Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Hicks, Miller, Vihstadt. Absent: Dallman, Rommel-; Alderman Dallman being absent through -being confined to the hospital with a broken leg. Upon motion b.y Vihstadt, second by Miller, the minutes of the meetingsheld on July 21st, 1930, and July 28th,1930, were each approved. President Liddle announced this as being the time and place .fixed for a hearing on the petition of Wm. A. Fitzgerald for the vacation of :;all of Ei hth Street Southwest between First Avenue Sout huest and Broadway Street South, all of Seventh Street Southuest between First Avenue Southwest ..and Broadway Street South, all of the alley running North and South through Block 103 in Willson's Addition, all of the alley running North and South through Block 104 Willson's Addition, :and all of the alley running North and I South through Block 105 in Willson's Addition, and asked if there was any person present who wished to be heard on any matter concerning the vacation ,.of the streets and alleys above described. There was no person present who wished to be heard. resident Liddle announced this as being the time and place fixed for a hearing on paving and curbing of apart of Tenth Street j Southwest and of Plummer's Road, and asked if there was any person present who wished to be heard concerning these improvements. Alderman Rommel came in at this time and took his Chair. i I John S. Reed,of the local Labor organization, made complaint that C. C. Pagenhart is not complying with the provisions of the local so-called Labor Ordinance ' D as the same applies to the contract for the construction of the new School building at Sixth Street Southwest andFifteenth Avenue Southwest, ald upon motion by Vihstadt, ., 'I (014 - - - - - - ------ - --- -- - - -- second by -- _..._ _.------- Miller, ---- - - - - ---- --- _ _ _. --- the Citv Clerk was - ---- instxu cted to request of Mr. C. C. Pagenhart that he furnish this Common Council with a certified list of his employees on this project together with the kind of work that they are doing and the wanes that they are being paid. A remonstrance against the use and maintenance of a gasoline curb pump on the boulevard at 648 Center Street West, signed by many residents of that vicinity, was read., and upon motion by Hicks, second by Vihstadt, the City Clerk was instructed to serve noti,ee upon Mr. Eldin E. Holtorf that he shall remove this curb pump at once. , • The City Clerk called attention to the fact that the original proceedings for the. paving and curbing of Tenth Street Southwest and Plummer's Road does not carry the width of the paving proposed, and suggested that these proceedings be abandoned and that new ones be started " at which motion by Rommel, second by Amundsen, carried. that the original proceedinfa for this paving and curbing be abandoned and that the Cite Clerk prepare proceedings for. a hearing on these improvements at 7:30 o'clock P.M. on August 18t h,1930 . The report of the City Treasurer for the ending of July,1930, a' ,showing 363757.37 as being on hand was read, and President Liddle ordered, that the same beplaced on file. The application of Nelson Tire Sales and Candyland for r ,permits to place and maintain signs were read, and upon motion by Hicks, isecond by Amundsen, permits were granted. ! The application of the American Legion Drum Corps for a public dance permit, at the Armory August 2nd,1930, was read. The application ofR. U. Williams for a transfer of hi.s '. .barber shop license No.32 from 10 Second Street Southeast to 12I. First ;Avenue Northwest, was read, and upon motion by Hicks, second by Amundsen, Itransfer was granted. The following emergency authorization for the repair of -khe ,paving on part of Center Street East, was read, and President Liddle ordered ?that the samebe placed on file: August 2,1930. Dear Sir: ° It having been made to appear that the paving on the ;; West approach to the CenterStreet East bridge over the Zumbro ;i River is unsafe for travel and that there is immediate need of i4 605� � F^ repairing the same, and also that the delay occasioned by strict compliance with the Charter of the City of Rochester, Minnesota, regarding the advertisement for bids for doing the said work and furnishing the materials, would cause great damage to public interests and endanger the safety of the public, I. as Mayor of the City of Rochester, Minnesota, do hereby authorize you to go into the open market immediately and purchase all necessary materials and employ all necessary labor for the relaying of the 1! paving surface on Center Street East between the West end of the bridge over the Zumbr o River and a point 120 feet West, with 22 inch No.l paving brick. H.Page, �I Eleorge Schmelzer, rand Felix Jacobs., as Special Patrolmen for July 31,1930, and the arn:ointment by the Mayor of Henry ?iath,as a Special Policeman on the grounds of the local United States Post Office, he to serve without pay and to hold office until !;the second Monday in April, 1931, unless sooner removed, were read, and President i Liddle ordered that the same be placed on file. It was explained that the license of the B111ir Brothers 101 Ranch Wild West Show in this City July 31st,1930, was,underpreliminary arrangements, issued. for thirty cars, while this 'shown came to the' City 6f Rochester in twenty-eight cars, at which motion by Amundsen, second by Hicks,earried that the sum of $5,00 be appropriated from the General Fund and paid to Miller Brothers 101 Ranch Wild West Show, as a refund of the overcharge in the license fee between that for thirty cars and that for twenty-eight cars. The City Clerk explained the request of the State of Minnesota Highway Department that a certificate be furnished by his office to the effect that the City ofRochester, Minnesota, does not now hold an option for the so-called Allis Property at Oronoco, which certificate will be attached to the deed to be given by the Allis interests for lands taken by the new Trunk Highway No.20, and upon motion by Hicks, second by Vihstadt, the City Clerk was authorized and directed to execute a certificate accordingly. The following copy' of resolution was read, and President Liddle ordered that the same be placed on file: ' "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Hon. Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the Donovan Construction Company of, St .Paul,Minnesota, for the furnishing of all the labor ,tools,piping and equipment necessary for the installation of piping and fittings according to speaifieations on file and in accordance with their bid dated I kf. Mayor and Common Council, Gentlemen: The Sewer Committee beg to recommend that the City Engineer be instructed to construct four manholes and two cross-overs in Third Ave. Northwest, between Fifth and Sixth Street Northwest. " A petition that a sanitary sewer be c anstructed and a water 'main laid in Sixth Street Southeast, from Third Avenue Southeast to the West line of Lot 10, in Block 19, and Lot 6 in Block 92, Original Plat, !was read, and upon motion by Vihstadt, second by :Hicks, the City Clerk ,was authorized and directed to prepare proceedings for the first hearing on If ;this improvement, Alderman Rommel called to the attention of the Common Council the necessity of rewiring' the fire` alarm system and President L,iddle referred the matter to the Fire Department Committee, z I > 14 699� The matter of better ptotection against fire, due to the large amount of gasoline that is stored in the Chicago Great Western Railroad Company right-of-way South of Fourth Street Southeast, was referred to the Fire Department Committee by President Liddle. i The recommendation of the Lighting Committee that a street light be installed at the intersection of Seventh Avenue Southwest and Second Street Southwest and at the intersection of Thirteenth Street Southeast and Seventh Avenue Southeast, was read, and upon motion by Rommel, second by Vihstadt, the recommendation was a-T)roved and the City Clerk was instructed to request of the Public Utility Board j Ithat installation be made accordingly. Amundson Alderman ._ introduced a resolution adopting the said plans, profiles and specifications for the paving of the alley running north and South across Block 25 in Head P- McIAahon's Addition to the City of Rochester, Minnesota, to a width of 18 feet with 7 inch steel reinforced one course concrete, ordering that the same be placed on file in the office of the City Clerk of said City, ordering that the said estimate of cost be placed on file in t Yee office of the City Clerk of said City, ordering that the said improvement -be made and done and that the cost thereof be paid for by special assessments levied as provided by law, ordering notice of hearing to the property owners concerned for 7:30 o'clock P.M., August 18th,1930, and ordering advertisement for bids to be opened at 7:30 o'clock P.M., on August 18th, 1930, which was read. Alderman Hicl,s,introduced a resolution fixing 7:30 o'clock P.M., August 18th,1930, as the time for a hearing on the construction of a sanitary sewer in Sixth Street Southeast, commencing at the center of the intersection of Sixth Street Southeast andE:ighth Avenue Southeast, and running thence Easterly along the center line of Sixth Street Southeast for a distance of 233 feet, which was read. Upon motion by Vihstadt, second by Hicks, that the said resolu- 4: tion be adopted as read, and all voting in favor thereof, President Liddle de I clared the said resolution duly passed and adopted. I Alderman ..Hicks introduced a resolution authorizing the Public Utility Board to lay.. a water::main in Fifth- Street Northeast.. between r ENinth Avenue Northeast and Eleventh Avenue Northeast, which was read. r I Upon motion by Vihstadt, second by Miller, thatthe said resolution be adopted as read, and all voting in Ravor thereof, President Liddle declared the said resolution duly passed and adopted. i� i II i fly 6 1-1 I i� i Alderman Amundsen introduced a resolution accepting the above quoted proposal of Martin Paulson for the construction of a surface drainage sewer in i Sixth Avenue Southwest between Eighth Street Southwest and Eleventh Street ;Southwest to discharge into the water pond in Soldier Field Golf Course, and jfixing the amount of the bond to be given by the said contractor at the sum of I$2150.00, which was read. Upon motion by Miller, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted.' Alderman Hicks introduced a resolution accepting the bbove quoted ;,proposal of Wm.C.Fraser and Son for the construction of a sanitary sewer in Eighth Avenue Northwest, commencing at the center line of Fifth Street Northwest and running Southerly along the center line of Eighth Avenue Northwest for a distance of 130 feet, and fixing the amourt of the bond to be given by the said contractor at the sum of A160.001, which was read. Upon motion by Rommel, second by Amundsen, that the said resolution be is adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced a resolution accepting the above quoted proposal of Wm. C. Fraser & Son for the construction of a sanitary sewer in Sixth Avenue Southwest from the center of the intersection of Sixth Avenue and Ninth Street Southwest and running southerly along the center line of Sixth Avenue Southwest to the center of the intersection of Sixth Avenue Southwest and Eleventh Street I Southwest, and the laying of a water main in the said part of Sixth Avenue Southwest, and fixing the amount of the bond to be given by the said contractor at the sum of '>1100.00, which was read. � Upon motion by Hicks, second by Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said I; resolution duly passed and adopted. ! Upon motion by Rommel, second by Vihstadt, it was ordered that the certified checks of the unsuccessful bidders for the construction of sanitary servers, the construction of a surface drainage sewer and the laying of a water main be returned to them. Alderman Rommel introduced thefoll'owing resolution, which was read: "Be it resolved by the Common Council of the City of Rochester,Minnesota; That the sum of `2410.90 be appropriatedfrom the General Fund of said City and paid to the Sewer Fund of said City as a temporary transfer which said temporary transfer shall be returned to the General Fund by a 1930 tax levy into the Sewer Fund specifically made for the return of the said transfer, the said transfer being made for the purpose of creating funds sufficient to pay forthe construction of a surface drainage surer in part of Tenth Street Southwest and in Plummer's Road. tlI i� The Mayor and City Clerk of said City are hereby authorized ;j and directed to draw a warrant upon the City Treasurer and make the transfer .� accordingly." Upon motion. by Vihstadt, second by Hicks, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Rommel introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester: That the sum of•;%1600.00 be and the said sum is hereby appro- priated from the General Fund of said City and ordered paid to Park Improvement f Fund, which. is for the transfer of the sum paid by the State of Minnesota, Highway Department for damages in connection with new routing of trunk highways 7, 20 and 59, through and overSoldier Field, the said State of -Minn-. rota Highway Department payment having been received into the General Fund and this transfer is made Lo make money available in the Park Improvement Fund for the removal of buildings and construction of golf greens, etc. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said paym ent to be made." i Upon motion by Rommel, second by Hicks , that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. iAlderman Miller introduced a resolution appropriating 11664.91 !from the New Central Fire Station Fund and ordering payment made to•H.' i Dornack as Estimate No.3 on contract for plumbing and heating in new central I . fire station which was read. Upon motion by Vihstadt, second by Miller, that the said ;i resolution be adopted as read, and all voting in favor thereof, President I (Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced a resolution appropriating �540.00 from the New Central Fire Station Fund and ordering payment made to the H. & V i f Electric Company for estimateNo.3, on contract for electric wiring at new central fire station, which was read. Upon motion by Hicks, second by Amundsen, that the said �I resolution be adopted as read, and all voting` in favor thereof, President Liddle declared the said resolution duly passed and adopted.
