Meeting c�alled to order by President Liddle. Roll Call: Present: Liddle, Amundsen, Dallman, Hicks, Miller, Rommel, Vihstadt. Absent: None. Upon motion by Hicks, second by Vihstadt, the -minutes of the meeting held on J91Y 7th91930, were approved. The fol lo-Ang quoted petition, signed by many influential citizens of the City of Rochester, Minnesota, was read., and President Liddle ordered that the s�.Me be placed on file: To The Common Council of the City of Rochester: ' The undersigned o%mers of'property affected by the proposed widening of Center Street Nest between Broadway and the alley in the block west of First Avenue, respectfully protest against such widening +` for the following reasons: , Because of the loading platform of the Lawler cleaning plant, the entrance on the south side of Hayes -Lucas & Green's lumber shed, the space .required in front of the Union Bus Depot and the development of the Skelly Oil Company's plant, the increased par -Icing space thus obtained would not be commensurate with the cost involved. The Increased parking space along the Colonial. Hospital and Botsford Lumber Company's lumber .shed would result in a great annoyance, and be detrimental, to the -patients of the Colonial Hospital because of the increased noise and gas fumes arising from ariving and departing cars. It would also prevent the use by patients of the sidewalk ' along the south side of the Colonial Hospital which is in great demand on sunny days in the winter and the cool days of spring and fall. } We feel that greater co sidde ation sh uld be given to the welfare of the patients at the Cd oniall Hospita�0 which is an old established institution, than to the slightly increased benefits which will accrue to the public from the small additional parking Space* Y Dated July l lth, 1930 . " The City Engineer submitted plans, profiles, specifications and estimate of cost for the widening of the paving and the construction of concrete curb on Center Street East and West from the West curb line of e First Avenue Northeast and First Avenue Southeast, to the East line of the alley running North and South across Bloeks3l, and 38, in Original Plat, } s and the widening of the paving and the construction of concrete curb on First Street Southeast and Southwest, from the West curb line of First Avenue Southeast to the East curb line of Third Avenue Southwest; t.fi@ ; estimate of cost for Center Street East and West being $3771.90, and that for First Street .Southeast and Southwest, being $6640.10. Alderman Miller introduced a resolution adopting the plans,profiles and specifications for the improvements described above, ordering that the same be placed on file in the office of the City Clerk of said City, orderings that the said estimates of cost be placed on file in the office of the City i II ------------ - - - l -fir 583 I1 1 I Clerk of said City, ordering that the said improvements be made and done, and that thel r • cost thereof be paid for by special assessments levied as provided by law, ordering ad,- • i vertisement for bids to be opened at a meeting%,. of this Common Council which is to be held at 2:00 o'clock P.M., on August 4th,1930, and ordering notice of hearing to all property owners concerned for 2:00 o' clocic P.M., August 4th,1930, which was read. i A motion by Hicks, second by Amundsen, that the said resolution be not adopted as read, carried by allvoting in favor thereof. I L. D. Williams told the Common Council that he has arranged for the construe= tion of a swimming pool do his property lying South of Tenth Street Southeast and near, ji Fifteenth Avenue Southeast, which pool will have approximately 16000 square feet of water surface,, withl a depth running from two feet to five feet, with about four acres for use as play grounds along the banks of this pool, to which he will admit children from the school age to the junior Oollege age free, with a small admittance charge m e to be/for adults; the assistance requested from the Common Council being that the f City of Rochester furnish two culverts to go in the fill necessary to get down from �, the street grade to his property. I Dr. Hans B.Stromberg, who is a chemist in charge of the experimental tests at the local sewage disposal plant, recommended the installation of a small water i tank for test purposes to determine the capacity required for a tank that will be part of the proposed facilities for the removal of water from the sludge before it is carried into the digestion tank, which aparatus would be installed between the recently constructed sedimentation tank and the digestion tank in the sewage disposal plant, f and suggested that different arrangements be made for cleaning out the sludge drying beds in that the present way of cleaning them out leaves a possibility for the City trucks to be busy and thereby tie up the facilities for cleaning of7sludge bed I when a digestion tank should be emptied, and said that he thot that an overhead type � :� of manure carrier might work for such an emergency. President Liddle referred Dr. Stromberg's recommendations and suggestions 1 to the Sewer Committee and the City -Engineer, with instructions that they make report thereon at the next meeting of this Common Council. George Fordham asked that action be taken to cause the removal of the garage owned by B. Gleekle from the alley .running North and South along the West side of the Fordham property, and upon motion by Miller, second by Dallman, the City ':Attorney was instructed to notify Mr. Gleekle to, within ten days, .remove h g garage from the alley mentioned. The reports of the Clerk of the Municipal Court for the week ending July 7th, 1930, showing criminal fines collected $100.00, civil fees received $4.95, and court costs charged to Olmsted County $4.35, for the week ending July 14th,1930, showing criminal fined collected $198.00, Civil fees received 010.25, court costs charged to Olmsted County $21.95, and fines collected due to Olmsted Coutity $13.20; and for the week ending July 21st,1930, showing criminal fines collected $185.00, civil fees received $4.95, Court Costs charged to Olmsted County $5.05, and fines collected due i 1� 'i to Olmsted County $95,501, were each read, and President Liddle referred the same to the City Attorney. i Upon motion by Rommel, second by Vihstadt, the sum 04108.70 was appropriated from the General Fund and it was ordered. that the same be paid l: to Olmsted County, Minne sot a, . for local municipal Court fines collected due �! to Olmsted County. Balancb sheet, income statements, etc., of the Public Utility Board, prepared by the Secretary of the Public Utility Board as of June. 30th,1930, were laid before the Common Council, and President Liddle ordered that the same be placed on file; the said income statements showing a new profit in the Light. Nepartment .for the month of June,1930, of $13287.78, and a net j profit in the Light Department for the three months of this fiscal year of $43885.15, and a net profit in the Water Department for the month of June, 1930, of $8397.29, and a net profit in the Water Department for the three ; months of this fiscal year of $10988,63. The report of the Milk Inspector for the month of June,1930, was read, and President Liddle ordered that the same be placed on file. General Balance sheet, trial balance, statement of funds, statement of unexpended budget appropriations, etc., prepared by the City Clerk as of June 30th,1930, were laid before the -Common Council and President Liddle ordered that the same be placed on file. The application of F. V. Kutzner, for -an electrician's license, s.as read and upon motion by Rommel, second by Dallman, ?icense was granted. The application of the Putity Diner Company for a. soft drink dealer's ;i license at 22 First Avenue Southwest, was read., and upon motion by Vihr+.adt, second by Dall.man, license was granted; The application of Roger Keith for a soft drink dealer's license at 202 First Avenue Northwest, was read, and upon motion by Vihstadt, second by Miller, license was granted; the vote on the said motion being: Ayes: Amundsen, Dallman, Miller., Vihstadt. C. Adams for a transfer of taxicab license No.24 a from an Auburh.5 passenger taxicab,to a 1930 modla,Ford Town sedan, was read, and upon: !mmotion by Miller, second by Vihstadt, the transfer was granted. !i The following applications for permits to place and maintain sites were read, and upon motion by Hicks, second by Dallman, permits were granted: Hack Motor Co., Manhattan Billiard Parlor, Arthur West Grocery, C. Delaney, Rev. Silverblatt, Zierath Brothers, West End Beauty Shop, New Store, Northwestern Hotel, Boston Shine Parlor, Connelly Beauty Shop, Queen City Cafeteria, Houser Moline Co., Nelson Tire Sales, F. A. Sehuchard(:R), Salvation Army. A petition asking that a sanitary sewer be constructed in Sixth Street ',::Southeast, between Eighth Avenue Southeast and Ninth Avenue Southeal"It, was read, and i� , Alderman Vihstadt, as Chairman of the Sewer Committee, recommended that the petition if Ibe granted providing that water service will be laid in this p.a rt of Sixth i; Street Southeast, at which motion by Vihstadt, second by Miller, carried that the City Clerk prepare proceedings for the construction of the sanitary sewer in the said �i 1part of Sixth Streets Southeast, the progress of which will be contingent upon the !'Public Utility Department protiding.for water service. ;i The following appointments by the Mayor were read, and upon motion by �+Dallman, second by Amundsen, the same were approved: " 21 July 1930 it !i Honorable Common Council, City of Rochester., Minnesota. ! Gentlemen: Subject to your approval I hereby appoint W.W. Churchill, Dr. A. F. Kilbourne and T. J. Dansingburg Directors of the Library Board of the City of Rochester, Minnesota, they to. hold office until the third Saturday in July, 1933; and I also appoint Carl Frank to fill the unexpired term of Mrs. S. C. FUrlow (deceased),his term to expire the third Saturday in July, 1931. I� Respectfully submitted, J. T. Lemmon Mayor.. " The appointment by the Mayor of M. E. Condrey as Special Policemen •for duty upon the property of the Nelson Motor Sales Company, he to serve without spay and to hold office until the second Monday in April, 1931, unless sooner removed, was read, and President Liddle ordered that the same be placed on file. A communication from Mr. Henry Rines, State Comptroller, stating that it is the intention td commence the examination of the books and records of the City of Rochester, Minnesota, for the past fiscal year, some time during this month, was read, and President Liddle ordered that the same be placed on file; the examination mentioned l being that which was requested .by this Common Council in January,1930. i A communication from the Minnesota Tax Commission, in reply to a letter written by the City Clerk,under instructions of the Equalisation Board, of this City, asking for the services of a qualified person from that ° j Department, Preferably Air. Rasmussen, of the City and County Assessor's office in St,Faul, Minnesota, to assist the Board of E0421tation in + connection with the'1930 real estate valuations, and to represent the Tax Commission for a decision as towhether or ,not the 1930 assessment is fAir and equitable, wherein they stated that such services could be furnished through them paying the per diem, provided that the City of Rochester, Minnesota, will take up the hotel expenses and railroad fare, and motion by Rommel, second by Dallman carried that the action of the Equalization Board in making the preliminary arrangements for these services was approved, and the City Clerk was instructed to p@quikst of tha Tax Commission that the local Equalization Board have the services of Mr. Rasmussen, or some other competent man from the Tax Commission, for six or eight days, with the expenses to be taken care of as above set forth. The Electrician's license bond of F. V. Kutzner, with the Fidelity & Casualty Company as surety thereon in the amount of $1,000.00, was read, and upon motion by Vihstadt, second by Dallman, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file. Upon motion by Rommel, second by Dallman, the City Clerk was authorized to employ bad secure the necessary clerical assistance, etc., for the compilation of the 1930 sprinkling assessment records. Upon motion by Hicks, second by Vihstadt', the rules were suspended and the said ordinance Was given its second reading. B. Rochester, Minnesota, in accordance with their sworn billing of July 16th,1930, and the certificate of the City Engineer made under. date of July 15,1930,,which was read. Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $37?.66 from the Sewage Disposal Plant Fund and ordering payment made to the Electric Supply Company for labor and materials connecting the motors and labor and materials for installing fl lighting system, both at the preliminary sedimentation tank for the local sewage disposal plant, in accordanow with sw orn billing of July 1,1930, which was read. Upon motion by Vihstadt, second bV Rommel, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said r resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $3094.00 from the Permanent Improvement Revolving Fund and ordering payment made to Feller Brothers for construction of curb and gutter on Seventh Avenue Southwest, from Sixth Street x� I Southwest to Eleventh Street Southwest, in accordance with estimate prepared by the i City Engineer under date of July 21,1930, which was read.` Upon motion by Rommel', second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said I, !I resolution duly passed and adopted. Alderman Hicks introduced a resolution appropriating $2912.68 from the Musical Entertainment Fund and ordering payment made to, A. J. Lentfer, Treasurer of the Rochester Park Band, for free musical entertainment furnished for the general public, 'which said sum is the amount boilected in the March and June 1930, tax settlements for that purpose, which was read. Upon motion by Vihstadt, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced a resolution appropriating $1423.95 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for Payrolls for labor during the period of the weeks ending July llth,1930, and July 18th,1930, in accordance with sworn billing made by Wm.Enke, Secretary of the Park Board under date of July 21st,1930, which was read. Upon be adopted as motion by read, and Miller, second all voting in by Dallman, that the said resolution favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman -Hicks introduced a resolution appropriating. $3597.67 from the Fire Protection Fund and ordering payment made to the City of 8ochester, Water Department, for hydrant rental, the said sum being the amount collected for that purpose in the March and June 1930 tax settlements, whit�h was read. Upon motion by Vihstadt, seccnd by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced a resolution appropriating 0480.00 from the Fire Protection Fund and ordering payment made to the Manhattan Manufac- turing Division of the Raybestos-Manhattan, Incorporated, for the 40 per cent provided in the specifications for the furnishing of 1000 feet of C:rown brand 2-2 inch fire hose at 01.20 per ft., which purchase was made under contract with the above mentioned firm, which was read. Alderman Dallman introduced a resolution a ppropriating $1471,71 from the -Sewage Disposal Plant Fund and ordering payment made to Feller Brothers for extra materials and labor and overhead in connection with the construction of a preliminary sedrimentation tank at the local sewage disposal plant, in accordance with their sworn billing of July 7th,1930, which was i; read,. Upon motion by ;filler., second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating $980.09 from the Street and Alley Fund and ordering payment made to the Standard Oil I Company for the furnishing of 230 drums of Stanolind Filler, 44.865 tons at $21e20 per ton,. $941.63, and $38.46 for gasoline furnished for City Engineer's j automobile, which was read. ,; Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced the following resolution,which wasread: "WHEREAS, The Common Council of ,the City of Rochester., Minnesota, deem it expedient and necessary that local public improvements, the cost and expense of which shall be paid by special assessments levied as provided by law, be made in said City of Rochester, Minnesota, the said improvements being described as follows: The paving with 7" one course steel 'reinforced concrete and the curbing of Tenth Street Southwest from the sliest line of Eighth Avenue South- west to the East line of Plummer's Replat "A", and the paving as above, and curbing of Plummer' s Road_, from the East line of Plummer' s Repl at A , to the 0 591 1: 4- �I West City Limits line, described more fully as follows: Commencing at the West line of Einhth Avenue Southwest and running West on the center line of Tenth Street Southwest 198.61 ft . , thence on right curve of 21° 11' 220.67 ft . , thence N. 46°45' West, 74,62 ft., thence on left curve of 110 1' 136.E ft., thence on right curve of 13048' 485.11 ft., thence on left curve of 20057.9' 218.21 ft., thence N.5"7° j' West j 108.3 ft., to city limits line. SO THEREFORE, Be it resOlved by the Common Council of the City of Rochester, Minnesota: That a public hearing of all persons and parties interested in the said improvements will be held at 2:00 o'clock P.M., on August 4th,19309 in the Council Chambers, in the City Hall, in said City, at v,hich time and place all persons and 'i parties interested in the said improvement may appear and be heard by said Common Council in relation to the said improvement. ; The City Clerk is hereby ordered and directed to cause to be published in the official newspaper of said City a notice to all interested persons and parties of the time, place and purpose of sand meeting and hearing. The City Engineer submitted plans, profiles, specifications and estimate of 000t for they aronatruotton of a sanitary sewer and the laying of a water main in Y 1� Sixth Avenue Southwest, between Ninth Street Southwest end Eleventh Street Southwest,: the said estimate of cost for the sanitary sewer being $666.75 and for the water main $639.25. Alderman Rommel introduced the following resolution, which was read: IsWHEREAS, The Common Council of the City of Rochester, Minnesota, at a meeting thereof held on July 7,1930, after due notice given and hearing had as pro- vided by law, did pass and adopt a resolution ordering that a sanitary sewer be constructed and a water main laid described: The construction of a sanitary sewer commencing at the center of the intersection of Sixth Avenue Southwest, and Ninth Street Southwest, and running southerly along the center line of Sixth Avenue Southwest, to the center of the intersection of Si.xt$ Avenue Southwest Land Eleventh Street Southwest and the laying of a water main in the said part of Sixth Avenue Southwest, and in said resolution directed the City En�,ineer of said City to prepare and file in the office of the City Clerks detailed plans, profiles and specifications for the said sanitary sewer and water mAin ind to make and report to the said Cd#*on Council an estimatt of the cost and expense of said sanitary sewer and water main, and said City Engineer pursuant to said directions did on July 15th,1930, file in the office of the City Clerk of said City, plans, profiles and specifications for the said sanitary sewer and water main and did report to the said Common Council an estimate of the cost and expense of the construction of the said sanitary sewer and water main; Therefore, Be it- and it is hereby resolved by the Common Couria'.il of the City of Rochester, Minnesota: That the plans, profiles and specifications for the said sanitary sewer and water main so filed by the said City Engineer in the office of the City Clerk be and the same are hereby adopted as the plans, profiles and specifications for the said sanitary sewer and water main, and that the said estimate of cost of the said sanitary sewer and water main reported to said Common Council be and the same are hereby accepted and ordered filed. The City Engineer submitted plans, profiles, specifications and estimate of cost for the construction of a surface drainage sewer in Sixth. Avenue Southwest, from Eighth Street Southwest to Eleventh Street Southwest, to discharge into the water pond in Soldier Field Golf Course; the said estimate of eostbeing $2518.35. Alderman Miller introduced the following resolution, which was read: "WHEREAS, It is deemed expedient and necessary that a surface drainage sewer be constructed in Sixth Avenue' Southwest, from Eighth Street Southwest, to Eleventh Street Southwest, and discharging into the water pond in the Soldier Feld Golf Course, and WHEREAS, The City Engineer has prepared and submitted plans, profiles, specifications and estimate of cost for the construction of the said surface drainage sewer; SO TFEREMRE, Be it Resolved by the Common Council of the City of Rochester, Minnesota: That a surface drainage sewer be constructed in Sixth Avenue South- west, from Eighth Street Southwest to Eleventh Street Southwest, to discharge into the water poAd in the Soldier field Golf Course, that the above men- tioned plans, profiles and specifications be adopted, for the construction of the above described surface drainage sewer, and that the same be placed on file in the office of the City Clerk of said City, and that the said estimate of cost be placed on file in the office of the City Clerk of said i� City. 1593 Be it further resolved by the said Common Council: That the City Clerk of said City is hereby authorized and directed to advertise for proposals for the 1 furnishing of all labor, materials, equipment, etc., necessary for the construction of the surface drainage sewer above described, which sealed proposals will be I received and opened at a meeting of this Common Council, which is to be held at 2:00 o'clock P1M., on August 4th,1930. Eaea bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of the City of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which check and the amount of money specified therein shall be .forfeited to the city of Rochester, Minnesota, as liquidated damages if the bidder upon the letting of the contract to him shall rail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids, A surety bond written for the full amount of the contract by a surety company authorized to do business in the State of Minnesota, will be required with the contract.
