a Minutes of a special meeting . of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the second floor of the Chamber of Commerce building in said City, at 7:30 o'clock P.M., on August 31st ,1931. Meeting called to order by President Liddle. Roll call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Vihstadt. Absent: None. The call for the special.meeting was read; said meeting being called for the purpose of amending resolution awarding new City Hall painting and decorating contract, and consideration of changing exterior cut stone for new -City Hall to Winona stone, and any other business that the said Common Council might deem proper. Alderman.Hieks introduced a resolution a©nsdating to and approving j the change in grade of the streets along which the new trunk highway No.? !will pass, as shown on the profiles in blue prints for State project No.7-43, which was read. Upon motion by Miller, second by Moody, that the said resolution The adopted as read, and all voting in favor thereof, President Liddle 'declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution consenting to and approving the change in grade of the streets along which the new trunk highway No.59 will pass, as shown on the profiles in blue prints for State project No.59-27, which was read. Upon motion by Dallman, second by Amundsen, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, An error was made in the resolution passed and adopted August 20th,1931, awarding the painting and decorating contract to John Persson, doing business as the Standard Decorating Company., in that the award was for a total of $4706,00 arrived at by using the base bid of $4785,00 less a deduction of $79*00 for Alternate No.l, which was for the omission of the construction of the garage, which said garage is not to be omitted, and WHEREAS, It was the intention to have accepted the base bid of $4785,00 less alternate No.3, which alternate is for the deduction which would come through the use of acoustical treatment in the Council Chamber ceiling and such corridor ceilings as are specified for this treatment, making a total of $4581,00, 379 SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said resolution awarding painting and decorating contract for new City Hall to John Persson, doing business as the Standard Decorating Company, be and the same- is hereby amended to the effect that the base bid of $4785.00 is hereby 6:ccepted:. less:.$-204-,Q0 for .the use of Alternate No.3, which is .for the credit due through the use of acoustical treatment in the locations mentioned above, and the amount of the surety contract bond to be given by the said contractor is hereby fixed at the sum of 510.00 ." Upon motion by Vihstadt, second by Hicks, thatthe said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The application of Henry L. Sedenberg for license to peddle genuine imported Swedish J.33nens, table cloths, napkins, and towels, during the period September 1st9 2nd;.--!dnd 3rd, 1931, and September 17th,1931, to October 15th,1931, inclusive, was read and upon motion by Hicks, second by Amundsen, license was granted for the period mentioned at a total fee of $31.00. Garfield Schwartz, for G. Schwartz & Company, the contractors on the new City Hall construction, offered to make the change from Kasota stone for the exterior out stone to Winona stone for the exterior out stone for an additional cost of $1700,06, which oral proposal was later followed by a written proposal. The report of the Clerk of the Municipal Court for the week ending August '17th,1931, showing Municipal Court fines collected $205.18, civil fees received $10.85. court costs charged to Olmsted County $9,50, fines collected -due to Olmsted County $5,859 and fines collected and remitted direct to the State Treasurer i $110.00;for the week ending August 24th,1931, showing criminal fines collected $90.80 civil fees received 011,20, court costs charged to Olmsted County $6.50, fines collected due to Olmsted County $5.85, and fines collected and remitted direct to i State Treasurer $200,00; and for the week ending August,31st,1931, showing criminal i fines collected 144.15, civil fees received $10.05, Olmsted County local Municipal C.^urt fee^ collected for July in the amount of $63,65, Court costs charged to Olmsted County $12.85, fines collected due to Olmsted County $11.20, and fine s collected and remitted direct to State Treasurer $100,00, were each read, and President Liddle referred the same to the City Attorney. Upon motion by Vihstadt, second by Dallman, the sum of $22.80 was appropriated from the Gener-1 Fund and it was ordered that the said sum be paid to Olmsted County, Minnesota, for local Municipal Court fines collected due to Olmsted County. 8U The following veto by the Mayor was read: " August 25, 1931. Honorable Common Council City of Rochester, Minnesota. Gentlemen: I return herewith without my approval the resolution passed and adopted by your Honorable Body - on ,August 20th,1931, awarding the contract for the construction of sludge drying bed No.2 at the local sewage disposal plant, which I veto for the reason that I believe this expenditure is not warranted at this time when consideration is taken of the fact that Dr. Stromberg has stated that a 1150,00 investment would take care of this feature of sewage disposal forpossibly a couple of years, and further because I do not think that this improvement should be made until an intelligent survey is made of the surface drainage and sanitary sewer systems' needs, v&ich of course would include plans for sewage disposal plant enlargement if such is necessary. Rdspeetfully submitted, Julius J. Reiter Mayor of said City. " Upon Upon motion by Hicks, second by Vihstadt, and all voting in favor thereof, the said resolution mentioned in the above veto was duly passed and adopted notwithstanding the Mayor's veto thereof. The following veto was read: "August 25 ,1931. Honorable Common Council, City of Rochester, Minnesota, Gentlemen: I return herewith without my approval the resolution passed and adopted by your honorable body August 20th,1931, authorizing the City Engineer to provide for the hauling of approximately 2000 cubic yards of earth excavation from the sludge drying bed No.2 excavation at the sewage disposal plant to Sixth Street Southwest, which veto is made for the reason that I have vetoed the resolution which would require this excavation through the award of a contract to Wm. C. Fraser & Son for the construction of the sludge bed mentioned. Respectfully submitted, Julius J. Reiter Mayor of said City. " Upon motion by Vihstadt, second by Miller, and all voting in favor thereof except Alderman Hicks, who voted "Nay", the resolution mentioned in the above quoted veto was duly passed and adopted notwitb.etanding the Mayor's veto thereof. mi►e following proposal of 0. Honorable Mayor and Common Council, j City of Rochester, Minnesota. t Gentlemen: We, the undersigned, hereby agree to furnish Winona Stone for the New City hall building in Rochester, Minnesota, in accordance with the specifications for the base course, and in place of the Kasota Stone above the water table as bid at an increased price and cost to the City of Rochester of Seventeen hundred ($17Q0.00) Dollars. " The application df Charles Bemel and Nathan Bemel, doing business as Bemel Brothers, for license to engage in the business of buying and collecting junk in the City of Rochester, Minnesota, and to use five (5) vehicles in the conduct of such business, being four (4) automobiles and one horse-drawn wagon, was read, and upon x4tion by Hicks, second by Dallman, license was granted at a fee of ,22.00,for the license applied for. The license bond of Bemel Brothers covering their license for buying and collecting of junk, with the Gaammereial Casualty Insurance Company, as surety thereon in the amount of $1000.00,was read, and upon motion by Hicks, second by Vihstadt, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. i the application of Curtis E. Hammer for a public dance permit at the Woodman Hall, September 3rd,1931, was read. i Alderman Amundsen introduced a resolution granting public dance permit i to Curtis E. Upon motion by Vihstadt, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The following spplieations for permits to place and maintain signs, were each read, and upon motion by Dallman,,second by Amundsen, permits were grantedt Rommel-Hotel,Pruett's Star Laundry, Chicago Great Western Railroad Co., F.W.Cowan, �1( u er' Sewald Bakery, Ckayton Hotel, Shell Petroleum Corp. (4), Phillips Petroleum Corp (2), F. A. Schuchard, H. Drosos, Stevens Store, Pete Rasmussen. The application of Cleve Johnson for a soft drink dealer's license at 1311 Broadway Street North, was read, and upon motion by Vihstadt, second by Moody, license was graht.ed. A �400.00 State of Minnesota, Highway check,drawn in favor of the C{.ty of Rochester, for the award of damaged in the taking of City Farm lands for the new routing of Trunk Highway No.20, was laid before the Common Council, and upon motion by Hicks, second by Vihstadt, it was ordered that this check be accepted and placed in the City Farm Fund in the City Treasury of said City. E ,mployment certificate made by the ,D mevan Construction Company showing their employees on the new boiler installation at the electric light plant, was read, and President Liddle ordered that the same be placed on file. The petition of Mrs. Ambrose Kelly, asking that a sanitary sewer be constructed and a water main laid in Eleventh Street Southeast between Third Avenue Southeast and Fourth Avenue Southeast, and in Fourth Avenue Southeast between Tenth Street Southeast and Eleventh Street Southeast, was read and President Liddle ordered the same placed on file. Blue prints showing proposed aerial and underground rearrangement of telephone distribution system in the alley between Broadway Street North and Broadway Street South, and First Avenue Northwest and First Avenue Southwest from First Street Northwest to Third Street Southwest, on account of the proposed steam heating line to be installed in the alley, being Tri-State Telephone & Telegraph, Company estimate No.3384, was laid before the Common Council, and upon motion by Moody, second by Amundsen, the said rearrangement was authorized,and the City Clerk was authorized and directed to endorse the said blue print accordingly. The official bond of Peter S. Mackey,as Secretary of,the Firemen's Relief Association, with the Aetna Casualty & Surety Company as surety thereon in the amount of $200.00, was read, and upon motion by Vihstadt, second by Moody, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. The application of George F. Strifert, Sanitary Inspector for a .ton day vacation starting September Sth,1931, was read, and upon motion by Moody, second by Vihstadt.; the vacation applied for was granted. Hong, Carlton nderson and Merlin Mewhorter, as Special Patrolmen for the period August 26th, to ptember 1st, 1931, inclusive, were each read,and President Liddle ordered that the same be placed on file; The following ruling by the City Attorney was read and President Liddle ordered the same placed on file: " City Attorney's Office CITY OF ROCHESTER,MINNESOTA ,James T.Spillane,City Attorney August 28th,1931 Mr. A.F.Wright, City Clerk, Rochester, Minn. Dear Sir: Under a recent ruling of the Attorney General's office, a copy of which is hereto attached for your convenience, I am of the opinion that it is no longer necessary for you, as City Clerk, to countersign any orders drawn on the Treasurer of School District No.8 of Olmsted County, Minnesota. Very truly yours, James T . Spillane City Attorney."' The following receipt for payment in full of the matter of Dale Conners, claim against Wm. R. Jones, City Scavenger, wherein Conners claimed $44.00 as being due him, which when he came to make sworn statement of the acoount was reduced to 038.00, was read, and President Liddle ordered the same placed on file: " Rochester, Minn Aug-22-1931 Re'cd of Wm. R. Jones $5.00 payment in full for labor. E. H. Conner. " The City Clerk reported that a $72;15 judgment had been taken by the City Justice court in the garnishment made by W. R. Liddle against the Rochester Morning Journal and the City of Rochester,,Minnesota, garnisheeing the $172*67 appropriation made at the meeting of August 14th,1931, and upon motion by Hicks, second by Dallman, '.. it was ordered that the warrant for 9�172,67 be cancelled and returned to the City 384 treasury and that a warrant for $72.15 be drawn in favor of J. W. Anderson, f City Justice for the judgment mentioned, and that a check for the $100.52 i �{ difference be drawn payable to the Rochester Morning Journal. Upon motion by Miller, second by Amundsen, it was ordered that the following rates per front, foot be used for assessing sprinkling .servioes which havel.,been added since the regular order for the 1931 sprinkling: Sixth Avenue Southwest between Ninth Street Southwest and 100 feet North of the North line of Eleventh Street Southwest, $.0345 per front foot; Second Avenue Northwest, from Tenth Street Northwest to Thirteenth Street northwest 0.03205 per front foot; Twelfth Street Northwest, from Broadway Street North to Second Avenue Northwest, $.03205 per front foot; Sixth Street Southwest from 300 Peet East of Fourteenth Avenue Southwest to the east line of Flathers' Addition 0.02958 per froutfoot; Eighth Street Northwest from Second Avenue Northwest to Fourth Avenue Northwest $.02465 per front foot; Ninth Street Northeast, between Broadway Street North and Second Avenue Northeast $.01972 per front foot. Informal instruction was given to the City Clerk that the estimate for the Oetober,1931, sprinkling, flushing and treating shall be the months average for the six months prior to October 1st ,1931. The City Clerk was informally instructed to use the same deprecia- tion rate ftr*machinery;_ 3n tht 1931 toot i-st at emeit, as was used in the 1930 sprinkling costs. The City Clerk was instructed to include the cost of the inlet construction on Fifteenth Avenue Southwest in the curb and gutter costs for that Avenue. An estimate prepared by the City Engineer in favor of Kris Nielson showing the sum of $346.57 as being due the said contractor for the grading of Fifteenth Avenue Southwest from Sixth Street Southwest to Seventh Street Southwest, " estimate prepared by the City Engineer in favor of Magnus j Augustson -showing the sum of $1756,65 as being due the said contractor for i the paving of the alley running, North and South across Block 25 in Head & McMahon's Addition, and an estimate prepared by the City Engineer in favor of Edward, Mattson, showing the sum of $903,19 as being due Edward Mattson Por the construction of curb and gutter in part of Sixth Street Southwest land FifteentIg Avenue Southwest, were each read,and President Liddle ordered ;i 11 that the same be placed on file. 385 . Upon, motion by Hicks, second by Vihstadt, the sum of $25.00 was appropriated from the General Fund and it was ordered that the said sum be paid to Nellie Maher i for damage to clothing on account of fall on loose plank on Bear Creek bridge July 7th,1931. The claim of Ruth Bernard $42,00 for Public Liability, property damage and fire insurance on the 1930 Dodge truck, was read, and President Liddle referred the same to the Insurance Committee. Alderman Miller introduced a resolution appropriating $824,35 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payroll for, labor•during the week ending August 21st,1931, which was read. Alderman Vihst.adt introduced a resolution appropriating .1903,19 from the Permanent Improvement Revolving Fund and ordering payment made to Edward Mattson, for the construction of curb and gutter on parts of Fifteenth Avenue Southwest and Sixth Street Southwest, under Job 1648, which was read. Upon motion by Voody, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the t said resolution duly passed and adopted. i Alderman Vihstadt introduced a resolution appropriating $1756.65 from the i Permanent Improvement Revolving Fund and ordering payment made to Magnus August -son, i for the paving of the alley rmning North and South across Block 25 in Head & McMahon"s Addition, under Job No.1564, which was read. Alderman Dallman introduced a resolution appropriating $346;.57 from the Permanent Improvement Revolving Fund and ordering payment made to Kris Nielson for the final payment on grading of Fifteenth Aveme Southwest, from Fifth Street Southwest to Seventh Street Southwest, under Job 19o.1647, which was read. Upon motion by Vihstadt, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced the following resolution, which was read: "Whereas, it appears from all available information in the matter that the City of Rochester, Minnesota, as well as other municipalities throughout the State are being required to pay a higher rate for telephone service than is r(Jagonable, legal and proper,, and; I � Where,as, it appears that there is not sufficient money in the hands of the Railroad and Warehouse Commission of the State of Minnesota to cause a proper survey and valuation to be made in the said City of Rochester in order that a fair and just j; rate for the said service may be ordered by the said Commission, and; Whereas, the Common Council of the City of Rochester cannot legally appropriate funds for the purpose of having the said valuation made, and; Whereas, the subscribers in the City of Rochester now are, and for many years past have been, paying a rate for in excess of what is proper and legal considering the amount of the investment of The Tri-State Telephone and Telegraph Company in the said City of Rochester, and; Whereas, The Common Council of said City of Rochester deems it expedient i and necessary that a survey and valuation of the Tri-State Telephone and Telegraph Company properties in the City of Rochester, be made without further delay. 0 Therefore, Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That said Common Council does hereby officially call the atten- tion of the Honorable Floyd B. Olson, Governor of the State of Minnesota, to the said above described situation and conditions and request him to take such steps as $fit may consider fit and proper for the purpose of having the necessary funds for the said purpose made available without delay. Be it further resolved by said Common Council: That the City Clerk of said City be and 1v is hereby ordered and directed to forward to the Honorable Floyd B. Olson, Governor of the State of Minnesota, a certified copy of this resolution." Upon motion by Moody, second by Vihstadt, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution fixing 7:30 o'clock P.M., September 14th,1931, as the time for a hearing on the construction of a �) sanitary sewer commencing at a point on the center line of Eleventh Street fI Southeast, nine (9) feet east of the east line of Third Avenue Southeast and running thence easterly to the center of the intersection of Fourth Avenue Southeast and Eleventh Street Southeast and running thence northerly' along the center line of Fourth Avenue Southeast to a point dorty-two (42) feet south of the south line of Tenth Street Southeast, and the laying of a water main in the said parts of Eleventh Street Southeast and Fourth Avenue Southeast, which was read. Upon motion by Hicks, second by Vihstadt, that the said resolu- tion be adopted as read, and all voting In favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution fixing 7:30 o'clock P.M., Sept ember 14th 11931, as the time for a hearing on and the levying of special assessments for the cost of the paving of the alley running North and South across Block 25 in Head & McMahon's Addition to the City of Rochester, Minnesota, to a width of eighteen (18) feet with seven (7) inch one course steel reinforced/concrete, which was read. Upon motion by Vihstadt, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adWed. Alderman Moody introduced the following resolution, which was read: "WHEREAS, It is deemed expedient and necessary that the creosoted wood blocks on Center Street East, between the east line of Broadway Street North and Broadway Street South and the east line of Eleventh Avenue Northeast and Eleventh Avenue Southeast, be removed and that the said part of Center Street East be:'repaved with 22 inch paving brick,, excepting that part of Center Street Vast which lies between a point 104 feet east of the west line of Section 36, Township 107 North, of Range 14 West, to a point 164 feet West, and AREAS, The City Engineer has prepared and submitted plans, profiles, specifications arid estimate of cost for this improvement, SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota, that the creosoted wood blocks be removed from Center Street East between the east line of BroadwayStreet North and Broadway Street South and the east line of Y Eleventh Avenue Northeast and Eleventh Avenue Southeast, excepting that part of Center Street East which lies between a point 104 feet east of the west line of Section 36, Township 107 North, of Range 14 West, and that the said part of Center Street East bE; repaved with * inch paving brick, and the said plans, profiles, and specifications are hereby adopted for this improvement and it is ordered that the same be placed on file in the office of the City Clerk of said City, and the said estimate of cost is hereby accepted and it is ordered that the same be placed on file in the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of ii said City, be and he is hereby authorized. and directed to advertise for sealed proposals for the furnishing of all labor, materials, equipment, tools, etc., 11 necessary for the above described removal of creosoted wso4 blooke and repaving with 2-� inch paving brick in accordance with plans, profiles and specifications for the „ said improvement, which sealed bids will be received and opened at a melting of this it !! Common Council which is to be held in the Council Chambers in the second floor of the Chamber of Commerce building of said City at 7:30 o'clock P.M., on September 14th, 1931, Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which check and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the if bidder upon the letting of the contract to him shall fail to enter into the contract �i so let; the said Common Council reserving the right to reject any and all bids. I i A surety bond written for the full amount of the contract by a surety ill company authorized to do business in the State of Minnesota, will be rgquired with the contract. (Personal bonds not to be accepted,) All proposals must be addressed to Mr. A. F. Wright, City Clerk of Rochester, Minnesota, and shall have endorsed thereon "Proposal for removal of creosoted wood blocks and repaving with brick of part of Center Street East"," I Upon motion by Hicks, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. �199 U Upon motion by Vihstadt, second by Moody, the City Engineer was Instructed to take up one strip of creosoted wood blocks along each side of the paving on Fifth Street Southwest; between First Avenue Southwest and Second Avenue Southwest and fill the space with paving pitch as an experiment to see whether this will keep the wood blocks from buckling. Upon motion by Hicks, second by Dallman, the Common Council adjourned. p City Clerk.
