HomeMy WebLinkAbout07-07-1930559 ; a Minutes of a regolbe,r meeting of the Common Council of the City of :Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City at 2:00 O'clock P.M., on July 7th,1930. Meeting called to order by President Liddle, Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Vihst,adt, Absent: Rommel. Upon motion by Miller, second by Vihstadt, the minutes of the meeting held on June 23rd,1930, were approved. President Liddle announced this as being the time and place fixed for a hearing on the construction of a sanitary sewer and the laying of a water main in I Sixth Avenue Southwest, between Ninth Street Southwest and Eleventh Street Southwest; i and asked if there was any person present who wished to be heard concerning these improvements. There was no person present who wished to be heard concerning the above ment i.oned sanitary sewer or water main. President Liddle announced this as being the time and place fixed for a hearing on the paving of the alley running North and South across Block 25, in Head and B[CMahznAs Addition, to a width of 18 feet, with seven inch steel reinforced �• 1 Iconerete, and asked if there was any person present who wished to be heard concerning I this improvement. i There was no person present who wished to be heard in regard to the paving i of the alley above described. President Liddle announced this as being the time and place fixed for a ii hearing on the construction of a concrete curb and gutter on Third Avenue Southwest, between First Street Southwest and Second Street Southwest, and the remving of the present curb and gutter, and asked if there was any person prese�it who wished to be heard concerning this improvement, There was no person present who wished to be heard relative to the above mentioned improvement. President Liddle announced this as being the time and place fixed for a hearing on the widening of the paving on Fourth Street Southwest, to a width of sixty feet, between the West curb.line of Broadway Street South, and the East curb i. line of Second Avenue Southwest, the paving with seven inch, one course concrete of the strip between the present paving and the new curb, and the construction of a cement concrete curb along both sides of the paving so widened, and asked if there was any person present who wished to be heard relative to these improvements. There was no person present trho wished to be heard in regard to the j improvement above described. i Alderman Rommel came in at this time and took his Chair. E. H. Schlitgus, as President of the Rochester Commercial Club, asked that the Common Council not pass the proposed franchiae.for the Interstate Power Company, who was followed by Walter F. Caustin, talking for :Charles F. Dabelstein, President of the Business Men's Association, with request that action on a franchise for the local gas c pany be deferred r until such time as a joint conference on rates, etc., can be held by all ' ;interests involved. Hayes Dansingburg, claiming to represent several local _ r ii restaurants and other large users of gas service, made a similar petition, ' which was followed by the opinion of A. J. Lobb ,of the,.:Mayo Clinic, that 'i so long as the local gas franchise has about three years to run, there is ample time for full consideration of all angles of the matter before a new f franchise is put into effect. ku I I6 '; Mr. Jordan, local4na,nager of the Interstate Power Co=any, j Imade the statement that this proposed franchise does not give a 'i ,i monopoly to his company but simply continues their right to do business in propose : this City, leaving it open for competition that might to furnish gas i� iservice at a lower rate than his Company might see fit to offer. j An ordinance of the City of Rochester, Olmsted County, State 41 i I ! of Minnesota, granting to Interstate Power Company, its successors and- �i I assigns, permission to erect, install, construct, reconstruct, repair, own, operate, maintain, manage and control a gas plant within the corporate limits of said City and a gas distribution system consisting of pipes, conduits and other fixtures, in, under, over, along and across the streets, lanes, i avenues, sidewalks, alleys, bridgesand public grounds of said City for the i purpose of furnishing gas for light, heat and power purposes to said City and its inhabitants, for a period of fifteen (15) years from and after i the.passage, approval and publication of this ordinance according to law, w&s given its third and final reading. j - A motion by Hicks, second by Amundsen, that the said ordinance be not adopted as read, carried by all voting in favor thereof. Upon motionby Hicks, second by Vihstadt, the above mentioned proposals i were referred to Chas. H. Armstrong, City Engineer, for tabulation. Gentlemen; ' We kindly ask you to approve of a resolution that was passed and adopted by the Board of Park Commissioners that you appropriate the sum of �'150.00 net to pay for lands that are needed to complete plans for additions to Kutzky Park The - Board deem it necessary that the said ground and lands are needed for Park Purposes. Respectfully submitted by The Board of Park Commissioners; Art Nachreiner, Pres, Wm. Enke, Sec, James H.Starkey, Com. Roger L. J. Kennedy, Com." i Alderman Rommel introduced the following resolution, which was read: "Be it resolved by the Common Council of the ,City of Rochester: That the sum of ',�250.00 be and the said sum is hereby appro- priated from the ParK Improvement Fund of said City and ordered paid to Wm. Enke, for refundment of payment made by him to Thomas A.Bender and Albertina Bender, July 3rd,19301, for lands in Section 34, Township 107 North, of Range 14 West, described in Warranty deed given by them on that date. The Mayor and City Clerk are hereby authorized and. directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made." Upon motion by Hicks , second by Rommel, that the said resolu- tion be adopted. as read, and all voting in favor thereof; President Liddle declared the said resolution duly passed and adopted: Warranty deed given by Thomas A. Bender and Albertina Bender transferring. to the City of Rochester-, Minnesota, a - fifty foot strip of land lying North of Kutzky Park, and lands sufficient for a channel change for Cascade Creek, was 3ald before the Common Council, and upon motion �.by Rommel, second by Miller, the said warranty deed was accepted, and it was . ordered that the same beplaeed. on Pdaord. Upon motion by Miller, seoond by -Rommel'. the Cite Attorney was instructed to draw an ordinance annexing the above described lands to the City of Rochester, Minnesota. A check for $100.00 from A. W. Kutzky• as • a donation toward the purchase price of the above mentioned lands, was laid before the Common i Council, and upon motion by Hicks, second by Dallman, it was accepted into the Park Improvement Fund. r Upon motion by Hicks, second by Dallman, the matter of the feasibility of the construction of wading pools and dimming pools in Cascade Creek, Silver Creek and Bear Creek, was referred to the Street and I � (jAlley Committee to work in conjunction with the Board of Park Commissioners. Louis West and A. F. Wright, made complaint about the difference between the �i proposed curb and ie I, p p gutter grade line and the sidewalk line in front of their oropert $h Seventh Avenue Southwest, and upon motion by Hicks, second by Rommel, their complaint was, referred to the Street and Alley Committee and the City Engineer, with power to i act. The report of the Clerk of the Municipal Court for the week ending June 24th,1930, showing criminal fines collected t77.00, civil fees received $.36, and .I court, costs charged to Olmsted County $23,05, and the report of the Clerk of the Municipal Court for the week ending June 30th,1930, showing criminal fines collected �$116.65) civil fees received $2.601, Olmsted County municipal court fees received for i May 1930, 0,?77.20, and court costs a l-arged to Olmsted County $14.40 were each read and President Liddle referred the same to the City Attorney. The report of the Building and Electrical Inspector for the month of June, 1930, shaving building inspection fees collected in the amount of73.00, and i electrical inspection fees collected in the amount of $11.00, wa.­ read, and President Liddle referred the same to the Finance Committee. The report of the H..ealth Officer for the month of June ,1930, showing receipts in the amount of U1 899.59, disbursements in the amount of 03136.27, and a balance on hand in the amount of $289,44, was read, and President Liddle ordered that the same be placed on file. J. W. Feller of Feller Brothers, asked for an exception of Walter ka-do-h as foreman, and Robert Sloan as cement finisher, in that although they are not able to qualify for resident identification cards under the so-called labor ordinance, and that his concern is unable to fill their places locally, that they be allowed to work on the construction of curb and 'gutter on Seventh Avenue Southwest, and upon motion by Dallman, second by Rommel, such'exception was granted. Upon motion by Rommel, second by Dallman, the City Attorney was instructed ;+ to draw a form which will provide that the City of Rochester may accept Feller Brother:'s billing for the construction of driveways in connection with the Seventh Avenue !'Southwest curb and gutter, and include' tliem with the regular curb and gutter assessment. President Liddle referred the matter of insufficient sanitary sewer ;facilities in Fourth Street Southeast in the neighborhood of Sixth Avenue and Seventh E Avenue , to the Sewer Committee . }:t The following report of the City Engineer in the matter of proposals " !;for curb and gutter aid widening of paving, was read, and President Liddle ordered 1; that the same be placed on file: JA " Rochester, Minn. The application of Virgil L. Ritter and T. H. Fluegel, for licenses to sell soft drinks, were each read, and upon motion by Vihstadt, second by Hicks, licenses were granted. The application of Frank Campbell of 417 East Fourth Street, Winona, Minnesota, for a pop corn stand license on a location at Third Street Southeast, adjacent to the Huey Cigar Store. property,, was read, and upon motion by Hicks, second by Miller, license was not granted. The application of J. C. Adams for a transfer of the license on one of his Auburn taxi cabs, to a Ford taxi cab, was read, but no action was taken as his application was accompanied by the 1929 license on the automobile for which he wished the transfer. Armstrong City Engineer Rochester, Minnesota Dear Sir: Liddle I i It having been made to appear that a nur;ber of streets and avenues were considerably damaged by the storms on June 12th and 13th and that there is immediate need of repairing the same and also that the delay occasioned by strict compliance with the Charter of the City of Rochester regarding the advertisement for bids for doing the said work would cause great damage to the public interest and endanger the safety of the public, I, as Mayor of the City of Rochester, do hereby order and authorize you to go into t 1-e open market immediately and purchase all necessary materials and employ all necessary labor for the relaying with 2-g inch No. 1 paving brick the following streets and avenues in said City: Center Street West, from Broadway Street North and South to the West line of Second Avenue Northwest and Southwest, the intersection of First Avenue Southwest and First Street Southwest, Second Street Southwest, from Broadway Street South to the alley next West, the intersection of Broadway Street North and Second. A communication from the League of Minnesota Municipalities notifying of the conference on Government Relationship, which will be held at the University of Minnesota, July loth to 18thI1930, was read, and President Liddle ordered that the same be placed on file. Upon motion by Hicks, second by Rommel, the Common Council and other City officials were authorized to attend this conference if they find it possible. Alderman Miller introduced a resolution accepting the bid and proposal of Edward Mattson, for the construction of curb and gutter in ;Third Avenue Southwest and the removal of the present curb and gutter, as above quoted, and fixing the amount of the bond to be given by the said contractor at the sum of 1900.00, which was read. . Upon motion by Vihstadt, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Rommel introduced a resolut ion accepting the bid and proposal of Edward Mattson for the widening of the paving on Fourtb. Street Southwest, between Broadway Street South and Second Avenue Southwest, and the construction of a cement concrete curb along both sides of the paving so i I e 'j a a liwidendd, as above quoted, and fixing the amount of the bond to be given by the said - ! contractor at the sum of $3300.00, which •wens read.
