Liddle, Amundsen,AHicks; Miller, Vihstadt. Absent: Rommel. The call for the special meeting was read; said meeting having been called for the purpose of action on change' in plans of Reid,Adurdoch & Company for the construction of surface drainage sewer facilities from their canning factory, and any other business,that the said Common Council might deem proper. The yetition of Reid,Murdoeh & Company asking for the right to construct, maintain and operatq,at a depth of approximately six_ feet,or more, a twenty four inch sewer running through, under, and along the easterly side of Broadway Street South and Trunk Highway No.59, as they cross what is commonly known as Soldier Field, and emptying into the Zumbro.,River at a point at or near the bridge which is to be built across the said rfter on said street and highway, for the purpose of emptying storm sewer water into said river and waste Water from the canning plant of the petitioner after the samehas been through its disposal plant, was read, and after Common Council donsideration of this petition, President Liddle ordered that it be placed on file. The petition of many residents of the City of Rochester, Minnesota, asking that this privilege be granted, was read; and'President Liddle ordered that tha same be placed on file. Alderman Vihstadt, introduced the following; resolution, which was read: "WEREAS, Reid,Murdoeh & Company has filed a petition, dated March 27, 1931, requesting that it be granted the right to eonstruct,mainttin and operate a sewer along and under the street and highway hereinafter mentioned; and WIDI:WAS the petitioner has obtained the consent of the State Highway Department to the construction of said sewer; and WTF,"IRFAS It dVJ3aArs to the Common Council that the construct ion,maintens.r..ce and operation of said" sewer will not ixt erfere with or prevent any public use of the street and highway along and under which the same will be built and that said petition should be granted: -Now, therefore, BE IT RESOLVED by the Common Council of the City of Rochester that said petition be, and the same hereby is, granted and that said Reid,M•ardoch & Company, its successors and assigns, be, and they hereby are, authorized and empowered and granted the right to construct, maintain and operate, at a depth. of approximately six feet or more, a twenty four inch sewer running through, under and along the easterly side of Broadway Street South and Trunk Highway No.59 as they cross what Is commonly known as Soldiers"?ield in said City of Rochester, in Olmsted County, Minnesota, and emptying into the Zumbro river at a point at or near, the bridge to be built across said river on said street and highway, togetU.er with the right to enter thereupon for the purpose . of l"ing such sewer, and after each such entry said premises shall be restored so nedrly as practicable to the same condition as before such entry and no unnecessary damage or waste shall be committed thereon. Said sewer is to' be used only for the purpose of empty1mr, storm water into said river, and waste water from the canning plant of the petitioner after the same has been pissed through its disposal plant, and no sanitary sewage whatever shall be discharged into said sewer, and said river shall not be polluted. 98 Reid, Murdoch & Company shall indemnify the . city of Rochester for all damages to person and/or property which it._MY suffer on account of the construeton and maintenance of said sewer. Should the city build a trunk line sewer ",ex enforgtto Sixth Street water running Southwest and Southeast of sufficient capacity. t through said first mentioned sewer and of such depth that the same may e connected to said trunk line sewer with gravity Peed thereto, peid, Murdoch Company, ' if requested so to do by the City of Rochester, shall connect said sewer with such trunk line sewer at its own expense, Upon motion by Ricks, second by Amundsen,'that'the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. S, local manager of the Reid, Murdoch & Company, stated that his company intends to retain connections with the City of Rochester surface drainage sewer system and said that:during the surmer season, whenever it might be deemed necessary, his company will flush the city surface drainage system in that section of the Oity, and also offered the use of their water -storage 3n case of an emergency"A. any time except in the three months of the canning season.
