HomeMy WebLinkAbout08-10-1931Minutes of an adjourned regular meeting of the Common Council of -the City of Rochester, Minnesota, held in the Council Chambers, in the second floor of the Chamber of Commerce Building in said City, at 7:30 o'clock P.M., on Au._nist loth, 1931. Meeting called to order by President Liddle. Roll Call. Present: Liddle, Hicks, Miller, Moody, Vihstadt. Absent: Amundsen, Dallman. In connection with the approval of the minutes of the meeting held on August 3rd,1931, the following communication was read, and upon motion by hicks, second by Moody, the minutes of the meeting held on August 3rd,1931, were approved after such exceptions as may be created by the application of the corrections mentioned; "Rochester, Minn. August 10, 1931 IT Mayor and Common Council Gent n: The undersigned bey; your consideration in the matter of statements I reported as having been made in connection with roof water cistern overflow and rain water entering the sanitary sewers in this city. Minutes of Aug. 3rd.- Page B-Column 4-Paragraph No.l and No.2. Quote: Alderman Vihstadt also called attention that the enforcement of this ordinance would relieve' the sewage Disposal Plant of about 50 per cent of the load by cutting off the rain -water received there, which has to be separated from the sewage at the Preliminary Sedimentation Tank, which separation is hot complete with consequent -suspended liquid carried into the digestion tank and through the sludge beds where the trouble is occasioned in that the' beds will not carry the' output of the diges- tion tank because it takes so long for the lic_juid to be disposed of by evavora- tian and seepage, � Charles H. Armstrong, City Engineer, recommended a survey aimed at euttin off all rain -water; that is roof drains, cistern drains, etc, from going into the sanitary sewer system and supported the statement Made by Dr. Stromberg and Alderman Vihstadt that such action would cut down the con?,es- tion at the Sewage Disposal Plant where all the trouble is caused by the necessity of netting this surplus water off from the sludge -drying beds. No such statement, as that rain -water in the sanitary sewers affecting the sludge beds was made. Rain -water causes an overload in the sanitary sewers, which often back up and cause damage in basements where sewers are shallow. Mention was made that the down spouts discharge into the drying bed at the plant, and should be changed. The only matter that is treated in the drying beds is settlable solids with a percentage of water content which percentage does not vary with the volume of sewage treated while passing through the plant. It should be bourne in mind that with the installation of the Preliminary Sedimentation Tank which was constructed in 1930, the capacity of the plant was increased at least 63 per cent, with the amount of solid P d .matter removed from the sewage was increased from 60 per cent to 95 per cent. Further, it should be noted that the influent has increased from 1.896.470 gal. per day in 1925 to 2700.000 gal, per dal,► in 1931, which is an increase of 42 per cent over the flow. of 1925, with the same increased percentage of demand in drying beds. This being the time and place fixed for the opening of proposals for the construction, equipping, etc., of a sewage lift station and for the playing of connecting linesto and from it, the following bids were opened and read: Carl Jacobsen and S. President Liddle referred the above proposals to the Sewer Committee and the City Engineer for their tabulation and recommendations. Alderman Amundsen came in at this time and took his Chair. A petition that a sanitary sewer and water main be constructed in Fourth Avenue Southeast from Tenth Street Southeast to Eleventh Street Southeast, was read, and President Liddle referred -the same to the Sewer Committee and the Water Committee for their report at the next meeting of this Common Council, which is to be held on August 20th,1931, Henry Kitzman and E. N. Hope of the H. & S. Investment Company of 2711 West Wells Street, Milwaukee, Wisconsin, asked for a permit to retain the gasoline pipe line which they have installed in the alley in Block 51 in the Original Plat, to which the City Attorney replied that this Common Council has no rinht to grsnt such a permit And suggested that this concern take out this illegally placed gasoline pipe line and conduct their business the same as any other local oil company. The report of the Health Officer for the City Farm for the month of July,1931, showing receipts in the amount of t"1201.52, disbursements ""1740.32 and a b°,lance on h,%nd of �1'26.45 was read, and President Liddle ordered that the same be placed on file. The report of the Building and Electrical Inspector for the month of July, 1931, shoring building inspection fees collected in the amount of f'%5.00, and electrical inspection fees collected in the amount, of .715.75, was had, and President Liddle referred the same to the Finance Committee. Balance sheet, income statements, etc., of the Public Utility Departments, pr,;pared by the Secretary of the Public Utility Board as of July 31st, 1931, were laid before the Common Council, and President Liddle ordered that the same be placed on file; the said income statements showing a net profit in the Light Department for the month of July, 1931, of �.'39405.16, and a net profit for the four months of this fiscal year of 1,36645.18, and a net loss in the Water Department for the month of July, 1961, of A253.07, and a net profit in the Water Department for the 4 months of this fiscal year of $11902.06. .he application of the Rochester Voiture No.327, 40 & 8, for a public dance permit at the Armory August 18th,1931, was. read. The application of Edison 0, Bahmer,::-: Harold Gentling, Ernest H. Maass Jr., and Mrs. Tillie Washburn, for licenses to sell loft drinks were each read, and upon motion by Dallmaan, second by Amundsen, licenses were granted. Phe application of the Rochester Plumbing and Heating Company for a plumbers license was read, and upon motion by Hicks, second by Dallman, license was granted. ,:.,he plumbers license bond of the Rochester Plumbing R. Heating Company, with the National Casualty Company as surety thereon in the amount of �1,000.00 was read, and upon motion by Hicks, second by Dallman, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file. The following permits to place and maintain signs, were read, and upon motion by Vihstadt, second by Hicks, permits were granted: Northern Grocery, New Store, West End Beauty Shop, Golden Rod Cafe, J. A. Leiferman (2), Arthur West, W. F. Klee, Ginther Roper Company, Handy Store, Dr. Jacobs .(2), Earl Irish (2) '-Dr, J. E'. Crewe., -Ellis Motor Co.,C, R. Delaney, J. C'. Thompaon, Zierith Brothers. P Pursuant to conditions of a resolution heretofore passed and adopted, the following communication was -presented and read, and President Liddle ordered that the same be placed on file: "August loth, 1931. Gentlemen: Pursuant to the order and the authority vested in the resolution passed and adopted by your honorable body on July 27th, 1931, we have on this date issued warrant No.2353 drawn upon the Park Improvement Fund in the amount of .141533,10 payable to John J. A communication from Truscon Laboratories to Heffron Pc Fitzgerald, contractors. for the construction of the new Central Fire Station, relative to the cement floors In that building which are in need of repair, whs read, and President Liddle referred the same to the Fire Department Committee with request that they make report and recommendations thereon at the next meeting of this Common Council. The certificate of Edward Mattson as to his employees on the construction of curb and gutter on parts of Fifteenth Avenue Southwest and Sixth Street Southwest was read, and President Liddle ordered that the same be placed on file. The appointment by the Mayor of John T . Hong, Carlton Anderson and Joseph J. O'Connell, as Special Patrolmen in'the Police Department of said City, during the j period August 8th,1931, to August' 14th,1931, inclusive, was read, and President Liddle ordered that the same be placed on file. The following veto by the Mayor was read, and President Liddle ordered i the same placed on file: "August 8th, 1931. Honorable Members of the Common Council, City of Rochester, Minnesota. Gunt1eruen: I am returning herewith, without my approval, the resolution which .you passed and adopted fixing; a new date as 7:30 o'clock P.M., August 20th, 1931, for the opening of bids for the construction of a sludge bed at the local sewage disposal plant. According to press reports, Dr. Stromberg, and members of the Common Council, it seems to be understood that I am not secure in my claim that Dr. Stromberg told the members of the Comrnon Council and myself that for a cost of approximately '�-150.00 a division wall could be constructed in the present sludge beds that would expedite the sludge drying, whieh,I must contradict, as,I heard him say those words and saw him poitt out where the divialon wall should be placed. Apparently this new sludge bed is born from a suggestion made by the City Engineer when the conference at the sewage disposal plant broke up and the Aldermen and myself were returning to the Council meet- ; Q I . ing which was being held July 13th, 1031, when,the City Engineer suggested th9t what is really needed is an additional sludge drying bed, a discussion of which did not come up until after I had left the Council meeting, which I did not do until after I inquired as to whether there was going to be any further business transacted or not. After I left, thisadditional sludge drying bed proposition was put forward to secure an estimate of cost -as a basis for a•diseussion of the merrits as to whether the investment would warrant when considered against the benefits. At the meeting held July 27th, $his project was jammed through without a chance for the proper discussion of it, making it quite evident that the support for'it was formed outside the Council meting, in which connection I am serving this as a notice that duti_ng the balance of my administration projects that do not get the merited discussion over the Council TA,ble will receive my veto if they savor of being "railroaded" through. In closing, I Still waintain that this expenditure is unwarranted at this time as the new sludge bed would cost in the neighborhood of 140000.00 while Dr. Stromberg's scheme Gould be installed for around-150.00. A motion by Miller, second by Moody, that the above mentioned resolution be passed and adopted notwithstanding the '.layor's veto thereof carried by all voting in favor thereof. The claims of Peter Lynaugh 116,00, George Hines 122,95, and Paul Splinter 18.45, for cleaning debris from the Zumbro river ware read and upon motion by Hicks, second by Dallman, the said sums were appropriated from the General Fund and it was ordered that the said amountsbe paid to the persons mentioned for the services rendered. The following claims for cutting of weeds upon the properties mentioned were read and upon motion by Dallman,.secodd by Hicks, the appropriations were made from the General Fund and it was ordered that the amounts stated bg paid to the persons mentioned for the services rendered: Jack McGovern for cutting weeds on property of A .W .Kutzky .14.25 , Max Wyrembek '1'1.00,Jas. Honorable Mayor and Common Council: We the undersigned, parade Committee of the 13th Minnesota State American Legion Convention to here -with extend to you our invitation to appear as our guests in the para*e, at 2 p.m. Tuesday August 18th. Mark J. Wilson, Chairman, Al. Wilson. Ben Nyhus. Harold Crawford. C.B.Hanscom. it The claim of the Kruse Insurance Agency 1-02.68 for public liability and property damage insurance on the Whippet automobile in use of the Health Department was read and upon motion by Dallman, second by Amundsen, the said sum was appropriates from the General Fund and it was ordered that the same be paid to the firm mentioned for the purpose stated. The following recommendation was read and upon motion by Hicks, second by Vihstadt,the City Engineer was instructed to secure the necessary labor, materials, etc., and make the improvement mentioned -therein: " August 8, 1931 Hon. Mayor and Common Council Gentlemen: We, the Sewer Committee, beg to recommend that a surface drainage sewer be constructed in the south side of Second Street South- east, from a point five (5) ft, west of theeast line of Fifteenth Ave. Southeast, and eighteen (18) ft. north of the south line of Second Street Southeast to a point eighteen (18) ft, north and ten (10) ft, west of the northwest corner of Lot No. 11 of Sanderson's Second Addition; and that the Ci-by Engineer be ordered and directed to construct said surface -drainage sewer, together with two manholes, one to be on the east side eald one to be on the west side of the center thirty (30) ft. of Sixteenth Avenue Southeast, and that the same be done as soon as reasonably possible. The City Clerk asked for an expression of the Common Council as to whether or not it is their desire that the bills heretofore made against Saint Mary's Hospit for share in operation of the local sewage disposal plant be made an asset of the City of Rochester, Minnesota, by creating a ledger account against them for the A2796.12 total now accumulated for those services, that is, 1620,80 for the year 345 ending September 30th,1927, "�,645.54 for the year ending September 30th, 1928, 1,794.89 for the year ending September 30th,1929, and '1734.89 for the year ending?; September 30th,1930, but, no action was taken thereon except that President Liddle referred the matter to the City Attorney. !� ,( President Liddle at this time excused Alderman Hicks who left the Council Chambers. Alderman Miller introduced the following resolution, which was read "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the bid and proposal of Carl Jacobson & S.Lindgren for the furnishing of all labor, materials, tools, equipment,ete., necessary for the ,( furnishing, construction, equipping and installing of a sewage lift station on Lot 280 in Block 7, Sunnyside Addition, and the laying of connecting lines ' 1i leading; to it and from it, in accordance with the plans, profiles and speci- fications for the said improvements which are on file in the office of the City Clerk of said City, viz: Lift complete 7225,00 it 10" Pipe Sewer, per ft. 1.35 .i• 10 7, Manholes each 75.00 Pavement removed & replaced, per sq. yd. 4.00 Extra steel, per lb. .05 eonerete, per cu. yd. 10000 �j "p be and the said bid and proposal is hereby accepted. Upon motion by Vihstadt, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President 1 Liddle declared the said resolution duly passed and adopted. Upon motion by Vihstadt, second by Dallman, it was ordered that ( €. the certified checks of the unsuccessful bidders for the construction,etc. of the lift station and the laying of connecting lines be returned to them. Alderman Miller introduced a resolution granting public dance �i permit to the Rochester Voiture 327, 40 and 8, for the Armotg'August 18th, w. 1 1931, and fixing the fee at $5.00, which was read. j Upon motion by Dallman, second by Vihstadt, that the said �I resolution be adopted as read, and all voting in favor thereof., President !Liddle declared the said resolution duly passed and adopted. �I Alderman Moody introduced the following resolution, which was read: "BP it resolved by the Conunon Council of the City of Rochester, (Minnesota: That the sum of $254.36 is hereby appropriated and paidto the City of Rochester, Light and Water Department, $60.70 thereof being appropriated from the Lighting Fund and $173.66 thereof to be appropriated from the Park 347" Improvement Fund; the distribution of the 1173.66 being 115.48 for Maint. Kutzky Park, 1100.11 for Maint Tourist Park, 118.36 for Maint. Mayo Park, O'39.71 for Maint. of Sqldier Field Golf Course. j The Mayor and City Clerk are hereby authorized and directed to draw warrants upon the City Tre--,surer and make payment accordingly." Upon motion by Amundsen, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating 1207,81 from the General Fund and ordering payment made to the Rochester Water Department for water furnished for flushing and sprinkling, which was read. Upon motion by Vihstadt, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating 1128.62 from the. New City Hall Fund and ordering payment made to Junell, Oakley, Driscoll and Fletcher, for part payment of serviced in connection with the preparation, approval, etc., of the New City Hall bonds, which was read. Upon motioll- by Amundsen, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said l� resolution duly passed and adopted, I Alderman Amundsen introduced a resolution appropriating 1756.95 from the Parr i Improvement Fund and ordering payment made to the Tlayo Trust Fund for payrolls for labor during the period of the week ending August 7th,1931, which was read. Upon_1motdon by Miller, second by Amundsen that the said resolution be adcpt(d as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: `_i'h.at the sum of Three hundred thirty-three and 10/100 (A333.10) Dollars be and the same. is hereby appropriated from the General Fund and ordered paid to Leo N. Herrick as payment in full of one Harley Davidson Model 32 Motorcycle for the: Police Department of said City, which said sum, in addition to the delivery of the old 1927 Harley Davidson Motorcycle is to be accepted as payment in full for the new Harley Davidson machine. The Mayor and City Clerk of said City are hereby authorized and directed to draw a warrant upon the City Treasurer of said City in accordance herewith and cause said payment to be made and to transfer title to said old Harley Davidson motorcycle to Leo N: Herrick. " Upon motion by Miller, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolu- tion duly passed and adopted. I 11 Alderman Amundsen introduced a resolution appropriating 11,000.00 from t he General Fund,02,000.00 from the Street and Alley Fund, 11,000.00 r {! from the Sewer Fund and :�500.00 from the Brddge Fund for use of the Street I' and Alley Comvmittee, which was read. Upon motion by Miller, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed -and adopted. 'Alderman Vihstadt introduced a resolution appropriating 1.1i'234.16 from the Park Improvement Fund and ordering payment made to the Olmsted County Oil Company for gasoline; oil, kerosene, etc., furnished, which was read: Upon motion by Moody, second by Amundsen, thatthe said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution fixing 2:00 o'clock P.M. September 8th,1931, as the time for a hearing on and the levying of special assessments for the construction of'a sanitary sewer commencing at the center of the intersection of Eighth Street Southeast and Eighth Avenue Southeast, and running westerly along the center line of Eighth. Street Southeast for a distance of 168 feet, which was read. Upon motion by Vihstadt, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The follosi.ng recommendation was read, and President Liddle ordered that the same be placed on file: " August 10, 1931 Hon. 1.4ayor and CommonCouncil Gentlemen: The Street and Alley Committee and the City Enginet-:r recommend that the wood block pavement in Center Street East, from a point 104 ft. East of the West line of Sec.No.36- 107-14, to a' point 16=.'_ ft. " 0 34 .h 4 President Liddle referred the matter of the removal of the creosoted wood blocks on and the repaving with brick of Center Street East between Broadway . Street and Eleventh Avenue to the Street and Alley Co=ittee and the City Engineer, with instructions that they make report and recommendations at the next meeting of this Common Council. The City Engineer submitted plains, profiles,specifieations and estimate of cost for the removal of the creosoted wood blocks on and the repaving with brick of a }part of Center Street East. Alderman Dallman introduced the following resolution, which was read: "THEREAS, It is deemed expedient : ,nd necessary that the creosoted wood block pav" on part of Center Street East be removed and that the said part of Center Street East be repaved with 21 inch paving brick, and WIIEIIAS, The City Engineer has prepared and submitted plans, profiles, specifications and estimate of cost for the removal of the creosoted wood, blocks and for the repaving with 2-1 inch paving brick; , SO THEREFORE, Be it resolved by the Common Council ,of the City of Rochester, Minnesota: ! That the creosoted wood blocks be removed from that part of Center Street j Fast which lies between a paint 104 feet East of the West line of Section 36, Township 107 North, of Range 14 West,, to a point 164 feet West, and that the said part of Center Street East, be repaved with 21 inch paving brick, that the said plans, profiles and specifications be adopted for this improvement and that the same be placed 'on file. in the office of the City Clerk of said City and that the said estimate of cost be accepted and placed on fdle in the office of the City Clerk of I said City, and 1 Be it further resolved by the said Common Council: That sitht City Clerk of said City be and he is hereby authorized and directed to' advertise for sealed proposals for the furnishing of all labor, materials,, etc., necessary for the ! above described removal of creosoted wood blocks and repaving with 2-1 inch brick, wb.ich, sealed bids will be received and opened at a meeting, of this Common Council which is to be held at 7:30 o'clock P.M., on August 10th,1931.
