Minutes of a special -'meeting of the Common Council of:the City of Rochester,
Minnesota, held in the, Coune it., Chambers, in the City hall, in said City, at 1:15
oclock P.M., on March 17th,1631.
`Meeting called to' order by -President Liddle.
Roll Call, Present: Liddle, Amundsen, Dkllihan, Hicks, Miller, Rommel,
Vihstadt. Absent: None.
The call for the Speeial' meeting was read; said meeting being called for
the purpose of appointing a Firemen'.8 Ciiii Service Commissioner to fill the
vacancy caused by the refusal of Hayes Dansingburg'to qualify under the appointment
March llth,1931, and any other business that the said Common Council might deem
proper, .
The following communication was read, and upon motion by Vihstadt, second
by Amundsen, the .refusal. of Hayes, Dansingburg . to qualify under the appointment
above mentioned was accepted:

Upon motion by Vihstadt, second by Rommel, Dan Macken was appointed a

Firemen's Civil Service Commissioner for three years to Fill the vacancy caused by
the refusal of Hayes Dansingburg to qualify under the original appointment.
Upon motion by Hicks, second by Vihstadt, it was ordered that Warrant No.
6243 and 6244 drawn under the provisions -of a resolution passed and adopted
February 20th,1931, payable to Anna Ranfranz and Ed. Ranfranz, her husband, in
the amount of $800.00,and to Otto W. Riess and Augusta Riess his wife in the
amount of 1300.00,be cancelled and returned to the General Fund, asa resolution
passed and adopted March llth,1931, provides that these payments shall be made
300.00 to Otto W. Riess and Augusta Riess, his wife, , and the First State Bank &
Trust Company, mortgagee, And$800.00 to Anna. Ranfranz and Edward'Ranfranz, her
husband, Albertina Babcock and Stanley Babcock, her husband, Otto Hanke and Pearl
Hanke, his wife, Fred Hanke, Herman Hanke and Jennie Hanke, his wife, and Edward
Hanke .
Warranty deeds given by Emi1Rbasseau and wife, C. H. Buttuff and wife,
Martha K. Schultz, and Lottie and Esther Walker transferring property for the Silver

contract with the Botsford Lumber Company of this ' City for the furnishing
to the said City, in accordance with specifications and with their bid,;.

City of Rochester,Minnesota: That the Hon. Common-.Counc.il. be and is hereby
requested to authorize the said Board to change .the:'SteamRBates from $1.18
per M pounds less 10, to;

Be it and it is hereby further resolved „that, :the said rate be
made effective on all steam consumed after -April lst 1931."
The City Engineer submitted specifications .and estimate of cost
for the furnishing of 160 tons to 250 tons of .calcium chloride for use
during the 1931 sprinkling season, which were laid before the Mommon
Council; the said estimate of cost being $29.25 per ton F.O.B. Rochester,
Minnesota.
Alderman Amundsen introduced a resolution authorizing the Public
Utility Board, to enter into .contract with the Botsford.Lumber Company for
the purchase of Western Red Cedar .poles and stubs in accordance with their
above .quoted, request, :and fixing the ,amount of,the, bond to be given by the
said contractor at the sum of $2065.00, which was read.

Upon motion by Hicks,` second by Dallman, that the said resolution be
idopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed `arid adopted. i
Alderman Dallman introduced the following resolution, which was read:
"Be it resolved by the Common Council of the 'City of Roehester,Minnesota:
That the Pubic'Utility Board- of said City, be and the said .Board is hereby
authorized to put, into effect, as of April lst_,19310 the steam rates set forth in the
resolution passed and adopted by the said Board on March 17th,1931.
The said resolution being quoted as follows:
'Be it; and it� ls': hereby- resolved by the Public Utility Board of the
City ,of Rochester, Minnesota: That the Hon. Uommon Council be and is hereby
requested to authorize the said Board to'change the Steam Rates from $1.18 per M
pounds less 10;b to;

Upon motion by Rommel, second by Vihstadt�, that the said Tesolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolut ion duly passed and adopted.
Alderman Rommel introduced' a resolution authorizing and directing the
City Clerk to advertise for proposals for the furnishing of 180 tons to 250 tons
of calcium chloride, which said sealed proposals will be received and opened at a
meeting of this Common Council which is to be held at 7:30 o'clock P.M., on March
30th,19311, which was read.
Upon motion by Rommel, second by Miller, that the said resolution be
adopted as read, and all,=voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Vihstadt introduced a resolution authorizing and directing the
City Clerk to advertise for proposals for the doing of all official printing and
advertising for the City. of Rochester, Minnesota, during the official year commencing
April 6th,1931, which proposals will be received and opened at a meeting of this
Common Council which is to be held at 2:00 o'clock.P.M., April 6th,1931, which was
read.
Upon motion by Vihstadt , second by DallmA.n; that the said resolution be
adopted as read, and all voting' in favor thereof, President Liddle-declared the said
resolution duly passed.:and adopted.

-Alderman Miller introduced a.resolution authorizing and directing
the City -Clerk to advertise for proposals for being designated as City ,
Depositories, which sealed proposals. will be received and.'opened at a meeting
of this Common Council, which is to be held at 2:00 o'clock P.M., April 6th,
1931, which was read. „
Upon motion by Rommel, second by Amundsen,.that the said resolution
be adopted as read, and all voting in favor thereof, Prbsident Liddle declared
the said resolution duly passed and adopted.
The following report was read, and President Liddle ordered that
the same be placed on file, and that the reports of th'e Clerk of the Municipal
Court mentioned therein be placed on file:

I have examined the reports of,the Clerk of Municipal
Court for the period Commencing March loth,1930 and, ending
February 23rd,1931, and find same to be?-. correct .

Alderman Miller introduced the following resolution, which was
read:
"WHEREAS, the Common Council of the City of Rochester, Minnesota,
deems it expedient and necessary that a' park be developed and:, a swimming
pool be constructed in the City of Rochester and finds that it is necessary
to obtain land and real estate for the aforesaid'purpose, and;.
WHEREAS, the committee appointed by said'Common Council to Investi-
gate the said matter and make report to , the said Common,. Council has
reported that the land and real estate deemed best suited for the said,
purposes cannot be acquired, by purchase at what isv o.onsidered a reasonable
price and figure;
THEREFORE, Be it and. it is hereby resolved by y, said Common Council:
That a public park and swimming pool along with such additional
equipment., buildings, dams and; fences as -way be deemed_ necessary is ordered
to be developed and constructed as and for an ,addition to the park system of
said city and that the following land andpremises', situated in the County of
Olmsted and State of Minnesota, • be :obtained and' condemned; by and in said
City of Rochester for the purposes aforesaid, .a description of said premises
being as -follows, to•wit:
Commencing at the southwest corner of Lot No.31 in Auditor's
,3'lat "A" of Sectionll. -Township-106,;„North-,of_ Range,,1. West, and
running East on the'south line of said Lot No:..31 five hundred and
sixty-one (561) ,feet, thence north,;parallel ;- lth -the, west: line of, .
said Lot No. 31 a distance of 954.98 feet,';'uthence west parallel with
the south line of said Lot No.31 a distanoe-roV�661:.feet, thence .-south
along the west line of said Lot No.31 a distance of 954.98 feet, to place
of beginning, containing 12.3 acres more or less, all of the said above
described land lying and being in the City of.Rochester in said,County

The City Attorney of said City�ishereby directed to prepare such resolu-
tions and take such, steps. as. may be necessary for the purpose of condemning said
premises and vesting the title to the said lands in the City of Rochester for said
purposes." ,
Upon motion by Miller, second by Amundsen, that the said resolution be
adopted as read, and all -voting in favor thereof, President Liddle declared the said
resolution duly passed'and adopted.
Alderman Hicks'introduced the following resolution, which was read:
"WHEREAS, the Common Council of the City of Rochester, Minnesota passed and
adopted bit the 17th day -of March, 1931,; a resolution, ordering a. park to be developed
as an addition to the City Park system and that a swimming pool be constructed
thereon on land to be acquired by said City and that it. is necessary for the said,
purposes to acquire by condemnation certain real estate and lands in said City;
THEREFORE, Be it and.it is hereby resolved by said Common Council:
That the followir}4 described parcel and tract of land in. the County of
Olmsted and State of Minnesota, be and the same is hereby 4ondemned and taken for
the said `City of $oehester for the said .purpose as aforesaid, to wit: for the
development of an addition to the park system of said City and the construction of
a swimming pool thereon and thereat, s desor ipt ion of said premises be in g as
follows, :to wit: ;
Commencing at the.southwesteorner,of Lot No.31 in Auditor's Plat "A"
of Section 1, Township 106',- North of Range 14, West, and running east on

Be it and it 13 hereby further' resolved by said Common Wommon Council:
That the right, title and interest in and to the said tract and parcel of
land herein above described'be and it is hereby condemned for the use of the said
City of Rochester as and.. for an addition to the park system of said City and for
the purpose of constructing a swimming pool thereon with such additional equipment,
buildings, dams and fences as may be deemed necessary for the same.
Be it and it is hereby further resolved by said Common Council:
That Wright L. Toogood of the First Ward of said City, J. F. Cooke of
the Second Ward of said City and Otto W. Riess of the Third Ward of said City,
three distinterested freeholders and qualified voters of the said City of Rochester,
Olmsted County, Minnesotg be and they are hereby appointed Commissioners to view the
said. lend and premises above described and assess the damages which diay be oeeasione
by said condemnation and the taking of the said property and real estate for the use
of the said City of Rochester for the purposes aforesaid.
The City Clerk is hereby directed to notify the said commissioners appointe
here in, to be and appear at the office of said City Clerk in the City Hall of said
City, at such time as he may designate, for the purpose of qualifying and entering
upon the duties of. their office as such commissioners. "
Upon motion by Hicks, second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.

Alderman Dallman introduced.a'resolution granting public dance
perilit to -L. A. Fellows for the Woodman Hall, March 17th9,19319 and fixing
the fee at $5.00, which was read. '
Upon motion by .Hicks, second by Dallman,' that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declare
the said resolution, duly laassed and adopted. .
Upon motion by Rommel, second by Miller', the matter of taking up
sanitary sewer lantern holes and building.manhol.es:instead', was ireferred
to the Sewer Committee and the Street. & Alley Committee and the City
Engineer for their recommendation.
upon motion by Miller, second by Vihstadt, the Public Utility
Board were requested to install a street light in the_eAd of Seventh
Avenue Southeast, where it intersects Bear Creek.
IIP ontmotion by Dallman, second by lWhstadt, •the':Public Utility
Board was requested to move the fire hydrant on Seventh Street Northwest in
front of the Harry Bennett residence so that the same will:not interfere
with his driveway toaa newly constructed garage,

Upon motion by Miller., second by Hicks,, the Public Utility Board
were req�Xested to move the fire hydrant from the ,,boulevard do the east side
of the Desnoyers grocery. store on Broadway Street Notth; t'o the boulevard
radius on the Northwest corner of the street intersect ion• at that. point.
Upon motion by Dallman, seoond.by Rommegl the: Common Council
adjourned.
