Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the second floor on the
Cb.e,inber of Commerce building„ in said City, at 2:00 o'clock P.V., on November 2nd,
1931. �
Meeting called to order by President Liddle.
Roll Call, Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody_
Vihstadty Absent: None.
The report of the Clerk of the Municipal Court for the week ending October
26th,1931, showing criminal .fines collected `?511.00, civil fees received �6.70,

were. each read, and President Liddle referred the sa:ae to the City Attorney.
The report of the Plumbing Inspector for the month of Oetober,1931, showing
t plumbing,, inspection fees collected in the amount of ne 4,!35.00, was read, and President
Liddle ordered that the same be placed on f ile.
Upon motion by Dallman, second by Amundsen, the above mentioned $35.00
plumbing inspection fees were appropriated from the general Fund for payment to
Don E. Postier, as additional salary on account of plumbing inspeetion�in accordance
with resolution passed and adopted July 6th,1931,
T he f ollowing communication was read and President Liddle ordered that the
same be placed on file:

To the Honorable Mayor, the President
and Members of the Common Council:
I understand that a difference of opinion exists as to the
li::1uid industrial waste from the Reid —Murdoch Canning plant,
Mr. H.P.MgDonnell is right, this sewage is not treated in a
m:a,nne:r to permit damping. it in- the river, It must either receive further
treat--ment or . it must be emptied into the city sanitary sewers.
I call to your attention a letter written to you by the Director,
Division of Sanitation, State Board*of Health dated April 4, 1931 in which he
refers to his report made to the City of Rochester and the Reid Murdoch Company
dated February 27,1930, the recommendations of which read as follows:
'i. The waste from this cannery should be discharged into the
municipal sewera,_;e system. The minimum treatment before the waste is discharged
should consist of fine screening followed by chemical precipitation and
chlorination.
'�. Experimental work should be carried on at the cannery
to obtain data regarding additional treatment.
( '3. If it is impractical to carry out the recommendations
I at this time, the storm sewer appears to offer the best outlet. It
Is questionable whether the above treatment will be satisfactory to
prevent a nuisance in the storm sewers.
!I ' 4. Care should be exercised in the operation of the
plant in order to reduce the quantity and strength -of waste.
jParticular care should be taken to prevent lodfiig,,of solids and
decomposition of sewage in the storm sewers.''
The last paragraph of this letter reads as follows:
'We wish it understood that the use of these outlets,namely,into
Bear Creek and into the Zumbro River, are recommended by us as
a temporary expedient ijntil the sewerage system of the city is
made adequate to receive the industrial waste from this plant.'
First you should decide if the City is to assume the
responsibility for disposing of the canning plant liquid'waste.
Then it must be determined.whether it should receive cpmplete
treatment at the plant and be emptied into the river as at present;
or be incorporated with the city sanitary sewerage and put,through
the existing sewage disposal plant. The latter will of course
result in a need for larger sewers and enlargement of the seviage
disposal plant. We need larger sewers and an enlargement of the
sewage disposal plant in any event.

and trunk line surface drainage sewer, were each read:

Proposition -- 3.
Making necessary preliminary surveys to check flows, sizes, etc., using data as
gathered by your City Engineer, check same, make drawings and specifications,
but the City Engineer to furnish one of his assistants to work with us in making
of surveys and drawings. City Engineer to have full charge of all construction
and supervision, with assistance from us any time he deems it necessary. This
work will be done for a fw of 2% of total cost of construction.

Proposition #4 .
To make a complete survey of sewer system for the City of Rochester, and
draw up a complete report, for a fee as follows: do all work on a per diam
basis of 1,25.00 per day, total cost not to exceed �"1200.00. j

We are herewith submitting for your consideration our proposal
for such sanitary engineering services as we deem necessary to assure Rochester
of a thoroughly satisfe,ctory and modern sanitary sewer improvement program.
We are also submitting a list of our achievements in this field of
sanitary engineering, as well as copies of several letters from other civic
officials of cities where we have been retained in the past.

You will note that the fee stated amounts to `I�2,750.00 but we
wish to call your attention to the fact that, if item l(b) is eliminated from
' the service rt%Juirc;d that we will correspondingly reduce our fee by `,250.00,

making the total ;�,2,500.00.
We believe that the service called for in•our proposal is partic-
ularly desirable at this time to assure a unified sewer system for the city of
Rochester, and to enable your city officials to evaluate the importance of each
phase of such a system. Such a comprehensive plan as we will submit will enable

future extensions to be made at a very ecomomieal figure with the assurance that
` they will fit in to the work that is contemplated at this time, as well as the work ;
II 'which has already been done.
l` .`.Realizing the urgent necessity of the trunk sewer problem and the
i expediency desired by you in the carrying forth of this improvement, we agree
that in the event our organization is selected that we will start investigation
on this matter at once and will present you with such material
resulting from our investigations as will enable yo-A. to carry out
this work in`the soonest possible time, keeping in mind, however,
that the trunk sewer must be a coordinated unit of your past,
present, and future sewer system.
Our organization is of such size as will readily permit this
work Going forward at once and we will make a special effort to
satisfy your demands for the trunk sewer work.

"PRELIMINARY 1. (a) The Engineers agree to furnish all help, instruments,
SURVEYS material and transportation except as hereinafter
specified, and to conduct a thorough survey and
investigation of time entire sanitary sewer system
of the City of Rochester, as well as a complete
investigation` of the eity8s sewage disposal plant.
The survey will determine a comprehensive plan of
improvement for the system and plant, suggesting
immediate improvements as well as future changes.
The survey and report to contain all estimates and
cost data.
1. (b)The Engineers will further investigate and report
upon the sewage disposal problem of the Beid-
Murdoek packing plant, giving recommended procedures
for method of treatment, type of plant, estimates
of cost and operation. Its relation to the sewage
disposal problem of the city of Rochester will be
fully discussed and allocation of costs determined.
REPORT. 2, The Engineers agree to personally present to the
Owner a written report of the results of their
surveys and investigations.
MAPS, 3. T$is report shall be accompanied by preliminary
ESTIMATES maps and drawings of the proposed improvements. It

that may be required, together with the Engineers'

APPROVAL OF
REPORT 40 The Engineers agree to present their report to the
State Board of health, and to make such changes as
may be required to secure the co-operation and
approval of said Board,
POSSESSION 5. The Owner agrees to make accessible to the Engineers
OF all available data affecting the proposed work.

data in the Owner's possession which may assist the
Engineers in their surveys and investigations,

6. In consideration of performing the above services, includ-
ing study and report upon the c it y' s sanitary sewer problem
and the problem of sewage disposal at the Reid -Murdock
plant under section la and 1B, the City of Rochester shall
pay to Burns and McDonnell -Engineering Company the sum of
Twenty seven hundred fifty dollars (`.2760.00).
Payments to be made as follows:
One-half of said amount at the time of completion of the
field work, investigation and examinations: and the balance
shall be due and payable at the time of the completion .of
the entire report.
9. It is agreed to begin the above work_ and services within ten
(10) days from the date of execution of this contract, and
to prosecute the same to completion without interruption. "
Alderfwm Hicks introduced the following resolution which was read, at
which motion by Moody, second by Miller, carried by all voting in favor thereof,
,that action thoreon be deferred until a later date:
"WI]EREAS, the Franklin Heating Plant, Rochester, Minnesota, wishes to use
;`natural gas, and to that end desires the City of Rochester to grant to the Minnesota
Northern Natural Gas Company a permit to lay a natural gas pipe line along, under and
: through the streets, alleys and public grounds of the City of Rochester, to connect
said Franklin Heating Plant with said company's natural gas pipe line;
`.'HE. all FORE, Be .it and it is hereby resolved that the Minnesota Northern
!Natural Gas Company is hereby granted a permit to lay such natural gas pipe line
along, through and under the streets, alleys and public grounds of the said City of
;Rochester, from said company's natural gas, pipe line system to said Franklin Heating
'`Plant, and to own and operate such natural gas pipe line ecnnection, and to furnish
i natural j;as through said pipe line to the Franklin Heating Plant only and to no
,; other person, partnership, association or corporation, except with the written
permission of the Common Council of the City of Rochester and the Franklin Heating
+;Plant, the permission of the said Franklin Heating Plant being required only during

II Such period as the said connection line is owned and operated by the said Minnesota
IiNorthern Natural Gas Company.
Be it further resolved by said Common Council: '
That the location of said connecting pipe line shall be along, through
and under such streets, alleys and public grounds as may be determined, approved and
allowed by the Common Council and City Engineer of said City of Rochester, and the
manner and mAhod' of constructing said line shall be subject to the approval of the
said City Engineer.
Be it further resolved by said Common Council:
�'h.at this permit cannot be assigned save &nd except to the City of
Rochester and it is granted expressly subject to the right of the said City of
Rochester, in the event it undertakes municipal gas distribution, to acquire, own
and operate the said connecting pipe line constructed hereunder, provided the said
City of Rochester and the Franklin Heating Plant mutually agree upon the arrangements 4
to that end;
Be it further resolved by said Common Council:
That by the laying of the said gas pipe line to the Franklin Heating Plant

the Minnesota Northern Natural Gas Company hereby accepts all of the terms and condi-
ti.ons of this resolution and by the said laying of the said line specifically waives
any and all objections to the terms and conditions hereof."

The application of Fire Chief Ginther for a vacation .staxtiXicp
November 9th,1931, wa.s react, and on motion. by Hicks, second by Amundsen,
such vacation was granted.
The following communication from the Chief of the Fire Department
was read, and President Liddle ordered that the same be placed on file:

The appointment by the Mayor of John T . Hong, Carlton
Anderson, Merlin Mewhorter, and C. B. Hanscom, as Special Patrolmen for
the period October 30th.,1931, to November 6th,1931, inclusive, and the
appointment by the Mayor,of Joseph J. O'Connell, as Special Policeman
for duty on the property of Wm. F. Klee on Fifth Street Southwest, to
serve without pay and to hold office until the second Monday in April,
1932, unless sooner removed, were each read, and President Liddle
ordered that the same be placed on file.
Estimate by the City Engineer showing the sum of 'M765.83 , as
being due Wm. C. Fraser & Son for the construction of a sanitary sewer
and laying a water main in parts of Eleventh Street Southeast and Fourth
Avenue Southeast, and estimate by the City Engineer in favor of Wm.C.
Fraser & Son, showing the sum of �P'445.25 as being due for the construction
of sludge drying bed at the sewage disposal plant, were each. read, 'n1
President Liddle ordered the same placed on file.
Y'stimate by the Architect in favor of Herman Dornack, showing the
sum of .04686.33 as being due as estimate No.2 on plumbing and heating
installation for the new City Hall, and estimate by the Architect in
favor of G. Schwartz P. Company showing ;318252,90 as being due as'estimate
No.2 on general contract for the construction of a new City Nall building,
were each read, and President Liddle ordered that the same be placed on
file.

from the General Fund for payment to D. B. McCray for the purpose stated.
Alderman Vihstadt introduced a resolution appropriating P,230.94 from the
Park Improvement Fund and ordering payment, made to the General Fund for sprinkling,
flushin< and treating; of streets around public parks within said City, during the
sea mon of. 1931, whic h was read.
Upon motion by Hicks, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said

resolution duly passed and adopted.
Alder,.ian Moody introduced a resolution appropriating `, 2765,83 from the
permanent Improvement Revolving Fund and ordering payment made to Wm. C. Fraser P,
Son, for final estimate on construction of a sanitary sewer and laying of a water

main in parts of Eleventh Street Southeast and Fourth Avenue Southeast, under Job
No.1655, which was read.

Upon motion by Moody, second by Vihstadt, that the said resolution be ,
adopted as read, and all voting; in favor thereof, President Liddle declared the said I
resolution duly passed and adopted.
Alderman Vihstadt introduced a resolution npropriating `h445.25 from the
Sewage Disposal Plant Fund and ordering payment made to W.m. C. Fraser R. Son, for'
payment of final estimate on the construction of sludge drying bed No.2 at the local:

from the New City Hall Fund and ordering payinent made to C. Schwartz X- Co.,
for estimate No.2 on gteneral contract for new City Hall building, which was

tion be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating 14688.33
from the New City Hall Fund and ordering payment made to Herman Dornack,
for estimate No..2 on installation of plumbing and heating in the new City
Hall building, which was read.
Upon motion by Dallman, second by Hicks, that the said resoltt ion
be . adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Upon motion by Vihstadt, second by Miller, the City Engineer was
regaested to prepare plans, profiles, specifications and an estimate of
cost for a trunk line surface drainage se;;er . in the east boulevard on

Brm dway Street North, running from the Zumbro River to Sixth Street
Northeast, and for the construction of a trLmk line sanitary sewer in
t,heeast boulevard of Broadway Street North, running from Twelfth Street
Northeast to Sixth Street Northeast, and in Sixth Street Northeast, from
Broadway Street North, to First Avenue Northeast.
The City Engineer stated that the local Division Engineer of the
Highway Department had asked that two surface drainage manholes be construe-
ted on the Rcid Murdoch surface drainage system, and, that a stub be
constructed on the Twelfth Street Southeast surface drainage sewer to bring
he stub out from under the new highway grade, which construction costs
ill be assumed by the State of Minnesota, Highway Department, at which

uthorized to secure the necessary labor and materials for the making of
hese improvements and changes, which costs will be reimbursed by the rta,te
