HomeMy WebLinkAbout10-05-1931Minutes of a regular meeting of the Common Council of the City of j� Rochester, Minnesota, held in the Council Chambers in the second floor of 'i the Chamber of Commerce building, in said City, at 2: 00 o'clock P.M. , on October 5th,1931. 0 Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Hicks, Moody, Vihstadt. Absent: Dallman, Miller. Upon motion by Vihstadt, second by Amundsen, the minutes of the meeting held on Septenber 21st,1931, were approved. President Liddle announced this as being the time and place fixed for a hearing on the construction of a sanitary sewer commencing at a point on the center line of Eleventh Street Southeast, nine (9) feet east of the east line of Third Avenue Southeast, and running thence easterly to the r F center of the intersection of Fourth Avenue Southeast and Eleventh Street Southeast, and running thence northerly along the center line of Fourth Ave- nue Southeast to a point forty-two (42) feet south of the south line of i Tenth Street Southeast, and that a water main be laid in the said parts of J Eleventh Street Southeast and Fourth Avenue Southeast, and asked if there �r was any person present who wished to be heard relative to either of the said improvements. !1 There was no person present who wished to be heard relative to the. construction of the said sanitary sewer or the laying of the said water main. This being the time and place fixed for the opening of bids for the construction of the sanitary sewer and the laying of the water main as above described, the following proposal of Wm. C. Fraser & Son was opened and read, which proposal was: 8" pipe sewer $1.70 per ft., standard manholes $ 75.00 each, 6" on 8" Y's $1.00 each, 4" glass "A" cast iron water main $1.20 per ft,, 4" cross $13,00, 4" gate valve $23,00, 4" plugs $1,00 each, with 20 per ft. added to water main piiee if 6" pipe is used instead of 4" President Liddle referred this bid to the Sewer Committee and the Water Committee and the City Engineer for their tabulation and recommenda- tions. Alderman Dallman and Miller came in at this t ise and took their Chairs. This being the time and place fixed for the opening of proposals for the furnishing of a new 4 or 6 cylinder 5 passenger sedan automobile with spare tire and other standard equipment,for use of the Police Depart- 427 t �ment of said City, the following bids were opened and read: CL - S CTTVROLET COMPANY: New 1931 5 passenger Chevrolet Sedan complete with spare tire, tire cover, bumpers, radiator cap, heater and complete set of tools $$699.00; L. President Liddle referred the above proposals for the furnishing of an automobile and for the furnishing of Police equipment to the Police Committee for their recommendations and requested that the Mayor serve with this Committee. The Common Council took recess for the purpose of committee consideration of the above mentioned proposals, and after it was decided as to which should be *purchased and which bids should be rejected, the Common Council again convened and were called to order by President Liddle. The following report and recommendations, signed by the members of the Committee assignments ,except Alderman Hicks, was read, and President Liddle ordered that the same be placed on file: " Oct. 5, 1931 Hon. Mayor and Common Council Gentlemen: We, the City Engineer and the Sewer Committee, beg to report the tabulation of bids for construction of Sanitary Sewer and Water Main in Fourth Avenue and Eleventh Street South- east as follows: Wm. C. Fraser & Son, lone bidder. Sanitary Sewer 1654,70 Water Main 1270,40 With a notation that if 6" pipe is used for Water Main, add 28 cents -oer ft. The City Engineer's Estimate, dated Sept. 19, is as follows: sanitary Sewer $1903.80,• Water Main $1274.40. The difference between the bid and the Engineer's estimate is $53.109 The per cent is 1.6 per cent. We beg to recommend that the contract be awarded to Wm. C.Fraser & Son. The report of the City Engineer for the month of September,1931,whowing disbursements from the General Fund, for labor, in the amount of $428,74, from the Street and Allen Fund $1715934, and from the Sewer Fund $345.75, was read, and President Liddle ordered that the same be placed on file. i The report of the Plumbing Inspector for the month of September,1931, showing'$30.25 collected for inspection fees,was read, and President Liddle ordered i the same placed on file. i Upon motion by Dallman, second by Miller, the sum of $30.25 was appropriated I from the General Fund and it was ordered that the said sum be paid to Don E. Postier,! as extra salary for plumbing inspection during the month of September.1931, in accordance with the terms of a resolution passed and adopted July 6th,1931. 4 The report of the City We ighmast er for part of August ,1931, and all of September,1931, showing 120,50 collected in weighing fees was read, and President Liddle referred the same to the Finance Committee. The report of the Clerk of the Municipal Court for the week ending September 28bh,1931, showing criminal fines collected $32.80, civil fees received 89.2 0, court costs charged to Olmsted County $3.65, and fines collected and remitted direct to the State Treasurer 82.0,00) was read, and President Liddle referred the same to the City Attorney. The report of the City Treasurer' for the month of September,1931,showing ,3 09584.87 as being on hand,was read, and President Liddle ordered that the same be placed on file. The application of Cirtis E. Hammer for a public dance permit at the Wood- man. Hall, September 29th,1931, was read. The application of Robert A. Orr for license to conduct an auction sale of a general stock of jewelry at No.21 First Avenue Southwest,during the period c ommenc ing October 10t h,1931, and continuing for one month, was read, and upon motion by Dallman, second by Hicks, license was granted; all voting in favor there- of except Alderman Moody, who voted "Nay". The jewelry auction sale license bonf of Robert A. Orr, with E. H. Coon and Mark Rideout as sureties thereon,eaeh in the amount of $500.00, was read, and upon motion by Dallman, second by Amundsen, the said sureties were acoepted,'the said bond was approved and it was ordered that the same be placed on file. I� ffI= f� , 431 Vd, Copies of requisitions by the Health Officer upon Saint Mary's Hospital for the isolation of Charlotte Graun, age 23, a student nurse at St. Mary's e Hospital, diagnosed to be suffering from poliomylitis, and for the isolation of William Kingrey, residing at 221 Seventh Avenue SoutIviest, diagnosed to be suffering from scarlet fever, were each read, and President Liddle ordered that i the same be placed on file. i The following copy of resolution passed and adopted by the Public Utility Board, was read, and President Liddle ordered that the same be placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City j of Rochester, Minnesota. that the Hon.Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the L.A. Kepp Electric Company for the furnidhing, aecor'ding to specifications and bid dated September twenty ninth 1931, of all thematerials, labor, tools and equipment necessary for the c �mplete installation of an underground Duct Transmission line from the City Light Plant as specified for a total contract price of TWENTY SIX THOUSAND ONE HUNDRED SIXTY DOLLARS ($26,160.00) said Company being the lowest.responsible bidder. ' i The following estimates prepared by John McG.Miller, Architect, in favor of the contractors mentioned, were each read, and President Liddle ordered that the same be placed on f ile G. Schwartz &-Company, Estimate No.l on general contract for construction of a new City Hall, $12878.10; Herman Dornack, Estimate No.l on contract for plumbing and heating contract at new City Hall, $1102.54; L. A. Kepp Electric Company: Estimate No.l on electric wiring of new City Hall, $971.10., The following estimates prepared by the City Engineer in favor of the ! contractors mentioned, were read, and President Liddle ordered that the same be placed on file: C. ,Jacobson and S.Lindgriep;Estimate No.l on construction of sewage lift station $6141.25 ; Wm. C. Fraser & Son, Estimate No.l on contract for construction of sludge drying bed at sewage disposal plant $2215,51. The following ccmmunicat ion from the City Engineer was read, and President Liddle ordered the same placed on file: " Oct. 51 1931. liHon.Mayor and Common Council Gentlemen: We beg to ask that the sum of $4000,00 be appropriated in the Street and Alley Fund for use of the Street & Alley Committee. j Respectfully, C: H. The claim of Ruth R.Bernard 810.00 for insurance premium for tornado insurance on oomfort station and bath house at Tourist Park, was read, and President Liddle referred the same to the Insurance Committee. The following recommendation of the Insurance Committee was head, and upon motion by Dallman, second by Amundsen, the recommendation was accepted, and it was ordered that the same be placed on file, and appropria- tions were made as follows in payment of the unpaid insurance premiums mentioned therein: From the General Fund: Stevenson & Melone Agency $48.60, From the Street and Alley Fund: Stevenson & Melone Agency $47.221, Stevenson & Melone Agency $27,25, Ruth R. The following reports and recommendations of the Mayor and Police Committee, relative to police automobile and police equipment, were each read, and President Liddle ordered that the same be placed on file: "Honorable Common Council, Rochester, Minnesota. , Gentlemen: Having considered and tabulated the bids for the furnishing of a police department car the undersigned committee recommends that the bid of Clements Chevrolet Company for the furnishing of a new 1931 six cylinder five passenger Chevrolet Sedan complete with spare tire and tire cover, bumpers, radiator cap, heater and. tools for the sum of $699,00 be accepted. P.S. This bid ineludes the furnishing of shatter proof glass. Respectfully submitted, Julius J.Rei.ter, Mayor Tom Moody, H. F. Vihstadt A. A. Hicks, Police Committee. " 433 rr Rochester, Minnesota. Gentlemen: We, the undersigned committee appointed to tabulate the bids for the furnishing of gas equipment for the police department of said city recommend that all bids be rejected. Respectfully submitted, Julius J. Reiter, Mayor POLICE C OMUITTEE Tom Moody, Chairman, H. F. Vihstadt A. A. Hicks. " Upon motion by Vihstadt , second by Moody, the proposals for the furnishing of gas riot guns, etc., and bullet proof vests for the Police Department, were rejected. The following emergency authorization,issued by the Mayor,was read, and President Liddle ordered that the same be placed on file: "Rochester, Minnesota. October 5th, 1931. Capt. Louis Claude, Police Department. Dear Sir: Under the power vested in my by the Charter of the City of Rochester, I hereby declare the existence of an emergency and order and authorize you to go into the open market and purchase the following; gas equipment for the police department: i 1- 12" Cal, gas riot gun 5- long range projectiles for same 5- short range projectiles for same I i 6- gas billies 12- cartridges for billies, the cost of which I am informed will not exceed 1,300.00. This order is given for the reason that great harm may be caused to the public interests if the above equipment is not purchased immediately without the necessity of taking the time to advertise for bids. j Very truly yours, Julius J. " Alderman Miller introduced a resolution accepting the bid and proposal of Clements Chevrolet Company for the furnishing of an automobile for use of the Police Department of said City, at a cost of $699,00, in accordance with their bid, and I 4j `- �- fixing the amount of the bond to be given by the said contractor at the sum of $700.00, which was read. Upon motion by Moody, second by Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution, duly passed and adopted. Alderme.o. Vihstadt introduced a resolution accepting the proposal of Wm. C. Fraser & Son for the construction of a sanitary sewer and the lay- ing of a water main in part of Eleventh Street Southeast and Fourth Avenue Southeast, as above described, and fixing the amount of the bond to be given by the said contractor at the sum of $4000.00, which was read. Upon motion by, Miller, second by Moody, that the said resolution be adopted as' read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Vihstadt, second by Moody, it was ordered that the certified checks of the unsuccessful bidders for the furnishing of an automobile and other police equipment, be returned to them. Specifications and estimate of cost for the furnishing of a quadruple pumping, booster, ladder and hose body engine and equipment, for use of the Fire Department of the City of Rochester, Minnesota, were laid before the Common Council, Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, It is deemed expedient and necessary that a quadruple pumping, booster, ladder and hose body engine and equipment be purchased for use of the Fire Department of the City of Rochester, Minnesota, and WHEREAS, Specifications and estimate of cost have been prepared and submitted for the furnishing of the said engine and equipme nt ; SO TBEREF'ORF, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said quadruple pumping, booster, ladder, and hose body engine and equipment be purchased for use of the Fire Department of said City, and that the said specifications be adopted for the furnishing of the said engine and equipment, and that the same be placed on file in the office of the City Clerk of said City, and that, the said estimate of cost be aecept'ed and placed on file in the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of said City be and he is hereby authorized and directed to advertise for sealed proposals for the furnishing of the said engine and equipment, which proposals will be received and opened at a public meeting of the Common Council of the City of Rochester, Minnesota, which is to be held in the Council Chambers in the second floor of the Chamber of Commerce building in said City, at 7:30 o'clock P.M., on October i 43 19th, 1931. Each bid must be accompanied by a certified 'check upon some reputable bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which check and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the bidder upon th^ letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. A surety bond written for the full amount of the contract by a surety company authorized to do business in the State of Minnesota, will be required with the contract. (Personal bonds not to be accepted.) All proposals must be addressed to Mr. A. F. Wright, City Clerk of Rochester, Minnesota, and shall have endorsed thereon ';Proposal for furnishing a quadruple engine and equipment.' Upon motion by Amundsen, second by Moody, that the said resolution be i .adopted as read, and all voting in favor thereof except Alderman Vihstaddt who voted "Nq.y" , President Liddle declared the said resolution duly passed and adopted. ,,,ZThe City Clerk submitted a report of the costs for the operation of the i sewage disposal plant during the period October lst,1930, to September 30th,1931, inclusive, showing a total of $12776.11 (actual disbursements), and President Liddle ordered that the same be placed on file. Upon motion by Vihstadt, second by Moody, the City Clerk was directed to bill the Rochester State Hospital for 11.89 per cent of the above mentioned costs, as being their share of the operation costs during the year mentioned, and that he bill St. Marys Hospital for 6.11 per cent of the above mentioned costs as being their share of the operation of the local sewage disposal plant during the period mentioned. A statement of the cubage of the various offices, corridors and rooms in i the new City Hall, together with the square foot areas, was laid before the Common Council, and President Liddle ordered that the same be placed on file for further i i reference. A claim of G. Schwartz & Company, $317.20,extras for excavation of stone and brick walls and concrete engine bases encountered in digging the basement for the new i City Hall, was read, and President Liddle referred the same to the City Attorney, Alderman Vihstadt introduced a resolution appropriating $646,85 from the Sewer Fund ' afid ' ordering payment made to the City of. Rochester, Light Department, j for'payment of the August,15ih,1931,billing for electric power furnished at the I ' isewage disposal plant, whioh was read. Upon motion by Vihstadt, second by Miller, that the said resolution be I adopted as read, and all voting in favor thereof, President Liddle declared the said reso iution duly passed and adopted, I I' i I Alderman Amundsen introduced a. resolution appropriating A694.65 from the Sewer Fund and ordering payment made to the City of Rochester, 1i 1 Light Department for the Sept enb er 15th,1931,billing for electric power �i furnished at the sewage disposal plant, which was read. Uponmotion by Hicks, second by Amundsen, that the said resolu- tion be adopted as read, and all voting in favor thereof, 13resident L.iddle i it declar' d the said resolution duly passed and adopted, !I Upon motion by Vihstadt, second by Moody, the City Clerk was directed to include the above mentioned disbursements of �646.85 and 0694.85 for electric power furnished at the sewage disposal plant with �•� i,the operation costs for the year ending September 30th �1931 � not withstand- ing the fact that the said disbursements were made on this date, and that he include the same in his statements to the Rochester State Hospital and tot St. Mary's Hospital for their share of the operation costs.
