Meeting called to order by President Liddle. Roll Call, Present: Liddle, ft13jAan, Hicks, Miller, Moody, Vihstadt./ Absent: Amundsen. / This being the time and place fixed for the opening of proposals for the purchase of $3,000.00 City of Rocl,.ester, Minnesota, 4 Sewage Disposal Plant bonds, the following proposals were opened and read: Webb,Hemenway & Company, par and accrued interest from December lot, 19319for' $3,000 -00; Rochester Fire{ Department Re�ief Association, per and accrued interest from December lots 19319 for $3000.00; Mary A.Ved�der Trust Estate, par and accrued interest from December 1st, 1931, for $1,000.00; Mrs. Frank Quick, par and accrued interest for $3,000.00 or $1,000.00 or $29000.00 if the $3000.00 were not available. This being the time and place fixed for the opening of proposals for the purchase of $8000000 19ity of Rochester, Minnesota, 42% Permanent Improvement Revolving Fund bonds, the following proposals were opened and read: Union National Bank, per and accrued interest from December 31st,1931, for $2000.00 maturing December lot, 1933, :and $2000.00 maturing December lot, 1934; Webb, Hemenway & Company, par and accrued interest from December 31st91931,for $8000.00 issue; II • i Rochester Fire Department Relief Association, par and t accrued i terest from December 31st,19319for $3000.00 of this issue if they were not warded the $3000*00 of the Sewage Disposal Plant bonds; Mrs Frank Quick, par and accrued interest for some of I Vthis issue if she was not awarded'$3000.00 of the -sewage Disposal Plant bonds. Alderman Moody introduced a resolution accepting the proposal of the Union Natlanal Bank for the purchase of $4000:00 of the City of Rochester, Minnesota, 4�% Permanent Improvement Revolving Fund bonds at per and accrued interest of $12:509which was read: Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 5859 Alderman Miller introduced a resolution accepting the proposal of Mrs Frank Quick for the purchase of $3000.00 City of Rochester 42-% Permanent Improve- ment -Revolving Fund Bonds at par and accrued interest of $9.38, which was read. Upon motion by Hicks, second by Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution accepting the proposal of the Rochester Fire Department Relief Association for the purchase of $1000.00 City of Rochester, Minnesota, 4"•Permanent Improvement Revolving Fund Bonds, at par and $30;13 accrued interest, which was read. Upon motion by Moody, second by Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the i said resolution duly .passed and adopted. Alderman Vihstadt introduced a resolution accepting the proposal of , I{ the Rochester Fire Department Relief Association for the purchase of $20000.A,City of Rochester 4 Sewage Bisposal Plant bonds at par and accrued interest of 4[14.519whichi was read. Upon motion by Dallman, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted.' i Alderman Dallman introduced a resolution accepting the proposal of Mary A. Vedder Trust Estate for the purchase of a $190000'00 City of Rochester, Minnesota, 4 Sewage Disposal Plant Bond at par and accrued;.interest of $7.26, which was read, Upon motion by Moody, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Vihstadt, second by Dallman, it was ordered that the checks of the unsuccessful bidders for the above mentioned bonds be returned to them.. Alderman Amundsen came in at this time and took his Chair. The report of the Building 'and Electrical Inspector for the month of collected December91932, showing building inspection fees in the amount of $55400 and electrical inspection fees collected in'thd amount of $7.009 was read, and President Liddle referred the same to the Finance Comnittee. The report of. the Clerk of the Municipal Court for the week ending January 18th91932, showing ctiminal fines collected $3.409 civil fees received $7.20, ' Court costs charged to Olmsted -County $3.75, and fines collected and remitted direct to State Treasurer $100409 was read, and President Liddle referred the same to the City Attorney. The report of the Weighmaster for the month of November, 1931,showing I weighing fees collected in the amount of $19080, and for the month of December,l931, showing weighing fees collected in the amount of $25080, were each read and President! , Liddle referred the same to the Finance Committee. Seneral Balance sheet, trial balance, fund statement., statement of unexpended budget approPriatings, statement of Sinking Fund investments, statement of account with Treasurer of Olmsted County, etc., prepared by the City Clerk as of December 31st,1931, were laid before the Common Council, and President Liddle ordered that the same be placed on file i The application of C1aud6 L. Dear Si r: Herewith is a list of the polling places of the City of Rochester, Minnesota, which will be effective for the coming primary and charter elections, if the same are not changfed to conform with the election laws, and in that connection I would like to have your written ruling as to whether each of these locations qualify as a polling place for the City of Rochester, Minnesota, or not. Dear Sir: I have your inquiry of the 19th relative to the matter of the location of the polling places for the coming primary and charter elections and have given the locations thereof as established in the list enclosed in your letter due consideration. You are advised that each of the places including the change in the Third District of the Second Ward are legal and proper polling places under all of the elections laws governing the same. Lawler made complaint about the drainage of the alley in the rear of his dry cleaning works and President Liddle referred the matter to the Street and Alley Committee and the City Engineer. The olaim of Spencer Holloway,,193.96, for repairs to his automobile after a collision with a City owned motor driven road grader, was read and upon motion by Hicks, second by Moody, the said sum was appropriated from the Street and Alley Fund',and it was ordered that the same be paid to Spencer Holloway for the purpose stated, all voting in favor thereof except Alderman Miller, who voted "Nay". The claim of Ub]� D. Adams, $64.80 for repairs to his automobile after having driven into an unguarded hole Lt the street at the intersection of Eighth Avenue Southwest and Seventh Street Southwest, was read, and upon motion by Hicks, second by Moody, this claim was referred to the City Attorney and the City Engineer for their consideration and report thereon. The bond of Charles Shields,as Treasurer of the Rochester Fire Depart- went Relief Association, with the Aetna Casualty 4nd Surety Company as surety thereon in the amount of y$4824.14, given to guarantee the proper care and disbursement of the Gr r8 M .1,2421002 appropriating which is to be made at this meeting payable to the Rochester Fire Department Relief Association, as being the 1931 tax collections for relief of Firemen and their wi.dows,etc., was read, and upon motion by Hicks, second. by Vihstadt, the said surety was 'accepted, the said bond was approved and it was ordered that the same be placed on file. The :License bond of Maass & McAndrew Company, covering their license to connect with seders and drains, with the National Surety Company as surety thereon in the amount of $1000:009 was read, and upon motion by Hicks, second by Amundsen, the said surety was accepted, the i; said bond was approved,and it was ordered that the same be placed on file subject-5 however, to the Maass & McAndrew Company making acknowledge- ment thereon duly witnessed, and attested by a notary public. The Electrician's license bond of Paul Plantz, with the National Surety Company as surety thereon in the amount of $1000.00, was read and upon motion by Hicks, second by Dallma n, the said surety was accepted, the said bond was approved and it was ordered that the same be placed on file, subject, however,. to him making acknowledgement thereon duly witnessed, and attested by a notary public. r The following license bonds were read and upon motion by Vihstadt, second by Moody, the sureties on each of them were accepted, each of the said bonds were approved, and it was ordered that each of then be placed on filet H. &' Ye Electric Compare electricians license bond, with the Aetna Casualty & Surety Company as surety thereon in the amount of $1,000,000; J. Nagle as a Special Policeman for duty at the Woodman Hall, to serve without pay and to hold office until the second Monday in April, 19329 unless soener �9 removed, were each read, and President Liddle ordered that the same be placed on file. f k communication from the Health Officer, recommending that the license heretofore granted to Jim Vader, allowing_him to peddle eggs, be revoked, as he has not passed a satisfactory physical examination, was read, and President Liddle instructed tl�.e City Clerk to furnish the Police Department iArith, a copy of the Health Officer's recommendations,and request that Department to check on this j person and see whether he ds peddling or not and if he is to see that hep stops until he has satisfied the Health Department that he is entitled to have a peddlers R license issued to him and has paid for the examination and the license fee. T. Collin, 0840,009 for fire insurance on the Witherstine property; P. F. Kelly $81.00 for fire, lightning, and transportation, and windstorm I insurance on the ##54 International truck, and P. F. Kelly $55.40, public liability and property damage insurance on the #54 International truck, and of T. F. Kennedy 16.00 for tornado insurance on the Witherstine property, were each read, and upon motion by Dallman, second by Hicks, the claims were allowed and it was ordered that the same be paid; the Collin and Kennedy claims to be from the Rei�ereli tindi%nd the Kelly claim to be from the Street and Alley 'Fund. Alderman Vihstadt introduced a resolution appropriating $718485 from the Park Improvement Fund acid ordering payment made to the Mayo Trust Fund for payroll for labor during the week ending January 15th919329 which was read. Upon motion by Miller, second by Ricks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced a resolution appropriating $398.85 from the Sewer Fund and ordering payment made to the City of Rochester Licht Department, for power furnished at the Sewage Disposal Plant, under billing of January 15th91932 , which was read. Upon motion by Moody, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced' -the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $2421:02 be &3md the said sum is hereby appropriated from the Firemen's Relief Fund of said City and ordered paid to Charles Fe Shields, Treasurer of the Rochester Fire Department Relief Association, being the amount of tax collections during 1931 for the relief of firemen,ete., and the interest collected thereon. The Mayor and^City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made. " Upon motion by Vihstadt, second by Moody, teat the said resolution be adopted..ss read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of'$314185 be and the said sum is hereby appropriated for payment to the Queen City Oil Company for gasoline, grease and kerosene furnished during the period November 1st, 1931, to January 8th,1932, . inclusive: $42. 31 thereof to be from the General Fund, $.76 thereof to be from the Sewer Fund, and $271e78 thereof to be from the Street and Alley Fund. • The Mayor and City Clerk of said City are hereby authorized and directed to draw warrants upon the City Treasurer and make payment accordingly." Upon motion by Amundsen, second by Hicks, that the said - resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced the following resolution,which was read: "Be it resolved by the Common Council.of the City of -tochester, Minnesota: i •4 593 That the sum of $1800.00 is hereby appropriated from .Code 1 of the General Fund of said City and it is ordered that the said sum be paid to Code 18 of the General Fund of said City, as a temporary transfer of the said sum to create funds in the said Code 18 for use in making a temporary transfer to the City Farm Fund -of said City. I . The Mayor and City Clerk of said City are hereby authorized and directed to draw a warrant upon the City Treasurer of said City and make the said transfer accordingly." Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof', President Liddle declared the said resolution duly passed and adopted. i Alderman Moody introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: i That the sum of $18000'00 is hereby appropriated from the General Fund Code 18 for payment to the City Farm Fund of said City as a temporary transfer of the said sum for use in payment of delinquent claims against the said City Farm Fund, for hogs furnished to the City Hog Farm. j The Mayor and City Clerk of said City are !�.ereby authorized and directed to draw a warrant upon the City Treasurer and make the said transfer accordingly. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Amundsen introduced a resolution making appropriatians for transferring funds to pay for use of equipment, which was read: Upun motion by Miller, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly.passed and adopted. i Alderman Hicks introduced a resolution appropriating $12.80, as a transfer for use of equipment, which was read. i Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hallman introduced a resolution appropriating $50.00 as a transfer for use of the motor driven flusher-rqpprinkler, which was read. Upon motion by Vihstadt, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating $69.86 as a transfer of funds for supplies used, which was read. Upon motion by Vihstadt, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, Presiden$Liddle declared the said resolution duly passed and adopted. Resolution passed by -tithe Whitlock -Sonnenberg Post No.1215, of the ii Veterans of Foreign Wars, and the William T. McCoy Post No.92 of the American i Lerrion, endors6d; by the North Rochester Improvement Association, recommending an eight hour day and forty hour maximum week, in the program of forty-one different improvements that might be made and done to relieve the local unemployment situation; was read, and after a discussion of it President Liddle ordered that the same be placed on file. Thomas J. O' Schaughnessey, cevmmander of the Vetotane of Foreign Ware, J. W. Feller, Commander of the American Legion, Charles Mohn, President of the Trades & Labor Assembly, Fred R. Witzke , President of 'the North Rochester Improvement Association, the Mayor, Wm. A. Fitzgerald, Matt Fitzpatrick and Erivin L Briese, talked in support of this program, as did Rev. A. R. Zick, with the exception that be cautioned against the use of bond issue funds -or general taxation for the relief of the unemployed, and stated that it is impossible to keep up propperity by taxation in any form, and recommended a charter amendment so that profits from the municipally operated public utilities can be used for reducing taxation. President Liddle cautioned that the assessment projects which are included in this program should originate with those benefited. Upon motion by Vihstadt, second by Amundsen, the City Engineer was instructed to prepare plans, profiles, specifications and estimate of cost for the so-called Manley Addition cutover, being a connection from the trunkline sewer running west and under Cascade creek to provide sanitalq sewer facilities for that part of Manley Addition which lies west of Cascade Creek and North of Ninth Street Northwest. Upon motion by Amundsen, second by D9.11ma -, the City Attorney was instructed to oarry:;-the request of this Common Council to the Charter Commission that they preparQ and submit an amendment to Section 178 of the Charter df this City as now amended, which will increase -the limitations of the City of Rochester sewer bonds from $25000.00 outstanding to $150,000.00 outstanding at ary one time. Alderman-Vihstadt introduced an ordinance to amend an ordinance entitled"An Ordinance regulating the operation and rates of fate for taxicabs and automobiles for carrying passengers for hire with a seating capacity not to exceed -seven passengers within the City of Rochester", which was given its first reading. A discussion of this ordinance, which would provide a mdxi- mum rate of fare for seven passen-ers or less of -twenty five cents for the first half mile or fraction thereof, and ten cents for each succeeding quarter mile or fraction thereof and a minimum rate of fare for seven passengers or less of twenty five cents for ,the first mile or fraction thereof and ten cents for each succeeding h :.lf mile or fraction thereof, 'brought the decision of Alderman Vihstadt that this ordinance amendment should be *itbArawn for correction as to the elimination of the maximum rate of fare, and he made request that he be allowed to withdraw this ordinance. tj`1 Upon motion by Hicks, second by Amundsen, Alderman Vihstadt was allowed to withdraw the above mentioned ordinance, and it was returned to him: Alderman Moody introduced the following resolution, which was read: "Be it resolved by the Common Council of the 91ty of Rochester, Minnesota: That the following named persons are hereby appointed judges of election for the City Primary Election to be held, February 23rd919329 and for the Charter Election to be held March Sth, 1932: e First WArdi,itii.: First District: C.
