Minutes of ame4journed regular meeting of the Common Council of the City of Rochester, Minnesota, -.held in the Council Chambers in the City Hall, in said City at 7:30 O'clock P.M., on October 20th,1930. . , Meeting called=to order by President Liddle, Roll Call. Present:' Liddle, Amandsen, Dallman, Hicks, Miller, Rommel, Vihstadt, Absent:. None. " President Liddle announced this as the time and place fixed for a hearing on the confirmation of the 1930 sprinkling assessments, which were levied October 6th, 19301, and asked if there was any person present who wished to be heard relative to either or any of the said asses8ments.- There was no; person present who. w14shed to be heard in regard to either or any of the 1930 sprinkling assessments. President Liddle announced this as being the time and place fixed for a hearing on and the levying of spec iAl assessments for the grading of, Seventh Avenue Southwest, between the South line of Sixth `Street Southwest and the South line of Eleventh Street Southwest, to a grade to oohform to the curb and gutter now constructed on the said part of Seventh Avenue Southwest, and asked if there was any person present who wished to be heard concerning this improvement. There was no person, present who wished to be heard. President Liddle announced this as being the time and place fixed for a hearing on and the levying of special assessments for the construction of a sanitary sewer commencing at the center of ti4e intersection of Third Aveme Southeast and Sixth Place Southeast, and running Westerly along the Center line of Sixth Place Southeast to the West line of Lot 12 in Block 91 and the West line of Lot 6 in Block 92, all in Original Plat, and asked if there was any person present who wished to be heard in regard to this sanitary sewer. There was no person present who wished to be heard relative to this impr oveme at President Liddle announced this as the time and.plaee fixed for a hearing on and the levying of special assessments for the construction of s sanitary sewer commencing at the center of the intersection of Sixth Street Southeast and Eighth Avenue Southeast.,. and running thence Easterly along the center line of Sixth Street Southeastffor a distance of 233 feet, and asked if there was arty person present who wished to be heard concerning the said sanitary" ewer. There was no person present who wished to be heard in regard to this impr President Liddle announced this as being the time and place fixed for a hearing on the levying of special assessments for the cost and expense of repairing sidewalks, and asked if there was any person present who wished to be heard. t. " This being the time and place fixed for the opening of proposals for the furnishing and installation of an automatic mechanical stoker and equipment at the new Central Fire Station, the following proposals were opened and read: Rochester Electric Company: One No.2 Iron Fireman automatic coal burner $860a00; k '.Herman Dornaek: No.21 Fire -King Stoker $865e00; i I Maass & McAndrew Company: Combustioneer No.20 Stoker $893.00. Upon motion by Hicks, second by Vihstadt, the above mentioned i proposals for the furnishing and installation of an automatic mechanical stoker, were referred to the Architect for his tabulation and recommendation. James Kelly, City Assessor, asked -for additional help, i.e. that the City of Rochester, dinnesot a, pay the salami of his Deputy for the I balance of the official year, and also that he be given an office in'which to do his work, and President Liddle referred the' matter to the Tax Committee of i the Common Council; The following communication was read, and President Liddle i ordered that the same be placed on file: "Rochester, Minnesota,. October 16th,1930. Honorable Council of the City of Rochester: ;I The need of additional park area, in. Northeast Rochester has beenconsidered by representatives of the following organizations: Commercial Club Isaac Walton League American Legion -- Veterans of Foreign Wars Society of Stationary Engineers North Rochester Civic Association i Rotary Club 'Kiwanis Club Trades and Labor Organization Elks Club I and at a public hearing held in the Commercial.Club and attended by over a hundred citizens, The unanimous opinion of both groups is that the Park System of Rochester should include the area known as the Silver Lake Project in Northeast Rochester and that your honorable body should provide adequate funds in your next 'budget to begin the acquiring of the land necessarylor the successful development of the.entire project in the near future in­aceordance with a definite plan for its eomplete development. " Harold Whiting, as the member of the committee for the promotion of the Silver Lake Project, asked that the Rity of Rochester acquire the approximately 58.17 acres of private lands which will be flooded by the lake, as proposedt, and that provision be made that the first installment on the purchase price of these lands $18,000.00,be `included in the 1930 tax budget, and also gave the information that the $5 acres which are to be WI taken from Otto W. Riess can be purchased for $200,00 per acre. PI I' 731 A. J. Labb of the Mayo 'CkAnie , and Rev. A. R. Ziek, both talked in favor of the g,ilver Lake Project. `` Upon motion by Vihstadt, second bpi Rommel, Mr. Whiting's request was referred to the Public Grounds Committee with instructions that they mebt with the Silver Lake Project Committee for conference as to how much should be included in the 1930 tax levy, The following report relative to the stoker bids was read, and President Liddle ordered that the same'be placed on file: "Oct. 20, 1930 Honorable Mayor and Common Council City of Rochester, Minnesota. Gentlemen: The following is a tabulation of the bids 'on an Automatic Stoker according to Specifications prepared by John McG.Miller, Architect; Rochester Electric Company 860&00 H. Dornack ...............:............... 865.00 Maass & McAndrew $ 893,00 The Rochester Electric Company is the low bidder. The latest installation of an Iron Fireman Stoker is in the Nelson Motor Sales Building.. ; The low bid for an Oil Burner in the Fire Station building is in the amount of $880,00. According to the coal dealers the difference between the cost of a stoker, and an oil burner will be saved in a eompara-. t ive ly short period of operation, I recommend the 'installation of automatic eontroled heat in the Fire Station Boiler due to the fact that we have already installed heat coAtrol in all rooms. As far as I am concerned the two different types of fuel feeders which have been specified will be satisfactory. I will therefore leave the matter of choice to the Common .Council. Alderman Amundsen introduced a resolution accepting the proposal of the Rochester Electric Company for the furnishing and installation of an automatic mechanical stoker `and equipment in the new Central Fire Station, for the sum of $8600,00, and fixing the amount of the bond to be given by thu said contractor at the sum of $860 00, which was read, Upon motion by Hicks, second by Amundsen, that the said resolution be adopte as read, and all voting in favor thereof, President Liddle declared the said resolu- tion duly passed and adopted. A motion b7 Rommel, second by Vihstadt, .carried that the proposalsfor the furnishing and installation of an oil burner at the new Central Fire Station, action on which was adjourned and continued to this meeting of the Common Council of the City of Roehester.,Minnesota, be rejected, and that the certified checks which accompanied the proposals for the furnish- ing and installation of an oil burner and equipment be returned to the bidders, and that the certified checks of the unsuccessful bidders for the furnishing and installation of an automatic mechanical stoker be returned to them. it Balance sheet, income statements, etc., of the Public Utility Departments of the City of Rochester, Minnesota, prepared by the Secretary of the Public Utility Board as of September 30t u,1930, were laid before the Common Council, and President Liddle ordered that the same be placed on file; the said income statement showing a net profit in the Light; Department for the month of September,1930, of $10,336.77, and a net profit for the six months of this fiscal 'y.:�r of $?6282.19, and a net profit in the Water Department 11 11 for the month arf Sept'e'mber,1930; o'f $13794.59, and for the six months of this fiscal year of $2818385. The report of the Clerk of the Municipal Court,for the week ending October 13th,1930, showing criminal fines collected $93,00, civil fees received $13,40, court coats,charged to Olmsted County $30,55, and fines collected due to Olmsted County .$19.80, and for the week ending October 20th,1930, showing criminal fines collected $35,00, civil fees received $9.20, court costs charged to Olmsted County $5.90, were'eaeh read, and President Liddle referred the same to the City Attorney, Upon motion by Rommel, second by Amundsen, the "sum of $19.80 was appropriated fr m the General Fund and it was ordered that the same be paid to Olmsted County Minnesota, for local Municipal Court fines collected due to Olmsted County. Theapplieation of Albert D, Posz, and Charles E. Young; for license to sell $1000,00 worth of potatoes and other vegetables from a car on the Chicago Great Western or the Chicago North Western tracks, during the psriod October 17th,1930, to and including November lst,1930, was read, and upon motion by Rommel, second by Vihstadt , license was granted at a fee , of $25.00o The application of Percy Cline for a public dance permit at the Woodman Hall,October 22nd,1930, was read. G The following communication was read and upon motion by Hicks, second by Miller, the New Amsterdam Casualty Company was released from bond No.632525, and the City Clerk was instructed to notify Peilen & Peilen,the agents, accordingly, Bui ld ing and and also to serve notice upon the Electrical Inspector of this Common Council action taken:. Copy of requisition made by the Health Officer upon Saint Mary's Hospital, for the isolation of Thomas Boyce, diagnosed;to be suffering from Poliomyelitis, was read, and President Liddle ordered that the same be placed on file. The appointment by J. Fe Roach, President of the Rochester Trades & Labor Assembly,_ of Allen Farnham as a member from that organization to serve on the Citizens i Committee; for consideration of the future location of the clock recently removed from the old Central Fire Station, was read, and President Liddle ordered that the said appointment be placed on file. Estimate -prepared by the -City Engineer in favor of Martin Paulson, showing the sum of $413e07 as being due the said contraetor,for the construction of a sanitary sewer in Sixth Place Southeast, was read, and President Liddle ordered that the same be placed on.filee , A communication from the' Chief Public Examiner asking if arrangements have been made for the contemplated audit of the George Healy Estate,was read and. upon motion by Hicks, second by Miller, the Chair was ® 11 requested to appoint a Committee. for conference with Mr.B.W.Eaton relative to the closing of the George .Healy Estate; 735 1, Copy of resolution passed by the Commission of Grand Rapids, Michigan, relative to .making constructive .measures in building up confidence and to reestabliehmen�.of normalcy in commerce, was read, and President Liddle ordered that the same be j)laced on file. The following copy of emergency authorization was read, and President Liddle ordered that the same be placed on file: " October 20th,1930. C. H: Armstrong, ty Engineer, Rochester, Minnesota, Dear Sir: It having been made to appear that the boiler in the Sewage Disposal Plant is in a very bad state of repair and that the delays occasioned by strict compliance with the City Charter relative to the advertisement for bids for purchasing a new one will greatly damage the public interest; you are hereby author- ized to go into the open market and procure the necessary labor and material necessary for the removal of the damaged boiler and the replacement of it with a new U,S.Boiler horizontal type, or its equivalent,boiler and also the necessary labor for the instal- lation of the same. ' The above authorization is given under and in accordance with the provisions of Sect ion_284 of the Charter of said City and you are to be governed thereby in the purchasing of the said boiler and in obtaining the necessary labor therefor. The following report, f:,•_ relative to the construction of a sidewalk in Sixth Street Southwest, was -read, and President Liddle ordered that the same be placed on file; " October 20,1930 Honorable Mayor and CommonCouncil Gentlemen: The Street and Alley Committee beg to report that the season is too far advanced to attempt to construct a sidewalk in Sixth Street Southwest as requested by the Board of Educa- tion., and that the. walk should be included in the general order for the season of 1931. " Alderman Rommel introduced a resolution confirming the sprinkling assessments for the year 1930, which was read. Upon motion by Hicks, second by Miller, that the said resolution be adopted as read, and all voting .in favor thereof, President Liddle declared the said resolution duly passed and .adopt ed. Alderman Rommel introduced a resolution appropriating $43.07 from the Permanent Im}rovement Revolving Fund and ordering payment made to Martin Paulson for the construction of a sanitary sewer in Sixth Place Southeast, under Job No.1599, which was read. Upon motion by Rommel, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $314.23 is hereby appropriated and it is ordered that the same be paid to the Anderson ire ,Stores,Inc., $312.23 thereof to be fram the General Fund for the relining of the brakes on the Whippet automobile in use of the Police Department $9.751, and for tires for the motor driven flusher -sprinkler $502.48,' and $2,00 thereof to be from the Street and Alley Pund f or the repair 'of a tire on the Model #74 International truck. . The Mayor and City Clerk of said City are hereby author ized and directed to draw warrants upon the City ;:Treasurer.d cake payment' accordingly." ' Upon motion by Miller, second :by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. - Alderman Miller introduced the following res olut fon,wh ich was read: "Be it resolved by the Common Council of the City of Rochester,, Minnesota: That the sum of $420 62 is hereby appr opr iated and it is ordered that thr, same be paid to the Winona Oil Company for the furnishing of gasoline, kerosene,.and cup gremse, during the period August 23rd,1930, to September 24th,1930; $253,71 thereof to be from the Street 'and Alley Fund and $1066 the re of to be from the Sewer 'Fund, and $165.26: thereof to be from true General Pund, I. The Mayor and City Clerk of said City are :hereby authorized and directed to draw warrants upon the City Treasurer and make payments accordingly." Upon motion by Dallman, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 11 73 • Alderman Miller introduced a resolution authorizing the Board of Park Commissioners to enter into contract with Herman Dornaok for the furnishing and installation of a new boiler at the Mayo Park greenhouse, and fixing the amount Ka of the bond to be given by the said contractor'at the sum of $6121,00, which was read. Upon motion by Rommel, second by Dallman, that the said resolution be 1 :6`4 r;.:. adopted as read, and all voting in favor thereof, President Liddle declared the said resolution, ion , duly pas8edand adopted. Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said .. resolution duly passed and adopted. Alderman.Hieks introduced an ordinance to amend an ordinance entitled "An } Ordinance licensing and reguldting selling, peddling, canvassing, and soliciting' orders for goods, wares or merchandise, in the City of Rochester", the same being Ordinance No.422 of said City, which was given its first reading. Upon motion by Hicks, second by Vihstadt, the rules were suspended and the said ordinance was given its second reading. mm Upon motion by Vihstadt, second by Amundsen, the rules were suspended and the said ordinance was given its third and final reading. ; Upon motion by Miller, second by -Rommel, that the said ordinance be adopted as read, and all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted, Alderman Dallman introduced a resolution levying special assessments for the cost and expense of grading Seventh Avenue Southwest, between the South line of Sixth Street Southwest and the South line of Eleventh Street Southwest,to a grade to conform to. the curb and gutter now constructed on the said liaGrt of Seventh Avenue Southwest., which was read.
