Minutes Of on -adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the second floor of the
Chamber of Itommerce building, in said City, at 7:30 o'clodk P. M., on November 23rd,
193le 11
Meeting called to order by President Liddle.
Roll Call. Present: Liddle. Amundeen, Dallman, Hicks, Miller,
Moody, Vihstadt. Absent: None.
Upon motion by Vihstadt, second by Moody, the minutes of the meetings:
held on November 9th,1931, November l0th,J9319 November 16th,19319 and November 'l8th, if
19319 were each approved:' i
President Liddle announced this as being the time and place fixed
for a hearing on and the levying of special assessments for the constructrion of
a sanitary sewer and the laying of a water main in part of'Eloventh Street Southeast and
in part of Fourth Avenue Southeast, and asked if -there was any, person present who
wished to be' heard concerning this improvement.
There was no person present who wished to be heard in regard to the
construction of the said sanitary .sewer or the laying of the said water main:
The following report of costs was read, and President Liddle ordered
that the same be placed on file:

Gentlemen:
I respectfully report the following as being the costs for the
construction -of a sanitary sewer and the laying of a water main in parts
of Eleventh Street and Fourth Avenue Southeast under contract with W *,C.

Note': The.cost of the construction of the sanitary sewer was 59420
of the costs of the entire project, and 40.80 9� was the share of
the water main costs in the entire; project.

Upon motion by Vihatadt, second by Miller, the sum of
$45-00 was appropriated from the General Fund and it was ordered that the
said sum be paid to Olmsted County, Minnesota, for local Municipal Court
i fines collected due to Olmsted County, Minnesota, ;
General balance sheet, income statements, etc., of the
,!Public Utility Depaz`�►ments of the City of Rochester, Minnesota, prepared
!,by the Secretary of the Public Utility Board, as of October 31st ,1931,
11were laid before the Common Council, and President Liddle ordered that the

11same be placed on file: the said income statements showing a net profit in

ij the -Light Department for the month of October,1931, of $109220,449 and

jl a net profit in the Lir,ht Department for the seven-., months of this
fiscal year of $70536484, and a net loss in the Water Department for the

month of Oetober,1931, Of $4739491, and a net profit in the Water Depart-

before the Common Council, and President' Liddle ordered that the same be

The following applications for permits to place and maintain
signs, were read, and upon motion by Dallman; second by Amundsen, permits
were granted: Minnesota Cafeteria, Globe Furniture Co,, E.H,Deitschmah, = Y
FeAeral Radio Salea, Bailey Tire Service,Marcell Shop, foOoLaerson.
The application of Ethel Quinell and Mrs. Rose kinggenberg
for a soft drink dealers license at 18 Third Street Southwest., was read,
and upon motion by Vibstadt, second by Amundsen, license was granted.
The application of Mervin E. Condrey for appointment as
custodian or Janitor of the new City Hall, was read, and President Liddle
ordered that the same be placed on file.

The appointment by the Mayor of Carlton Ee Anderson, as a Special ;
Patrolman for duty November 21st, 1931, to November 27th91931, inclusive, was read,
and President Liddle ordered that the same be placed on file.
Employment certificate made by Magnus Augustson, showing the
employees on the resurfacing of the Fourth Street Southeast bridges, was read, and
President Liddle ordered that the same be placed on file.
Copy of Requisition by the Health Officer upon Saint Mary's Hospital, for
the isolation of Betty McGoon, age 7 years, living at 206 Eleventh Avenue Southeast,
diagnosed to be suffering from whooping cough, was read, and President Liddle ordered
that the same be placed on file.
Estimate by the City Engineer in favor of Magnus Augustson, showing
the sum of $1545e64 as being due the said contractor for the resurfacing of the
Fourth -,Street Southeast bridges over Bear Creek and the Zumbro River, was read, and
President Liddle ordered that the same bg placed on fiiee,
• The following request for authority to make the improvement mentioned
was read, and upon motion by Moody, second by Amundsen, the request set forth therein
was granted, provided that the construction is under the supervision of the City
Engineer:

Attached. please find two prints of proposed -Estimate
#34109 Aerial Cable Extension and Removal of Open Wire on Eleventh
Av,enue Northeast.
This estimate, if approved by you,. will remove two
crossarms of open wire and place one aerial cable on the present
electric light poles from Fifth Street Northeast on filth Avenue
Northeast to 14th Street Northeast, then east on 14th Street, a
distance of 981 feet_.
If permission is granted to proceed work as outlined,
kindly arrange to have one print approved and returned as soon as
possiblee

The City Clerk reported the payment of $1500e00 by the State of

Minnesota on the $1678:61 Rochester State Hospital account for their share in the
operation of th• sewage disposal plant during the year ending September 30th919319
and asked for authority to charge back the $178061 difference, as the $1500.00 is
the maximum amount the State of Minnesota can pay finder their existing budget, and
notion by Ylhetadt, second by Moody, carried that the City Clerk transfer
$178*61 from the State Hospital account back to the account for the operation of
the local sewage disposal plant; which is known as Job 1050.

The report of the Public liAamin'er on his examination of the
books and records of the City of Rochester, Minnesota, for the fiscal year
ending March 31st,19311 under an audit mated May 31st91931,+was laid before
the Common Council, and upon motion byMiller, second by Moody, action
thereon was deferred until the next meeting of this Common Council, ,and the
City Clerk was instructed to furnish each of the Aldermen with copies of
the Public Examiner's comments and erttieiads.
Alderman Dallman introduced a resolution levying special
assessments for the cost of the construction of a sanitary sewer and the
laying of a water main described as follows: Commencing at a point on the
center line of Eleventh Street Southeast, nine (9) feet east of the east
line of Third Avenhe Southeast, and running thence easterly to the center
of the intersection of Fourth Avenue Southeast and Eleventh Street South-
east and running thence northerly along the center line of Fourth Avenue
Southeast to a point forty-two (42) feet south of the south line of Tgnth

Street Southeast, and that a• water main be laid in the said parts of Eleventh
Street Southeast and Mirth Avenue ' Southeast, which was read.
;Upon motion by Vihstadt, second by Hicks, that the said resolution
be adopted as read, and all voting in favor thereof, Propident Liddle declared the
said. resolution duly passed and _adopted.
Alderman Miller introduced a resolution fixing 2:00 oclock P.M.,
December 7th,19319 as the time for a hearing on the construction of sanitary sewer
along the North 4 feet of Lots 5. and 10 in Block.889 Original Plat, from a point
45 feet West of a continuation of the West line of Second Avenue Southwest to a
point 25 feet east of the center line of Third Avenue Southwest,. thence south V
west 196 feet to manhole in place, which was read.
Upon motion by Vihstadt, second by Hickv,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted. i
Alderman Moody introduced a resolution appropriating $1545.64 from i
the Bridge Fund and ordering payment made to Magnus Augustson for the first and
final estimate on contract for the resurfacing of the bridges over Fourth Street
Southeast over the Zumbro'River and Bear Oreek, in accordance with contract under
Job No16589 which was read.
Upon motion by Moody second by Miller, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the

said resolution passed and adopted.
��- Alderman Dallman introduced a resolution appropriating $685.25
from the Sewer Fund and ordering payment made to the Cit)C of Rochester, Light

Department for electric power furnished for the operation of the Sewage Disposal
Plant, in accordance with their billing of November 15th919319 which was read.
Upon motion by Vihstadt, second by Moody, that the said resoI Lion
be adopted as read, and all voting in favor thereof, President Liddle declared the

said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $61575 from
the Park Improvement Fund and ordering payment made to the Mayo Trgst Fund for
payrolls for labor during the period of the weeks ending November 13th,1931, and
November 20th,19319 which was read.
Upon motion by Dallman, second by Amundsen, that the said resolution
be adopted as read, andall voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted. i
Upon motion by Vihstadt, second by Hicks, the City Clerk was
instructed to bill the State of Minn:)sote, TTi fir.,+rw�� Department for one half of the
costs of the resurfacing of bridges oos � the Fourth Street Southeast ever Lear
Creek and over the Zumbro River, up to$750'.009as being their one half share.
Alderman Hicks introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:

That the proposal of the Burns & McDonnell Engineering
Company of Kansas City, Missiuri, dated October 31st,1931, offering to
make a survey, and investigation of the entire sanitary sewer system of
the City of Rochester, Minnesota, and an investigation of the local sewage
disposal plant, together with the furnishing of a comprehensive plan of
improvement for the local sanitary sewer system and the sewage disp®sal
plant for $2750.00, which survey and investigation shall. also cover an
investigation and report,on the Reid Murdoch ffompany sewage disposal
Problem and give recommended prodedure for method of 'treatment, type of
plant, estimates of costs and operation with full discussions of its
relation to the sewage disposal plant problems of the City of Rochester,
which report thereon will show allocation of the costs determined, with
their reports in each case to be accompanied by preliminary maps and
drawings of the proposed improvements with comparative estimates for var-
ious types of purification, which said plans and improvements shall carry
the approval of the State Board of Health of Minnesota, made thereon
before the said plans and improvements are submitted to the Common Council
of said City of Rochester, all of which is with the understanding that
such data as may be in the possession of the City of Rochester, Minnesota,
Is to be available to the. said Engineering company for their use in
connection with the said survey and report, be and the said proposal is
hereby accepted and the Mayor and City Clerk of said City are hereby
authorized and directed to enter into contract with the Burns & McDonnell
Engineering Company of Kansas City Mi,:souri, for the furnishing of the
services set forth in their proposal of October 31st,1931."
Upon motion by Moody, second by Hicks, that the said resolir
Lion be adopted as read, and all voting in favor thereof except Alderman
Vihstadt, who voted "Nay% President Liddle declaredthe said resolution
duly passed and adopted
Upon motion by Miller, second by )doody, the Sewer. Committee
and the City Engineer, and all members of the Common Council who can go,
were authorized to accompany the City AttarheJ[ before the Attorney General
when he presents the question of whether, or not the trunk line sanitary
,sewer construction in Broadway Street North can be paid for from Rinds
realized from a bond issue under authority of the 1927 law which gives
power to the Common Council of any second class city for the issuance aVd
sale of up to $200,000 bonds for .the construction of storm water sewers,
paving and curbing, and that the City Engineer secure the approval of the
Board of Health of the State of Minnesota, on his plans for the trunk
line surface drainage sewer and the. trunk line sanitary sewer in part of
Broadway Street North.
Upon motion by Miller second by Dallman, the Public Utility
Board -were requested to install a street light on Recond Street Southwest
midway between Ninth Avenue Southwest and Eleventh Avenue Southwest.

Alderman Hicks introduced the following resolution, which
"Be it resolved by the Common Council of the City of
Rochester, Minn.: That the Public Utility Board of said City be
authorized to lay a water main in Third Avenue Southeast from the dead
end north of Fourth Street Southeast and running southerly to the water
main in Fourth Street Southeast. "
Upon motion by Hicks, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President.
Liddle declared the said resolution duly passed and adopted.
Upon motion by Miller, second by Vihstadts the City Engineer was
III authorized to engage a,.,.:steam shovel for stripping at the gravel pit and casting
back gravel in the Thebi pit.Ij II
Upon motion by Amundsen, second by Vihstadtq.the City Engineer was
authorized to purchase two 38 by 7 automobile tires for use on the model 74 Inter-
national track at an adjustment price of $400-00 each.
