Minutes of an adjourned regular meeting of the Comon
Council of the City of Rochester, Ylanoseda, held In thf Ceauell Chambers,
In the second floor of the Chamber of Commerce building in said City, at
7:30 o'clock P.M.,. on December. 14th,1931.
Meeting called to order by President Liddle.,
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Mill-
er, Moody, Vihstadt. Absent: None.
Upon motion by Moody, second by Amundsen, the minutes of
the meeting held on December 7th919319 were approved:
The report of the Milk Inspector for the months of September,
October and November919319 was read, and President Liddle ordered that the,
same be placed on file.
The report of the Building and Electrical Inspector for the
month of Novembr919319 showing building inspection fees collected in the
amount of $46 00, and electrical inspection fees collected in the amount of
$22.50, was reed, and President Liddle referred the same to the Finance
f �+ Committee.
IIThe report of the Health Officer for the City Farm for the
i ;!month of November919319 showing receipts in the amount of $611003, disburse-
(iments in the 'amount of $1290.419 and a balance on hand in the amount of
i$37436, was read, and President Liddle ordered that the same be placed on

I' The City Engineer's trial balance of disbursements in his

�Idepartment to and including November919319 was laid before the Common
I Council, and President Liddle ordered that the same be placed on file.
The balance sheet, income statements , etc., of the Public
!!Utility Departments, prepared by this Secretary of the Public Utility Board
+as of November 30th919319 were laid{ before the Common Council, and Pre.siderit
�JLiddle ordered that the same be placed on file; the said income statements
ishowing a net profit in the Light Department for the month of November,19319
of $14205.18, and a net profit in the Li c#t Department for the eight months
iof this ftseal year of $84744429 a net profit in the Water Department
I!for the month of November,1931, of $27260,88, and for the eight months of
jthis fiscal year of $2507941, and a net profit in the Steam Heating

The claim of the Weed Insurance Agency $46000, for fire, tornado
and transportation insurance on the #74 International Truck and the Russell Grader
So.2, was read, and President Liddle referred the same to the Insurance Committee.
The claims of Saint Mary's Hospital for the isolation of Betty
McGoon $30.009 Geraldine Cassutt $60,00, and Charles Klasky $72.50, were each read,
and upon motion by Hicks, second by Vihatadt, the said sums were appropriated from
the General Fund and it was ordered that the same be paid to Saint Mary's Hospital
for the purposes stated.

Dear Sir:
} Inquiry as to who would be liable in those cases where
unemployed individuals are given two or three days' work under the,
supervision of the city is acknowledged. Attached is a recent
decision of the Commission on a parallel case. The city and county,
through its Welfare Board, extended work to unemployed one or two
' days per week under the.direct supervision of the city, giving in
j return groceries and absolute necessities of life; Pursuant to this
j arrangement the man sustained an injury. The Commission held that he
was an employe of the city of Saint Paul and entitled .to the benefits
of the Compensation Act of this state:

Gentlemen:
The Unemployment Committee has geen'giving consideration
to a made -work program and the question as to whom could assume the
liability under the Compensation Act of this state has come before use
We have written the State Industrial Commission and have
received as their opinion that the city should assume such responsi-
bility.
We would like to take this opportunity of asking that the
City assume this liability in case the program is carried out.
We are inclosing the copy of the letter received from the
Industrial Commission together with a decision on a similar case.

Your lette of June loth to the attorney general has been
referred to me for attention.
You call attention to Laws 19319, chapter 331, limiting the
allowance which may be made to any employe of the state " any municipal
subdivision thereof as reimbursement for the use of his own automobile
in the public service, and ask certain questions relative to the
application of this low. - - - - - - - - - - _ -
- - - - - - - - - - - - - - - - - - - - - - - - - - - - - -
You refer to a third class of employes who, are allowed twelve
cents per mile for the use of their cars in transpoAiAg-cre*s of
workmen to an from municipal Projects, with a limitation of $55 per
month.
In an opinion dated April 279 1931, to the comptroller, this
office held that chapter 331 did not limit the amount which Might
be.paid to an officer or employe of the state for carrying other
employes in his automobile. In other words, where a person in the
performance of his duties is required to transport other persons in
public service, we believe the amount which.may be allowed for the
transportation of such` additional persons is not limited by chapter
331 and may be regulated by the office having jurisdiction to author-
ize and allow the expenditure. We therefore believe that the city
may authorize the reimbursement of a person who uses his car in the
transportation of other persons in the public service twelve cents
a mile or such other sum as the council deems proper.

that warrant No.2475 dated August 11th,19319 and drawn payable to the Roches►
ter.Iron Works in the amount of $4.50, had been lost by the concerns in whose
favor these warrants had been drawn, and upon motion by Vihstadt, second
by Moody, the Mayor and City Clerk were authorized and directed to draw

Alderman Hicks introduced a resolution apprlptieting
$1375.00 from the General Fund and ordering payment made to Burns &
McDonnell Engineering Company of Kansas City, Missouri, for one half of
fee due at completion of field work and investigations and examinations in
connection with the s-ewur system survey and comprehensive plan for the
improvement of same, under contract dated November 24th,19311 which was
read.

Upon motion by Vihstadt, second by Moody, the proposal

of Fraser & Feller for the •constraction of a trunk line sanitary sewer in
part of Broadway Street North and Sixth Street Northea-st, and for the
construction of a trunk line surface drainage sewer in part of Broadway
Street North, was rejected, and it was ordered that the certified check
which accompanied their proposal be returned to them.
President Liddle referred the matter of the Minnesota
Northern Natural Gas Company leveling off their excavations for gas main
installations within the City, to the Street and Alley Committee and the
City Engineer.
