HomeMy WebLinkAbout10-14-193146t Minutes Of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, , in the, Boeond floor of the ChWber of Commerce Building, in said City, at 7:30 o'clock P.1.I., on October 14th, 1931. Meeting called to order by President Liddle, Roll Call. Present: Liddle, Amundsen, Hicks, Miller, ?Moody, Vihstadt. Absent: Dallman. Upon motion by Vihstadt, second by Moody, the minutes of the meeting held on October 5th,1931, were approved. I14F.Eusterman, for the recently organized local Tax Payers Association, re a copy of a resolution passednand adopted by this association at a meeting held October 13th,1931, and President Liddle ordered that the same be placed on file. Copy of resolution passed and adopted by the Wm. T. McCoy Post, No.92, American Legion, and its auxilliary under a joint meeting thereof held on October tl , 1931 -recommending the construction of a trunk line sanitary sewer and a trunk line storm sewer as a means of relieving the local unemployment situation, was read, and President Liddle ordered that the same be placed on file. Apprdval by the Whitlock -Sonnenberg Post No.1215, Veterans of Foreign Wars, of ,the above mentioned American Legion resolution, was read, and President Liddle ordered that the same be placed on file. John S. Reed, for the local Trades and Labor Assembly, stated that his have organizzat ion approved the plan for the unemployment relief recommended by the American Legion. Alderman Dallman came in at this time and took his Chair. President Liddle at this time excused Alderman Hicks, who left the Council Chambers. 11 Walter H. Newsome, of Jorgenson & Newsome, made oral request, and a written request, which was read, that his firm be allowed to use Chas. Johnson of Minneapolis; Minnesota, as a superintendent of their work on laying of brick for the new high pressure boiler at the local electric light plant, and that he be allowed as one of their -force of brick layers, at which motion by Moody, second by Amundsen, carried that Jorgenson be allowed to employ this person for the; work mentioned not withstanding the fact that lie is not a citizen of the City of Rochester, Minnesota. The following rulings by the City Attorney were read, and President Liddle ordered that the same be placed on file: 4, 462 Mr. A.F.Wright, City Clerk, Roehebtt-r, ?Minnesota. Dear Sir: " October 8t.h, 1931. Re: Resident Identification Cards. You inquire as follows: Is a man who elassif ies himself in the year 1030 as a Carpenter forever thereafter bound to remain so classified under and in accordance with the provisions of the ordinance covering the said matter. Your inquiry must be answered in the negative . , . A man who classifies himself under any one classification for any year is bound to remain so classified as to city work only until December 61st of the year in which he so classifies himself. For example a man may be classified as a laborer during the year 1930 and may be In an entirely different classification for the year of 1931 or::he'may- choose, to classify himself as a carpenter during the year of 1930 and as a laborer during the year 1931. In my opinion to you under date of October St,* ,1931, I stated that skilled tradesmen might register under a skilled craftsman Classification, for one year and for the following years mi�#it register as a common laborer and that one who registered as a common laborer for one year might register as a skilled craftsman for the.following year, Upon a further reading and consideration of the ordin- ancees in question I find that I was in error as to the first part of the above paragraph since the point I had in mind at that time is covered definitely.by Section 6 of Ordinance No.416. You are now advised that a common laborer may change his classification from that of common laborer to that of a skilled craftsman, but that a skilled craftsman cannot change his classi- fication to that of a laborer after having chosen his proper classification. _ Any cards issued by you under the ruling as contained in my opinion of October 8th,1931, may be recalled by you by citing this opinion. " 463 � The, report of the Clerk of the Municipal Court for the week ending October 5th,1931, showing criminal fines mollected $6.00, civil fees received -6.00, !t37.00 received from Olmsted County for the Au#ust,1951,1ocal Municipal Court fees,. and 124.75 court costs charged to Olmsted County, was read, and President Liddle referredthe same to the City Attorney. The report of the Health Officer for the City Farm for the month of September ,1931, showing receipts in the amount of A1953.90, disbursements in the amount of ""1838. ,9, and a balance on hand of 190.52, was read, and President Liddle ordered that the same be placed on file. General Balance sheet, trial balance, fund statement, statement of unexpended budget appropriations, etc., prepared by the City Clerk, as of September 3 Oth,1931, were laid before the Common Council, and President Liddle ordered that the same be placed on file. f or The City Engineer's trid6l.balance disbursements in his department for Septeraber,1931, vvp,s laid before the Common Council, and President Liddle ordered that the same be placed on file. The report of the Publid Utility Board for the month of September,1931, showing a net profit in the Light Department for the month of September,1931,of $12406,21, and a net profit in the Light Department for the six months of this fiscal year of �t)59,616.40, and a net profit in the Water Department for September, 1931, of .112125.36, and a net profit in the Water Department for the six months of this fiscal year of `",27092.62, and a net loss in the Steam Heating Department for September,191511, of 1�398.55, and a net profit in the Steam Heating Department for the six months of this fiscal year of 1�90.90, was laid before the Cormon Council, and President Liddle ordered that the same be placed on file. The application of Anna Ebenhoh for a soft drink dealers license at 1326 Third Avenue Southeast, was read, and upon motion by Moody, second by Vihstadt, license was granted. The application of Joe T. Warneka, for a drivers license was read, and upon motion by Vihstadt, second by Moody, license was granted. The following notice of cancellation was read, and upon motion by Miller, second by Dallman, the City Clerk was instructed to notify Captain Louis J. Claude of this cancellation and request that he see that Mr. Herman Rahbain does not after the effective date operate his taxicab/until such time as this policy is reinstated or another one filed with the City of Rochester,* Minnesota; !, 4 [_ 14 Mr. Herman Rahbain, 310 --- 1st Ave SW., City. Adams (Town Taxi) for a transfer of taxicab license N0.20 now covering a 5 passenger Auburn,be transferred to a 7 Passenger Buick bearing State license B.180191, and motor number 2556277, was read, and upon motion by Vihstadt, second by Dallman, transfer was granted. A petition that a sanitary sewer be constructed and a water mein laid in Twelfth Street Southeast, from the center of Eighth Avenue Southeast to the .center of Ninth Avenue Southeast, and in Ninth Avenue Southeast, from the center of Twelfth Street Southeast to the center of Thirteenth Street Southeast, was read, and upon motion by Hicks, second by Moody, the said petition was referred to the Sewer Committee ,nd the Water Committee snd the City Engineer. The following communication was read, and President Liddle ordered thatthe same be placed on file: "October 14th 1931 The. Hon.Mayor and Common Council, City of Rochester, Minnesota., _ Gentlemen - The Public utility Board is contemplating the employing of the firm of Burns and McDonnell for the purpose of making an investigation into the advisability of accepting the proposal of the Minnesota Northern Natured Gas Compdny to connect the boilers of the City Light Plant with their line as proposed. The said Board feels confident that this firm is capable and reliable to undertake this survey; the price therefore to be TWO HUIMPED AND FIFTY DOLLARS ($250.00). Respectfully submitted, A.J.Lentfer, Secretary." 14 465 The following communication was read,.end President Liddle ordered that the same be placed on file: "Oct. 14 1931 The Hon, Common Council, City of Rochester, Minnesota., Grnt lemen- Your recent request under date of October 6th relative to the installation of a street, light on Fourteenth Avenue Northeast at the North end thereof near the C and NW RR Tracks is undoubtedly in error as the said avenue mentioned does not extend to this point, Yours very truly, A. J. Lentfer, Secretary." Ul:on motion by Miller, second by Hicks, it was ordered that a street light be installed at the curve of the intersection of Second Avenue Northwest and Thirteenth Street Northwest, and that the Public Utility Board be requested to make installation accordingly. 'Phe following copy of resolution passed and adopted by the Public Utility i Board was read, and President Liddle ordered that the same be placed on file: ! "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Mi-Lmesota that the Hon. Common Council be and is hereby requested to authorize the said Board to increase the amount of the total contract price for the undergrounding of the 33 KV Transmission Line, as awarded to the L.A.Kepp Electric Company under ,late of September 29th 1931, in the amount of EI!IITEEN HUNDRED DOLLARS' ($1800.00) due to the necessity of placing the same in the West Boulevard of North Broadway instead of the East Boulevard as originally specified and bid upon by the said L, A. Kepp Electric Company." The following License Committee report was read, and upon motion by Amundsen second by Miller, license was granted to Chas. F. Wilitins to sell bakery goods from bakeries in the City of Rochester, Minnesota, for the period commencing September 24th919311to and including March 24th,1931., .at a fee of $5.00 for the period mentioned: " Rochester, Minnesota. ! October 14th, 1931. Honorable Common Council, City of Rochester, Minnesota. Gentlemen: The matter of the application of Chas. F. Wilkins for a license to cfanvassand peddle bakery goods in the City of Rochester for a period of six months having been referred to the undersigned committee, the following recommendation is submitted: That he be granted the license applied for upon his payxkent by him of a license fee for the said period of $5.00, Respectfully submitted, License Committee Paul H.Dallman, Chairman j F.W.Miller, I B. He' McDonnell of Burns Ar McDonnell Engineering Company, read a proposal from his firm for the making of an, -:appraisal of the local gas distribution system and the local gas manufacturing plant owned by the Interstate Power. Company, and upon motion by Hicks, second by Amundsen, the City Attorney was i"trueted to draw a resolution accepting the said. proposal. A dertified copy of the budget for the special school tax levy by the Board of Educ*t ion of School District N0.8 in Olmsted County,Minne- s9ta, at a meeting thereof held at 5:00 o'clock P.M... October 6th,1931, was read, and President Liddle ordered that the same be placed on file for further reference; the total of the said levy being .$333,825,00. The following budget requests to be included in the 1931 tax levy, were read, and President Liddle ordered that the same be placed on file for further reference: For the lighting of public . streets and grounds 1409000.00 if the 3X per KWH rate remains in effecit , or $301,000.00 if a 2� per K{WH rate goes into effect April lst,19321 -Pbr far-nishing free musical entertainment to the general public $5000.00; ,For Civic League activities $2280.00; For Health Department expenses not including salaries and expenses of Milk Inspector, Assistant Superintendent of Dumping Grounds, Public health Nurse, isolation expenses, scavenger service, etc., �116,000.00 ; For operation of Fire Department $71575.00,which includes '110,000.00 as being the balance of costs for a new fire engine after considerink:the $5000.00 lev$ed in the 1930 tax; $19,139.84 for the operation of the Public Library-. 11360.00 as the balance due Mrs. Catharine Fritsch as compensation for the death of Mr. Christopher Fritsch, being for 68 weeks from and after October lst,1931: Upon motion by Hicks, second by Vihstadt, the City Attorney was instructed to attend the meeting of the depositors of the Olmsted County Bank A,! Trust Company which is to be held in the local Armory at 2:00 o'clock P.M., on October 15th,1931, where he will attend to the interests of the City of Rochester, Minnesota,in connection with the City Savings account of $23500,00 in the said bank. 467 The appointment by the Mayor of Bernard Voeltz as a Special Policeman for duty at St. Mary's Hospitalhe t o serve without pay and t o hold office until the second Monday in April, 1932, unless sooner removed, was read, and President Liddle ordered , i that the same be placed on file. i Employees certificate made by the Rochester Plumbing & Heating Company as ! to their empoloyees on the steam line extension, and employees certificate made by the :Donovan Construction Company as to their employees on the new boiler installa- tion, were each read, and President Liddle ordered that the same be placed on file. The following communication was read and President Liddle ordered that the y same be placed on file after the City Attorney had ruled that such an appropriation !M of City Funds could not be made: "Rochester, Minnesota October,2, 1931. Mr. M. F. Liddle President City Council ' Rochester, Minnesota. ! Dear Mr. Liddle: ! This is to advise you that we are starting the annual Community Chest Drive on October 12, Mayor 'Reiter outlined a Welfare Program in which he stated that if one person was in charge of welfare work that they could do direct it as to do away with the duplication which apparently has existed. We wish to advise you that such an arrangement will be in effect this winter under the direction of the Red Cross who is a participant of the Community Chest, I wonder if it would be possible for the City Council to appropriate any money from the emergency fund to the Community Chest this year because you no doubt know that the demandt for assistance will be greater this winter than ever before. " i The followinf; amending report of sprinkling costs was read, and President Liddle ordered that the same be placed on file: "October 7th, 1931. Honorable Mayor and Common Council, City of Rochester., Minnesota. Gentlemen: Relative to the 1931 sprinkling costs rendered to your Honorable Body on October 5th,1931, I will say that $48.60 should be added as an unpaid item, being public liability and property damage insurance premium due the Stevenson & Melone Agency on the motor driven flusher -sprinkler, which addition will make the total of the unpaid claims to be 1372.58, instead of .:p 98,a,nd the total of the 1931 sprinkling, flushing and treating costs to be 115777.41 instead of $15728.81, Yours truly, A. " V The City Clerk reported having billed the 1167e.61 against the Rochester State Hospital, and 1862.60 against the St. Mary's Hospital, as being their share of the local sewage disposal plant operat ion:3eosts for the year ending September 30th,1931, and upon motion by Miller, second by Moody, thecity Clerk was instructed to make asset accounts of these billings, and that he also create an asset account for the previous billings against St, Mary' s Hospital which remain unpaid at this ,time . Copy of correspondence between McGee-Meixner Company of St .P:-.ul, Minnesota, and the City Engineer, relative to machinery thatthe said Company has shipped to Axel F. Peterson, in the amount of -1�1245.00, Which machinery will be for equipping the southeast Rochester sewage lift station, under contract with C. Jacobson and S. Lindgren, was read, and President Liddle ordered that the same be placed on file. Copy of petition made by Helen O'Brien Kessler to Governor Floyd B. Olson, asking; him to require that the individual members of the Railroad Warehouse Commission shall show cause, if any they have, why said members, as a Commission, have not upon their own motion, regulated and reduced telephone rates in the City of St. Paul, Minnesota, to a reasonable degree, was read, and President Liddle ordered that the same be placed on file. Upon motion by Hicks, second by Vihstadt, the sum of. 41,2.00 was appropriated from the General Fund and it was ordered that the said sum be paid to Paul Calliea for cutting weeds upon the property of Chasm. ffould and John Har. Upon motion by Vihstadt, second by Hicks, the sum of 1140,00 was appropriated from the General Fund and it was ordered that the said sum be paid to Mrs. Catherine Fritsch as compensation for the death of Christopher F.Fritsch during the period August 27th,1931, to October 14t.h,1931, inclusive . Wright, City Clerk Rochester, Minn. Dear Mr. Wright! 1 Upon receipt of your letter of an earlier date, enclosing resolution relative to the telephone situation at Rochester, tb.e Governor had me take this matter up with the Railroad & Warehouse Commission. We are in receipt of the,following letter from Mr. Laurisch of that Commission: "I am returning you herewith the resolution from'Rocrester perte,ining to the telephone situation. Replying thereto, will say that I do not know of anything the Governor eouid do in the matter other than as'a member of the Emergency Board, determine whether or not the law would permit them to emplov an additional telephone expert whom I feel the Commission needs before any of the telephone matters can be properly passed upon. j We are now taking a physical inventory of the prop2rty at Rochester which we have been anabled to do because of a considerable saving vye brought about in the consolidation of some of our Departments. I think, however, that these funds will be completely exhausted when we have completed the St. Paul, Owatonna and Rochester exchanges. When these exchanges have been completed by our Telephone Department I expect to then take up with the Emergency Board the question of raising sufficient funds to employ an engineer. Upon motion by Hicks, second by Moody, the rules were suspended and an ordinance describing and designating lands in the City of Rochester, Minnesota, to be known as Thirteen and Ong; -Half Place Southeast in said City, was given its third and final reading. Upon motion by Dq,llmF�n, second by Miller, that the said ordinance be adopted,' and all voting in favor thereof., President Liddle deglared,the,said ordinance duly passed and adopted. Upon motion by Hicks, second by Amundsen, that the said resolution be I adopted as read, add all voting in favor thereof, President Liddle declared the said i resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating -1699,00 from the - General Fund and ordering payment made to Clements Chevrolet Company, for the furnishing under contract of one new six cylinder standard five passenger Chevrolet sedr,n, which was read. Upon motion by Moody, second by Vihstadt, that the said resolution be P:dopted as read , and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: '!'hat the proposal of Burns & McDonnell Engineering Company of Kansas City, Missouri, for making; a survey and appraisal of the properties of the Interstate Power Com-f)any in the City of Rochester, Minnesota, as set forth in its proposal under date of October 14th,1931, be and the same is hereby accepted. Be it, further resolved by said Common council: rPhat the Mayor and City Clerk of said City be and they are hereby authorized and directed to enter into a contract for the doing of the said work as outlined in said contract and agreement with Burns & McDonnell Engineering Company for the sum of Three thousand seven hundred fifty ($3750.00) Dollars." Upon motion`by Dallman, second by Amundsen, that the said resolution be except Aldermen Moody and Vihstadt, who voted "Nay", adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: 'Chat the Public Utility Board of said City, be andthe said Board is hereby authorized to enter into an amended contract with the L.A.:Kepp Eleotric Company for the furnishing of underground conduit system for the so-called high line, in the east boulevard of Broadway Street North, to the effect that this underground system shall j n E 4 A ` be constructed in the West Boulevard of Broadway Street North, between the local E1Fetrie Light Plant and the south end of Broadway Street North bridge overthe Zumbro river, which change in routing will be at an addi- tional cost `of �-''1800.00. The amount of the bond to be given by the said contractor 1a connection with the contract for the construetIon of this underground system, is hereby increased "11800.00. Upon motion by:�diller, seeo4d key, Dallman,, that the said: reso:lu- tion.be adopted' as'.'read, and ell votliig in favor thereof except Alderman Vihstadt, who voted "Nay", President Liddle declared the said resolution duly passed and adopted. .Alderman Amundsen introduced.the following resolution, which was read.: "WHEREAS, The City Engineer of the City of Rochester, Minnesota, has caused to be repaired, under aryl in accordance with the provisions of Section 249 a.nd 257, includive, of the Charter of the City of Rochester, Minnesota, sidewalks in the said City, and has filed with the City Clerk of said 'City a report of the cost of such sidewalk repairs in each case with a description of the lot or. parcel of land abutting upon each sidewalk on which such repairs have been made, which said report is now on file in the office of the City Clerk of said city as aforesaid. NOW TIii.I,RFFORE, Be it resolved by the said Common Council of said City of Rochester, Minnesota: That aid common Council will meet at 7:30 o'clock P.M., on Octobery26th, 1031, in the Council Chambers, in the second floor of the Chamber of Co._i:_ieree building, in said City, and will then and there levy assessments for the cost and expense of making the above mentioned repa3:'rs against the respective properties and lots benefited and abutting upon the sidawalk upon which said repairs have been made.. according to the provisions of Section 253 of the Charter of the City of Rochester, Minnesota, determin- ing, the mode of such assessment for such repairs as aforesaid. Be it further resolved by said Common Council: That each and all of the assessments so made by said Common Council pursuant to said Section 253 rill be made by said Common Council unless sufficient cause be shcrivn to the contrary and that objections to any particular assessment must be filed with the City Clerk of said City one day before the time herein set forth. Be it further. resolved: That the City Clerk of said City, be and he is hereby directed to cause notice of the time and place of said meeting and hearing and the purpose and object thereof and cause the same to be published once in the official newspaper of said City, not less than ten days prior to the date of said meeting add hearing. 4 Upon motion by Hicks, second by Amundsenythat the said resolution s be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 473 Upon motion by Amundsen, second by Vihstadt, the City Engineer was author- ized and directed to secure the necessary labor, materials, etc., and relay the paving brick on the Chicago Great Western Railroad Company crossings on Center Street East, being a strip 42..4 feet east and west over the west crossing, and a stria 44 feet east and west over the east crossing.
