r�. 505 I MinAtes of an adjourned regular meeting of the Common Council of the city of Rochester, Minnesota, held in the Council Chambers, in the second floor of the Chamber of Commerce building, in said City, at 7:30 &!'clock P. M. on November i 9th, 1931. I Meeting called to order by ]President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Miller, Moody, Vihstadt. Absent: Hicks. Upon motion by Dallman, second by Vihstadt, the minutes of the meeting3held on October 26th, 19319 October 30th, 1931, and November 2nd, 1931, were each approved. f Dr. A. He Sanford, President of the Board of Education of School District No. 8, asked for reconsideration of the Common Council's approval of the j 1931 school levy, and presented 9nd read the following ruling from the attorneys of the Board of Education: ff1GRANGWILOBLE THEN Rochester,Minnesote November 6,1931. Bos d of Education Rochester, Minnesota, Dear Sirs: - You have advised us that the Common Council of the City of Rochester has agreed to appropriate $359000.00 from the public utility funds of the city and pay that amount to School District No.89 to be used by it in paying an equal amount of school district bonds which will become due in 1932. You are advised that it would be unsafe for you to rely upon that arrangement as it is entirely illegal. The city of Rochester and Independent School District No.3 of Olmsted County are separate and distinct municipal corporations and the city of Rochester has no more right to appropriate or give money to the school district than it would have to do so to the town of Cascade . Any officer of the city taking any part in such a transaction would be guilty of misappropriation of the funds of the city and the amount might be recovered from the school district at the suit of the city or of any aggrieved tax payer, or any tax payer, by injunction, could prevent it being paid to the school di strict. The report,of the City Weighmaster for the month ending Octbber 31st, 1931, showing weighing fees collected in the amount of $29.60 was read, and President: Liddle rererred',the same .:to :.the Finance Committee. The report of the Health Officer for the City Farm for the month of October 19319 showing receipts in the amount of $1372.409 disbursements $746.18 , � and a balance on hand of $716.74, was read, and President Liddle ordered that the �I same be placed on filei i The report of the Clerk of the Municipal Oourt for the week ending November 9th919319 showing criminal fines collected $17.901, court costs charged to !I Olmsted County .13:50, and fine collected and remitted direct to the State Treasurer $10.00, was read, and President Liddle referred the same to the City Attorney. 06 The report of the. City Treasurer for the month ending October 31st, 19319 showing 1239826.63 as being on hand at that time i was read, and President Liddle ordered that the same be placed on file. The following applications for pub-li0l':dsnce permits were read: WW. T. McCoy Post No. 92, American Legion, for the National Guard Armory November llth,1931; American Legion Auxiliary for the National Guard Armory November 9th919;-1; and A. M. Van Kirk for the Woodman Hall November llth,1931. A petition that provision be made for furnishing adequate and dependable sanitary sewer service to Lots 49 59 6, and ?, in Block 88, in Ori ;inal Plat, signed by Charles A. Rich, J. H. Dolan, Wm, M. Dexter, Rolland Slatterly, and Julius J. Reiter, was read, and President Liddle referred the same to the Sewer Committee with request that they make report thereon at the next meeting of this Common Council. A certificate in favor of the L. A. Kepp Electric Company, signed by L. A. Cowles, Superintendent of the Electric Light Plant, and C. H. Armstrong, City Engineer, vouching for the completion of the installation of the traffic signal system in accordance with contract and showing $ 286040, as bf,ing due the said contractor, •, ax s rce.d, and President Liddle ordered ,that the same be placed on file. The following emergency authorization given by the Mayor was read, and President Liddle ordered that the same be placed on file: "Rochester, Minnesota, November 6th, 1931. Mr. C. E • Ginther, Chief, Rochester Fire Department, Rochester, Minnesota. Dear Mr. Ginther: It has come to my knowledge that your department is badly in need of additional hose of the kind and brand you are now using and with which you are entirely satisfied. Due to the fact that this need is urgent and that the delays occasioned by strict compliance with the Charter *dAild no doubt result in great damage to the public interest you are hereby authorized, under and in accordance with the provisions of Section 284 of the.Charter of the City of Rochester, to go into the open market and purchase the hose required at this time ry your department, the maximum amount of hose, however, not to exceed one. thousand (1000) feet and the price to be paid for t}-.e same shall not exceed the sum of eight hundred dollars in all. Copies of requisitions by the Health Officer upon St. Mary's Hospital for the isolation of Geraldine Cassutt, age five years, living at 24 Fifth Avenue northwest, diagnosed to be suffering from scarlet fever, and for the isolation of .Charles Klasky , age 28 years, staying at the Martin Hotel, diagnosed to be suffer- ing from diptheria., were each read, and President Liddle ordered that the same be placed on file. The application of Roland L. Bond for appointment as Custodian of the new City Hall, was read, and President Liddle ordered that the same be placed on file. A questionnaire from W. N. Carey, Secretary of the American Engineering Council Committee on Employment for the State of Minnesota, was read, eeid upon motion by Miller, second by Moody, the City Clerk was instructed t-j makb reply to the questions set forth. Alderman Hicks came in at this time and took his Chair. A questionnaire from the Commercial West asking for information as to what the City of Rochester, Minnesota, is doing towards securing natural gas service, was read, and President Liddle ordered that the same be placed on file. A communication from Morris B. Lambie, Executive Secretary of the League of Minnesota Municipalities, asking for a representative fjran. Rochester, Minnesota, on the special committee of the League f8r consideration of questions relative to unemployment and for the reference of their decision to the Employment Stabilization Research Institute, was read, and upon motion by Vihstadt, second by Hicks, Presidents Liddle was requested to represent the City of Rochester on this special committee. 7 Upon motion by Miller, second by Hicka, the City Attorney was instructed to prepare a resolution reconsidering this Common Council's approval of the School District tax levy made October 26th,1931, 4266825*00, and providing for approval of the 1931 tax levy of $321825:00. Final estimate prepared by the City En,;ineer in favor of Co Jacobsen and S. Lindgren, showing the -sum of $2017.00 as being due the said contractorsfor the construction of a sewage lift station on the west twenty (20) feet of. Lot twenty-eight (28) in Block seven (7), in Sunnyside Addition, was read, and President Liddle ordered the same placed on file. The following copy of resolution passed and .adopted by the Public Utility Board was read, and President Liddle ordered the same placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Hon. Coron Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the Minnesota Northern Natural Gas Company, a Minnesota Corporation, for the furnishing,'at the City Light Plant, of natural Gas of the quality and in the manner prescribed in the copy of attached contract and at the rates stipulated in the said Contract together with certain other stipulations concerning the installation of equipment as prescribed in the attached contracts" Alderman Amundsen introduced a resolution prpvIdingt,f or the issuanee'and sale of $75,000.00 City of Rochester Improvement Bonds-, dated May 1st, 19 1, as authorized by the voters of said City, on April 21st919319 and authorizing the,exeeution and delivery of the said bonds, which was read. Upon motion by Vihstadt, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed sad adopted. Alderman Dallman introduced the following resolution, which was read: "Be it resolved by the eommom Council of -the City of Rochester, Minnesota: 11 That the Mayor and City Clerk are hereby authorized and 1 directed to execute two notes in favor of the Li A. Kopp Electric Company ifor the furnishing add installation of a traffic signal system in accordance with contract dated May 12th,19319 02830:00, and 30.00 for .the furnishing of a larger feeder wire to alley for two way signals, one of which notes shall be dated November 7th919319 drawn payable to LA.Kepp ,Electric Company, for $1144409 due July let,19329 and carrying an interest rate of six (6) per cent per annum, and the other note to be dated ;'November 7th, 1931, and drawn payable to L.A.Kepp Electric Company for $1716.00 maturing December lst919329 and carrying an interest rate of six 1(6) per cent per annum." Upon motion by Miller, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopteds Mr. Craft, of the Minnesota Northern Natural Gas Company, . was present and informed the Common Council that the domestic "gate" rate for natural gas will be forty-five cents (45j) per thousand cubic feet for the a 59 j first ten million Peet, forty-four cents (44A per thousand for the next ten million, forty-three cents (43,4) for the next$ forty-two cents (421) for the neat, forty-one !cents (41,4) for the next, forty cents (40,6) for the next, thirty-nine cents (39, ) for the next thirty-eight (38�) for the next ten million, and thirty-seven and one I half per thousand cubic feet for any over that, that is over tighty million cubic feet. Alderman Hicks introduced the following resolutions which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said Common Council does hereby approve 'of the attached copy of II contract form to be used by and between the Minnesota Northern Natural Gas Company, a {;Minnesota corporation, and the Public Utility Board of the City of Rochester, Minnesota, !1for furnishing the City Electric Light Plant in said City of Rochester, with natural gas .of the quality and in the manner prescribed in the said contract form at the rates stipulated in the said contract, together with certain other stipulations concerning the installation of equipment as prescribed in the said contract copy.'! Upon motion by Hicks, second by Amundsen, that the said resolution be `adopted as read, and all voting in favor thereof except Alderman Moody, who voted "Nay!, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $3405:00 be and the said sum is hereby appropriated from the Permanent Improvement Revolvingg Fund of said City and ordered paid to First national Bank of Rochester, Miota', for the December lot, 1931, maturity of nn s ii principal on Cit of Rochester Permanent Improvement Revolving Fund bonds Nos. 1311 329 and 339 839Y00.009 and for the December lst919319 maturity of interest on "City of Rochester 4 Permanent Improvement Revolvin:gFund Bonds Nos. 31 to 48 , �i inclusive, $406.00. The Mayor and City Clerk are hereby authorized and directed to draw a iwarrant for said sum upon the City Treasurer in accordance herewith, and cause said t payment to be made*" Upon motion by Vihstadt, second by Moody, that thesaid resolution be adopted as read, and all voting in favor. thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced the following resolution* which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $30900.00 be and the said sum is hereby appropriated from the Permanent Improvement Revolving Fund of said City and ordered paid to First National Bank of Rochester, Minnesota, for the December lot, 1931, maturity of principal $30,000000 and interest $900000 on City of Rochester, Minnesota, 6 % Permanent Improvement Revolving Fund Bonds Nos. 271 to 300,inclusive. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made: " Upon motion by Moody, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced a resolution appropriating $636.05 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the period of the weeks ending October 30th919319 and November 6th919319 which was read. Upon motion by Amundsen, second by Hicka, that the said resolution be adopted as read, and' all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Aldermen Miller introduced a resolution appropriating $2017.0 0 from the Sewer Fund and ordering payment made to C. Jacobson and S. Lindgren for final estimate. on contract for construction of a sewage lift station ! and laying of connecting lines under Job No 1649, which was read; Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President !Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution fixing.7s30 o'elbck 'P.M., November 23rd, 19319 as the time for a hearing on and the levying of special assessments for the construction of a sanitary sewer commencing at a point on the center line of Eleventh Street Southeast, nine (9) feet l! east of the east line of Third Avenue Southeast, and running thence easterly '!to the center of the intersection of Fourth Avenue Southeast and Eleventh !Street Southeast, and running thence northbrly along the center line of ',!
