Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said i
City, at 7:30 o'clock P.M., on June 23,1930,
Meeting called to order by President Liddle,
Roll Call. Present: Liddle, Amundsen, Dallaan, Hicks, Milier, Rommel,
Vihstadt, Absent: None. j
Upon motion by Rommel, second by Vihstadt, the minutes of the meetings
held on June 2nd ,1930, and June 9t h,1930, and June 14th,19,3D, were each . approved .
President Liddle announced this as the time and place fixed for a hearing
on' the Construction of curb and gutter on Seventh Avenue Southwest, between Sixth
Street Southwest and Eleventh Street Southwest, and asked if there was any person
present who wished to be heard relative to the above mentioned improvement.
There was no person present who wished to be heard concerning the above
described curb and gutter.
This being the time and place fixed for the opening of proposals for

Upon motion by Hicks, second by Vihstadt, the above proposals were referred
to the City Engineer for tabulation.
President Liddle announced t his ' as being the time and place fixed for a
hearing on the construction of a sanitary sewer described: Commencing at the center

IDine of Fifth Street Northwest, and running Southerly along the center line of Eighth
AVena6 Northwest for a distance of 130 feet, and asked if there was any person
present who wished to be heard concerning this proposed improvement.
There was no person present who wished to be heard concerning this sanitary

i� sewer.
This being the time and place fixed for the opening of
proposals for the purchase of $35,000.00 City of Rochester 42-% Improvement
Bonds offered for sale on this dste, the following proposals were opened and
read:
THE SINKING -FUND COMMISSION OF THE CITY OF ROCHEST , MIMf -
SOTA: Proposal to pay 101.41 find accrued interest frgm'June 1,1930;
WELLS -DICKEY COMPANY: Proposal to pay par and a premium of
$180,00 plus accrued interest from June 11,1930, to date of delivery.
Alderman Dallman introduced the following resolution, which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the bid and offer of Sinking Fund Commission of Rochester,
Minn., for $35,000.00 City of Rochester, Minnesota, 4-?/, Improvement Bonds,
dated February 1st,1930, which were of this meeting offered for sale, being
$35,000.00 as the principal on the said bonds, $493.50 as premium on the
said bonds and $96,25 as accrued interest from June 1st, 1930, is deemed to
r� be the most favorable proposal for the said bonds, and
Be it further resolved by the said Common Council: That the
said bonds are hereby awarded and sold to Sinking Fund Com, of Rochester,
Minn... and that the same be de livered to them upon them paying,into the.
City Treasury of the amount of the said bid,therefory said bonds hereby
awarded and sold are•desoribed as being numbered: 3, 42 51 8, 99 10, 13,
14, 15, 18, 19, 209'239 249 25, 27, 28, 29, 309 32, 332 349 35, 379 38,
390•402 42, 43, 441, 452 47, 489 49; and 50, all,dated'February Ist, i930,
and having the December 1st, 1930, and all subsequent interest coupons
attached, (the June 1,1930, coupon to be removed and cancelled;) the
maturities of the said bonds being three (3) thereof on December 1st in
each of the years 1931, 1932, 19332 1934, and 1935, and four (4) thereof on
December 1st of each of the years ,1$36, 1937, 1038, 1939, and 1940,
inclusive, the said bonds bearing interest at the rate of 4-?,, per annum
i payable semi-annually on the first .day of June and December of each year,
both principal and interest on the said bonds being payable at the office of
the City Treasurer in the City of Roehester, Minnesota, and
Be it further resolved by the said Common Council: That the
-i Mayor and City Clerk of said City are .hereby authorized and directed to
duly execute the said bonds and the City Treasurer of said City is
hereby directed to deliver the said bonds to the said purchaser upon the
payment, into the City Treasury of the above mentioned purchase price, and
at said payment the City Treasurer will place the principal and premium
collections in the New Central Fire Station Fund, and the accrued interest
1collection in the Interest Fund."
Upon motion by Vihstadt, second by Miller, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Upon motion by Rommel, second by Vihstadt, it was ordered
that the certified check filed by Wells -Dickey Company with their proposal

The following report of the City Engineer in the matter of the iproposals
for the construction of curband gutter was read, and President, Liddle ordered that
the same be placed on file:

Roy Watson, for the Kahler Corpqration, objected to the proposed widening
Of the paving on Center Street West along the South side of the Colonial Hospital,
and also to the proposed widening of the paving on First Street Southwest along
the South side of the Kahler Hotel and Hospital, as did A. J. Lcbb, for the Mayo
Clinic as to their interest in the proposed widening of the paving on First Street
Southwest, along the Mayo Clinic building.
The Manager of the Chateau Dodge Theatre objected to the widening of the
paving on First Street Southwest along the front of the Chateau Dodge Theatre. r
Upon motion by Hicks, second by Vihstadt, further proceedings relative
to the widening of the paving on Center Street East and Center Street West from
the West.curb line of First Avenue Northeast and First Avenue Southeast to the
East line of the alley running North and South through Blocks 31 and 38, in
Original Plat, and for the widening of the paving on First Street Southeast and
Southwest, between the West Curb line , of First Aveme Southeast,. and the East curb
line of Third Avenue Southwest were adjourned and continued to the next meeting of
this Common Council and that the Street and Alley Committee and the City Engineer
make recommendations to this Common Council at the next meeting thereof as to what
parts of the paving on the streets above described shall be widened.

The City Engineer submitted plans, profiles, specifications and estimate
of cost for the widening of the paving on Fourth Street Southwest from Broadway Street
South to Sbeond Avenue Southwest, and for the construction of a concrete curb along
both sides of he
i� t paving so widened.
{ Alderman Miller introduced the following resolution, vdiich was read:
"WHEREAS, The Common Council of the City of Rochester, Minnesota, at a
f! meeting thereof held on June 9th,1930, after due notice given and hearing had as

provided by law, did duly pass and adopt a resolution ordering that local
public improvements be made and done in said City as follows: - That
the Fourth Street Southwest paving from the West curb line of Broadway
Street South to the East curb line of Second Avenue Southwest, be widened
to a width of 60 feet, and that the strip between the present, paving and
the new curb be paved with 7" one course concrete and that a cement concrete
curb be constructed along the both sides of the paving; so widened; and in
said resolution directed the City Engineer of said CiTy to prepare and file
in the office of the City Clerk detailed plans, profiles and specifications
for the said paving and concrete curb, and to make and report to said Common
Council an estimate of the cost and expense of the said paving and concrete
curb, and said Ctt Engineer pursuant o a

1930, file in the office of the City Clerk of said City, plans, profiles
and specifications for the said paving and concrete curb and did report to
the said Common Council an eatimate of the cost and expense of the making
and doing of the said paving and concrete curb;
THEREFORE, Be it and it is hereby resolved by the Common Coun-
cil of the City of Rochester, Minnesota:
That the plans, profiles and specifications for the said paving
and concrete curb so filed by the said City Engineer in the office of the
City Clerk, be and the same are hereby adopted as the pland, profiles and
specifications for the said paving and concrete curb, and that the said
estimate of cost of the said paving and concrete curb reported to said Common
Council be and the same is hereby accepted and ordered filed in the office
i� of the City Clerk.
Be it further resolved by said Common Council: That the whole
cost and expense o f the making and doing of the said paving and concrete
curb shall be assessed, as provided by law, against each lot, piece and
parcel of land benefited by the improvements., to -wit: - Against each and `ever
lot, piece ;and parcel of land abutting upon the said paving and concrete
curb, without regard .to cash valuation, ratably and in proportion to the
special benefits conferred by the said paving and concrete curb, respectively
upon each said lot, piece and parcel of land;

Be it further resolved by the said Common . Council : That a
meeting of the said Common Council will be held at 2:00 o'clock P.M.,
July 7th,1930, in the Council Chambers, in the City Hall, in said City,
at which meeting all persons interested in the said paving and concrete
curb may appear and be heard before' said Common Council in relation to
the said paving, and concrete curb, or to the mode of the assessment for
the cost and expense thereof, or any other matter or objection relating
to the said paving and concrete curb upon which they may desire to be heard;
Be it further resolved by said Common Council: That the City
Clerk of said City is hereby ordered and directed to prepare a list which
will contain a description of each and all of thepropert ies abutting upon
the said paving and goncrete curb above described, and the names of the
owners of the said properties so far as the same are known, which list,
together with a notice of the time, place and purpose' of the said meeting
and hearing above mentioned, he shall cause to be published once in the
official newspaper of said City at least ten days prior to the date of said
meeting and hearing.
Be it further resolved by the said Common Council: That the
City Clerk of said City be and he is hereby ordered and directed to advertise
for bids, as provided by law, for the furnishing of all of the materials,
and doing all of the work necessary for the doing of the said paving and
concrete curb, above described, said bids to be received and opened by
said Vommon Council at a public meeting thereof to be held at 2:00 o'clock
P.M., on July -7th,1930, in the Council Chambers, in the City Hall, in
said City. Each bid must be accompanied by a certified check for at least
ten per cent of the amount of the bid, and this Common Council reserves the
.,right to reject any and all bids."

Alderman Hicks introduced the following resolution, which was read:
P "WHEREAS, The Common Council of the City of roehester, Minnesota, at a
meeting thereof, held on June 9th,1930, after due notice given and hearing had as
provided by law, did duly pass and adopt a resolution ordering that curb and gutter

The construction of a combined concrete curb and gutter along both sides of
Third Avenue Southwest between the South curb line of First Street Southwest and the
North curb line of Second Street Southwest, the said concrete gutter shall be 36
inches wide, the said curb to be 6 inches wide and set to a distance of 50 feet, between
the inside faces; such concrete curb and gutter as now might be in place to be rennved,
and in said resolution directed the City Engineer of said City to prepare and file in.
the office of the City Clerk, detailed plans, profiles and specifications for the said
curb and gutter, and to make and report to said Common Council an estimate of the

cost and expense of the said curb and gutter, and said City Engineer pursuant to said
directions did on June 19th,1930, file in the office of the City Clerk of said City, p
plans, profiles and specifications for the said curb and gutter and did report to the
said Common Council an estimate of the cost and expense of the said curb and gutter;
THEREFORE, Be it and it is hereby resolved by the Common Council of the
City of Rochester., Minnesota:
That the plans, profiles and specifications for the said curb and gutter so _
filed by said City Engineer in the office of the City Clerk, be and the same are
hereby adopted as .the plans, profiles hnd specifications for the said curb and i
! gutter, and that the said estimate of cost of the said curb and gutter reported to
said Common Council be and the same is hereby accepted and ordered filed in the office
of the City Clerk;'
Be it further resolved by said Common Council: 'That the whole cost and

of all labor, materials, equipment, etc., necessary for the construction of
a: combined concrete curb and gutter along both &ides of Seventh Avenue South -
'West, between the South line of Sixt11 Street Southwest, and the North line of
, El ^venth Street Sout bNest , which said concrete gutter is to be 36 inches wide,
:the said curb to be 6 inches wide and set to a distance of 40 Peet between

Upon motion by Hicks, second by Rommel, the City Engineer was requested to cl
confer with the management of Saint Mary's Hospital relative to the construction of
a curb along the North side of their driveway leading to Fourteenth Avenue Southwest.

August Hein complained about the drainage on Ninth Avenue Southeast, between'
Center Street East and First Street Southeast, and President Liddle referred the

complaint to the Street and Alley Committee and the lKity Engineer.

A. H. Clemens representing C., M. Judd and Maurice J.McElligott, asked for j
an improvement of the drainage situation on Sixth Street Southwest, just East of

Fourteenth Avenue Southwest , and President Liddle referred his request to the U
Street and Alley Committee and the City Engineer.
The following petition signed by John W. Young, and J. A. Fiegel, was ,

read, and President Liddle ordered that the same be placed on file:
That a sanitary sewer be constructed and a water main laid in Sixth Avenue
Southwest, from the center of Ninth Street Southwest to the center of Eleventh St.
S.W., with a condition that when water service 'use is commenced each lot as it i
commences the use will be refunded its pro rata share of the water main costs, and
further provision is made that the costs of the sanitary sewer end water main shall i
be assessed to the property on the West side of the avenue with the exception that
the City of Rochester, Minnesota, will assume payment on what amounts to one

frontage for the possible future connection of the said services for Soldier Field."
Alderman Vihstadt introduced a resolution fixing 2:00 o'clock P.M., July
7th,1930, as the time for a hearing on the 'construction of a sanitary sewer
commencing; at. the center of the intersection of Sixth Avenue Southwest and Ninth °
Street Southwest, and running southerly along the center line of Sixth Avenue South-

west to the center of the intersection of Sixth Avenue Southwest and Eleventh Street
Southwest and the laying of a water main in the said part of Sixth Avenue Southwest,

The report of the Clerk of the municipal Court for the week ending June 16th
1930, showing criminal fines collected $78.70, and court costs charged to Olmsted
County $17,95, was read, and President Liddle neferredttht some to the City Attorney.'
General Balance sheet, trial balance, fund statement, statement of unexpended
budget appropriations, etc., of the City of Rochester, Minnesota, as at May 31,

1930, as prepared by the City Clerk, of said City, were laid before the Common Council,
and, President Liddle ordered that the same be placed on file..
The Cft y Engineer's trial balance of disbursements in his department during
! May,1930, was laid before the Common Council, and President Liddle ordered that the
same be placed on file.
Balance sheet ,income statements, etc., of the Public Utility
Departments of the City of Rochester, Minnesota, as at May 3191930, as
prepared by the Secretary of the Public Utility Board, were laid before the
Common Council, and President Liddle ordered that the same be placed on file;
the said income statements showing a net profit in the Light Department
for the month of May 19309 of .$18,284.78, and a net profit for the two
months of this •fiscal ,year of $30,597:37, and a net profit in -the Water
Department for the month of May019301, of 03403.45 ,and a net profit in the
Water Department for the two months -of this fiscal year of ,Y2591.44.
The applications of Charles Albert Nelson and Oscar Saterdalen
for drivers licenses were each read, and upon motion by"Vihetadt, second by
Dallman,licenses were granted.
The application of Rowland Williams for a soft drink dealers
license was read, and upon motion by Rommel, second by Vihstadt, lin.ense
was granted.
Mayor J. T. LeMMon asked that the soft drink dealer's license
of Ira Fe,th be revoked, and upon,�motion by Hicks, second by Miller, the
soft drink dealers license of Ira ltd th was revoked.
The application of Martin Paulson for license to connect to
sewers and drains was read, and upon motion by Rommel, second by Amundsen,

license was granted.
1 The license bond of Martin Pauldon covering the license to
'. connect to sewers and drains, with the Fidelity & Casualty Company as surety
thereon in the amount of $1,000,00 was read, and upon motion.by Hicks, second
by Vihstadt, the said surety was accepted, the sa:U b and was approved, and
it was ordered that the same be placed on file.
The following applications for permits to place and maintain
signs, were each read, and upon motion .by Rommel, second by Asal�en,

A petition asking that the sidewalk on the South side of Thirteenth Street
Northwest, between Broadway Street North and Second Avenue Northwest, be fixed so
that the outside of the walk line will be 12 feet from the property line in order
to save some trees which would be in the migular.'. sidewalk line, was read, and
Presidant Liddle ordered that the same be placed, on file.
A petition askinF, for the vacation of the alley running North and South
along the West side of Block 2, in Flather's addition, was read, and upon motion
by Hicks, second by Rommel, the said petition was referred to the Street and
Alley Committee, and the City Engineer, with instructions that they make report

thereon at the next meeting of this Common Council.
The following emergency authorization was read, and President Liddle

Dear Sir:
It having been made to appear that a number of streets and
avenues were considerably damaged by the storms of June 12th and 13th
and that there is immediate need of repairing the same and also that
the delay occasioned by strict compliance with the Charter of the City
of Rochester regarding the advertisement for bids for doing the said
work would cause great damage to the public interest and endanger the
safety of the public, I. as Mayor of the City of Rochester, do hereby
order and authorize you to go into the open market immediately and
purchase all necessary materials and employ all necessary labor for
the relaying with 22 inch No. 1 paving brick the following; streets and
avenues in said city: Center Street West, Broad%,;,ay to west line of 2nd
Avenue; intersection of 1st Avenue and 1st Street Southwest; 2nd Street
Southwest, Broadway to alley west; intersection of Broadway and 2nd,
Street North, and north to Ry, tracks; 2nd Street Southwest at 13th
Avenue Southwest and Broadway and 3rd Street, south intersection.
This order is given you under and in accordance with the pro-
visions of Section 284 of the City Charter,

A list of lighting equipment, which has been tested and approved under
Section 52 of the Uniform Highway Traffic Act, furnished by Earl Brown, Chief Patl-ol
Officer of the Minnesota Highway Patrol, was ta•id,before the Common Council and
President-Liddle ordered that the same be placed on file.
Copy of requisition upon Saint Mary's Hospital for the isolation of Miss
Ruth Godfrey, age 26, living on Rural Route 3� Rochester, Minnesota, diagnosed as a
suspicious case of diptheria, was read, and the City Clerk was instructed to
return the same to the Health Officer• with the information that this person
is not a resident of the City of Rochester Minnesota and consequently

the local Health Department, should have no connection with the case, and

be purchased for use in the Police Department of the City of Rochester, Minnesota,

WHEREAS, Leo N. Herrick has made a proposal for the furnishing of a 1930
74" V.L.Harley-Davidson motor cycle, fully equipped, at a price of $467,00, with.
an allowance of 01500000for the 1927 motor cycle now in use of the Police Depart-
: I ment of said City, making.a net cost for the new motor cycle of $317,00, and

WHEREAS, It is deemed for the best interests of the City of Rochester,
Minnesota, that the said proposal be accepted.
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the above mentioned proposal be accepted and that the said motor—
cycle be purchased at a net cost of $317,00 after the allowance above mentioned."

Alderman Vihstadt introduced the following resolution, which was read:

"WHEREAS, The storms of June 12th and 13th, 1930, have greatly damaged
the paving on certain streets within the City of. Rochester, Minnesot4 and
WHEREAS, It is deemed of public necessity that the said paving be
immediately repaired, and
WH''RFAS, It is deemed that the time required for advertisement for bids
for materials and labor to make these repairs would be of great damage to the
public interest and of great danger to the public safety;
SO `FHEREFORE, Be it_resolved by the Common. Council of the City of
Rochester, Minnesota:
Thdt J. T . Lenmon, Mayor of said City, be and he is hereby respectfully
requested to authorize the Department of the City Engineer of said City, to purchase
the necessary material's and employ the necessary labor, and provide for the
necessary equipment, which is necessary for the repair of the paving on Center
Street West, from Broadway Street North and South to the West line of Second Avenue
Northwest and Southwest , the repair of the paving on the intersection of First
Avenue Sout unrest and First Street Southwest, the. repair of the paving on Second
Street, Southwest, from Broadway Street Sotith to the alley next West, the repair of
the paving on the intersection of Broadway Street North and Second Street
Northwest and Northeast, and from that intersection to the C.G.W.R.R.Co. tracks on
Broadway Street North, the repair of the paving on Second Street Southwest between
Twelfth Avenue Southwest and Fourteenth Avenue Southwest, the repair of the paving
on the intersection of Broadway Street South and Third Street Southwest and South-
east, for -the repair of the paving on First Avenue Northwest between the North line
of Center 'Street West and the South line of First Street Northwest, for the repair of
the paving on First Avenue Southwest between the South line of First Street South-
west and the North line of Second Street Southwest, and for the repair of the paving
on First Street Southwest, between the West Line of First Avenue Southwest and the
East line of Third Avenue Southwest, as provided for in Section 284 of the Charter i
of the City of 'Rochester, Minnesota. j
Be it further resolved by the said Common Council: That all resolutions
and parts of resolutions inconsistent herewith are hereby repealed.
Upon motion by Miller, second by Dallman, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Rommel introduced a resolution fixing 2:00 o'clock P.
M., July 7th,19300 as the time for a hearing on the paving of the alley
running North and South across Block 25, in Head & McMahon's Addition to

the, City of Rochester, Minnesota, to a width of 18 feet, with 7" steel
reinforced one course concrete, which was read.
Upon motion by Miller, second by.Amundsen, that the said
resolution be adopted as read,. and all voting in favor thereof.,Presi.dent
Liddle declared the said resolution duly passed and Adopted.
Alderman Rommel introduced the following resolution, which
was read:
"WHEREAS, During November and December, 1929, and during
January,.February, March and part of April, 1930, Chester R. Fellows
received weekly-, appointments and .served as a Special Patrolman pending his
appointment as a Patrolman at the beginning of the official year in April
1930, and his salary was paid from, the budget division for special
patrolmen's services, and
WHEREAS, The payment for his services has made an unexpected
drain on that budget division with consequent overdraft, and it is deemed
right and proper that so long as he was filling the place of a regular
Patrolman his salary should have been paid .from the budget d ivis ion f or
Patrolmen's salaries.
j SO THEREFORE Be it resolved by the Common Council of the
City of Rochester, Minnesota:
That the sum of $732,66 be appropriated from the General Fund
Code 63, and paid to the General Fund Code 83, for the transfer of the above
mentioned payments from the division for the payment ofPatrolmen's
Salaries to the division for the payment of special patrolmen's salaries.

The Mayor and City Clerk of said City are hereby authorized
and directed to draw a warrant upon the City Treasurer and make payment
and transfer accordingly."

Alderman Vihstadt introduced a resolution ordering plans,
profiles, specifications, and estimate of cost for the construction of a

sanitary sewer described; Commencing at the center line of Fifth Street
Northwest and running southerly along the center line of Eighth Avenue
Northwest, for a distance of 130 feet, ordering that: the said iMprovement
be made and done and that the cost and expense thereof be paid for
by special assessments levied as provided by law, which was read.
Upon motion by Rommel, second by Vihstadt, that the said

1930 payment on contract for deed dated Bei3tembpr27th91929, for the so-called
Stebbins property $3999.00, and interest on the said contract for deed, September
27th,1929 to June 30th,1930, inclusive, $456.64, 8hieh was read.

Alderman Hicks introduced a resolution appropriating 1,1516.45 from the
park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls
for labor during; the period of the weeks ending June 13th,1930, and June 20th,1930,
which was road.
Upon motion by Hicks, second by Amundsen,, -that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said

Alderman Miller introduced a resolution appropriating 11,000.00 from the
General Fund, $4,000.00 from the Street and Alley Fund, I1,000.00 from the Sewer
Fund, and 1117`•00,00 from the Permanent Improvement Revolving; Fund for use of
the Street and Alley Committee, which was read.

President Liddle referred the matter of the sprinkling in front of 208
Seventh Street Southwest to the Sprinkling Committee for their attention.

a Committee for the purpose of recommending; an ordinance which shall provide for
the trimming; of trees under City Force Account, and the assessment of the costs against
