Minutes of an adjourned regular meeting of the Common Council of the i
City of Rochester, Minnesota, held in the Council Chambers, in the second floor of

the Chamber of Commerce building iih said City, at 7:30 o'clock P.M., September

Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody,

President Liddle announced this as being the time and place fixed for
,
a hearing on and thg levying of special assessments for,the paving of the alley
i
running north and s out h across Block 25 in Head & McMahon' s Addition, to the City
i
of Rochester, Minnesota, to a width of eighteen (18) feet with seven (7) inch steel
i
reinforced one course concrete, and asked if there was any person present who
wished to be he Nrd concerning tktis improvement.
There was no person present who wished to be heard relativdnto".the above
described'improvement .
President Liddle announced this as being the time and place fixed for a
hearing on the construction of a sanitary sewer commencing an the center line of
Eleventh Street Southeast,nine (f) feet east of the east line of Third Avenue South -
least and running thence easterly to the center of the intersection of Fourth Avenue
Southeast , and Eleventh Street Southeast, and running thence northerly along the

center line of Fourth Avenue Southeast to a point forty-two (42) feet south of the
south line of Tenth Street Southeast, and that a water main be laid in the s&id parts
of Eleventh Street Southeast and Fourth Avenue Southeast, and asked if there was any
person present who wished to be heard concerning this proposed improvement.
There was no person present who wished to be beafd concerning the said
sanitary sewer. or water main.
This being the time and place fixed for the ,ope4ing of proposals for the j

removal of creosoted wood blocks on and the repaving with brick of a part of '
Canter Street East, that is,between Broadway Street North and South and Eleventh

Avenue Northeast and Southeast, the following bids were opened and read:

,labor and materials except paving brick $11734.00;
Fielding & Ghepl- 6y.- Inc.,: Completed Job $19,830.60, with no bid for the

(furnishing of all labor and materials exclusive of brick;
Utton Construction Company, Inc.: $13,463.46 for furnishing of all labor
and materials except having brick, with no bid for a completed job.
President 'Liddle referred these three bids to the Street & Alley Committee
and the City Engineer for tabulation and recommendations.

Police Civil Service Commissioner, R. M. Graen,made request
that new revolvers be purchased for use of the local Police Department and
that gas guns and cartridges and gas billys and cartridges and two (2)
bullet proof vests. and sub -machine gunsi be purchased for use of the Police
Department and he also.recommended that a squad car be purchased for
additional Police transportation facilities.
President Liddle referred these suggest ions.and recommendations
to the Police Committee,
Marshall N. Brown, Sanitary Inspector George F. Strifert and City
Scavenger Wm. R. Jones, were before the Common Council pursuant to order
given at the Council meeting September 8th,1931, dot their appearance at
this meeting, and they were told that the scavenger assessment matter should '
be straightened out between Mr. Brown and Mr. Jones.
The .following report of costs for the paving of the alley as
above described was read, and President Liddle drdered;.�t hst the same be
placed on file:

across Block 25 in Head & mcMahon's Addition under contract

The City Engineers trial balance of disbursements
in his
department for August,1931, was laid before the Common Council,
and
President Liddle ordered that the same be placed on file.

The report of the Clerk of the Municipal Court for the week ending
September 14th,1931, showing criminal fines collected $73.80, civil fees received
$4.,35, and fines collected and remitted direct to the ,State Treasurer $20.00, was
read, and President Liddle referred -the same to the City Attorney.
The report of the Health Officer for the City Farm for the month of
August,1931, showing receipts of $983.12, disbursements "P1034.20, and an overdraft
of 125.09, was read, and President Liddle ordered the same placed on file.
Balance sheet, income statements, etc., of the Public Utility Departments,
prepared by the Secretary of the Public Utility Board,as of August 31st,1931, were
laid before the Common Council, and President Liddle ordered that the same be placed
on file; the said income statements showing a net profit in the Light Department
for the month of August 1931, of %0365.01, and a total net profit for the five
months of this fiscal year of $47210.19, and a net profit in the Water Department fo
the month of August,1931, of 03065.20, and a net profit for the five months of this
fiscal year of $14,967.26.
General balance sheet, trial balance, fund statement, statement of
unexpended budget appropriations,ete., prepared by the City Clerk as of August 31,
1931, were laid before the Common Council, and President Liddle drdered that the
same be placed on file.
The application of Curtis E. Hammer for a public dance permit at the
Woodmen Hall, September 15th,1931, and September 23rd,1931, was read.
The following copy of resolution passed and adopted by the Public
Utility'Board was read and President Liddle ordered that the same be placed on file:i
"Be it and it is hereby resolved by the Public Utility Board of the City
of Rochester, Minnesota that the Hon. Common Council of the said City be and is
hereby requested to authorize the said Board to deed to the Park Board of the said
City certain properties and lands known as the 'Lower Mill' property according to
legal descriptions to be later decided upon and designated by the said Public
Utility Board."

The following copy of resolution was read and President Liddle ordered the
same placed on file
"Resolution adopted March 5th, 1931.
Be it resolved that the Rochester Chapter of the Izaak Walton
League of America does hereby go on record as being opposed to the
pollution of our streams and waterways from any source whatsoever and
that this Chapter will cooperate in every way possible with the State
Game.and Fish Commission, the Public Health Service, our local manufac-
turers and our local officials in preventing any such pollution.

The appointment by the Mayor of Joseph J. O'Connell, as a Special
Patrolman, September 14th,1931, to September 20th,1931, inclusive, and the
appointment of John T. Hong, Carlton Anderson, Merlin Mewhorter, and C.B.
Hanscom as Special Patrolmen September 10th,1931, to September 16th,1931,
inclusive, were read, and President Liddle ordered that the same be placed
on file.
Employment. certificate by the Donovan Construction Company,
showing a list of employees on the new boiler installation at the electric
light plant was read, and President Liddle ordered that the same be placed
on file.
A communication from the Herring -Hall -Marvin Safe Company, as to
the furnishing of their equipment fqr the new City Hall, was read, and
!President Liddle ordered the same placed on file.
The following communication was read, and President Liddle ordered

I would judge by an article in yesterdays Pioneer Press that
your city is interested in the buying of the Tri State Tel Co. by
the N.W.Be ll Co.
When the hearing on the matter was held during the past winter
the subject was gone into thoroughly by a number of witnesses and
for that reason I am writing to ask if the City of Rochester would
be interested in securing a copy of the testimony, in order to
present that objections, if any you may have in this matter.
I ::can prepare a copy for you on very short notice if you so
desire.

say that at a meeting of the Common Council of this City held
the afternoon of September Bth,1931, a committee was appointed'to
work with the committee of the local Chamber of Commerce in the
making of an accurate survey of the unemployment situation in this
City, which will be done with all possible speed, after which
fwe will return your questionaire filled in with the result of this
check taken on our unemployed here.

Dear Sir:
Answering your letter of August 19th,1931, addressed
to Mr.Julius J.Reiter, Mayor of this City, I will say that the
Tri—State Telephone & Telegraph Company furnishes the Visiting
Nurse of this City with a two party business telephone gratis,
the regular service charge for which would be $4.00 per month,
and a charge is made of $1.00 monthly for an extension telephone
which is connected to this gratis telephone.
Otherwise all telephones are paid for at the regular
business and residence rates for the class of service furnished
except that the bill,ingq are net, which billing was put into
effect some time ago as it was found that the Council meeting
dates were never convenient to make the appropriations in order
to save the discounts, which mode of billing has, I think, been
authorized by the Railroad and Warehouse Commission.

The following report and recommendation were read and upon motion by

Vihstadt, second by Amundsen, the plan for the taking of a census of the unemployed
i
of this City was adopted and the City Clerk was authorized to incur the expenses
necessary for this account:

Gentlemen:
Your Committee appointed in the matter of making a check of the
unemployed persons in the City of Rochester, Minnesota, have to report that

on Friday, September llth, 1931, they held a meeting with a
committee from the local Chamber of Commerce, at which ways
and means were discussed for the taking of a dependable survey
of the unemployment dituation in this City and it was decided that
the actual data should be procured by persons selected from the areas
to which they are assigned, which area might be 2, 3 or 4 city blocks,
depending upon the density of the population there which selection
of canvassers would'be made by taking a city plat and blocking out
assignments and picking a person living within the limits as being
the one best qualified to efficiently take the census in that area
and with the administration and clerical work in the compilation
of the result to be centralized in the office of the City Clerk.
A further proceeding taken at this meeting was the selec-
tion of a permanent committee to superintend the taking of this
census and to make recommendations for the relief where warranted
Biased upon the situationsthat the tabulation of the result will
disclose; said committee being Manfert Johnson, A.R.Nachreiner,
AlA.Hieks, John S.Reed, Geo.Lemke, A.F.Wright, Dyer Hi.Campbell,
It is our respectful recommendation that ybu' adopt the
proposed plan for taking this unemployment count and that you
authorize the City Ckrk to incur the necessary expenses such as a
stenographer for the circular letters to the persons who will take
this block census,ete., and for the printing of record forms, etc.,
which will be printed on two different colors of paper, one which
will be for the unemployed at the date of taking the census and
the ather with slightly different wording for record of those who
are employed at the t ime of taking the census but who know that
they will be unemployed at some future date during the winter,
record of which data will be made on the card for a follow-up as
to their status on the date which they expect to be unemployed.

Upon motion by Dallman, second by Hicks, the sum of $16.25 was
appropriated from the General Fund and it was ordered that the said sum
be paid to 0. W. Schroeder, as additional premium on policy No.7 covering
City Hall equipment now in use at various locations.
The following claims for cutting weeds were read and upon motion
by Hicks, second by Dallman, appropriations were made from the General
Fund and it was ordered that payments be made to the persons mentioned in
the amounts stated for the services rendered; Paul C^llies for cutting

Upon motion by Vihstadt, second by Moody, all bids for the removal

East as above described, were rejected and the City Engineer was authorized

the certified checks which accompanied the proposals for the rei_nval of creo

�1 were requested to assist the City Engineer in the purchase of materials
for the removal of creosoted wood blocks on and the repaving with brick

Avenue Northeast and Southeast.
Alderman Vihstadt introduced a resolution levying special assess-
ments for the paving of the alley running North add South across Block
25 in Head & McMahon's Addition to the City of Rochester, Minnesota, to a
width of eighteen (18) feet, with seven (7) inch steel .reinforced one
course concrete, which was read.
Upon motion by Hicks, second by Amundsen, that the said,resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
The following recommendation was read, and President Liddle
ordered the same placed on file:

At a meeting of a joint committee of the Common Council
and the Chamber of Commerce appointed for the purpose of investi-
gating and reporting on the mattes of the application of the Inter -
State Power Company for an extension of the present franchise now
held by said Company, which meeting was held at the Chamber of Com-
merce on September 10th,1931, a resolution was passed and adopted by
said Committee recommending to both the Common Council and the

Chamber of Commerce that a competent appraisal company or engineer be

retained by said, Common Council for the purpose of having the physical
properties of the Inter -State Power Company appraised and for the
further purpose of having a survey made as to the possibilities of

using the present mains and equipment of. said Company used for the

distribution of natural gas in'said City.

Alderman Dallman introduced a resolution granting public dance permit to
Curtis E. Hammer for the Woodman Hall, September 15th,1931, and September 23rd,1931,

and fixing the fee at 1�10.00 which was read.
Upon motion by Dallman, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the r
said resolution duly passed and adopted.
Alderman Amundsen introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the sum of $320.77 be appropriated and paid to Skelly Oil Company
for gasoline, kerosene, and grease furnished during the period July 4th,1931, to
July 30th,19 l,inclusive; $137,75 thereof to be from the General Fund, $3.04 thereof
to be from the Sewer Fund and $179.98 thereof to be from the Street and Alley Fund.
The Mayor and City Clerk of said City are hereby authorized and directed
to draw warrants upon the City Treasurer and make payment accordingly. " i
Upon motion by Miller, second by Moody, that the said resolution be
adopted as read, and all voting in favor thereof. President Liddle declared the said
resolution duly passed and adopted. '
Alderman Hicks introduced a resolution ordering plans,profiles and speci-
fications and estimate of cost for the construction of a sanitary sewer commencing
at a point on the center line of Eleventh Street Southeast, nine (9) feet east of
the.east line of Third Avenue Southeast and running thence easterly to the center of
the intersection of Fourth Avenue Southeast and Eleventh Street Southeast and running'
thence northerly along the center line of Fourth Avenue Southeast to a point forty -
two feet south of the south line of Tenth Street Southeast, and the laying of a
water main in the said parts of Eleventh Street Southeast and Fourth Avenue Southeast,
and ordering that the said improvements be made and done and that the costs thereof
be raid for by Special assessments levied as provided by law, which was read.
Upon motion by Dallman, second by Hicks, that the'said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Fred R. W itzke, and Harold E. Whiting made complaint about Moe Goldberg
operating a junk yard within the City of Rochester without a license, and President
Liddle referred the matter to the Mayor, City Attarney, and Police Department.
Fred R. Witzke asked that signs be placed at the entrance to the City
dumping grounds so that residents may know where to take and dispose of refuse,
rubbish, etc., and upon motion by Hicks, second by Dallman, the City Engineer was
instructed to place a sign in accordance with this request.

Rev. A. R. Zick,and E. M. Raetz recommended that a committee be
appointed for drafting a proposed charter amendment to provide for zoning,
at which motion by Miller, second by Vihstadt, carried that the Chair
appoint: & Committee to prepare and submit a charter amendment .: •galizing
a zoning ordinance provision, at which President Liddle appointed the
so-called Building Committee as a committee for serving on the preparation
of a Pharter amendment for zoning, with request that the Chairman of this
Committee name women appointees from the local women's Civic organizations.
Alderman Dallman introduced the following resolution,which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That all bids for the furnishing of all labor, materials, equip-
ment, • etc ., necessary for the removal of the creosoted wood blocks on that
part of Center Street East which lies between the East line of Broadway
Street North and South and the East line of Eleventh Avenue Northeast and
Southeast, excepting that part of Center Street East which lies between a
point 104 feet east of the west line of Section 36, Township 107 North of
Range 14 West and a point 164 feet West,,and also excepting such parts of
said Center Street East within the above described limits as may be already
paved with brick, in accordance with plans, profiles and specifications
for the saidremoval and repaving, be and the same are hereby rejected.
Be it further resolved by said Common Council:
That the City Engineer be and be is hereby authorized, directed
and ordered to do the said work including the furnishing of all labor and
materials therefor in strict accordance with the plans, profiles and speci-
-'i.c.ations therefor as adopted by said Common Council, all in accordance
with the provisions of Section 281 of the City Charter of said City of
Rochester. "
Upon motion by Hicks, second by Dallman, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Fred R. Witzke, as a member of the Committee which was before the
Common Council, stated that the North Rochester Improvement Association
favored that the so-called " **ir Mill" property be deeded to the Board of
Park Commissioners to be used for park purposes.
On motion by Hicks, second by Vihstadt, the City Attorney was
instructed to prepare a resolution authorizing the Public Utility Board to
deed the so-called Lower Mill property to the Board of Park Commissioners
to be used for park purposes.
Upon motion by Vihstadt, second by Hicks, the Police Committee were
authorized to purchase traffic signs for local schools where needed.
Upon motion by Amundsen, second by Miller, the Common Council
adjourned to 7:30 o'clock P.M., on September 21st,1031.
