Minutes of an adjourned regular meeting of thw Common Council of the
City of Rochester, Minnesota, held in the Council Chambers,in the second floor of
the Chamber of Commerce building, in said City, at 7:30 o'clock P.M., on December i
2lst,1931.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, Dallman, Miller,.Moody,
Vihstadt. Absent: Hicks.
The following Committee report and recommendation was read, and
President Liddle ordered that the same be placed on file:

The Common Council
Rochester, Minnesota
Dear Sirs:
A motion was made by Mra Reiter, seconded by Mr. Hicks that
the following report of the Unemployment Committee be submitted to the
Common Council of the Citytof Rochester, and the Board of Directors of
the Chamber of Commerce.
The Committee has completed its census of the unemployed
showing a total registration of 993 and it has certified 120 men for
work on the natural gas pipe line and has furnished work ranging from
a few hours to permanent positions to twenty-seven men and women.
The Committee has studied and suggested a number of plans
for the relief of the unemployed, from other than tax funds, but we
find that most of these plans are impracticable or that for some
reason it is unadvisable to follow them out and would like to recommend
to the Common Council of the City of Rochester the following plan: that
the Common Council provide for the transfer of five thousand dollars
($5,000) from the General Fund to the Park Improvement Fund to be
disbursed by the Board of Park Commissioners in the regular way except
that record of it shall be kept as a separate division of their disburse-
ment records in that this committee's program for relief is mostly park
work, namely, the clearing of the proposed Silver Lake basin, the clear-
ing of the expected. -,addition to. Kutzky Park, the clearing of the Zumbro
River bed and banks outside the Mayo Park limits, the clearing of Bear
Creek bed and banks, the making of the improvements which can be made at
this time in Slatterly's Park, and cleaning up and clearing all approaches
to the City; and further that in the event of the necessity for snow removal
work that the City Engineer be requested to call upon the records of this
Committee for the names of the persons most urgent in need of work.

Alderman Hicks came in at this time and took his Chair: Il
Alderman Dallman introduced the following resolution, which was read:;
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the sum of $5000.00 is hereby appropriated from the General
Fund of said City and it is ordered that the said sum be paid to the Park Improvement
Fund of said City being for temporary transfer of funds to be used for the relief
of unemployment in the clearing of the Silver Lake basin, the clearing of the
expected addition to Kutzky Park, the cleaning and clearing of the Zumbro River bed
and banks, the clearing and cleaning of the Bear Creek bed and banks, the making
of such improvements as can be made at Slatterly park during this season of the year,
the clearing and cleaning of all. approaches to the City, the said fiend to be disbursed
by the Board of Park Commissioners in the regular way except that record thereof bhall'
be kept as a separate division of their disbursements.

The Mayor and City Clerk of said City are hereby authorized
acid directed to draw a warrant upon the City Treasurer and make payment
accordingly*"
Upon motion by Miller, second by Moody, that the said
resolution be adopted as read, and all, voting in favor thereof, President
Liddle declared.the said resolution duly passed and adopted.
General balance sheet, trial balance, fund statement,
statement of unexpended budget appropriations, statement of Sinking Fund
investmbnts, etc., of the City of Rochester, Minnesota, prepared by the
City Clerk of said City, as of November 30th91931, were laid before the
Common Council, and President Liddle ordered that the same be placed on
filed
The report of the Clerk of the Municipal Court for the
week ending December 14th919310 showing criminal fines collected $66 440 ,
court costs charged to Olmsted County $11025, and fine collected and
remitted direct to the State Treasurer $10.00, and for the week ending
December 21st919319 showing criminal fines collected $205.00, civil fees
received $2.359 court costs charged to Olmsted County $4020, and fines
collected due to Olmsted County $32.45t were each read, and President
Liddle referred the same to the City Attorney:
Upon motion by Vihstadt, second by Dallman, the sum of
$32.45 was appropriated from the General Fund and it was ordered that the
said sum be paid to Olmsted County, Minnesota, for local Municipal Court
fines collected due to Olmsted County.
The application of'C. B. Connty for a public dance permit
fiat the Woodman Hall December 23rd91931, was read.
The application of Jim Vader for a. license to peddle..eggs
during the period December 21st919319 to'June 30th91932, was read, and upon
motion by Hicks, second by Miller, license was granted for the period
lending April lst91932, at a fee of $5400 for that period.
Copy of requisition by the Health Officer upon Saint Mary's
!Hospital for the isolation of Katheryn Glade, age 18 years, living at
Kehler Hall, diagnosed to be suffering from cdiir,cX on -Tex was read, and
President Liddle ordered that the same be placed on file.
The appointment by the Mayor of Carlton E. Anderson, as a
special patrolman December 15th, 1931, to December 21st,193it inclusive,
iliwas read, and President Liddle ordered 'that the same be placed on file.
Upon motion by Vihstadt, second by Moody, the City Clerk
was instructed to bill the State of Minnesota Highway Department for the
1931 installment of one tenth of the cost of the State Highway Department's
share of the repaving of Second Street Southwest between First Avenue
Southwest and Third Avenue Southwest.

A communication from R. A. Miller, Tax Commissioner of the Chicago
& Northwestern Railway Co. , asking for tt : refund of the 1930 and 1931 sprinkling
tax of ,12.76 for each year made against Lot 1, Block 38, in Northern Addition,
heretofore paid by their lessee the Kra"se-Lamella Lumber & Manufacturing Co., in
that no sprinkling was done.in front of that portion of Lot 1 occupied by the

lumber company, and that the sprinkler only operated from the west up to theAracks
which are approximately on the west line of the said Lot 19 was read, and upon
motion by Hicks, second by Vihstadt, the City Clerk'was instructed to reply to '
the abaid communication and say that there is no refund due for the years mentioned,,
as the proceedings for the sprinkling of Seventh Street Northeast covered property
to the west line of Second Avenue Northeast, but that the 1932 sprinkling proceedings
will stop the sprinkling of Seventh Street Northeast at the west line of Lot 1 in
Block 38 in Northern Addition.
The following copy of Charter Commission appointment was read and
President Liddle ordered that the same be placed on file: -

Third Judicial District:
WHEREAS, on July 1st, 1927, the Hon. Karl Finkelnburg and
Vernon Gates, Judges of the District Court of the Third Judicial Dis- .
t rict of the State of Minnesota, did by an order dated on -said day and
filed with the Clerk of District Court in and fdr said Olmsted County,
appoint a Board of Freeholders for the purpose of framing a Charter for
the City of Rochester, in the County of Olmsted and State of Minnesota,
AND WHEREAS, the term of office of each and all of the members
of said board, so appointed, has expired,
NOW THEREFORE, by virtue and in pursuance of the authority in
us vested by the laws of the State of Minnesota in such ease made and
provided, we do hereby appoint the following named persons, who are
freeholders of said city of Rochester and who now are, and for five
years last past have been qualified voters in said city of Rochester,
to -wit: Dr. A.W-Adson, H.O.Christensen, Harold H.Crawford, Hayes
Ddnsiftgburg, R.W.Goddafd,'H.A.Johnson,Mrs, George Knowlton, George
Lemke, John Lemmon, John A. Marsh, Mrs. Agnes Moersch, A.G.Nixa, John

Board of Freeholders in and for the city of Rochester, in the county
of Olmsted and state of Minnesota, and to act as such Board of Freeholders
in accordance with the provisions of the constitution} and laws of said

It is further ordered 'that the rules heretofore made by Judge
Charles E-Callaghan, deceased, for the government of said board be, and
they hereby are, made and -tontinued as the rules with reference thereto
until further order of the court.

..Our reports.are typewritten and we ordinarily furnish two
copi,es.'to the'City as the reports contain a considerable
nu�b.er of exhibits and maps. The problem of furnishing addi-
tional copies is more complicated than would be it if were
only printed matter. It occurs to us that the extra copies
requested might be arranged for immediately after we have
presented the report "nd the council may thereby determine
just what they might need. In several cases.cities have
considered it worth while to have bound printed editions of

the report made.

starting about the first of the year.
The estimate, if approved by you, upon completion will
have removed from West Center Street several poles, also several
from other streets in the northwest section.
Two prints showing the construction and two of the
removal of existing plant have been attached.

Alderman Dallman introduced a resolution granting public dance permit
to C. Be Conaty for the Woodman Hall, December 23rd91931, and fixing the fee at
$5.009 which was read.
Upon motion by Dallman, second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Moody introduced a resolution granting the Public Utility
Board authority to enter into contract with the Botsford Lumber Company, for the
purchase of the above described Western Red Cedar treated poles, and fixing the
amount of the bond to be given by the said contractor at the sum of $1080.009 which j
was read. j
Upon motion by Hicks, second by Miller, that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted*-

Alderman Vihstadt introduced a resolution appropriating $656-045
from the Sewer Fund and ordering payment made to the City of Roohester, Light
Department for electric power furnished for the operation of the sewage disposal
Plant, liar billing dated December 15th919319which was read.
Upon motion by Moody, second by Amundsen, that the said resolution be
adoptedass read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Miller introduced a resolution appropriating $484.55 from
the -Street and Alley Fund and ordering payment made to G.Schwartz & Company, for 12
days steam shovel rent at 025.00 per day,105 hours steam shovel operators time,at
$ 1.15"per hour, and 116 hours fireman's time at $.55 per hour,which was read.
Upon motion by Hicks, second by Vihstadt, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Alderman Dallman introduced the following, resolution, Waich
was read: ,
"Be it resolved by the Common Council of the City of
Ro chest er, Minnesota:
That the sum .of $357.27 is hereby approAriated and it is
ordered that the said sum be paid to the Mid -Continent Petroleum Corpora-
tion, for gasoline,kerosene and oil furnished September llthi1931, and
during October 15th,1931, to November 16th, 1931; $72.80 thereof to be
from the General Fund, $3.27 thereof to be from the Sewer Fund and 0281.20
thereof to be from the Street ,and Alley Fund.
The Mayor and City Clerk are hereby authorized and directed
to draw warrants .upon the City Treasurer and m.,.ke payment accordingly."

Upon motion by Amundsen, second by Miller, that the said
resolution be adopted'as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Upon motion by Hicks, second by Dallman, John McG.Miller,
Architect, was authorized to provide for the installation of a sink for
the washing of photograph print$vin the Hertillion room in the basement
of the new City Hall, at a cost of not to exceed $75.00.
Alderman Dallman introduced a resolution ordering the
construction of a sanitary sewer along the North 4 feet of Lots 5 and 10,
in Block 88, in Original Plat, from a point 45 feet west of a continuatign
of the west line of Second -Avenue Southwest to a point 25 feet east of
the center line of Third Avenue Southwest, and thence south 70 west 196
feet to manhole in place, ordering that the said improvement be paid for
by special assessments levied as provided by law, and ordering that the
City Engineer prepare and submit plans, profiles, specifications and
estimate of cost for the construction of the said sanitary sewer, which was
read.
Upon motion by Moody ,second by Vihstadt , that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
The City Engineer submitted plans, profiles, specifications
and estimate of cost for the construction of the above described sanitary
,sewer, the estimate of cost thereof being $523.25.
Alderman Amundsen.introduced a resolution adopting the
plans, profiles and specifications for the sanitary sewer above described,
and ordering that the same be placed on file in the office of the City
M Clerk, accepting the said estimate of cost and ordering the same placed on
file in the office of the City Clerk, ordering that the said improvement
be made and done and that the cost thereof be paid for by special assess-
ments levied by law, ordering notice of hearing on the said improvement for

Upon motion by Hick$, second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
The matter of placing gravel on what will be Fifteenth Avenue
Southeast, between Second Street Southeast and Fourth Street Southeast, was consider-
ed by the Common Council, and President Liddle refsrred the subject to the Street and,
Alley Committee and the City Engineer with power to act.
Upon motion by Hicks, . second by Amundsen, the City Engineer was
authorized to purchase two sets of socket wrenches at a total cost of $57.50.
