?Minutes of an adjourned rermlar meeting of the Common Council of the City
lof Rochester, ?,:Ainnesota, held in the Council Chambers, in the second floor of the
Chamber of Commerce building, at 7:30 o'clock P.M., on August 20th,1931.
Meeting called to order by President Liddle.
Roll Call, Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody,
jVihstadt, Absent: None.
Upon motion by Vihstadt, second by Moody, the minutes of the meeting held
on Au�gr st 10th,1931, .August 12th, 1931, and August 13th,1931, were each approved.
President Liddle announced thisas being the time and place fixed for
hearing on then -award made by the Commissioners in the condemnation and taking of
Lot 281, in Block 7, in Su nysideiAddition to the City of Rochester, for use as a
site for the construction of a sewage lift station thereon and them at,and asked if
there was any person present who wished to be heard concerning this award of damages.
There iias no person present who wished to be heard concerning the above
mentioned awar_1 of damages and the City Clerk reported that no written objections
to this report had been filed.
`Alderman Dallman introduced the following resolution, which was read:
"WIi1;It}�AS, Wright L. Toogood, John M. Norton, and Otto W. Riess, the
COi::n1iss loners appointed on July 6th,1931, in and by resolution of the Common Council
of the City of Rochester, Minnesota, to view the lands and preinises and to assess
the damages occasioned by the condemnation and taking by said City of Rochester,
Minnesota, for use of said City as a site for the construction of a sewage lift
station Viureon and thereat, the lands described in said resolution of appointment
being, to -wit: Lot Twenty-eight (28), in Block Seven (7), in Su-nnyside Addition to
the City of Rochuster, Olmsted County, Minnesota, and
0 RD,'AS, The City Clerk on July 31st, -1931, did publish a notice to all
persons interested in said lands, in the Rochester Morning Journal the official
newsn_ aper of said City, to the effect that said` report and award of damages had
been ma.du and filed as afores -�.id and unless written objections were made thereto
by persons interested in said lands, the eaid:,,report and award of damages would be
confirmed by the Common Comicil of said City of Rochester, Minnesota, at a meeting
of the said G:ommon Council to be held at 7:::50 o'clock P.M., on August 20th,1961, at
the Council Chambers in the second floor of the Chamber of Commerce building in said
City; and the said notice was published in the said newspaper for at least ten (10)
days prior to the date of said meeting held on August 030th,1961, and

and duly considered all objections offered and interposed by persons interested in
the said lands and duly considered the said report and the award of damages therein

Be it further resolved by the said Common Council: That there is
hereby apnroprie,ted from the Sewer Fund of. said City, the sum of h600.00
for payment to the heirs of i:?.tlek Berven, deceased, for the condemnation
and tal-ing of. Lot Twenty-einht, (26), in Block Seven (7), in Sunnyside Addi-
ti.on'to the City of Rochester, Olmsted County, Minnesota, and
Be it further resolved by the said Common Council: That there is
hereby appropriated from the Sewer Pund of said City the sum of 137,50 for
payment to said Commissioners for their services in the said mRtter and the
Mayor and City Clerk of said City are hereby authorized s,nd directed to draw
warrants upon the City Treasurer for the said sums and cause payments to be
made to the heirs of Atlek Berven, deceased, and to the said Commissioners."
Upon motion by Hicks, second by Vihstadt, that the said resolution
be adopted as read, and all voting in favor them; President Liddle declared
the said resolution duly passed and adopted.
Upon motion by Vihstadt, second by Moody, the City Clerk was
Instructed to bill the Rochester Morning Journal for $$7.50 being Commissioner's
services in making second notice of hearing after the Rochester Morning
Journal had made an error in the publication of the first notice.
The City Clerk reported that there had been no bids received for
the removal of the creosoted wood blocks on and the repaving with brick of
that part of Center Btreet East which lies between a point 104 feet east of
the west line of Section 36, Township 107 North; of Range, 14 West, to a point
164 feet west.
I; Upon motion by Vihstadt, second by Amundsen, the City Engineer was

i; authorized and directed to secure the necessary labor,materia:ls etc., and
it remove the creos&ted we od blocks from the above described part of Center
Street Fast and repave the same with two and one-half (21) inch paving brick
it in accordance with the clans, profiles and specifications for the removal
of the said creosoted wood blocks and the repaving with 2 inch paving brick.
('The City Clerk requested that record be made of the fact that up
to this time the Cit r Engineer had refused to return the original plan for
;i sludge bed No.;? st the local sewage disposal plant, which plan was adopted
(' July 27th.,19, and released to the City at the

same to St. Paul, Minnesota, for approval of the State Board of Health.

Engineer turned over to the City Clerk a plan purnort,dd� to be the one adopted July
27t]i,19':51, even though it has the imprint of the City Engineers preparation dated
Aut�,ust 10th,1931.
This being the time and place fixed for the opening of proposals for the
construction of sludge bed No.2 at the local sewarre disposal plant, the following
proposals were opened and read:

President Liddle referred the above quoted propos:;ls to the Sewer
Committee and the City Engineer for their tabulation and recommendations. �
Coi=unicat ions from the State Board of Control and from L. G. Foley, Jail
Inspector, approvint; the new City Hall and jail plans, were read, and the set of
�lans with their approval thereon was laid before the Common Council, and President
Liddle ord�rtd the said, couununications placed on file and that the approved plan

be placed on file.
1. A comm-inication from the Minnesota Department of Health, Division of

Sanitation approving the Sewage T,ift station plan and the plan for the sludge bed

No.2 at the local sewn-;e disposal plant, was read, and the approved sewage lift sta-
tion plan and a blue print of the slud�ne bed plan carrying their approval were laid
before the Coi;r,on Council and President Liddle ordered that the same be placed on
file; record bein7 hereby made that the sludge bed blue print was made from a
sketch. dated August 10th,1931 although the original plan for thj.s sludge bed was
adopted July 27th,1931.
Certain addenda to specifications for the new City Hall general contract
and to the specifications for the plumbing and heating in the said building prepared
by John McG.Miller,. architect, werelaid before" the Corafnon Council,and edbh`of:-:..
l �I the bidders being pres5nt,verification .,as made of the fact that each of them had

received a cony of this addenda before they submitted their bids.
Alderman Dallman introduced s, resolution adopting addenda dated
Au,,qust 14th,1931 , for the general contract specifications for the Wew
City Hall ds,ted July 15th,19:1, which refers to floors, caulking, beams,
aluminum, 71azing, to the exterior doors and vestibule doorp, wood mouliding �
and provides an alternate No.S as to acoustical treatment for certain
offices, which was read.
Upon moti..on by Vihstadt, second by Hicks, that the said resolution
be adopted as road, and all voting, in favor ;thereof, President Liddle
declared the said resoltiti.oA duly passed and adopted.
Alderman Hicks introduced a resolution adopting addenda No.2 for
general ,contract specifications for the new City Hall and. jail equipment,
dated July 15th,1931, which refers to eom:.,on brick as Alternate No.9, to
face brick, to steel wind ou guards, to garndge door, and to plaster, which was
read.
TJpon motion by Dallman, second by Amundsen, th-t the said resolu-
tion be adopted as read, and all voting in favor thereof, President t,iddle
declared the said resolution, duly passed and adopted.
Alderman Hicks introduced a resolution, ado-otin€? addenda Yo.1
dated Au,ryust 15th,1931, for the plumbing; and heating specifications for the
new,City Hall, which refers to the covering of concealed steam and return
risers, and to the welding of pipes, which was read.
Upon motion by Vihstadt, second by Dallman, that the said resolu-
tion be adopted as read, 9,nd 9,�1 voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Dallman introduced a resolution adopting; addenda No.2
dated August 19th,1931, for the plumbing and heating specifications for the
new City Hall, which refers to a change in the wording of paragraph No.28
which was read.
Upon motion by Doody, second by Amundsen, that the said resolution
be. adopted as read, and all voting in favor thereof., president Liddle
declared the said resolution duly passed and adopted.
This being the time and place fixed for the opening of proposals

Upon the decision as to which of the alternates were to be accepted in
each case, the Common Council returned to regular session and were called to order
by President Liddle as such.

Alderman Dallman introduced the following resolution, which was read:

Stoppel barn and South of the Fullerton Lumber Company property as a public
dumping grounds.
Besides being very unsightly it is a menace to health and property,
as to health from the unbearable stanch arising from the deeayin-r matter
which has been de posited there w,-ich attracts flies to crrry the ;rieans for
a possible epidemic, and as to a fire menace from the fact, that the lawn
refuse, stable manure, brush, paper boxes, etc., which are left there catch-
ing afire and jeopardizing that section of the City with. complete destruc-
t ion if a fire bra _d _should get to the gasoline storage tanks nearby, and
further from the underground burning which is going on at all times with
constant danger that it way strike a vein carrying a leak from one of these
tanks and be the means for a city-wide conf lagi•at ion by the flaming liquid
from axploded tanks carried on the surface of the Zumbro River •.
After your consideration of the situation we hops; that you will
place a s i,rict prohibition on the dumping of any refuse on the so-called
C.0.W.R.R.Co. dump, and if possiblL, require that the owners abate this
wnace by coverin,r; it, with dirt, gravel or s�..nd (not with cinders as that
would not cure the fire danger) . "
Upon motion by Vihstadt, second by Dallydan, the City Attorney was instructed
to serve a notice upon the Chicago Great Western Railroad Company that they shall at
once cover the F.o-culled Great Western dump with dirt to abate the fire menace there
(clot with ashes or cinders) and that he put out an order to all property owners in
that immediate locality that they shall not allow dumping of refuse on their premises.
