HomeMy WebLinkAbout02-01-193296 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the second l; floor of the Chamber of Commerce building of said City, at 2:00 o'clock P.M., on February 1st, 1932. Meeting called to order by President Liddle. i !� Roll Call.. Present: Liddle, Amundsen, Dallman, Nicks, Miller, Moody, Vihstadt. Absent: None. Upon motion by Vihstadt, second by Moody, the minutes of the meetingsheld on January'llth, 1932, January 15th;1932, and January 25th, 1932, were each approved. The reports of the Clerk of -the Municipal Court, for the week end�_ng January 25th,1932, showing criminal fines collected $30.00, civil fees received $4 05, Dec6mber,1931 Olmsted County municipal court fees collected in the amount of $39i30,.and court costs charged to Olmsted Count.-ly $35.70; and for the week endin�*February lst,1932, showing criminal fines collected y$45,00, civil fees received $4435, and court costs charged to Olmsted County $9.70, were each read, and President Liddle referred the same to the City Attorney, The City'Engineer's'report for the month of January91932, showing $.55 expended from the General Fund for labor, �$3497 86 from the Street and Alley Fund, $224.45 from the Sewer Fund, $3.30 from the $ ridge TUnd and .9362.45 from the Permanent Improvement Revolving Fund, v&84.Tead; and President Liddle ordered that the same be placed on file. The balance sheet, income statements,etc., of the Public Utility Departments prepared by the Secretary of the Public Utility Board a3 of December 31st,19319 were laid before the Common Council, and President Liddle ordered that thy - same be placed on file; the said income st"'t:­ment showing a net profit in the Light Department for the month of December,1931, of $15570909, and a net profit in the Light Department for the nine months of this fiscal year of $100314011, and a net profit in the Water Department for December,19319 of$$522408, -and a net profit in the Water Department for the nine months of this fiscal year of $326014,89; and a net profit in the Steam Heating Department for the month of December,1931, of v$982.409 and for the nine months of this fiscal year of $1577 85. The report of the Plumbing Inspector for the month of January 1932, showing plumbing inspection fees collected in the amount of $33.75, was read, and President Liddle ordered that the same be placed on file. Upon motion by Vihstadt, second by Amundsen, the sum of $33.75 was appropriated from the General Fund and it was ordered that the said sum be paid to Don E. Postier as extra salary for services as Plumbing Inspector during January,1932, in accordance with resolution passed and adopted July 6th,1931. 597 The application of H. W. DeWitt, and H. B. DeWitz, for license to sell soft drinks at 611 Broadway Street North, was read, and upon motion by Hicks, second by Vihstadt, license was granted. The following applications for publibsdance permits were read: a Degree of Honor Lodge by Mrs. Bertha Paine, for the Woodman Hall.. February 9th91932; A. G. Berndt, for the Woodman Hall, February 13th, 20th, and 27tr, 1932, and March 5th,1932; J. L. Cronin, for the.Woodman Hall February 2nd, 1932. A petition that & sanitary sewer be constructed in Third Street Northeast, approximately 138. feet or less to 1 foot east of the west line of Let`_.15,.`.Bl ck;:,6 in Morningside Addition, and 1 foot east of the west line of Lot 5, Block 79 Morningsridd:, Addition, was read, and upon motion by Vihstadt, second by Hicks, the City Clerk was instructed to prepare proceedings for the construction of the ,aaAdtary sewer as petitioned for. The appointment by the Mayor of Carlton E. Anderson as a Special Patrolman during the period January 28th,1932, to February 2nd, 19329 inclusive, was read, and President Liddle orderod th;=.t the s34ne be 1)1�.ced on file. The followingestimates prepared by John McG.Miller, Architect for the new City Hall, were each read, and President Liddle ordered that the same be plated on file: i Estimate No.5 in favor of G.Schwartz & Company on General contract for the construction of the new City Hall $ 10,499,4©; i Estimate No. 5 in favor of Herman Dornack on contract for plumbing and heating installation in new City` Hall $3329,39; Edtim.ate No.3 in favor of L. A. Kapp Electric Company on contract for; electric wiring for new City Hall $688.50. .The application of James R. Ryan for appointment as janitor of the new City Balls -was read, and President Liddle ordered that the same be placed on file.; Upon motion by Hicks, second by Amundsen, the City Clerk was ordered to cancel the account of $6.24 against the Olmsted County Fair Association for the 1931 sprinkling, etc., at the fair grounds. Upon motion by Hicks, second by Moody the following claims were referred to the City Attorney with instructions that he enforce collection thereof: A. E. GATES $3047, H. & H. Sanitary Dairy Co. $$16.38, Leon Joyce $34.819 Rochester ,Morning Journal $7.509 Saint Mary's Hospital $3658.729 Arthur Sonnenberg $3.20, Upon motion by Hicks, second by Dallman, the sum of $160.00 was appropriated from the General Fund and it was ordered that the said sum be paid to Mrs. Catherine Fritsch, as compensation for the death of Christopher F.Fritsch during the period December 3rd,1931, to January 26th919329inclusive, i The claim of McGeary Motovot Inc., $94.78, for expenses of two of the .'Committee members who went to Chicago September 9th,1931 to September 13th91931, for inspection of fire fighting equipment, was read. The said claim was accompanied by a statemeht of the costs for the three.members of this committee totaling $138.179 and upon motion by Amundsen, second by Moody, the sum of $138.17 was appropriated from the Fire Protection Fund and it was .ordered that the said sum be paid to the McGeary Motors, Inc., for the expenses of the said three con®nittee members, provided that the McGeary Motors,Inc., make sworn claim for the $43.39 in addition to the above mentioned $94.78. Alderman _ Dallman introduced a res olut iqn appropriating $710.13 from the Park Improvement Fund and ordering ;Payment made to the Mayo Trust Fund for payrolls for labor during the wehkending January 29th, 1932, which was read. Upon motion by Hicks, second by,Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriaging $688v50 from the Hew City Hall Fund and ordering payment made to the L.A. Kepp Electric Company, for payment of estimate No.3 on contract for electric wiring for the new City Hall, which was read, Upon motion by Dallman, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President iddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating $3329439 from the New City Hall Fund and ordering payment made to Herman Dornack as estimate No. 5 on contract for installation of plumbing, and heating in new City Hall, which was read. Upon motion by V;Lhstadt, second by Amundsen, that the said resolution be adopted as read, and all. voting in favor thereof, President iddle declare d the said resolution duly passed and adopted. Alderman ' Dallman introduced a resolution granting public dance permit to JO C'. Cronin for the Woodman Hall-, February 2nd,1932 , and fixing the fee at $5409 which was read. Upon motion by Vihstadt, second by Amundsen, that the said .,resolution be adopted as read, and all voting in favor thereof, President jLiddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution granting public ;;dance permit to A"VQ..Berndt,for the Woodman Hall, February 15th, 20th, and I E j27th, 1932, and March 5th,1932, and fiutng the fee at $20e00, which was read* Upon motion by Dalman, second by Hicks, that the said resoln *ion be adopted as read, and all voting in favor thereof, President Liddle declared the saidresolut ion duly passed and adopted. Alderman Dallman introduced a resolution granting public dance permit to the Degree of Honor' Lodge for the Woodman Hall, February 9th,1332, and fixing the i fee at $5000, which was read. Upon motion.by Hicks, second by Dallman, that the said resolution be Idopted as read, and all voting in favor thereof, P resident Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $10499.40 from the New. City Hall Fund and ordering payment made to G. Schwartz & Company as payment of Estimate No.5 on the general contract for the construction of the new City Hall, which was read. UpOn motion by Moody, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, Presidmnt Liddle declared the sadd resolution duly passed. -and adopted. John McG.Miller, Architect for the new City Hall, presented plans and; i specifications and estimate of cost for the lighting 'fixtures for the new City Hall; the said estimate of cost being $5200.00. Alderman Moody introduced the following resolution, which was read: 'WEREAS, It is deemed expedient and necessary that the electric fixtures for the new City Hall building be purchased and installed, and WHEREAS, John McG.Miller, Architect, and G. M. Orr & Company, consglting Engineer, have prepared and submitted plans and specifications and estimate of cost for the said electric fixtures and installation; SO THTREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said electric fixtures be purchased and installed and that the said plans and specifications be adopted for the said purchase and installa- tion and that the same be placed on file in the office of the City Clerk .of said City, and that the said estimate of cost. be accepted and placed on file in the office; of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of said City, be and he is, hereby authorized and directed to advertise for sealed proposals for the fuirishing and installation of the said electric fixtures in accordance with the plans and specifications for the same, which sealed proposals will be received and opened at a meeting of this Common Council which is to be held 11 at 7:30 o'clock P.M., on February 15th, 1932., in the Council Chambers, in the second floor of the Chamber of Commerce building in said City. ; it Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the ?Mayor of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which eheek and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the bidder upon the letting fif the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. A surety bond written for the full amount of the contract by a surety Compariy authorized to do business in the State of Minnesota, will be required with the eontracto (Personal bonds not to be accepted.) i All proposals must be addressed to Mr. A. F. Wright, City Clerk of Rochester, Minnesota, and shall have endorsed thereon "Proposal for the furnishing I! and installation of electric fixtures in the New City Hall." Bidders may have access to plans, and specifications which are on file at the following places; City Clerk's Office at Rochester, Minnesota (Official File). Office of John McG.Miller, Architect, at 2ochester, Minnesota. Office of G. M. Orr & Co., Consulting Engineers, at Minneapolis, Minnesota. Office of Builder's Exchange at Minneapolis, Minnesota. Upon motion by Hicks, second by Miller, that the said reso- r Lion be adopted as read, and all votin g in favor thereof, President Liddle 1'declared the said resolution passed and adopted: I1 ' 601 Alderman Moody introduced anrordinehee providing for the licensing, conducting and regulating of auction sales within the City of Rochester, Minnesota, which was given its first reading. Alderman Vihstadt introduced an ordinance amending an ordinance entitled "An Ordinance regulating the op r>rction and rates of fare for taxicabs and automobiles for carrying passengers for hire, with a seating capacity not to exceed seven passengers, within the City of'Rochester", which was given its first reading. George T. Trenholm of the Rochester Bus Line asked for the elimina- tion of the last paragraph of Section 6 of this ordinance, the said paragraph being "There shall be no charge for extra persons regardless of the number of stops made to discharge passengers on one continuous trip, no more shall be charged for the entire trip than the total mileage of said trip, computed at the above rates". John S. Reed requested the adoption of an ordinance safe -guarding the theater going public and expressed the wish that a committee be appointed for the purpose of drafting such an ordinance,with. suggestion that this committee sheuld Electrical include the Fire Chief, Building an specto r, and City Attorney, and members of the! Chamber of Commerce. ' Upon motion by Vihstadt, second by Moody, the City Attorney,thd j Fire Chief, the Building and Electrical Inspector ,and members ofthe Fire Department Committee were designated as a Committee to meet with a committee from the Trades & Labor Assembly for drafting such an ordinance. i John J. Kerr presented the following and requested that the Common Council submit the same to the Charter Commission with recommendation that it be proposed as an amendment to the Charter of the City of Rochester, but no action was taken thereon except that President Liddle ordered that Mr. Kerbs proposed amend- ment be placed on file: "Amend section 120 of the charter of the city of rochester to read as follows. It shall be the duty.of the city engineer to make all surveys, plans and estimates required of him by the common council, or by any provision of this charter and to establish all grades of streets when required by the common council. he shall perform such further duties pertaining to his office as the common council may from time to time require. He shall make surveys of private property as directed by the Common Uouncil 2.nd not otherwise. Any compensation derived from such surveys shall be paid to the city treasurer. The word City engineer as used in this section are to be taken to mean The "City En"ineer and all of his assistants". Surveys of private property are to ,be construed as a contract between the city of rochester and the party or parties who may request said survey. " The Mayor asked that the Common Council support a proposed amendment to the sprinkling provisions in the Charter of the City of Rochester, Minnesota, which would provide that the same be done by general taxation instead of by special assessments. The Common Council took recess for the purpose of informal consider- ation of the Veterans of Foreign Wars and American Legion program for relief of un em to p ymentt, after which the Common Council again convened and were called to order by President Liddle. j �r 11 ("0�' Pesidfnnt Liddle Wt this ti-AO excused Alderman Moody, who ^ left the Council Chambers. Upon motion by Hicks, second by Amundsen, the City Clerk I� was instructed to carry the request of tb.is Coznnon Council to the Charter Commission that they propose an amendment to the local Charter that will regulate the trimming, -planting, etc., of trees on boulevards. j I' Upon motion by Miller, second by Amundsen, the City Clerk was instructed to carry to the Charter Commission the request of this i Common Council that they give consideration to amendments for the Charter that will set up a more workable scheme for sprinkling procedure.
