Minutes of a regular meeting o.f .thel Common Council of the City of Rochester,
Minnesota, held in'the council' Chambers, in" the City Hall, in said City, at 2:00
o' clock P.M., 'on March 2iid,. 1931. '
Meeting called to ordei by President Liddle,
Roll Call. Presents Liddle, A*undseii, Dallman, Hicks, Millers Rommel,
Vihstadt! Absent: 'None.
Upon -motion by Rommel, second b3 Dallman, the minutes of the meeting held on
February 25th, 1931, were approved,
This being the time and place fixed for the opening of proposals for the
operation and maintenance of the Publio•Comfort Station daring the period April
1, 19319 to March Slat, 1963 `the following proposal was opened and read:
"To the Hon 4 MByor & Aldermen
My bid for the operation ,of City rest room is 21.00 per me. with
check for one tenth the total amount as per specifications.
Concession is to be Barber Shop same as now is

Alderman Rommel introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the bid and proposal of George Lemke for the operation and mainten-
ance of the Public Comfort '9tdtion :of said City during the period April lat. 19319
to March 31st, 1933, viz: 21,00 per month, payable ,in advance, during the said
period, be and the said bid and proposal is hereby► ,accepted. '
The amount of the bond to be given by the successful bidder is hereby
fixed at the sum of $§00:00." s
Upon motion by Hicks, second by Vihstadt, that the edid resolution be
adopted as read, and 'all voting in favor thereof, President Liddle declared the
said resolution duly passed and ad opted.
The following .report` made of gas tests during the month of February,1931,
was read ,'and President Liddle ordered that the same be placed on file:

The report of the Clerk of -the Municipal Court. for the week ending
February 23rd,1931, snowing criminal Pines ,collected $34.00, civil fees
received $4.35, court costs charged to Olmsted,eounty.06' and Pines
collected due to Olmsted County..16.25, was read,. and President Liddle referred
the same to the City Attorney.
Upon motion by Rommel, second by Dallman,, the sum of �6.25 was
appropriated from the General Fund and it was ordered that the said sum be
paid to Olmsted County, Minnesota, for local Munio ipal Court fines collected
due to Olmsted County, Minnesota.
The application of .Roy T. Masuda for :a soft drink dealer's license
at 102 Broadway Street South and Lof Lyman A.SAmpson fora soft drink dealer's
license.at 1129 Second Street Southwest, were each read and upon motion by
Hicks, second by Dallman, lioense was granted -tp Roy T. Masudag
Upon motion by Dallman, second by Amundsen; a soft drink dealer's
license was granted to Lyman A. ;Sampson.
The following copy of resolution passed and adopted by the Public
Utility Board was read:
"Be it and it ie hereby, resolved;.by,,,the Publio, Utility Board of the
City of Rochester, Minnesota that the Hon,, Common Council be and ishereby°
requested to authorize the said Board ..to enter lato'.a', contract with the

mentioned in the above report be acquired by condemnation, and L. D. Williams
cautioned that the construction of.a dam across Bear Creek on this property might
overflow some of the land&-, owned- by him.
Upon motion by Hicks, second by Rommel, the City Attorney was instructed to
draft condemnation Probeedings- for the above mentioned Slatterly property�Por use as
an addition to the Park System,and Por S Swimming pool, all voting is favor thereof
except Alderman Vihstadt, who voted "lay".
The annual report of the City Engineer for the period beginning February
1st, 1930, and ending January 30th,1931, was laid.before the Common Council after
the reading of the recommendations set forth therein, and President Liddle ordered
the same placed on 'file.}
The following certificate by the County Auditor as to abatements made by
the Minnesota T6x Commission and the.Board of County Commissioners in cancelling
uncollecta.ble 1929 personal property tax, was read, and upon motion by Rommel,

whether it would be more,practical to take your present beam and
change the poise that you have, meaning at the same time of course

In checking up -the; balances of the different funds, I
find that the � following --mistakes' were made in the distribution
of speoial `assessments=
March- 1930, $306 `56, stidewalk reported as 1929 tax
should have been 1928-taxj November 1930, $780,72 reported as
Paving should have been Special Sewer; With the exception of
these changes, all other accounts check.

The okaim of Geoj Holland $50:00 for damages in connection with the
stoppage of the Second-Street'Southwest sanitary sewer January 31st,1931, was
read, and upon motion by:Miller, setroond by Rommel, the claim was referred to the
City Attorney,
The applieat ion of Ben Wong for a soft drink dealer's license at 323 First
Avenue Southwest, was read and upon motion by Dallman, second by Amundsen, license
was granted,
,The petition to -the local Charter Commission, circulated by -"one John J. Kerr,
under the initiatory provisions of the State Constitution, was considered by the
Common Council as to whether the question of. whether the, City Clerk, City Engineer,
the City Attorney and the Building Inspector offIces shall be f illed by election,
be submitted to the Voters at -a . speeialc e3aetion which is to be called for April
21st, 1931, on whether it be .proposed at .another special election called during the
six months . period in,which the :proposition will have to be voted upon, and to save
the cost of a second: spe,eia.l eleetion,it was deemed best that the question come up
on April 21st,1931, and upon,motion by.Vihstadt., second by Hicks, the City Clerk
was instructed to request of the president of the Charter Commission that this
amendment or amendments be prepared and submitted so that it may have action thereon
at -the special election-Apri1 21et,1931,.
.The following report and reoommendation was read and upon motion by
Rommel, second by Amundsen, the Common Council endorsed this legislation .and
instructed the .City Clerk`:to.notify Senator Richardson and Representative Beach
accoadingly and to request their support:

we held a meeting at the -Central Fire Station with all of the local male
City employees that could get away from their world, or other appointments,

and explained the provisions of House file 595 which proposes
to amend Chapter 1910 of Session Laws of 1929, so that the same
may, in addition to State employees, .cover)a,11:County, City,
Village, Town or School District:employees,'with certain excep-
tions. .... =
The meeting was 100 for, this legislation, and department
heads are circulating among their'employees.,pe.titions to our
Senator and Representative asking for,, their-.;supp_ort of this measure.
It is suggested that, if the Hon. Common Council sees fit,
endorsement, be given this bill, and -that the Senator and Repre-
sentative be advised of such action taken.

That the appointment of the' three police civil liervice commissioners as
provided for in the said,,. ct';be made. by the Mayor of the City of Rochester on the
first Monday in April, 1931, and not otherwise, the said appointments to be
confirmed by the Common: Council of_ said City of Rochester. "
Upon motion by Hick's" by'Dallman, that the said resolution be
adopted as read, and all voting'in favor thereof, President Liddle declared the said
resolution duly passed and adopted;
Alderman Daliman'introduced the following resolution, which was read;
"Be' it' resolved by the` Common Council of the City of Rochester, Minnesota:
That said Common Council does hereby expressly accept the provisions of
Chapter 57 of the 1929'Session.Laws.of the State of/f innesota, the same being"An
act. providing that a firemen's civil service commission may be created in cities not
of the first class "and,"in villages having a population of 2000 inhabitants or mere,
and having a.regularly;.employed and.;paid municipal fire department, and defining the
powers and duties of such commission."
Be it further resolved by said Common Council:
That the appointment of the three 'commissioners by said Common Council
shall, -be made so as to ,.take - effect on the first Monday of April, 1931 and not

Upon motion.by;Dallman,..second,by Rommel, that the said.resolution be
adopted as read, and all voting in, favor thereof except Alderman Vihstadt who
voted "Nay", President Liddle declared the said resolution duly passed and adopted.
Alderman Vihstadt introduced a resolution authorizing the Public Utility
Board to enter into contract with the American Cast Iron Pipe Company of Birmingham
Alabama, in accordangw with the above quoted request and authority, and fixing

Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls
for labor during the period of the weeks ending February 6th,13th, 20th, and 27th,.
