Minutes of a r4galar meeting of the Common Council of the City of
IRochester, Minnesota, held in the Council Chambers, in the second floor of the i
Chamber of Commerce building, in said City, at 2:00 o'clock P.M., on September 8th,

Meeting called to order by President Liddle,
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody,
jVihstadt. Absent: ,None.,
Upon motion by Vihstadt, second by Miller, the minutes of the meeting
hold on August 20th,1931, and August 31st,1931, were each approved.

President Liddle announced this as being the time and place fixed for
the, hearing on and levying of special assessments for the construction of a sanitary t
sewerfaeommencing at the center of the intersection of Eighth Street Southeast and

Eighth Avenue Southeast and running westerly along the center line of Eighth Street
Southeast for a distance of 188 feet and asked if there was any person present who
wished to be heard concerning this improvement.
There was no person present who wished to be heard relative to the above.

President Liddle arnounced this as the time and place fixed for the

Avenue Southwest to an established grade line betteen the south line of Sixth
Street Southwest and the North line of Seventh Street Southwest, if extended, and
asked if there was any person present who wished to be heard concerning this

President Liddle announced this as being the time and place fixed for a

Street Southwest to the North line of Sixth Street Southwest,' and asked if there
was any person present who wished to be heard eoncer ring this improvement.
Were was no person present who wished to be heard relative to the
above described curb and gutter.
The following supplemental estimate made by the City Engineer was read, and
President Liddle ordered the same placed on file:

Upon motion by Hicks, second by Vihstadt, United States Court Commissioner
Oscar C. Ronken was granted the prizilege of using the Municipal Court room for
pederal court hearings when it does not interfere with local Municipal Court or City
Justice business.
Marshall N. Broom made remonstrance against the assessment laid against
his property on Fourth Street Southeast for scavenger service, stating that such
service has not been rendered, and upon motion by Moody, second by Amundsen, the

City Clerk was instructed to request .of George F. Strifert, Sanitary
Inspector, and Wm. R..Jones, City Scavenger, that they be before the next.
meeting of this Common Council with An explanation of why this charge
for scavenger service had been made.
i Captain Louis J. Claude, stated that the Parent -Teachers Associa-
tion of the Lincoln School and the Parent -Teachers Association of the
Hawthorne School had asked for "Stop" signs to be placed around these
schools, which request President Liddle referred to the Street and Alley
C omaiitt ee .
The report of the Milk Inspector for the months of .Juile, July

and August,1931, was read, and President Liddle ordered the same placed on
file.,
The report of the Building, Electrical and Plumbing Inspector
for the month of August.1931, showing Building Inspection fees collected
in the amount of $58.00, Oleetrical inspection fees $13,75, and plumbing
inspection fees $3.25, was read, and President Liddle referred the same
to the Finance Committee.
Upon motion by Miller, second by Moody, the sum of $3.25 was
appropriated from the General Fund and it was ordered that the same be
paid to Don E. Postier, for extra pay as Plumbing Inspector in accordance
with the provisions of a resolution heretofore passed and adopted.
The report of the City Engineer for the month of August 1931,
showing the sum of $686.23 as having been expended from the General Fund for
labor, $1466.92 from -the Street & Alley Fund,$177.20 from the Sewer Fund and
4392.65 ftom the Bridge Fund, was read, and President Liddle ordered the
,same placed on file.
The report of the City Treasurer for the month ending August 31st,
1931, showing the sum of $361459 *75 as being on hand at that time, was
' read, and President Liddle ordered the same placed on file.
The application of M. W. Alexander for a plumber's license was
read, and upon motionby Hicks, second by Vihstadt, license was granted.
The application of Maass & McAndrew Company for a plumber's
license was read, and upon motion by Vihstadt, second by Amundsen, license

was granted.
The plumber's license bond of Maass a! McAndrew Company, with the
!� National Surety Company, as surety thereon in the amount of $1,000.00,was
read, and upon motion by Vihstadt, second by Moody, the said surety was
accepted, the said bond was approved, and it was ordered that the same be

The plumber's license bond of M. W. Alexander, with the Fidelity &
Casualty Company of New York as surety thereon in the amount of $1,000000, was
Iread.,and upon motion by Moody, second by Amundsen, the said surety was accepted,
it the said bond was approved, and it was ordered that the same be placed on file.
The application of J. C. Adams, for a transfer of taxicab license No.22
now covering a Yellow 5 passenger sedan, to a 7 passenger Buick sedan, was read, and
upon motion by Vihstadt, second by Moody, transfer was granted.
The following communication and recommendation was read, and upon motion by

We are enclosing a copy of the minutes of the meeting of a
Committee appointed to study the question of relief of the unemployed
and needy of Rochester, and the feeding of transient needy.

We relieve that if the plan outlined is adopted it will
save considerable money for the City and the citizens, by eliminating
a duplication of this work. We feel that the plan merits the 30 day
j, trial suggested and hereby submit it for your approval. !

I� A meeting of the Committee appointed to study the question of relief to the
! needy of Rochester and the feeding of transients was held Wednesday evening
September 2nd with the following men present:

On motion by Mr. Spillane seconded by Mr, Dabelstein the following plan
'I was recommended for adoption: -
For a period of thirty (30) days starting Wednesday, September 9th all
transients asking for meals or a place to sleep shall be taken care of at

!� the Salvation Army. However, the person asking aid must register at the
'i Police Department, where he will receive a card which will entitle him to
j a nights lodgeing and one meal. This card must be presented to the Salvation
is
Army, and the City of Rochester shall re-imburse the Army 15� for each meal
{i served to holders of cards. The citizens of Rochester are requested not to i
give meals to persons that solicit at homes, but to advise these
persons that they may receive a meal at the Salvation Army by
'registering and getting a ticket from the Police Department. In
cases where a person registers at the Police Department and has
funds, the Police areto make an effort to collect for the ticket.
The Committee wishes to ask the Police Department to stop all
` begging or panhandling on the streets, and to ask all persons
that are solicited to refer these men to the Police Department
where they may receive a card entitleing them to a meal.

The question of establishing a wood -pile was discussed and on
motion by Mr. Spillane seconded by Mr. Sehlitgus it was decided
to defer action on this matter for thirty (30) days.

j 14 Upon motion by Miller, second by Hicks, the City Engineer was
I I authorized to buy 500 yards of fill at ten cents per cubic yard leveled
off on the intersection of Fourth Avenue Northwest and Eleventh Street
Northwest, and Kris Nielson was authorized to grade Eleventh Street
i
j� Northwest to an established grade between Fourth Avenue Northwest and the
alley next West, which grading shall be done under supervision of the City
Engineer.
The report of the Clerk of the Municipal Court for the.week
ending September 7th,1931, showing criminal fines collected $64.80, civil
fees received $,25, court, costs charged to Olmsted County $15.50, fines
collected due to Olmsted County $6,20, and fines collected and remitted -
direct to the State Treasurer $20.00, was read, and President Liddle
referred the same to the City Attorney.
Upon motion by Vihstadt, second by Miller, the sum of $6.20 was
appropriated from the General Fund and it was ordered that the said sum
be paid to Olmsted, Copnty, Minnesota, for local Municipal. Pourt fines
collected due to Olmsted County.
The following communication was read, and upon motion by Vihstadt,

second by Hicks, C. H. Ellison , Justice of the Peace of•the Second Ward,
was appointed City Justice during the absence of J. W. Anderson, for the
period ending October lst,1931, subject to correction :of this appointment
if the Mayor, by law, is charged with making the appointment:

The following copy of resolution passed and adopted by the Public Utility
Board, was read, and President Liddle ordered that the same be placed on file:
'IBe it and it is hereby resolved by the Public Utility Board of the City
of Rochester, Minnesota that the •Hon. Common Council of the said City be and is
hereby requested to authorize the said Board to enter into a contract with the
Rochester Plumbing and Heating Company of the said City for the furnishing of all
pipe, materials, labor and equipment necessary for the installation of certain
laterals to steam heating line in accordance with specifications and.with their bid
dated Septvi 4th 1931 and in accordance with the schedules of quantities also
stipulated in said specifications at the following unit prices; -

Gentlemen:
In connection with the operation of the "Lower Mill" the -
Public Utility Board ask your consideration and opinion as to the
advisability of discontinuing its operation and demolishing the
structure with a view of selling the building and the machinery
therein.
This mill has been operated by the City since its acquirement
through the purchase of the Rochester Milling Company property in North
Rochester and was operated at a profit for a considerable period of time.
In the meantime, however, three private concerns have started in this
business and the mill has been operated at a loss for some time.

The appointment by the Mayor of Joseph J. O'Connell, as Special
Patrolman from September 7th,1931, to September 13th, 1931, inclusive, and
the appointment of John T..Hong, Carlton Anderson, Merlin Mewhorter, C.B.
Hanscom, and S. A. Boelter as Special Patrolmen from September 3rd,1931,
to September 9th,1931, inclusive, were each read, and President Liddle
ordered that the same be placed on file.
Upon motion by Miller, second by Moody, the Public Utility Board
were authorized to wreck the so-called "Lower Mill" and to fill the Mill
pond, subject to formel authority to be obtained prior to contract.
The following communication was read, and President Liddle ordered
that the same be placed on file:

Proposal made by the Engineering Service of St. Paul, Minnesota,
for a survey of the Interstate Power Company's local gas plant system, was
read, and President Liddle ordered that the same be placed on file:
An employment certificate made by Eugene Schwarz, Superintendent
of the Water Department, showing the Employees on the building being
constructed at the pumping station, was read, and President Liddle ordered
that the same be placed on file.
Upon motion by Hicks, second by Moody, the Chair was requested to
appoint a Committee for conference with the Chamber of Commerce committee
relative to the registration of unemployed persons within the City of
Rochester, Minnesota, for report thereon at the meeting of this Common

Council which is to be held September 14th,1931, and President Liddle accordingly
appointed Alderman Hicks, Miller and Moody, and the City Clerk as members of such
committee, with request that the Mayor also serve. ,
A•request from the City Engineer that $2000,00 be appropriated from the
I Street and Alley Fund for use of the Street and Alley Committee was read, and
President Liddle ordered that the same be placed on file.
Upon motion by Dallman, second by Amundsen, the sum of $96.02 was appro-
�priated from the Joslyn Clock Fund and it was ordered that the said sum be paid to
the New City Hall Fund to apply on the cost of the electric clock to be placed over
the main entrance to the New City Hall..
Upon motion by Hicks, second by Miller, the -sum of $50.00 was appropriated
from the General Fund, and- it was ordered that the said sum be paid to the, League of
Minnesota Munic ipal-ities as League dues for the year ending August 31st,1932.

The City Engineer submitted plans, profiles and specifications and estimate
of cost for the replanking of the bridges on Fourth Street Southeast over the
Zumbro River and over Bear Creek, with asphalt plank, which were considered by the
Uommon Council.

Alderman Hicks introduced a resolution adopting the above mentioned plans,
profiles and specifications for the resurfacing of the Fourth Street Boutheast
bridges over the Zumbro River and over Bear Creek, with 12 inch asphalt plank and
ordering advertisement for bids to be opened at 7:30 o'clock P.M., September 21st,
1931, which was read.
Upon motion by Vihstadt, second by Miller, that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the said f
resolution duly passed and adopted. b

Alderman Miller introduced the following resolution, which was read:

"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the Public Utility Board be authorized to enter into contract with
;;the Rochester Plumbing 19nd Heating Company of Rochester, Minnesota, for the furnishing
'.!of all pipe, materials, etc., necessary for the installation of certain laterals
running from the main steam heating line in accordance with the resolution of request
!ifor authority made by the said Board and ,quoted as follows:
'Be it and it is hereby,resolved by the Public Utility Board of the City

Heating Company being the lowest responsible bidders.'
Be it further resolved by the said Common Council: That the
amount of the surety contract bond to' be given by the said eonttactor is
hereby fixed at the sum of $9690.00, and ,
Be it further resolved by the said Common Council: That the
authority for expenditure on this certain improvement does not extend
beyond 5�9685.50,' and that the construction, etc., shall be made' and done'
at the locations set forth in the specifications for this project with
due exception given for _the ten (10) probable additional laterals
undetermined when the specifications were drawn and for the six (6)
prospective additional laterals undetermined at the time the specifica-

Upon motion by Dallman, second 'by Amundsen, that the said
resolution be adopted �sread, and all voting in favor thereof , President
Liddle declared the said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $2000.00
from the Street and Alley Fund for use of the Street and Alley Committee,
which was read.
Upon motion by Vihstadt, second by Hicks, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Vihstadt introduced the following resolution, which was
read:
"Be tt resolved by the Common Council of the City of Rochester,
Minnesota:
That the sum of <$253,08 is hereby appropriated and paid to Dodge
Lumber & Fuel Company, for lumber, cement, etc., furnished.during August,
1931, per sworn billing made under date of September,2nd, 1931; $1.25 to
be from the Sewer Fund for 15th Ave .S.W.inlet; and $43.64 thereof to be
from the Street and Alley Fund, 39.00 for cement to Stock and %,, .64 for
barricades; and $196.34 to be from the Bridge Fund $126.34 for Jab 1651
and $70.00 for Bear Creek bridge; and .$11.85 from the General Fund for
Masonite, etc., for Police Dept,
The Mayor and City Clerk are hereby authorized and directed to
draw warrants upon the City Treasurer and make payment accordingly."
Upon motion by Miller, second by Amundsen, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle

Alderman-'Vihstadt introduced a resolution appropriating 131,92 from the i
Permanent Improvement Revolving Fund and ordering payment made to Kris Nielson for
supplemental final estimate on the grading of a part of Fifteenth Avenue Southwest
under Jab No.1647,which was read.
Upon motion by Amundsen, second by Moody, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Hicks introduced a resolution appropriating 1237,32 from the
Park Improvement Fund and ordering payment made to Olmsted County Oil Company for
the furnishing of gasoline, kerosene_, etc., which was read.
Upon motion by Hicks, second by Amundsen, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Hicks introduced a resolution appropriating %Z7,51 from the
General Fund and ordering payment made to the City of Rochester, Water Department
for water furnished for

and sprinkling, which
was read.

Alderman Dallman introduced a resolution appropriating $858,40 from
the General Fund and ordering payment made to C. C. Pagenhart for labor and materials;
moving and reinstalling the city scales under the Mayor's emergency authorization,
which was read.
Upon motion by Hicks, second by Moody, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Hicks introduced a resolution appropriating $746,19 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payroll
for labor during the week ending Sel)tember 4th,1931, which was read.
Upon motion by Hicks, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, except Alderman Miller, who
voted "Nay", President Liddle declared the said resolution duly passed and
adopted.
Alderman Vihstadt introduced a resolution levying special assessments for
the construction of a sanitary sewer commencing at the center of the intersection of
Eighth Street Southeast and Eighth Avenue Southeast, and running westerly along the
center line of Eighth Street Southeast for a distance of 188 feet, which was read.

Alderman Miller introduced a resolution levying special assess—

appropriated from the General Fund and it was ordered that the said sum be
paid to J. J. Reiter, Mayor, as advance for expenses of trip to a meeting
of the Municipal Ownership League of Americai}Oetober 1st, 2nd, 3rd, and 4th,
19319 at Los Angeles, California.
Upon motion by Miller, second by Amundsen, the City Engineer was
authorized and directed to secure the necessary 'labor, materials, etc.,
and change the curbing and paving radius ftc:thd:18outhwest and Southeast
corners of the intersection of Fourth Street Southeast and Third Avenue
Southeast.back to the sidewalk line.
Upon motion by Dallman, second by Hicks, the Common Council
adjourned to 7:30 o'clock P.M., on September 14th,1931.
