i Minutes of a regular meeting of the Common Council of the City of Rochester,
IMinnesota, held in the Council Chambers, in the City Hall, in said City, at 2:00
I o'clock P.M. on November 3rd,1930.
Meeting called to order by President Liddle.

The report of the Clerk of the Municipal Court for the week ending October

20th,1930, showing criminal fines collected $24*00, civil fees received $2.50,
Olmsted County Municipal Court Fees for September,1930, received in the amount of
$51.30, and for the week ending November 3rd,1930, showing criminal fines collected
$105,00, civil fees received $4.25, and court costs charged to Olmsted County
? `.13.40, were each read, and President Liddle referred the same to the City Attorney.

, and Frank ,Lent, •as Special Patrolmen for duty October 31st,
1930, of Wm. Williams, for duty upon the Presbyterian Church Property, E. Je Kelly
for duty at the home of the late E. Aq Knowlton, James Joslyn for duty at the Bemel
Brothers home, C. H. Ellison for duty at the Klee Grocery rat 212 Fifth Street
Southwest, and Fred Zimmerman and Georg �Eay..rea for duty on the City Warehouse
property, each of the last mentioned six persons being appointed

they to serve without pay and to hold otfice until the second Monday in April,
,# 1931, unless sooner removed, were each read, and President Liddle ordered
that the same be placed on file.
Aldermen Miller and Vihstadt came in at this time and took their Chairs.

A communication from the ,League of Minneso ca Municipalities, asking for
proposed legislation to be submitted to the legislative conference' of the League,
which will be called early in January,1930, was read,and upon motion by Hicks,
second by Dallman, the City Clerk was instructed to reply to the communication,
asking that consideration be taken of an election law amendment that will allow a
person who has moved from one precinct to another to vote in his or -:-:her old precinct
until the required thirty days residence is gained in the new precinct.
Upon motion by Vihstadt, second by Dallman, the following sums were appropria-
ted and it was ordered that the same be paid to th., Qeneral Fund for sprinkling and
flushing streets abutting on the property mentioned:

Al2.96 from the General Fund for sprinkling and flushing around
the Witherst ine Property;
a14.40 from the General Fund for sprinkling and flushing around the
Hattie .Riege property on, Second Street Southwest, as this property is not
within the City Limits and consequently not assessable for, sprinkling.
$8.50 from the General Fund for sprinkling along, the Pest House
I� Property;
$20.84 from the General Fund for sprinkling around the City Hall;
$11.22 from the General Fund for sprinkling around the Armory;
$17,19 from the General Fund for sprinkling around the Post Orfice;
09,12 from the Street and Alley Rind for sprinkling in front,of the
City Warehouse.
The following copies of resolutions passed by the Public Utility
;Board were read, and President Liddle ordered that the same be placed on file:
"Be it and it is hereby resolved by the Public Utility Board.of the
City of Rochester,Minnesota, that the Hon, Common Council be and is hereby
requested to authorize the said Board to enter into a contract With the Midland
Lumber and Coal Company of this City for the furnishing to the City of Roches-
ter, Minnesota, in accordance with,specifioations and with analysis attached
to their bid, of from 10,000 to 15,000 tons of * inch O'Gara Coal Company
Screenings at a price of $4,86 per ton F.O.B. Rochester, Minnesota,"
"Be it and it is hereby resolved by the Public Utility Loard of thr
iCity of Rochester, Minnesota, that the Hon. Common Council be and is hereby
requested to authorize the said Board to enter into a contract with Mattson
lend Peterson of St, Paul, Minnesota for the furnishing of, all the material,
labor, tools and equipment necessary for a steam line extension to the Dolores
'Apartment and the Sister's of St, Frances, in accordance with specifications
;and with their bid dated October 29th,1930, said Company being the lowest
;responsible bidder."

"Be it and it is hereby resolved by the Public Utility Board of the
'City of Rochester ,Minnesota, .that the President and Secretary of said Board be
and are hereby directed to sign a contract with the Mayo Properties Association
relative to the accepting and transfering of certain rural transmission lines
which have been the property of the said Mayo Properties Association,, the
Academy of Our Lady of Lourdes, the Rochester Country Club, J. H. North,
`C, H, Mayo, H. I. Lillie, Joseph G. Mayo, E. S, Judd, L. W, Pollock, Charles
V . Mayo, D. C. Balfour, E,;D. Hubbard, Christopher Graham, John Nigon, Abe
.Bailey, W, J, Bointon,'Chailes Stoppel, School District No464, and I,H,Snow.
Be it and it is Thereby furthtr resolved that the Mayor and the
City Clerk be and hre hereby requested to sign the said document."
The following communications from the Board of Park Commissioners
were read, and President Liddle ordered that the same be placed on file:

Amundsen, the same were allowed and the Mayor and City Clerk were authorized and

Alderman Vihste.dt, introduced the following resolution, which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the Mayor and City Clerk of said City and the President and
Secretary of. the Public Utility Board of said City, be and the said officials
and employees are hereby auThorized and directedto sign a contract with the
Mayo Properties Association reiative to the acceptance and transfer of certain
rural transmission lines which have been the property of the said Mayo
Properties Association, the Academy of Our Lady of Lourdes, the Rochester
Country Club, J. H. North, C. 11. Mayo, H. I. Lillie, Joseph G. Mayo, E.S.
Judd, Tj.W.Pollock, Charles 4 ,11ayo, D. C. Balfour, E. D. Hubbard, Christopher
Graham, John Nigon, Abe Bailey, W. J. Poynton, Charles Stoppel, School
District No,64, and I. I -I, Snow. The said contract provisions being;
That each of the vendors'. In consideration of the agreements
of the City of Rochester hereinafter set forth, does hereby sell, convey and
transfer to the City of Rochester, its successors and assigns, all his, her or
its right, title and interest in and to the transmission lines now running
to th-ir respective properties, including poles, wires, insulators, transforl7F-
ers, switching material and such transmission lines complete to users eonneei`
t ions.
Each of the vendors does also grant to said City of Rochester an
easement, for the term of five years, over the property owned by such vendor,
respectively, where said lines arenow located across such property, for the
purpose, of maintaining and operating the same, with the right to enter upon
such property for the purpose of rebuilding,repairing and maintaining such
lines. .
In consideration thereof, the City of Rochester does hereby accept
said transfer and conveyance and agrees that it will mainT,ain and operate
said lines for �t least five years and will inclease the capacity thereof
whenever it shall be necessary soto do to maintain the same quality of service
as at present and that the rates to the vendors,during said term shall not
exceed the rates now being charged them for such service. "
Upon motion by Hicks,, second by, Miller, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared

Alderman Miller introduced a resolution authorizing the Public
' Utility Board to enter into contract with the Midland Lumber & Coal Company

' for the furnishing of 10,000 to 15,000 tons 1� inch O'Gara Company Coal
screenings, at a price of $4.86 per ton, and fixing the amount of the bond
to be given by the said contractor at the sum of$72,900,00,which was reed,
Upon motion by Rommel, second by Amundsen, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President I,idd le
declared the said resolution,duly passed and adopted.

Alderman Miller introduced a resolution authorizing the Public CTtility
Board to eater into contract with Mattson_& Peterson, of Saint Paul, Minnesota,
in accordance with the above quoted resolution request, and fixing the amount of the
bond to be given by the said contractor at the sum of $6880,001 which was read.
Upon motion by Buller, second by Dallman, that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted,
.Alderman Amundsen introduced a resolution appropriating $376*45 from the
New Central Fire -Station Fund and ordering payment made to Elmer Lyon,for payrolls
for labor wrecking the old Central Fire Htation during the period October 27th,1930,
to November 1st ,1930,Inclusive, in accordance wi uh sworn billing made under date of
November 3rd,1930, which was read.
Upon motion by Vihstadt, second, by Rommel, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted,
+ Alderman Dallman introduced a resolution appropriating $2,000,00 from the
i Park Improvement Fund and ordering payment made to C, C, Pagenhart, to apply on
contract for the construction of a garage in Mayo Park, which was read.
Upon motion by Hicks, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Dallman introduced a resolution appropriating $500,00 from the
Park Improvement Fund and ordering payment made to H, Dornack, to apply on
contract for the furnishing and installation of a new boiler in the greenhouse in
Mayo Park, which was read,
Upon motion by Vihstadt, second by .Hicks, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
, resolut lon duly passed and adopted,
Alderman Vihstadt introduced a resolution appr opriat ing $500,00 from the
Park Improvement Fund and ordering payment made to the Treating Specialties Company
to apply on contract for the furnishing and installation of an oil burner in the
greenhouse in Mayo Park, which was read,
Upon motion by Dallman, second by Amundsen, that the said resolution be
adopted as read; and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted,
Alderman Rommel introduced a resolution appropriating $1251.97 from the Park
Improvement Fund and ordering payment made to the Mayo Trust Fund, for payrolls for
I! labor during the period of the weeks ending October 17th,1930, and October 24th,1930,

I in accordance with sworn billing made by Wm. Enke, Secretary of the Park
Board under date of November 3rd,1930, which was read.
Upon motion by Dallman, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President,

Alderman Hicks introduced a resolution appropriating $167.45 from
the Sewer Fund and ordering payment made,to Wm. C. Fraser & Son, for final
;I estimate on contract for the construction of a surface drainage sewer in
Kutzky Park, under Job No.1598, which was read.
Upon motion by Vihstadt, second by Rommel, that the said resolution
be adopted as read, and all voting infavor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Miller introduced a resolution appropriating $456.30

from the Sewer Fund and ordering payment made to Martin Paulson as final
estimate on contract for the construction of a surface drainage sewer in
Seventh Street Northwest, from Second Avenue to Sixth Avenue, which was read.
Upon motion, by Hicks, second by Vihstadt, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared

Alderman Amundsen introduced a resolution appropriating $120,00
from the Bridge Fund and ordering payment made to C. R. Knttzen and August
Harnack,for cleaning, painting and repainting of the bridge over Cascade
Creek at Third Avenue Northwest and Fourteenth Street Northwest., which was

Upon motion by Rommel, second by Amundsen, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Hicks introduced a resolution appropriating .$65.00 from
the Bridge Fund and ordering payment made to Joe Creeley, L. C. Gronquist,
and Carl Carlson, for the cle.aning,painting and repainting of the Third
Avenue Southeast foot bridge over the Zumbro Rive, which was read.
Upon motion by Dallman, second by Amundsen, that the said

Alderman Vihstadt introduced a resolution appropriating $476.00-
from the Bridge Fund and ordering payment made to Joe Creeiey, Louis C. Gron-
quist, and Carl Carlson, for the eleaning,painting and repainting of the

Center Street bridge over the Zumbro River, in accordance with eatinate No.l,
which was read.
Upon motion by Hicks, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted. • .
Alderman Rommel introduced a resolution appropriating $209.73 from the Park

Imorovement Fund and ordering payment made to the City of Rochester, General Fund,
for sprinkling and.treating with calcium chloride, of streets around and through

j parks within the said City, which was read.
Upon motion by Vihstadt, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and • adopted .
Alderman Rommel introduced the following resolution, which was read:
"Do it resolved by the Common Council of the City of Rochester:
That the sum of $4962.64 be and the said sum is hereby appropriatdd from
the Genera.L (Code 18) Fund of said City and ordered paid to General Fund (Code 20)
for difference between the assessments made for the 1930 sprinkling and flushing
; and treating with calcium chloride $11287.79, and the costs reported $16250.43.

The Mayor and City Clerk are hereby authorized and directed to draw a
warrant for said sum upon the City Treasurer in accordance herewith, and cause said
!� paym..nt to be made,"

Upon motion by Hicks, second by Vihstadt, that the said resolution be aid opted
as read, and all voting in favor thereof, President Liddle declared the said resolu-
tion duly passed and adopted.
Upon motion by Hicks, second by Dallman, the sum of $80*00 was appropriated
from the General Fund and it was ordered that the same be paid to Mrs. Catherine
Fritsch, as compensation for the death of Christopher F.Fritsch during the period
October 3rd,1930, to October 30th,1930, inclusive.

Upon motion by Vihstadt, second by Roavel, the Mayor,the Common Council, and

the Ciuy Engineer, were designated as a Committee to meet with the State Highway

Department officials relative to immediate grading of the new trunk highways No.7
1{ !I and-20, between Second Street Southwest and the joining of -the two highways in the

Southeast section of the City, and also that this Committee urge the use of local
i
labor so far as possible,
The following report of the Tax Committee was read, and upon motion by Hicks,
second by Dallman, the said report was'aceepted, and it was ordered that th. same be
placed on file:

The matter of the City Assessor's request for an
increase in salary having been referred to the undersigned
Committee, the following report and recodimendation is sub-
mitted for your consideration:
That said request be nbt granted for the reason
that Section 295 of the Charter of'the City of Rochester
provides in part that no officers salary shall be increased
or diminished during his term of office.

' Upon motion by Hicks, second by Amundsen, the City Clerk was

{� instructed to prepare a resolution authorizing the purchase of a carload of
. coal for use at the new Central Fire Station.
ii Upon motion by Rommel, second by Hicks, the Mayor was requested to
, issue an emergency authorization empowering the Pollee Committee to purchase a
new automobile for use in the Police Department.
,Upon motion by Miller, second by Rommel it was ordered that
street lights be installed, one on Center Street East near Eighth Avenue
;j Southeast, mi
and that,the necessary street lits be installed on Sixth Street
Southwest, between Twelft4 Avenue and Fourteenth Avenue, and the City Clerk
;j was instructed to request of the Public Utility Board that these installations
i
be made.
Upon motion by Miller, second by Dallman, the Mayor was instructed
;► to issue an emergency authorization empowering the City Engineer to purchase
a six cylinder one and one-half ton truck for use of the Street and
Alley Department.
Upon motion duly made and carried, the above request that the

Mayor issue an emergency authorization for the purchase of an automobile fvr
;;use of the Police Department,was reconsidered.
Upon motion by Hicks, second by Amundsen, the Police Committee and
the City Clerk were instructed to draw specifications for an automobile for
use of thePolice Department, the cost thereof not t o exceed 01,000.00 and the
Whippet automobile now in use of the .Police Department"

The following/emergency authorization was read, and President Liddle ordered

that the same be placed on file:

City Engineer,
Rochester, Minnesota,
Dear Sir:
It having been made to appear to me that the old Dodge one and
one-half ton truck is in a very bad state of repair and that it would be
useless to repair same for wo-k on the City streets and sewers and that
the. delay occasioned by the advertisement for bids would cause great damage
to'the public interest inasmuch as a truck is immediately needed for public
work, and
It further having been made to appear that Ellis Motor Company
will make a substansial allowance for the said old truck and furnish a new
Model F. 30 six cylinder 11 truck for the sum of $1050*00 net after allowance
for the old truck, according to specifications hereto attached and made a
part of this authorization and order, I, therefore, under and in accordance
with the ,rovisions of Section 284 of the Charter of the City of Rochester,
do hereby declare the existence of an emergency and order you, as City Engin-
eer of the said City of Rochester, to go into the open market and purchase
a suitable truck for use by said City for the departments of streets and
sewers without delay.
