Meeting called to order by President Liddle.
Roll Call, Present: Liddle. Amundsen, Dallman, Picks, Viller, Roif. me1.,

The application of L. A. Fellows for public dance permit at the Wood,u:an Hell,'
December dt'i, s,nd 18th,1930, was read.
The :Ipplication of John C::•oper Company and of the Independent Oil Company
for permits to place ?,nd maintain si;Jns, were each read, and upon motion by
Vihstadt, second by Dallman, permits were granted.
Uj_-o 1 motion by Hicks , second by Amundsen, the stun of :`'10.00 was appropriated

Minnesota Municipalities, as payment or assessment for legislative reference
service during the session of the 1931 legislature.
Upon motion by Hicks, second by Dallman, the City Attorney was instructed
to confer with Senator Richardson, and Senator Beach, relative to them furnishing
copies .of legislation proposed during the 1931 session of the State Legislature.
The claim of the Weed Insurance Agency,' 60.60,for fire, lightning and
transportation insurance on the Model 74 International Truck and the No.3 Russell
gra.dor purchased in 1988=•, was read, and President Liddle referred the sauce to the
Insurance Committee,
The followini; arziending and corrected authorization was read, and President
Liddle ordered that the same be placed -on file:

I hereby amend and correct my authorization made to you November I
3rd , 1930, for the purchase of a new truck, so that the sa.;:ie shall read as
follows:

'It having been. made to appear to me that the old Graham one and
one-half ton truck is in a very bad state of repair and that it would be
useless to repair sane foK work on the City streets and sewers and that
the delfiy occasioned by the advert.i_se-nent for bids would co.lxse great.
dains.ge to the public interest inasmuch as a truck is fa ned-iately needed
for public work, and
It further having been made to appear that Ellis Motor Company will
make a substantial allowance for the said old truck and furnish a. new
TAodel F.30 six cylinder 1-1-truck for the suM of $1050.00 net 'after allow-
ance for the old truck, according to specifications hereto attached and
made a part of this authorization and order, I. therefore,' under and in
accordance with the provisions of Section 284 of the CharteX of the City
of Rochester, do hereby declare the existence of an emergency and order
you, as City Engineer of the said City of Rochester, to go into the open
market and purehnue a suitable truck for use by said City for the depart-
ments of streets and sewers without delay.'

The following ruling by the City Attorney was read and President
Liddl_e ordered that the same be placed on file:

Gentlemen:
The matter of the application of the City Assessor for
additional compensation having been referred to my office for an
opinion as to the legality of same, the .following is submitted:
Section 295 of the Charter of the City 'of Rochester provides
In part that the City Assessor shall receive such compensation as the
Common Council shall deem proper, that such salary and com-pensation
shall be fixed at the coimnencement of the official year, that no
officer's salary ghall be increased or diminished during his term of
office and that the Commnon Council may at any time fix the compensation
of any officer or committee for any extraordinary service performed.
It is therefore my oplfii;on that arty additional compensation
for the City Assessor would be illegal unless such compensation was
deemed necessary and proper by the Common Council for any extra, ordinr-.ry
services performed -by the Assessor.
In this connection it might be well to consider the fact that
there can be a great difference between extraordinary services and
additional duties that might be required of any City official during his
term of office. However, the entire question hinges upon the point as
to whether or not the additional compensation requested by the Assessor
is for extraordinary services, a definition of which term is not
deemed necessary at this time.

Liddl a ordered that the same be placed on file:

Gentlemen:
Your Committee appointed to investigate the matter of the
request of the City Assessor for additional compensation, reports and
recommends as follows:
The City Charter provides that no additional compensation '
can be paid to any city official except for extraordinary services, and j
your Committee has no knowledge of any extraordinary services having i
been performed by the City Assessor or his Deputy and therefore recommends
that said request be denied. j

Alderman_ Amundsen introduced a resolution appropriating $860.00 from the
New Central Fire, Station and ordering payment made to the Rochester Electric
t Company, for the furnishing and installation of an automatic mechanical stoker at

i the new Central Fire Station, which was read.
Upon motion, by Rommel, second by Vihstadt , that the said resolution be -
adopted as read, and all voting; in favor thereof, President Liddle declared the said
! resolution duly passed and adopted.
i Alderman Hicks introduced the following resolution., which was read:
"Be it resolved by the Common Council of the City of Rochester,Minnesota:
{:'hat the Public Utility Board of said City, be and the said Board is hereby
authoiized to appropriate the following sums from the Public Utility Fund of said
City for the purposes stated:
$10,000.00 from the Public Utility Fund to the Sinking Fund, of said City,
j for the payment of Electric Light Bonds Nos.211 to 220 inclusive, maturing January
lot, 1931;
015',000„00 from the Public Utility Fund to the Sinking Fund of said City,for
the payment of Water Works bonds Numbers 46 to 50 inclusive, maturing January 1st,
1$11,000.00 from the Public Utility Fund to the Interest Fund of said City,
for the payment of interest due January lst,1931, on Electric Light bonds Numbers
i 211 to 650 inclusive;

,"2925.00 from the Public Utility Fund to the Interest Fund of said City, for
the payment of interest due January lst,1931, on Water Works Bonds, Numbers 46 to
175 inclusive."
Upon motion by Rommel, second by Miller, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Dallman introduced a resolution appropriating �220.50
from the Fire Protection Fund and ordering payment made to the Manhattan
Riibber Mfg. Division of the Raybestos-fanhattan, Inc., for 300 feet of 1-1
inch Crown brand, double jacket, fire hose, coupled with rocker lug couplings,
which was read.
Upon motion by Hicks, second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Vihstadt introduced a resolution granting public dance
permit to L. A. Fellows, for the Woodman Hall, December 4th, and 18th,19a0,
and fixing the fee at '10.00 which was read.
Upon motion by Rommel, second by Vihstadt, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle
declared the said' resolution duly passed and adopted.
The following claims were read, and upon motion by hicks, second
by Vihstadt, the same were allowed, and the Mayor and City Clerk were
authorized and directed to draw warrants upon the City Treasurer and make
payment accordingly:
From the Genera ,. Fund: Ella Bergan 845.81, Estel.l.q. M. Wright "2 .25;
From the New Central Fire Station: City of Rochester, Light
Department <k 89.55.
Upon motion by Rommel, second by hicks, the City Engineer was
authorized to purchase 2000 .feet of snow fence.
Upon motion by Hicks, second by Vihstadt, the Common Council
adjourned to 7:30 o'clock P.M., on December 15th,1930.
