Minutes of an adjourned regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the Council Chambers, in the

City hall, in said City at 7:30 o'clock P.M., on August 18th,1930.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen., Hicl,.s, Miller, Rommel,
`?ihsta.dt. Absent: Dallman; Alderman Dallman being absent through being
confined at the Colonial Hospital with a broken leg.
Upon motion by Rommel, second by Vihstadt, the minutes of the
meeting held on August 4th,1930, were approved.

President Liddle announced this as being the time and place
fixed for a hearing on the paving of the alley running North and South
across Block 25 in Head & McMahon's Addition to the City of Rochester,
Minnesota, to a width of 18 fect, with 7" steel reinforced one course concrete
and ad-ked if there was any person Present who wighed to be heard regarding
this improvement.
Arthur Reiter and John J. Fulkerson, Jr., appeared in opposi-
tion to this improvement except that the City of Rochester or the Rochester
�. Holding Company pay the cost and expense ofdmaking dt, to which Mr. Reiter
;added a claim that the Rochester Holding Company during the construction of
:;their building damaged the alley paving lying West of his property, which

was constructed under private contract and paid for by the property bbnbfitf. ,
also that they damaged his lawn, which he has had fixed at his rnvn
';expense..
This being the time and place fixed for Vie opening of

President Liddle announced this as thetime and place fixed for the

1920.
President Liddle announced this was the time and'place fixed for a hearing
on the paving with 7 inch steel reinforced c onci�ete to a width of 30 feet and the
curbing of 91.1enth SIrreet Southwest, from the West line of Eighth Avenue Southwest
to the East line of Plummer's Replat"A", and the paving as above and curbing of
Plummer's Road, from the East line of Plummer's Replat "A", to the West City Limits
line, and asked if there was any person present who wished to be heard in regard to
these improvements.
Dr. H. S.,Plummer asked that this paving and curbing project be
lideferred until next year.

Alderman Vihstadt introduced a resolution ordering plans, profiles,
!:specifications and estimate of cost for the paving and curbing above described and

ordering that the said i.wproveuients be made and done and that the cost thereof be
paid for by special assessments levied as provided by law, which was read.

Upon motion by Rommel, second by Vihstadt, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted. '
The City Engineer submitted plans, profiles, specifications and estimate
:of cost for the paving and curbing of.a part of Tenth Street Southwest, and of
Plummer's Road, as above described, the said es-dmate of cost being14496.76.

Alderman Miller introduced a resolution adopting the plans,
profiles and specifications for the paving and curbing above described, and
ordering that the same be placed on file in the office of the City Clerk of
;said City, accepting the said estimate of cost and ordering that the same
be placed on file in the office of the City Clerk of said City, ordering
that the said improvements be made and done and that the cost thereof be
be paid for by special assessments levied as provided by law, ordering .a
notice of public hearing on the said improvemehts for 2:00 o'clock. P.M.,
on May 4th,1931, and ordering,,advertisement for bids to be opened at 2:00
o'clock P.M., do May 4th,1931, which was read.
Upon motion by Vihstadt, second by Rommel, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
President Liddle announced this as the time and place fixed -
for a hearing on the grading of Seventh Avenue Southwest, between the South
line of Sixth Street Southwest and the South line of Eleventh Street Southwest
to a grade to conform to the curb and gutter now -constructed on thL; said part
of Seventh Avenue Southwest, and asked if there was any person present who
wished to be heard concerning this grading.
R. J. Thompson stated that he objected to payinany of the

costs for this and expressed himself as not being satisfied with the curb
and gutter grade in front of his property. Mrs. Dinah G. Olin asked that
the assessment for this grading be made with consideration of the fact that
the bulk of the excavation is between Ninth Street Southwest and Eleventh
Street Southwest, and A. Fe Wright, followed with a discussion asking
for the same result. Newton Holland appeared later with the opinion that
the assessment Chould 'be spread against those benefited..
In the debate of the subject, the City Engineer a itbd�,dssess—
ments made for grading which he claimed were parallel cases, wherein no
r�jgard was taken of benefits involved.
Emil Reiter asked for a "No Parking" designation on the
! North side of Center Street between the bridge and his private driveway and
also suggested that a traffic line be provided for across Center Street
between Mayo Park acid the store east of his property, which request and
suggestion was by President Liddle referred to the Street and Alley Committee.
R. R. Boyce,representi.ng the Rochester Airport Company,
asked for permission to place "Airport" signs on electric light poles at the
vlassey corner, the Library corner, the Claussen.Apartment corner, the

standards provided by the Airport Company.

Peter Kruger asked that consideration be taken of the construction of
' a sanitary sewer and the laying of a water main in Third Avenue Northwest, North of

Fourteenth Street Northwest, and President Liddle referred the matter to the Sewer
Committee and the Water Committee,
E. V. Raetz spoke of the need for a public swimming pool in Southeast

Rochester, but no action was taken on his suggestion.
Alderman Miller introduced a resolution ordering plans, profiles,

President Liddle announced this as the time and place for 'a

hearing on the construction of a sanitary sewer in Sixth Street Southeast,
commencing at the center of the intersection of Sixth Street Southeast, and
Ei�hth Avenue Southeast, and running thence Easterly along the center line
of Sixth Street Southeast for a distance of 233 feet, and asked if there
was any person present who wished to be heard concerning this improvement.
There was no person present *ho wished to be heard concerning
,the said sanitary sewer.
A. H. Clemens presented the petit ions and agreements of
"Cornelius M. Judd and Maurice J. McElligott, Jr., asking for the construction
of curb and gutter and sidewall,.. along their property on the North side of
Sixth Street Southwest, and wai.vingthe regular assessment proceedings
for these improvements, which were read, and upon motion by Hicks, second by
Amundsen., the pdtiitions were granted and the City Clerk was instructed to
record the said petitions and agreementsa.gainst the property concerned..

Upon motion by Miller, second by Vihstadt, the Mayor was
requested to issue an emergency authorization to the City Engineer for the
construction of the curb and gutter and sidewalk along the Judd and McElligott
Properties as above requested.
Alderman Amundsen introduced the following resolution,wh.ich

"Be it resolved by the Common Council of the CJ.t;r of
Rochester, Minnesota:
That the bid and proposal of G..Schwartz R� Co. for the
furnishing of all labor, materials, equipment, etc., necessary for the paving
of the alley runn ing North and South across Block 26, in Head & McMahon's
Addition to the City of Rochester, Minnesota, to a width of 18 feet, with 7"
steel reinforced one course concrete, in accordance with the plans, profiles,

Clerk of said City, viz:

A motion by Amundsen, second by Miller, that the said resolution be

I; The City Attorney ruled that in ,:..:.. the proceedings for this

improvement did not originate with more than a majority of the property owners

petitioning for it, the passage of any resolution In the proceedings should have a
favorable vote of five -sevenths of the members of the Common Council, and accordingly

President Liddle declared the motion to adopt the above quoted resolution lost, as
I' only four -sevenths voted for its passage and adoption.
Upon motion by Ro.mael, second by Hicks, it was ordered that the certified
checks of all of the bidders for the paving of the alley in Block 25, Head F- McMahon'
A ddit ion, above described, be returned to them.
VG.Rolets and L. A. Fellows, asked that the Common Council consider the
reduction of the an.ctionder license fee of $25,00 per year, as they feel that the
ii 6litye license together with the State of Minnesota license of -%5.00 makes .quite a
I; high license for them to engage in their profession, and President Liddle referred
their plea, to the License Committee and the City Attorney.
Ti. A.Yallows asked, that in the event lie constructed a dance pavilion
j within the City limits, if he could be granted his dance permits in such a way
that a yearly period would be covered with provision that so many nights each week
could be used regardless of what days of the week they might be, and further
that if it would be possible for a change of the present 12:00 o'clock closing hour
on week days to 1:00 o'clock A.M.,on week days except Saturdays, and President
Liddle referred his request to the License Committee and the City Attorney.
Certificate made by C. C. Pagenhart as to his employees on the construction
of the new school building at Sixth Street Southwest, and Fifteenth Avenue Southwest,
made under provisions of City ordinance No.415, was read, and President Liddle
ordered that the same be placed on file.
The report of the Health Officer for the City Farm for the -month of July,
19,50, showing• 2045.08 received; disbursements of ?2594,14, and an overdraft of
was read, and President Liddle ordered that the sa:iie be placed on file.

President Liddle referred the same to the Finance Committee..
The report of the Building & Electrical Inspector for the
:month of July,1930, showing building inspection fees collected in the amount
of $124.00, and electrical inspection fees collected in the amount of $32.50,

The City Engineer's trial balance of disbursements in his
department during the month of 4uly,1930, was laid before the Common Council,
and President Liddle ordered that the same be placed on file.
The following applications for permits to place and maintain
signs, were each read, and upon motion by Hicks, second by Amundsen,

The application of Harry Taggart for a soft drink dealer's license was
read, and upon motion by Vihstadt, second by Rommel, license was granted.
The following copy of resolution requesting authority was read,and

';to authorize the said Board to enter into a contract with C. C. Pagenhart for the

material and equipment necessary for the complete construction of a turbine foundation

The following emergency authorization given to the City Engineer by the

It having been made to appear that the paving on Fourth Street
Southeast from the west end of the bridge over -..the Zumbro River on Bourth
Street Southeast, is unsafe for travel and that there is immediate need of
repairing the same, and also that the delay occasioned by strict compliance
with the Charter of the City of Rochester,Minnesota, regarding the adver-
tisement for bids for doing the said work and furnishing the materials,
would cause great damage to public interests and endanger the safety of the
public, I, as mayor of the City of Rochester, Minnesota, do hereby authorize
you to go into the open market immediate ly and purchase all necessary
materials,and employ all necessary labor '-or the relaying of the paving
surface on Fourth Street Southeast from the West end of the bridge over the
Zumbro River on Fourth Street Southeast, to east line of Broadway.
This order is given you under and in accordance with t'ie provisions
of Section 284 of the Charter of the City of Rochester, Minnesota.
This order will be retained by the City Engineer and a copy of
same be attached to the certificate for payment of the brick purchased.

Broadway to First Avenue Southwest is being; widened and because of

the necessary steps and to expend t ht-� necessary funds to dothis work
as economically as possible.

Council.
Alderman Miller introduced a resolution adopting the said
specifications and ordering the wrecking and removal of the so-called City
Toolhouse, and ordering; advertisement for proposals to be opened at a
meeting of this Common Council which. is to be held at 2:00 o'clock P.M. ,

directed to secure the necessary lal-ior., materials, and equipment and construct four
manholes and two cross overs in connection with the Third Avenue Northwest surface

"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the Public Utility Board of said city be and the said Board is hereby
authorized in enter into contract with C. C. Pagenhart for the furnishing of all
labor, tools, materials, and equipment, necessary for the complete construction of a
turbine foundation in accordance with the plans and specifications at a total lump
sum price of A1608.00.
The amount of the bond to be given by the said contractor is, hereby fixed
at the sum of A1608.00. "

Alderwnn Rommel introduced a resolution authorizing the Public Utility
Board to lay a water main in Sixth Place Southeast, from Third Avenue Southeast to
the West line of Lot 10 in Block 91, and to the West line of Lot 63, in Block 92, all
in Original Plat, which was read.
Upon motion by Rommel, second by Miller, that the said resolution be adopted
as read, and all voting in favor thereof, President Liddle declared the said resolu-
tion duly passed and adopted.
Alderman Amundsen introduced a resalution appropriating 1372,24 from the
Street and Alley Fund and ordering payment made to John McDonald for labor and
materials, etc., for the construction of sidewalk crossings and approaches, in
accordance with sworn billings made August 1,;th,1930, and August 18th,1930, which
