Present:' Liddle, Amundsen, Hicks, Miller, Moody, Vihstadt. _A i Absent: Dallman. - Upon motion by Hicks ;• second by Vihstadt, the minutes of the meetingsheld on April 13th,1931, and April 20t h,1931, were ec,ch approved. President Liddle announce& this as being the time and place fixed for a hearing on the paving .end curbing of a part of Tenth Street Southwest and of Plummer' f Road, and asked if there.was.any person present who wished to be heard.concerning this improvement* There was no 'person present who hAd'­aAything to -.say regarding this paving or curbing; but the following remonstrance was read, after .which President Liddle ordered that the same be placed on file: "April Twenty-eighth 1 9 3 1 City Council of Rochester, Minnesota. gentlemen: Referring to the pending project for pavement and curb construction in loth Street Southwest, I desire to state that I am the owner of approximately eighty per cent of the abutting land. There is no dwelling fronting on that street, and the development :of the abutting property is not being forwarded by the erection of any new dwelling or other structure requiring the use of the street. The property is all dormant and general conditions indicate that it will remain so.. Present economic conditions are such that these abutting dormant properties should not be now burdened with the expense of an improvement using materials which as 3het have not been reduced in price. The cost of theimprovement, under present conditions, would seem to be grossly out of proportion -'to the value of the property to be assessed. These and other reasons have probably occurred to you, but I wish to register my petition that the paving and curbing of that street be indefinitely postponed. ' Yours truly, H. S. Plummer." Upon motion by Hicks, secono lky �Amandsen, and, all voting in favor thereof further proceedings for the paving and curbing of a part of.Tenth Street Southwest and of Plummer's Road were abandoned, and the City Clerk was instructed to return 184 MR the proposals of 1i. A. Patterson, Utton Construction Company,Ino., Edward Mattson, and Feller Brothers unopened. The City Clerk asked for consideration of the #faposal of $182.54 charge against this projeot through expenditures made by City Engineer's Department for the surveys, preparation of plans and profiles, figuring yardage, etc., and upon motion by Miller, second by Vihstadt, the City Clerk was instructdd to bill the various properties benefited for their pro rata share In this $182,54, President Liddle announced this as being the time and place fixed for a hearing on the construction of a sanitary sewer In parts of Seventh Street" Southwest and Ninth Avenue, Southwest, and• asked if there was any person present who wished to be. heard concerning this sanitary sewer. There was no parson present who wished to be heard in regard to this improvement. President Liddle announced this as the :time .,and place fixed for a hearing on the grading of Second Street Northwest from a point eighteen (18) feet east of the west line of Thirteenth Avenue .Northwest to thirty-three (33) feet west of the east line of Sixteenth Avenue Northwest, to a grade { to conform to the curb and gutter now in place, .and ,Biked if there was any person present )Yho wished to be heard concerning this grading. There was no person present who wished to beheard relative to t$is project. The City Clerk reported that no Aids had been received for the grading of Second. Street.Nortlwest, astabove described. The followingCommitteerecommendations relative to condemnation of,the so-called Slatterly lands .were read and President Liddle ordered the same placed on file: "Rochester, Minnesota, April 29, 1931. Honorable Mayor and Common Council, City of Rochester', Minnesota. We, the Board of Park Commissioners of said City, and the p,ublie Grounds Coinmittee'of the -Common Council of said City, have held a meeting with We Roland A.Slatterly, representing the Estate of Mary A. Slatterly, deceased, relative to the Commissioners award for the taking of certain lands for use as an addition to the Park system ;and the eonstruotion"of a swimming pool thereon and thereat, and he has agreed that if the following stipulations are added to and become an amendment to the`'sa,id commissioners report on their award of damages for lands taken; - that' he "w ill.. aoeept settlement; the said conditions being`�as follows:' That the City.of Rochester, Minnesota, construct -a temporary fence along the east and' north sides of the lands taken, as above described, and that .within three -,years from this date the said City shall replace this temporary fence with a permanent 4� foot Cyclone fence or its equal. That the City of Rochester, Minnesota, 'shall make provision so that the present owners (the estate of Mary A. Slatterly), their heirs and assigns, may have access to and use the waters of Bear Creek for cattle drinking purposes only, at the point where the north bank of Bear Creek intersects the north line of the._property taken, as above described; which water use shall be through adequate piping eontrolled.with proper shutoff. That the City. of Rochester., Minn., excavate an outlet for the old creek bed at the Northwest corner of the property taken, as .above described, so as to allow water from Bear Creek to circulate through old bed brut back to Bear Creek above the dam which is proposed to be built on property taken; the estate of Mary `A. Slatterly to at once, thereafter, fence the said old, creek bed 'so that cattle, horses, swine, . sheep, etc., can not get to the water so circulated and contaminate the water in the swimming pool. That, the estate of Miary A. Slatterly for themselves and for their heirs and assigns forever waive any and all claims for damages, of any kind or nature to their abutting property, against the City of Rochester,Minnesota, ocouring through overflow, erosion, or any other' reason on account of the 'changing of the channel of Bear Creek across this property as above described. Commissioners appointed on March 17th, A.D..1931, in and by resolution of the Common Council of the City of Rochester;,Minnesota, and John:M. Norton, appointed as a Commissioner by the other two Commissioners at their first meeting on March 21st, A.D.1931, because of the absence of John F. Cooke, to view the lands and premises and to assess the damages occasioned by the condem- nation and taking by the said City of Rochester, Minnesota, for use as an addition to the Park System of said City, and for the construction of a swimming,pool thereon and thereat, the lands described in the said resolu- tion of appointment, to -wit: Commencing at the Southwest corner of Lot No.31 in Auditdr's Plat "A", of Section 11 Township 106.North, of Range 14 West, and running Easterly on the south line ofa.said.Lot, 561 feet, thence North parallel with the west line of said Lot 954.98 feet, thence west parallel with the south line of .said lot. 561 feet, thence south along the west line of said Lot 054.98 feet to place of beginning, consisting of 12.3 acres, more or less, all of the above described land lying and being in the City of Rochester and the County of Olmsted ,and State of Minnesota, and WHEREAS, The City Clerk on April 2nd, 1931, did publish a notice to all persons interested ,in said lands -in the Rochester. Be it further resolved by the said Common Council: • That there is hereby. appropriated from the General Fund of said City the sum above stated and payment is hereby ordered to be made'to the Rstate of Mary A. .Slatterly, deceased, for the taking of the above. described'real estate for use as an addition to the Park system .of said City and for' the' e.onetr'uetion of a swimming pool thereon and thereat, and Be it further resolved. -by said Common Council: That there is hereby appro- priated from the General Fund oY said City, the sum of $30.00 for, payment to said Commissioners for their servieee in the said matter, and the Mayor and City Clerk of said City are hereby authorized and directed to draw warrants upon the City Treasurer for the said sums and cause payments• to be made to the Estate of Mary A. Slatterly, Deceased, and to each of the said Commissioners. " Upon motion by Hicks, second by Miller, that the said resolution be adopted as read, and all voting in. favor thereof, President Liddle declared the said resolu- tion duly passed and adopted. Dr. George M. Higgins made complaint about the improvements that are being made by School District, No. 8 in the ; grading of Fifteenth Avenue Southwest and Sixth Street Southwest around the :Folwell School, as the grade of the street as they are leaving it will be a damage to his property in that it is one and six tenths '(1 6/1C V. feet lower than his sidewalk level. President Liddle'referred this matter to the Board of Education, the property owners concerned, the Street and Alley Committee and the City Engineer, for a meeting at, that location:to decide what can be done to remedy the situation. Alderman Dallman came in at this time.and took his Chair. An ordinance to amend an ordinance entitled "An Ordinance regulating the operation and rates of fare of ,taxicabs and automobiles carrying passengers for hire, t of with -s . seating capacity/not to exceed seven passengers, within the City .of Rochester", the same being Ordinance No.343 of the City of Rochester as heretofore amended, was given its seeond•reading, . I� Rev. A. R. Zick, and others, opposid the present ordinance in effect is , fixing minimum charges for taxicab service and favored the above mentioned ordinance which will put fees back to maximum control only, while Mayor Reiter talked in favor of the existing ordinance fixing minimum charges. Rev. Zick presented the petition of between six and seven hundred local residents asking for the repeal of the ordinance providing minimum charges for taxicab services and President Liddle ordered the same placed on file; the said petition being headed as follows: "Rochester, Minnesota, �i April 27th, 1931. Honorable Mayor and Common Council, City of Rochester, Minnesota. :i Gentlemen: u We, the undersigned, hereby remonstrate gggainst the taxi- cab rates now in effect through the adoption April 13, 1931, of the ordinance amendment fixing a minimum charge for such service, and also hereby most earnestly petition your Honorable Body that you at once accomplish the adoption of the amendment proposed April 22nd, 19311, which, will put the matter back to maximum control only, i.e. it will allow us to have a 2V taxi fare again, if any company or indi- vidual is disposed to do business for that fee." A motion by Alderman Moody that the rules be suspended and that the above mentioned ordinance be given its third and final reading, received no second. The following report from the City Engineer,relative to proposals for sanitary sewer construction,, was read, and President Liddle ordered ;1 i the same placed on file; " May 40 i931 Honorable Mayor and Common Council Gentlemen: I herewith submit tabulation of bids for eonstruction of sanitary sewer in Seventh Street Southwest and Ninth Avenue Southwest: Wm. C. Fraser & Son, complete as bid $ 1034.00 Wm, C. Fraser & Son as per estimate 1051,50 M. Paulson as per estimate 918.75 Respectfully submitted, C.H.Armstrong,City Engineer." Upon motion by Miller, second by Amundsen the City Engineer was p instructed to secure the necessary labor and materials and grade Second Street Northwest, between eighteen (18) feet east of the west line of .i Thirteenth Avenue Northwest and thirty-three (33) feet west of the east i • , ji f l H i WT= 189 � I line of Sixteenth Avenue Northwest, to a grade to conform to the curb and gutter now in place, in accordance with the plans, profiles and specifications heretofore adopted for this improvement. This being the time and place fixed for adjourned and continued action on the fixing of the salary of the Chief of Police for the current official year, and the Common Council not being ready for action thereon, motion by Hicks, second by Amundsen, carried that the matter be adjourned and continued to a meeting of this Common Council which is scheduled for 7:30 o'clock P.M., on May llth,1931. The following report on gas tests made during Apri1,1931, was read, and President Liddle ordered the same placed on file: "May 1, 1931 Gas report for the month of April 1931, Date B:T .U. Post ier Building & Electrical Inspector." The report of the City Treasurer for the month ending April 30th,19311 shoVving 8226,718.33 as being on hand was read, and. President Liddle ordered the same placed on file. The report of the City Engineer for the month of April, 1931, showing expenditures from the General Fund for labor of �)359,47, from the Street and Alley Fund $1186,10, from the Sewer Fund $277.35, and from the bridge fund $2.20, was read, and President Liddle ordered the same placed on file. The application of Andrew Chafoulias for soft drink dealer license at No.9, Broadway Street North, was read, and upon motion by Vihstedt,second by Dallman, license was granted. The following request for withdrawal was read, and upon motion by Hicks, i second by Miller, it was granted: '. VI is "1- 9 0 "Rochester, Minnesota. May 4th, 1931. Honorable Mayor and Common Council, City of Rochester, Minnesota. li Gentlemen: The transfer recently request:d from your honorable body regarding the operation of the Town Taxi Line is hereby withdrawn as it is my wish that the transfer formerly applied for is not to take effect. Respectfully, Town Taxi Cab Co. By. Roy Schlief. . " Replies from Representative Victor Christ gau and Senators Thomas D. Schall, and Henrik Shipstead, concerning the request of the Rochester Engineer's Club that a local resident architect be selected for the �I proposed new locAl`post office building, were read, and President.Liddle ordered that the same be placed on file. The following offer was read, and President Liddle referred the same to the Public Grounds Committee, the City Clerk and the City Engineer: "Rochester, Minnesota, 5/4/31, it 4I The Hon. Common Council Ii City of Rochester Gentlemen I offer for your consideration the lower Northwest Apartment of the Clausen Apartments, at a monthly rental of j $35.00. This includes heat and water. Yours truly, G. N. Sherman ., Adin. of B. Clausen. Estate." A communication from M. J. Boyle, Superintendent for the Chicago North Western' Railway Company, calling attention that the light and power wires crossing their mill track on the North side of Fifth Street Northeast is short one side guy, was read, and President Liddle referred the same to the Public Grounds Committee, with instructions that they confer with the Public Utility Board asking for installation of this side guy. Alderman Dallman introduced a resolution accepting the bid and proposal of Martin Paulson for the construction of a sanitary sewer in parts of Seventh Street Southwest and Ninth Avenue Northwest, and fixing the amount of the bond to be given by the said contractor at the sum of 191_ !� `�920.00, which was read. ! Upon motion by Vihstadt, second by Amundsen, that the said resolution be j{ adopted as read, and all voting in.favor thereof, President Liddle declared the said; i; resolution duly passed and adopted. Upon motion by Miller, second by Amundsen, tt was ordered that the certified check which accompanied the bid of the unsuccessful bidder for the construe- Lion of the above described sanitary sewer, be returned to than. i !i The petition of Oscar C. Ronken, Geo, PJI, Higgins, Amid L. Glabe, u antes A. Ford, and C. W. Walters, that a curb and gutter be constructed in Fifteenth Avenue Southwest, from the south line of Sixth Street Southwest to the South line ! of Fifth Street Southwest, and that the cost of constructing be spread over a period of two to five years, with five years preferred, was read, and President Liddle referred the same to the Street and Alley Committee. Alderman Dallman introduced the following resolution, which was read: "RESOLUTION PRESCRIBING THE FORM OF THE ONE HUNDRED EIGHTY THOUSAND DOLLARS ($1802000.00) OF CITY OF ROCHESTER,MINNESO- TA, IMPROVEMENT BONDS AUTHORIZED BY THE VOTERS THEREOF APRIL 21st,19311, AND PROVIDING FOR THE ISSUANCE AND SALE OF FIFTY THOUSAND DOLLARS ($50,000.00) THEREOF AND AUTHORIZING THEIR EXECWION AND DELIVERY. - - - - - - - - - - - - - WHEREAS, At an election duly called and held in the City of Rochester,Minnesota, after notice thereof duly given _'or the time and in the manner required by law, more than three -fifths (3/5) of the legal voters in said City voting at said election declared in favor of the issuance of the City of Rochester, Minnesota, Improvement Bonds in the amount of One hundred eighty thousand dollars ($180,000.00), and approving the resolution of this Common Council adopted March llth,19319 and W:FCEREAS, It is deemed necessary and expedient that the form of such bonds be prescribed and adopted by this CorAnon Council and it is necessary and for the best interests of the said City of Rochester, to sell and issue at this time Fifty thousand dollars (,�500000.00) par value, of said bonds so authorized; SO THEREFORE, Be it resolved by the Common Council of the City of ! That said bonds when duly prepared in the form aforesaid, shall be held by the City Treasurer of said City, and when a block or portion thereof is, by this Common Council, determined to be sold and issued, that the same shall be signed by the Mayor of said City and the City Clerk of said City, and the corporate seal of the said City duly attached to each, and the coupons attached to each of the said bonds authenticated by the fae-simile signature of 'the City Clerk of said City, and when so executed, the coupons of all said bonds then to be placed on the market, which have matured and become past due shall be cancelled and detached from the bonds before the same shall be delivered to the purchaser or purchasers thereof. r , Section 4. That it is deemed to be necessary and for the best interest of the City that there shall be, at this time, issued and sold Fifty (60) bonds all dated May 1st, 1931, and to become due and payable in their numerical order as follows: Three (3) thereof on the first day of December of each of the years 1932 to it1941, both %nclusive, Two (2) thereof on Deoenber first of each of the years 1942 to 1951,1nclusive; with exception as to maturity of those of 1941 to 1951,inclusive,. in that the principal on those shall be optional as to payment on any interest date after December 1, 1940, and prior to maturity. Section 5. That the City Clerk of said City be and he is hereby directed to publish notice of the meeting of the Common Council of said City which is directed to be held in the Council Chambers, in the City Hall, of the City of Rochester, Minnesota, on the 25th day of May, 1931, at 7:30 o' clod P.M., for the purpose of opening and considering bids for the said bonds, in the Rochester Morning Journal, a local newspaper printed and published in said City, and the official newspaper thereof, in which said notice shall be published as required by law. Section 6. That said advertisement for bids for the sale of said bonds shall be substantially as follows: NOTICE OF SALE OF FIFTY THOUSAND DOLLARS ($50,000.00) City of Rochester, Minnesota, IMPROVEMENT BONDS. The Common Council of the City of Rochester, Minnesota,. will meet in its Council Chambers, in the City Hall, in said City, on the 25th day of May, 1931, at 7:30 o'clock P.M., to open and consider sealed bids for A50,000,00 of the City of Rochester,Improvement Bonds, then to be issued and sold, being part of an issue of $180,000,00 authorized by the electors of said City to be for the purpose of erect- � ing and constructing of a new City Hall, in and for tht; said City of Rochester, Olmsted County, Minnesota, upon such parts of Lots Ten (10), Eleven (11), and Twelve (12) in Block Nineteen (19) in Original Plat of Town, now Cite, of Rochester, ♦ 1 �m Minnesota, as may be required for such purpose. All of said bonds shall be of -the denomination of one thousand dollars (11,000,00) each, dated May 1st, 1931, and to mature as follows: Three (3) thereof on the first day of December of each of the years 1932 to 1941, inclusive, and two (2) thereof on December first of each of the years 1942 to 1951, both inclusive, with exception as to maturity of those of 1941 to 1951, inclusive, in that the principal on those shall be optional as to payment on any interest date after December 1st, 1940, and prior to maturity, with interest until paid at the rate of four and one -quarter per cent (4 ) per annum, -payable 'setii- annually on the first day of June and December of each year. Both princi- pal ar.d interest of the said bonds will be made payable at the office of the City Treasurer in the City of Rochester, Minnesota. All bids must be addressed to the undersigned City Clerk of Rochester, Minnesota, and accom- panied by a duly 'certified check for two per cent (2%) of the principal of the bonds bid for, payable, without any condition, to the order of the Cit r Treasurer of Rochester, Minnesota, which two (2%) will, if the bid is accepted, be applied to the purchase price of the bonds, otherwise to be returned to the unsuccessful bidder or bidders and such successful bidder will be required to accept delivery and pay for said bonds immediately upon his bid being accepted. No bids will be considered for less than par and accrued interest from May 1st., 1931. The successful bidder will be furnished the approving opinion of Junell, Oakley, Driscoll and Fletcher, of Minneapolis, Minnesota. " Upon motion by Vihstadt, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle i declared the said resolution duly passed and adopted. Alderman Moody introduced an ordinance creating a Sinking Fund and levying tcxes for the payment of principal and interest of $160,000.00 Improvement Bonds of the City of Rochester, Minnesota, dated May lst,1931, which was given its first reading. ` Dr. Stromberg made recommendations for improvements at the local Sewage Disposal Plant, and upon motion by Hicks, second by Dallman, the i same was referred to the Sewer Committee and the City Ent-ineer, with instructions that they make report thereon at the next meeting* of this Common Council. i ;i 0 19 The City Engineer reported that he had hired Albert Christopherson for the construction of a fence along the East side of the City Dumping Grounds without having made any definite arrangements for his rate of pay and said that when the payroll was turned in for the six days, April 27th, 28th, 29th, and 30th, and May 1st and 2nd1 1931, it became known that Mr. Christopherson expected $.90 perhour for his services, and the Common Council after consideration of the situation, agreed that the claim of Mr. Christopherson be allowed at $,90 per hour. Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, At the Special Election held on April 21, 1931, the question of the issuance of A180,000.00 City of Rochester, Minnesota, 4e Improvement Bonds for the purpose of erecting and constructing a new City Hall upon such parts of Lots Ten (10), Eleven (11) and Twelve (12) in Block nineteen (19) in Original Plat of the Town, now City, of Rochester, Minnesota,, as, will be required for that purpose, rectived the approval of the voters of the City of Rochester, Minnesota; and WIEREAS, Preliminary to the said erecting and constnieting there must be the appointment and selection of an ar,chiteet for the preparation of plans, profiles, and specifications and estimate of cost for the said erecting and con- structing., and WHO REAS, The various Architects made proposals and talked of. their qualifications at a meeting of this Common Council, held on April 0-7th,1931, at which time the informal selection and appointment of John McG.Miller was made as the architect for the above mentioned erecting and constructing of a new City Hall, SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the formal selection and appointment of John McG.Miller, of Rochester,. Minnesota, as the architect for the above mentioned erecting and construction of a new City Hall is hereby made, and his fee is hereby fixed at the sum of five (5) per cent of the cost of the erecting and constructing of a new City Hall, exclusive of the Architects fee, which five per cent (5%) shall be full payment for the preparation of plans, profiles, specifications and estimate of cost, and specially as to supervision of the pouring of concrete which shall be supervised at all times while such work is under way, with the presence of the architect or his representa- tive to be required on the work at least four times daily while the other construc- tion work is being; done, with provision that if only the preparation of plans, profiles, specifications and estimate of cost is required the fee shall be three and one-half per cent (31f) of the total cost of the erecting and aonstrueting exclusive of the architects fee, for which three and one-half per cent (3-2-%) no supervision will be given by the architect. Be it further resolved by the said Common Council: That a further condi- tion shall enter into the selection of John McG.Mi.11er as the architect for the erecting and constructing of the new City Hall, which shall be in the event of the adoption. of the plans, profiles, specifications and estimate of cost, for the said work and the advertisement for the same it shall be found that the bids are in excess of the $180,000,00 available for these purposes the said architect shall amend and revise his plans, profiles and specifications to such an extent that the contract price plus architects fee will come within the money available, for which he, the architect, shall receive no further compensation for the said amendment and revision other than the 5% for preparation and supervision as heretofore arranged for, or the said three and one-half (3970 ) per cent if it is deemed that supervision can be dispensed with insofar as the architect is concerned. i Be it further resolved by the said Common Council: That the Mayor and City Clerk of said City be and they are hereby authorized and directed to execute a contract for the City of Rochester, Minnesota, with the said John McG.Miller as architect for the erecting and constructing of the new City Hall in accordance with the above services, duties, etc." Upon motion by Miller, second by Vihstadt, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. G. Worth appeared before the Common Council and made objection to the abandonment of the proceedings for the paving and curbing of part of Tenth Street Southwest, and of Plummer's Road, atiwhieh motion by Vihstadt, second by Hicks,carried that the Street and Alley Committee and the City Engineer confer with Dr. H. S. Plummer, asking him to reconsider his remonstrance against this project, and that they make report thereon at the next meeting of this Common Council. Alderman Moody introduced an ordinance regulating the regulating the installation, construction and maintaining of plumbing, plumbing fixtures, private sewers, and sewer connections within the City of Rochester, Minnesota, which was given its first reading. Alderman Dallman introduced an ordinance to amend ordinance No.286 and providing for the appointment of one person to the office of Building, Electrical and Plumbing Inspector, and prescribing powers and duties, which was given its first reading. Upon motion by Vihstadt, second by Dallman, the City Attorney was instructed to prepare an amendment for the ordinance, providing for i electrician's licenses, electrical inspection, etc., to correct the I' I published ordinance compilation relative to who shall countersign the li licenses, and also to provide for identification signature on the licenses issued. The ' claim of Chas. H. Aznmstrong $27.35 for expenses of himself, + Aldermen Miller, Vihstadt, and Amundsen on a trip to inspect city halls, } and of Albert Christopherson $48,60 for 54 hours labor at $.90 on the days above mentioned,were each read, and upon motion by Hicks, second by Amundsen the same were allowed and it was ordered that these claims be paid from the i General Pund. Upon motion by Hicks, second by Dallman, the rules were suspended and an ordinance regulating the installation., construction, and mainten- ance of plumbing, plumbing fixtures, private sewers and sewer connections within the City of Rochester, Minnesota, was given its second reading. Alderman Hicks introduced a resolution appropriating $1199.20 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the period of the week ending May 1, 1931, in accordance with sworn claim made by Wm.
