Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Vihstadt, Absent: None. Upon motion by Dallman, second by Vih stadt, the minutes of the meeting held on May llth,1931,`were approved. This being the time and place fixed forthe opening of proposals for the purchase of $50,000.00 City of Rochester 4-�% Improvement Bonds, offered for sale on this date, the following bids were opened and read: Drake -Jones Company and Justus F. Lowe SE Co., of Minneapolis,Minnesota: par, accrued interest and a premium of $$2125; Central -Illinois Company of Minneapolis, Minnesota: Par, accrued interest; i and a premium of $1325.00; First National Bank of Wiliona and Winona National & Savings Bank: Par, accrued interest and a premium of $1502.00; Wails -Dickey Company of Minneapolis, Minnesota: Par, accrued interest and a premium of Q$13860`00; First Securities Corporation of Minnesota: Par, accrued interest and a premium of 9$1800.00. Alderman Hicks introduced the following resolutions which was read: "Be it resolved by the Common Council of the city of Rochester, Minnesota: That the bid and offer of Drake -Jones Company and Justus F. Lowe and Co. for Fifty Thousand Dollars ($$50,000.00) City of roehest.er four and one -quarter per cent (4j%) Improvement Bonds dated May 1st, 1931, which were at this meeting for sale, being d$50,000.00 'as the principal on the said bonds $2125*00 as premium on the said bonds and d$147.55,as accrued interest from May 1st, 1931, is deemed to be the most favorable proposal for the said bonds, and Be it further resolved by the said Common Council: That the said bonds are hereby awarded and sold to Drake -Jones Company and Justus F. Upon motion by Miller, second by Dallman, the rules were suspended and an ordinance creating a Sinking Fund and levying taxss for the payment i of principal and interest on $180,000,00 Improvement bonds of the City of Rochester, Minnesota, dated May lst,1931, was given.its second reading. p 8 Upon motion by Miller, second by Dallman, the rules were suspended ' ip and the said ordinance was given ,its third and final reading. { i Upon motion by Hicks, second by Moody, that the said ordinance ;i be adopted as read, and all voting in favor thereof, President Liddle declared the said ordinance duly passed and adopted.. Allen Farnham and E. M. Raetz, representing the Holmes School and Hawthorne School Parent -Teachers Association, asked that the Common � !. Council arrange for the biiildingobf a bath house at the newly ,acquired 1 swimming pool property. 'g i 4. Upon motion by Hicks, second by Miller,, the' Board of Park Commissioners were requested toemppaddnot over $400.00 for the construction 3 of a bath house at the newly acquired swimming pool property. I !+ ! PJ esident Liddle referred the matter of a sidewalk grade for the j ti 1!, Theodore A.. Johansen property to the Street and Alley Committee and the ii City Engineer for report thereon at the meeting of this Common Council, which is to be held at 2:00 o'clock P.M., on June lst, 1931; the situation ji being that the sidewalks constructed for properties on both sides of the Johansen property are approximately one foot higher than the proper grade.. f ' ji President Liddle referred Bert Leitzen's oral petition for sanitary sewer and water service to his property in Shervem's Replat to the Sewer` Committee and the Water Committee. e ,r l 3 :::.. �Ct.}': i, S,� j"4;.d• +la'�•C�I J �" rQ�• U. ! file 215 Upon motion by Hicks, second by Miller, the sum of `�150.00 was appropriated from the General Fund and it was ordered that the same be paid to the Rochester ii Chamber of Commerce to apply on the cost of the printing of 5000 Rochester Official i� iDirectories and advertising folders. Upon motion by hicks, second by Dallman, George N. Sherman, Chas, F. Dabelstein, John M. Norton, Fred D. Rommel, and W. L. Toogood were appointed as unofficial appraisers for fixing the damages to the Reid-Murdooh Company for the taking of lands and by the construction of an overhead crossing over -the Chicago Great Western Railroad Company tracks in connection with the so-called belt line" routing for trunk highways No. 7 and No.20, and that they be requested to make report thereon to this Common Council at t}r meeting which is to be held at 2:00 o'clock P.M., on June 1st, 1931, which action was taken pursuant to an informal agreement made by the management of the Reid-$Iurdoch Company with certain local cit izens ,that they would accept the appraisement for their damages if it were made and presented by a Committee of disinterested local business men. The applications of the Publix Theatres Corporation for the Rochester Amusement Company for motion picture licenses, one for the Lawler Theatre, one for u the Empress Theatre, and one for the Chateau -Dodge Theatre, were each read, and upon motion by Dallman, second by Amundsen, licenses were granted. The following petition of Edward Fanning, Fred Roban, Tonga, Erickson and Mary.. Proud, ;was read, and President Liddle referred the same to the Street and i� Alley Committee, the City Engineer, and the City Attorney: "That the East twenty-five (25) feet of Outlot No.l of Panning's Addition and the west twenty-five (25) feet of Lot No.6 of Auditor's P1 at "A" and that the west twenty-five (25) . feet of the north 45:55 feet of Lot No.16 in Auditor's Plat "A" be taken for street purposes and to be known and designated as a part of Fifteenth Avenue Southeast." General Balance sheet, trial balance, Fund statement, statement of unexpended budget appropriations, etc., of the City of Rochester, Minnesota, prepared by the City Clerk as of April 30th,1931, were laid before the Commcn Council, and President Liddle ordered that the same be placed on file. A report of the Clerk of the Municipal Court for the week ending May 18th, 1931, shoding criminal fines collected $266,40, court costs charged to Olmsted County $6.90, fines collected due to Olmsted County $118,75, and fines collected and StatV paid to u-7 Treasurer $40.00, was read, and President Liddle referred the same to the City Attorney. Upon motion by Hicks, seeond by Dallman, the sum of $118.75 was appropriated from the General Fund and it was ordered that the said sum be paid to Olmsted County, u Minnesota, for the above mentioned local Municipal Court Pines collected due to Olmsted County. 11 Balance sheet, income statements, etc., of the Public Utility Departments, prepared by the Secretary of the Public Utility Board, seref April 30th,19311, were laid before the Common Council and President Liddle ordered that the same be placed on file,; the said income statements showing a net profit in, the Light Department for the. month of April,1931, of $9678.709 a net profit in the Water Department for the spme period of $766.27, and a net loss in the Steam Heating Department for the same period ;i of $48.39. I The report of the City Weighmaster for the month of April, 1931, i; showing weighing fees collected in the amount.of A15,40, was read, and President Liddle referred the sameto the Finance Committee, The application of Chris Dillon for a license to connect . with sewers an a drains, was read, and upon motion by Miller, second by Moody, II it was &Veed,;thst no action thereon would be taken until such time as he makes payment for the cost of paving repairs over excavations made by him during his past license year, and that the City Clerk notify the Chief of Police that until Mr, Dillon does secure the new license the Chief of Police ;i will take action against him under the local ordinance for new excavations that he might make between now and the time that the, new license is granted. :I The applications of Fred W. Oesterreieh for soft-drink dealers license at numbers 9 Broadway Street South and No.322 Broadway Street South, were each read, and upon motion by Vihstadt, second by Dallman, !i licensed were granted, II . it Upon mot ion by E�sll" , second by Ric xs, pr ovis ion was made that the carnival license heretofore issued to the Elk's Drum Corps be endorsed to the effect that they may show the Morris & Castle Shows under this license instead of the Rubin & Cherry Shows. The following appointment was read, and upon motion by Miller, second by Moody, and all voting in favor thereof, it was approved: " May 25th, 1931. Honorable Mayor and Common Council,, City of Rochester., Minnesota, Gentlemen: Subject to your approved, I herebJ, appoint Henry Kenneth Armstr ang to the position of Second Assistant City Engineer to take office May 28th, 1931, and to hold office until the Second Xenda;Vn.Jh April of 1932, unless sooner removed, Respectfully submitted, C. H. Armstrong. City Engineer." 0. Alderman Miller introduced the following resolution, which was read: 27. "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the salary of the Second Assistant City Engineer of said City is hereby fixed at the sun of 1175,00 per month for the balance of the ensuing official year, payable from the General Fund of said City. The said salary and compensation shall be paid semi-monthly; one-half thereof being payable on the 16th day of each month and the balance on the last day of each calendar month during the balance of the said official year. " Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The applications of A. E. Wilsey and Arnold Ti. Brown, for drivers license, were each read, and upon motion by Vihstadt, second by Amundsen, licenses were granted. A petition that a sanitary sewer be constructed and a water main laid in Fourth Avenue Southeast, from Tenth Street Southeast to Eleventh Street Southt;ast, was read, and President Liddle referred the said petition to the Sewer Committee and the Water Committee, The petitions of the Rochester Holding Company, Louis Enke, and R. R. Dixon, that the alley running�North and South through Block 25, Head 81 MCMahon's Addition,be paved with seven inch,one coarse, steel reinforced eonerete,was read, andPresident Liddle referred the same to the Street and Alley Committee. The following report Prom the Sanitary Inspector was read and President Liddle ordered the same placed on file: " May 21, 1931. To the Common C ounc it , City of Rochester, Minnesota Gent lemen: A general clean-up inspection in the 8,ity of Rochester was made during the month of May 1931. There were eight legal notices served to different parties (owners of property) to clean up and remedy insanitary conditions existing on their premises. A second inspection was made ten days later to see if all parties receiving such notices complied with same. There were also eight legal notices given to property owners to connect up with city sewer and water. This notice was given to make such changes in sixty days. Corrections are to be made as requested by said notices. Eleven were prosecuted and paid fines for violation of City Ordinance pertaining to' dumping garbage and having objectionable material on their property or in the rear of their place of business. Four of the eleven were prosecuted and paid fines for hauling in an uncovered wagon. Yours verjr truly, George F. Strifert,Sanitary Inspector". Mayor and Common Council Gentlemen: The Street and Alley Committee and City Engineer beg to recommend that the petitions as follows be granted: For the construction of curb and gutter in Sixth Street Southwest from 18 ft, east of the west line of Fifteenth Avenue to a point 311,12 ft. west of the west line of Fifteenth Avenue Southwest, and in Fifteenth Avenue Southwest., from Fifth Street to Sixth Street Southwest* And that Fifteenth Avenue Southwest be graded to an established grade frum the south line of Sixth Street Southwest to the north line of Seventh Street Southwest, if extended, Respectfully submitted, STREET & ALLEY COMMITTEE & CITY ENGR- Fred W. F, Wright City Clerk Rochester Minnesota Dear Sir: I am in receipt of your letter of May 12th regarding the audit of the books and affairs of the City of Rochester, I am very sorry that we have been unable to get around to your city up to this time as when your request was received it was marked for special attention shortly after the close of your fiscal year, However, special Investigations have made It absolutely impossible to send the proper man to your city. My dear Sir: I am in receipt of your letter of May 5th enclosing certified copy of a resolution passed and adopted by the Common Council of your city pertaining to the retirement fund of city officers and employes. The same has been duly filed in this office. .I want to congratulate the employes of the city of Rochester for electing to come under chapter 307, Laws 1931, and as the years go along I feel quite confident that they are going to be pleased over the provisions made under that chapter. Upon motion by Miller, second by Dallman, the Mayor and City Clerk were authorized to execute a lease with the Chicago & North,lWestern Railway Company for property -to be used as storage for coal for use at the local electric light plant. May 12-1931 ' May we call your attention to: -.a condition in bidding on City work which does not do justice to the bidders.. That is the matter of slipping in addendas•and alternates not called for in thr bid forms, In the case of the traffic signals; your engineer specifically states that the bidder "holds his bid liable to rejection, if not made in strict accord wi �h the proposal form". If your engineer is incompetant to write bpecif ications to cover all the items why not hire one who is capable of foreseeing these; the items in this case could be readily foreseen. When a bidder spends his time and money compiling a bid in accord with certain prescribed forms it is hardly fair to him to permit other bidders from d6viating from this practice without so stating In the invitation for bids, Lets have our' bidding done on an equal basis for all bidders. Lochead, Deputy Health Officer, setting forth comments and recommendations relative to sewage disposal and stream pbllut icn,vas read, and upon motion by Hicks, second by Amundsen, the same was referred to 'the Mayor and the Sewer Committee. The following appointment was read and President Liddle ordered the same placed on file: "Iffay 232 1931, Honorable Common Council, City of Rochester, Minnesota, Gentlemen: Under request of the Commissioner of Agriculture of the State of Minnesota, I have this day appointed Fred R. Witzke as Weed Inspector for the City of Rochester, Minnesota, for the period ending on October 15th, 1931, at a salary of 50� per hour and 8� per mile for traveling expenses while traveling solely on weed inspection activities. Respectfully submitted, Julius J. Reiter Mayor of said City. " The following notice of reinstatement was read, and President :,addle ordered the same placed on file: 22t " May 25, 1931, Honorable Common Council, Rochester, Minnesota. Gentlemen: Effective with April 16th, 1931, I hereby reinstate Elbert L. Whiting as Patrolman in the Police Department in said City, thereby cancelling my removal of him from duty as.a Patrolman in the Police Depart- ment of said City effective April 15th; 1931, Respectfully submitted, Julius J. Reiter, Mayor of said City," Upon motion by Amundsen, second by Hicks, the Mayor and City Clerk were authorized and directed to draw warrants upon the City Treasurer and make payment to Elbert L, Whiting for services as Patrolman during the last half of April,1931, and the first half of May 1931, in accordance with the above quoted reinstatement i by the Mayor. i The following c ummunieation was read, and President Liddle ordered the same placed on file: "STATE OF MINNESOTA INSURANCE DIVISION Department of Commerce St, Paul May 23, 1931., Honorable Mayor and City Council, Rochester, Minnesota, Gentlemen: During the past week our deputies in inspecting your city directed our attention to the gasoline storage tanks located in the yards of the Chicago Great Western Railroad Company at Fifth Street Southwest. These tanks are used by a number of companies. , In the opinion of our deputies these tanks containing, as they do approximately a million gallons of gasoline, constitute a very serious hazard and menace to your community. Should an explosion occur in one of the tanks it would be very difficult to prevent a fire from being communicated to the other tanks and should the burning gasoline escape from the tanks onto the river the burning fluid would be carried down stream with the most disastrous i results. ; The Legislature has not enacted any statute giving the State Fire Marshal authority to regulate the location and construction of gasoline storage tanks but has left the subject f(r regulation by local municipal authorities. We sincerely hope that this subject will have your earnest attention and consideration and that such regulations will be established as will Aliminate the existing hazard, Yours very truly, C. P. Liddle ordered the same placed on file; The claim of Brown-Knopp Agency $16.38 for t4$3,000.00 tornado j insurance and $500.00 fire insurance on the dumping grounds building,and the claim of 0. W. Schroeder 1122.20, for public liability and property damage insurance on the Dodge 1920 truck, were each read,and President Liddle referred the same to the Insurance`'Committee,, Upon motion by Vihstadt, second by Dallman, the sum of $5,00 was appropriated from the General Fund and it was ordered that the said sum be r paid to D. L. Williams, ,Postmaster,for stamps for use of City Clerk. j ! A blue print of the Tri-State Telephone & Telegraph Company, estimate No.3309, for proposed relief On cables numbers 1 and 5 North of 1 the Chicago & North Western Railway Company tracks, was laid before the Common Council, and upon motion by Miller, second by Dallma n, the said Company was granted authority to make this improvement. President Liddle referred the matter of the sanitary sewer ! connection for the newly constructed residence on the property at the southeast corner of the intersection of First Street Northwest and Thirteenth Avenue Northwest to the Sewer Committee for investigation in that if this property is connected to the sanitary sewer in First Street i Northwest the ownef thereof should pay the 36.68 General Ledger book account set up and recorded against this property as provided for in Ordinance No.396. .$ iry�''S YY•. pf Li..'v. �!-�ys.. 93 The following claims were read and upon motion by Hicks, second by Amundsen, the same were allowed and the Mayor and City Clerk were authorized and directed to draw warrants upon the City Treasurer and make payment accordingly: From the General Fund: M. Enke $5.00. Alderman Hicks introduced a resolution levying special assessments for scavenger service, which was read. Upon motion by Hicks, second by Da llman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced a resolution appropriating $2335.63 from the park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the period of the weeks ending Magi 15th,1931, and May 22nd,1931, i i which was read. Upon motion by Dallman, second by Amundsen, and all voting in favor thereof,, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $425.00 from the Sewer Fund and ordering payment made to Yeomans Brothers Company ttrChicago, Illinois, for the furnishing of one Yeomans 3 inch H.N.C. sewage pump complete as per City Engineer's letter order of February 17t h,1931, which was read. Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted* Alderman Vihstadt introduced a resolution appropriating .$900,00 from the Permanent Improvement Revolving Fund and ordering payment made to the First National Bank of Rochester, Minnesota, for interest due June l st,1931, on City of Rochester,1 Minnesota 61'1� Permanent Improvement Revolving Fund bonds dated April 1st, 1921, and, numbered 271 to 300 inclusivep which was read. Upon motion by Vihstadt, second by Dallman, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution fixing 7:3u o'clock 1931, as the time for a hearing on the construction of curb and gutter on Sixth {. Upon motion by Vihstadt, second by Amundsen the City Engineer was authorized to spend $199.00 for the cleaning and painting of the aerators at the sewage disposal plant. Upoh motion by Hicks, second by Moody, the City Attorney was j. instructed to require of Kris Nielson that he provide some protection for his old gravel pit excavation in the neighborhood of Twplfth Street :i and Third Avenue Northwest, either by properly fencing it or filling it up. President Liddle to tted the invitation of A. L. Mitten, Chairman of the Memorial Day Parade Committee, that the Mayor and Aldermen be at the point . of the parade formation at ' 9:3 0 o'clock A.M.,, May 30th,19312 to head the Decoration Day parade. President Liddle made request that the Public Grounds Committee view -the Ci iy Hall and comfort station for designation of salvage that will be retained for use in the new City Hall.
