Minutes of / regular meeting of the C6mmon Council of the City of Rochester,
Minnesota., held in the Council Chambers, in the second floor of the Chamber of
!Commerce building in the said City, at 7:30 o'clock P.M.,, on September 21st.,1931.
Meeting called to order by President Liddle.

Upon motion by Yihstadt, second by' Moody, the minutes of th8 meeting held
September 8th,1931, and September 14th.,1931, were approved.
This being the time and place fixdd for the opening of proposals for the

President Liddle referred the above quoted proposals to the City
Engi er and the Street and Alley Committee for tabulation and recommenda-
tion.
Dr. Stromberg asked for the purchase of two tanks of chlorine for
use in experimental tests for control of odors at the sewage disposal plant,
nd stated that if the City of Rochester buys two tanks of chlorine, the
lorine Institute will furnish two tanks free, at which motion by
ihstadt, second by Amundsen, carried that the City Engineer be authorized
o purchase two tanks of chlorine for use at the local sewage disposal
,lant with the understanding that the Chlorine Institute will furnish
tanks free.
S. N. Jordan, District Manager of the Interstate Power Company,
Offered a twenty per cent deduction from the present gas franchise rates
if provision will be made to allow the use of natural gas, and urged that
an early decision be made as to the renewal of the local franchise for
his company, in connection with which he offered access to all records of
is company for production costs, distribution costs, etc., for use in
onsideration of rates for a new franchise.
C. F. Wilkins made oral application for a license to
eddle bread, baked goods, etc., and President Liddle referred his
equest to the License Committee.

Rev. A. R. Zick recommended that extensive. -experiments be made In'. providing I
for expansion joints for the creosote wood block paving in this City, in an attempt
to save it from bulging up and, having to be replaced with brick.
The following report and recommendation of the Street and Alley Committee
and the City Engineer relative to the above quoted proposal for replanki.ngodf
bridges was read, and President Liddle ordered the same -placed on file:

Alderman Miller introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the bid and proposal of M. Augustson for the furnishing of all labor,
materials, equipment, etc., necessary for the furnishing and laying of 1-�" asphalt
plank on the Fourth Street Southeast bridges over the Zumbro River and over Bear
Creek in. accordance with the plans, profiles and specifications for the said
replanking, viz:

The amount of the surety c antract bond to be given by the said
contractor is hereby fixed at the sum of $1650,00. "
Upon motion by Hicks,,, second by Amundsen, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Upon motion by Vihstadt, second by Moody, it was ordered that
the certified checks of the unsuccessful bidders on the replanking of the
Fourth Street Southeast bridges be returned to them.
The application bf Chas. F. Wilkins for license to sell
bakery goods, during the period Septembe r 24th,1931, to and including
March 24th,1932, was read, and President Liddle referred the same to the
License Committee.
The report of the Clerkof the Municipal Court for the week
ending September 21st,1931, showing criminal fines collected 140.40,
civil fees received $4.25, court costs charged to Olmsted County $6.95, add
fines collected and remitted direct to the State Treasurer $10,00, was
read and President Liddle referred the same to the City Attorney.
The application of the Yellow Cab Company and the Red Top Cab
Company for a transfer of taxicab license N0.2 on a Cadillac 7 passenger
Sedan to an Auburn Safety Cab, 5 passenger, bearing State license
No.B-14799, was read, and upon motion by Vihstadt, second by Amundsen,
the .transfer was granted.
The application of J. F. Mertz, for license to sell'soft drinks
at 120 Fifth Street Southwest, was read, and upon motion by Dallman,
second by Hicks, license was granted.

Notice of hearing before the Railroad and Warhouse Commission at the
Chicago & Northwestern Railway Company depot at Mankato, -Minnesota, on the 22nd
day of. September, 1931, at 10:00 oclock A,M.,, in the matter of the application of
,the Chicago & North Western Railway Company for permission to discontinue operation
of its passenger trains Nos. 6 and 7, between Rochester. and Mankato, Minnesota,
was read, and President Liddle ordered that the same be placed on file.
j Warranty deed given by Arthur E. Gates and Georgia A. Gates, his wife, to the
j City of Rochester, Minnesota, transferring lands for road purposes, was read, and
upon motion by Hicks, second by Moody, the same was accepted, and it was ordered that i
the said warranty deed be placed on record; the description of the property tran2ferred i
being as follows: The east twenty-five (25) feet of the following described property, '
to -wit: Commencing at a point on the north line of the N,.E.quarter, Section one,
township 106, Range 14, 53 rods 32 feet east of the quarter post of the N.W.Quarter
corner thereof; thence west on the seption line 6 2/5 rods; thence south 25 rods;
thence east 6 2/5 rods; thence north 25 rods to beginning, lines parallel to quarter
line,
The application of A. sRmheim that a sidewalk be constructed along his
property known as N'os. 618 and 620 Eighth Avenue Southeast, was read, and upon
motion by Hicks, second b y Moody, the same was referred to the Street and Alley
Committee and the City Engineer,

City Water Works garage, were read, and President Liddle ordered that the same be
placed on file,
The following recommendation of the Police Committee was read, and Presi-
dent Liddle ordered that the same be placed on filet

Alderman Hicks introduced a resolution ordering advertisement for
bids for the furnishing of a new four or six cylinder , 5 passenger sedan
automobile, with a spare tire and other standard equipment, for use of the
i Police Department of said City, which bids will be received and opened
at a meeting of this Common Council, which is to be held at 2:00 o'clock
!! P.M,,, October 5th,1931, which was read,
Upon motion by Hicks, second by Amundsen, that the said resolu-
tion be adopted as read,j and all votigg in favor thereof, President Liddle
declared the said resolution duly passed and hdopted.
Alderman Moody introduced a resolution ordering advertisements
for bids for the furnishing of one gas riot gun, 5 long range cartridges,
for same, 5 short range cartridges for same,' six gas billys, 12 gas billy
cartridges for same , `and two bullet proof vests, which bids will be
received and opened at; a meeting of this Common Council,which is to be
held at 2:00 o'clock P.M., on October 5th,1931, which. was read.
Upon motion by Amundsen, second by Moody, that the said resolu-
tion be adopted as read, and all voicing in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
A dotreeted proposal made by the Engineering Service Company of

St. Paul, Minnesota, in connection with the making of a valuation of the
physical properties of the local ga, Company, was read, and President Liddle
ordered that the same be placed on file.
An estimate prepared by the City Engineer in favor of the Rochester
Ice & Fuel Company for the furnishing of 40 tons of calcium chloride in
D. & L.W. car No.43344, showing the sum of �!11160.90 as being due the said
contractor, was read, and President Liddle ordered the same placed -on file.
The following: recommendations of the Fire Department Ckmittee
were read, and President Liddle ordered that the same be placed on file:

We, the undersigned committee appointed to investigate the
matter of additional, fire apparatus and equipment for the Fire
Department of the City of Rochester report and recommend as follows:
We recommend that the 19ity Clerk be directed and instructed
to advertise for bids for the furnishing of one Service Truck for the
Fire Department as mentioned and described in a previous report of this
committee.

Preparation of specifications for a service truck for use in the Fire
Department of this City was discussed, and it was agreed that the specifications

shall be drawn so that the Seagrave, The American-LaFrance, the Ahrens Fox and
the Mack Companies can each bid on this equipment, which Fire truck hhall have a
i
1000 gallon pumping engine, 1000 foot hose body, 235 to 250 feet of ladder, chemical ;
I
tank and other minor equipment usually furnished with a modern fire truck, the
c
specifications for payment to be forty per cent on or before July 1st ,1932, and j
i
I
sixty per cent on or before December 1st, 1932, with an interest rate of not to
exceed five per cent per annum, arranged so that the bidders may propose the
i
i
interest rate that they will take,and further that the specifications shall be
drawn so that the bids may be held for at least.thirty days for consideration of
i
the .me°rits of the equipment offered.
,Alderman Moody introduced a resolution appropriating 11094.80 from the
i
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls
. i
for labor during the period of the weeks ending September llth,1931, and September
18th,1931, which was read,
Upon motion by hicks, second by Amundsen, that:;.the-jsaid, resolution be
adopted as read, and all voting in favor thereof,except Alderman Miller, who voted
"Nay", President Liddle declared the said resolution duly passed and adopted.
Alderman Miller introduced a resolution appropriating .1913.14 from the
Street and Alley Fund and ordering payment made to the Purington Paving Brick
Company for the furnishing of 27000 2-� inch No.l paving brick at $33.62 per
thousand and used for repaving of a part of Center Street Bast under Job 1652,whieh
was read.
Upon motion by Moody, second by Vihstadt, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Dallme,n introduced a resolution appropriating ftl60.90
from the General Fund and ordering payment made to the Rochester Ice & Fuel
Company for the furnishing 'of 40 tons of calcium chloride in D.L.W. car No.
43344, which was read.
Upon motion by Vihstadt, second by Moody, that the said resolution
he adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Upon motion by hicks, second by Amundsen, the City Clerk was
instructed to notify Wm. R. Jones, City Scavenger, that effective from
this date no claims for scavenger service rendered will be allowed in his
favor except that.his billing carries the lot, block and addition for
the property tt which he rendered the service.
The matter of having the Assistant Superintendent of the Dumping
Grounds occupy the City owned residence at the dumping groLmd in place of the
City Scavenger, who has no responsibility as to the condition of the
dumping ground, the matter of the wrecking of the old barn on the City
dumping grounds, the employment of extra help and the possible construction
of a second house thero:for use of the one who is in charge of the dumping
grounds, leaving the City Scavenger to occupy the house as under the present
arrangements, were discussed, and President Liddle referred these matters
to the Public Grounds Committee for their consideration and recommendation.
Alderman Amundsen introduced a resolution amending the special
assessmentz,:resolution passed and adopted August 31st,1931, levying special
lassessments for scavenger service, as to property description, due to the
�faet that the City Scavenger turned in street numbers which do not belong
'!to the property involved, which was read.
Upon motion by Amundsen, second by Miller, that the said resolu-
tion.be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
The City Engineer submitted plans, profiles, specifications and
estimate of cost for the construction of a sanitary sewer and the laying of
a water main in parts of Eleventh Street Southeast and Fourth Avenue South-
east.

Alderman V1,hatadt introduced the following resolution, which was read:
"WHEREAS, The Common Council of the City of Rochester, Minnesota, at a
I meeting thereof held on September 14th,1931., after due notice given and hearing had
as provided by law, did pass and adopt a resolution ordering that a sanitary sewer
be constructed commencing at a point on the center line of Eleventh Street South -
least, nine (9) feet east of the east line of third Avenue Southeast, and running
Ithenee easterly to the center of the intersection of Fourth Avenue Southeast and
I E-I.eventh Street Southeast, and running thence northerly along the center line of
Fourth Avenue Southeast to a point forty two (42) feet south of the south line of
Tenth Street Southeast, and that a water main be laid in the said parts of Eleventh
Street Southeast and Fourth Avenue Southeast, and in said resolution directed the
City Engineer of said City to prepare and file in the office of the City Clerk,
detailed plans, profiles and specifications for the said sanitary sewer and water
main and to make and report bo the said Common Council an estimate of the cost and
expense of said sanitary sewer and water main, and said City Engineer pursuant to
said directions did on September 19th,1931, file in the office of the City Clerk of
said City, plans, profiles and specifications for the said sanitary sewer and water
main and did report to the said Common Council an estimate of the cost and expense
of constructing the said sanitary sewer and water main;
THEREFORE, Be it and it is hereby resolved by the Common Council of the
City of Rochester, Minnesota:
That the plans, profiles and specifications for the said sanitary sewer
and water main so filed by said City Engineer in the office of the City Clerk be
and the, same arV hereby adopted qs the plans, profiles and specifications for the
said sanitary sewer and water main, and that the said estimate of cost of the said
sanitary sewer and water main, reported to said Common Council be'and the same are
hereby accepted and ordered filed in the office of the City Clerk;
Be it further resolved by said Common Council:, That,the whole egst and
expense of the construction of the said sanitary sewer and water main shall be
assessed as provided by law, against each lot, piece and parcel of land benefitted by
the improvements, to -wit: - Against each and every lot, piece Rnd parcel of land
abutting upon the said sanitary sewer'and water main, without regard to cash valua-
tion, ratably and in proportion to the special benefits conferred by the said
sanitary sewer and water main, respectively, upon each lot, piece and parcel of
land; ,
Be it further resolved by the said Common Council: That a meeting of the
said Common Council will be held at 2:00 o'clock P.M., October 5th,1931, in the
Council Chambers, in the second floor of the local Chamber of Commerce Building,in
said Cityt at which meeting all persons interested in the said sanitary sewer and
water main may appear and be heard before said Common Council in relation to the
said sewer and water .main or to the mode of -the assessment fcw the cost and expense
thereof, or any other utter or objection relating to the said sewer or water main
upon which'they may desire to be heard.
Be it further resolved by the said Common Council: That the City Clerk of
said City be and he,is hereby ordered and directed to prepare.a list which will
contain a description of each and all of the properties abutting upon the said
sanitary sewer and water main above described, and the names of the owners of the
said properties so far as the same are known, which list, together with a notice of
the time, place and purpose of the said meeting and hearing above mentioned, he will
cause to be published once in the official newspaper of said City at least ten
days prior totthe date of said meeting and hearing;
Be it further resolved by the said Common Council: That the City Clerk
of said City be and he is hereby ordered and directed to advertise for bids as
provided 'by law, for the furnishing of all the materials, and doing all of the work
necessary for the construction of the said sanitary sewer and water main above

described, said bids to be received and opened by said Common Council at a
;i public meeting thereof to be held at 2:00 o'clock P.kf., on October 5th,
jl 19312 in the Council Chambers, in the second floor of the. Chamber of
Commerce building , in said City. Each bid must be accompanied by a
certified check for at least ten per cent of the amourt of the bid, and
,i this Common Council reserves the right to reject any and all bids; the
bidders to be requested to. quote a unit price for the sanitary sewer
installationt:and for the laying of the water main in order that the water
main costs may bepro-rated and reimbursement made after installation of
service connections. "
Upon motion by Miller, second by Moody, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution -duly passed and adopted.

authorized and directed to draw warrants upon the City Treasurer and make

Upon motion by Miller, second by Dallman, it was ordered that
