and ne cessary , that a local public improveme nt , to be paid for by spec2a l !. assessments levied as provided by law, be made in said City as follows: The construction of a combined concrete curb and gutter' along both sides of Third Avenue Southwest between the 'South curb line of First Street Southwest and the north curb line of Second Street Southwest, the said concrete gutter shill be 36 inches wide, the said curb to be 6 'inches wide and set to a distance of 50 feet between the inside faces; such concrete curb and gutter as now might be in place i to be removed, and said Comrznn Council in and by said resolution ordered that a public hearing of all persons interested be held at 2:00 o'clock P.M., on June 2nd, 1930, in the Council Chambers, in the City H911, in said City, and directed the City . it Clerk to give notice of said hearing to - all persons interested, as provided by law; and said resolution was duly approved and signed by the Mayor of said City; and WHEREAS, Said City Clerk duly and in due. time, as ordered in said resolution, did publisdi a notice in the Rochester Post -Bulletin, the official newspaper of said City, upon May 21,1930, to all persons inter- ested in said improvement of the time and place of said hearing and the purposes for which the same was to be held; and WHEREAS, on June 2nd, 1930, at 2:00 o'clock P.M., at the Council Chambers, in the City Hall, in said City,, said Common Council duly met pursuant to said resolution and notice and said hearing was then and. there held, and all persons interested who were present were then and there heard before said Common Council concerning and relating to the said improvement; the said Common Council having duly considered the matter of the making of said improvement and the arguments for and against the same, and deeming it expedient and necessary that the said improvement be made; THEREFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That a combined concrete curb and gutter be constructed along both sides of Third Avenue Southwest between the South curb line of First Street Southwest and the North curb line of Second Street Southwest, the said concrete gutter shall be 36 inches wide, the said curb to be 6, inches wide and set to a distance of 50 feet, between the inside faces; such concrete curb and gutter as now might be in place, to be removed. Be it further resolved by the said Common Council: That the concrete combined curb and gutter shall consist of a curbing and a gutter flag; the curb portion shall be six (8t inches in height from the finished gutter flag, and six (6) inches thick, with the upper face -corner rounded to a radius of * inches, and the corner of the junction of the curb and gutter rounded to a radius of three (3) inches, the gutter flag shall be thirty-six (36) inches wide from the face of the curbing and shall be six (6) inches thick, the top line of the curb shall coincide with .,the intersecting grade line of the street, the corner at entrances to alleys and drives shall be an are of a circle of six (6) feet radius, and the corners at street intersections shall be an are of a circle of ten (10) feet radius. The concrete curb and gutter shall be composed of one part Portland cement, two parts clean sharp sand, and three parts 'broken stone, all proportions shall be actual measurement. All cement used shall be American Portland cement of some standard well-bnown brand, the broken stone shall be the run of the crusher, i the best quality of lime stone, the fragments not to exceed 14 inches in the largest dimension and not to contain more than one (1) per cent of material passing a No.10 sieve. It shall be free from dirt, dust, loam and other objectionable materials and shall be screened when necessary to eliminate all dust and small particles. The gravel used shall consist of particles ranging in size from coarse sand to pebbles one (1 )inch in the greatest dimension of hard, tough material, free from loam, vegetable matter, clay and other foreign material. All sand shall be sharp siliceous sand free from clay and other mineral properties. Be it further resolved by the said Common Council: That the aforesaid improvements and the whole thereof, be made and done in the manner and with the materials herein specified and that the whole cost and expense of making the said improvement shall be paid by special assessments levied according to law. i Be it further resolved by the said Common Council: That the City Engineer of said City be and he is hereby ordered and directed to prepare and file in the office of the City Clerk of said City detailed plans profiles and specifications for the said improvement and to make and ij 537 5 report to said Common Council an estimate of the cost and expense of hhe said improvement as herein set forth." Upon motion by Hicks, second by Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. SO THEREFORE, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That Fourth Street Southwest, from the West curb line of Broadway Street South to the East curb line of Second Avenue Southwest, be widened to a width of 60 feet, and that the strip between the present paving and the new curb be paved with 7" one course concrete and that a cement concrete curb be constructed along the both sides of the paving so widened;' i That Center Street East and West, from theeEast curb line of First Avenue Northeast and First Avenue Southeast to the East line of the.alley running North and South across Blocks 31 and 38, in Original Plat, be widened to a width of 58 j; feet, and that the strip between the present paving and the new curb be paved with j 1 I� 7" one course concrete and that a cement concrete curb be constructed along the both sides of the paving so widened; That First Street southeast and Dirat Street Southwest, from the West curb line of First Avenue Southeast to the East curb line of Third Avenue Southwest, be widened to a width of 58 feet, and that the strip between the present paving and the clew curb be paved with 7" one course concrete, and that a cement concrete curb be constructed along the both sides of the paving so widened. i Be it Aurther resolved by the said Common Council: That the aforesaid paving shall consist of one course Portland cement concrete not j less than 7" thick after being thoroughly compacted, the surface of the said new paving to incline upward from the present curb line of the paving now r in place to a line 4" below the top of the sidewalk line on each side. The concrete for the said additional paving shall be composed of one measure of Portland cement, two measures of sand and three and one-half measures of + broken stone or crushed rock, with 83 per cent water cement ratio, provided, that the mixer shall run one and one-half minutes after all ingredients are deposited in the mixer. All cement shall be American Portland cement of some standard well-known brand, the broken stone shall be the best quality • of limestone, the run of the crusher, the fragments not to exceed 2" in the largest dimension and the broken stone is not to contain more than 5% of material passing a No. 8 sieve, it shall be free from dirt, dust loam and other objectionable materials, it shall be screened when necessary to eliminate all dust and small particles, all sand shall be sharp, silicious sand, free from clay and other mineral properties, the corners at entrances to alleys and drives shall be an are of a circle of 3 feet.radius and the corners at street intersections shall be an are of a circle of 3 feet M radiusp wherever specified. F The paving slab shall be kept moistened with 3 C gunny sacks, D or earth, saturated with water for a period of ten days. The sloping curb shall be 6 inches to 8 inches in`thickness and the h6fl3hts may vary as circumstances may require, with standard heights to be 8 to 10 inches. i Be it further resolved by the Common Council of the said City of Rochester: That the aforesaid improvements and the whole thereof be made aa& done and that the same are hereby ordered to be made and done in the manner and with the materials herein specified and that the whole cost and expense of making of the said improvements shall`be paid for by special assessments levied as provided by law. i That the City Engineer of said City be and he is hereby directed to prepare and file in the office of the City Clerk detailed plans, profiles and specifications for the said improvements as herein set forth and to make and report to said Common Council an estimate of the cost and expense for the making of the said improvement." Upon motion by Hicks, second by Miller, that the said. resolu- t ion be adopted as read, and all vot irg in favor thereof., President Liddle declared the said resolution duly passed and adopted.
