Minutes of an adjourned reggrlar°me'eting of the Common Council of the
City of Rochester,Minnesota, held in the Council' Chambers in the City Hall, in
said City, at 7:30 o'clock P.M., March llth,1931.
Meeting called to. order �by President Liddle.
Roll Call, Present: Liddle, Amundsen, Dallman, Miller, Rommel, ilihstadt.
Absent: Hicks.
Upon motion by Rommel,;seeond by Dallman, the minutes of the meeting held
on March 2nd,1931, were approved.
President Liddle announced this as being the time and place fixed for a
hearing ion the grading of Second Street Northwest, between Thirteenth Avenue
Northwest and Sixteenth Avenue Northwest, and asked if there was any person
present whoa wished to be' heard`; concerning this improvement.
There was no person present who wished to be heard concerning this grading.
E. L. Van Atta asked, for a license for a carnival which vA ll show on the
so-called .circus grounds under the auspices of the Elks' fi-am Corps June 22nd919310
to J=e 27tI,1931, incfudive, which oral application was later. in the meeting
followed by a written application.
Alderman Hicks* came, in'at this time and took. his Chair.
The following report was read, and President Liddle ordered that,the same
be placed on file:

The Board of Park Commissioners is cognizant of the .following:

The sower in'South.East Rochester is inadequate to care for the waste
water from the Reid -Murdoch Canning Factory and its use has resulted in
undesirable` conditions in some of the South East Rochester homes as well as
in the canning plant itself. .
The sewage fsoiliti.es. of the city have not been extended or developed
sufficiently IDo make possible for the canning factory to connect with any
sewer without, bringing about a condition undatisfaetory to residents or the
factory or both.
Under the arrangement in use during the past t o years., the
iheawastnd e water
from the treating plant of the canning' factory hasstagnated
ow
Mayo Park cresting a condition of excessive pollution with the resultant
offensive appearance and odor.
The present method of treating waste water at the canning factory does not
eliminate its undesirable` qualities- in so far as its effects :in bringing about
this condition in Mayo Park waters is concerned.

The proposal for construction of a sewer which.shall carry this
waste water through a portion of Soldiers' Field' tQ the river has been
considered ,by the Board of Park . Commissioners.with due thought to the
mutual obligations of the City of Rochester and ,of Reid Murdoch Company.
Obviously, it is the obligation and responsibility of the Board of
Park Commissioners to oonserve 4ud -.develop"the :natural park facilities.
Therefore, it cannot consistently countenance any measure which might
prolong .a practice which results Ing public''nuisance in the park areas,
or which might detract from the usefulness . of park properties.
It is the opinion .of the Board that :the .pedple. of Rochester are
entitled to the use Hof the river for recreational purposes and :the
Board wishes to take this occasion to Point,:Out,the desirability not
only .for preventing further pollution 'of the river,`: but *of steps which
will result in :a speedy return to the, nQturalf ;o,on4ition ;of the river so
that these recreational objectives may, in Fact, be obtained,
To this end, the Board urges that some method of ddsposal of this
waste water be found which will eliminate` its'd'ischsrge' 'at any point wh
from which it may find its way into the river„south, of; Mayo Park.

In -the discussion of the petition of Reid -Murdoch Company for permission
to construct and maintain- a sur de dra•iaage sewer across a part of Soldier Field,
John S. Reed made the 'statdment that the to cal Trades & Labor Assembly endorses the
construction of this sewer' along the East side of the new trunk highway. Reverend
Gleason as Commander of the Wm. T. McCoy Post of the American Legion asked that
his organization be placed'on record as opposing the dumping of any sewage in the
Zumbro River at that point. George Lemke.'as an Isaac Walton League Committeeman
opposed any further pollution of the Zumbro River, and Wm. A. -..Fitzgerald as a member
of Soldier Fdeld.Co=itt.ee, says that he; will do all. in his power to keep the Reid -
Murdoch Company from getting the pr.ivilgge to dump their sewage into the Zumbro
River at this -point, and suggested eojmmeneing the preliminary proceedings for a bond
issue large enough to, provide Pox- the construction of a trunk line surface drainage
sewer, in.Broadway Street.,South, running from. -where the Reid Murdoch Company proposes
to duj ip their disposal. plant affluent, 'along Broadway -Street, South and Broadway"
Street North *towhere-. the- Zuinbro •River crosses Broadway Street North.
The following• communication' from the Isaac 11alton League was read, and
President Liddle ordered the sei4e placed on file:.
" March 6th;1931.
At the annual meeting of the Rochester Chapter of the Isaac Walton
League last night the-> following resolution was unanimously carried:
Be,it resolved that, the Rochester Chapter of the Isaac Walton League
of America hereby goes;on record as being against the pollution of our streams
from any source• whatever'• an& that.' this Chapter will cooperate in every way
possible with .the State Fish, and Game Commissioner, the,public Health Service,
our local manufacturers..' and our Local Officials in preventing any such
pollution.
Be it also resolved -that the Secretary be instructed to forward a copy
of this resolution to the City Council.

The Electrician's license bond of George E. Fordham, doing business as the
Queen City Electric Company, with the Fidelity & Casualty Company of New York, as
surety thereon in the amountof $1,000 00 was read, and upon•motion by Rommel, second

of each year during the life of the' said bonds, except that the first interest

oil companies having storage at the C.G.W.R.R, tracks on the banks of
the Zumtro River south of Fifth Street Southeast report as follows:
We have hadtwo conferences with the representives of almost
all of the companies interested and at the last one we were informed
that all of the comp.anies who:were then represented would be willing
to take any steps deemed .nedessary`as 'a safety fire prevention measure
including the construdtioa'of either a large earthen dike or the con-
struction of smaller individual- dikes, most of the companie$ believing
that the latter method•would.insure the greatest protection to all of
the property involved.
It is, therefore, recommended that your honorable body notify
the representatives of,all oft Oil Companies interested in'this area
to arrange to appear before 'thotinoil at some future date in order to
arrive at the best solution of the problem. '

The Common Council canvassed the returns from the annual Charter Election,
held March 10th,1931:
Alderman Dallman introduced the following resolution, which -was -read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the following is a tabulated statement and list of the number of votes
cast for each person'at the Charter Election held March 10th J931, in the City of
Rochester, Minnesota, as -determined by said Common Council on the canvass of the
returns of said elect ion made the llth day of March, 19310, and said tabulated state-
ment is hereby declared to show the result of said eleetion.`Said tabulated list and
