HomeMy WebLinkAbout02-15-1932(! 0 8 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the second floor of the Chamber 'of Commerce building, in said City, at 7:30 o'clock P.M., on February 15th91932. Meeting called to order by President Liddle. Roll Call. Present% Liddle, Amundsen,' Dallman, Hicks, Miller, Moody, Vihstadt. Absent% Nonee Upon motion by Vihstadt, second by Dallman, the minutes of I! the meetingsheld on February 1st, 1932, February 5th, 1932, February 9th, ji1932, were each approved. A copy of the Minnesota Department of Health Division of Sanitation report on the plans for the proposed sanitary sewer in part of ;Tenth Street Northwest, constructed for service to the Manley Addition, - ,!was read, as was copy of letter from the.City Engineer to Mr. H.A.'Nhitaker, i! Il Hirector of the Division of Sanitation of the Board Ff Health, wherein he 'explains the ratiG:vf the grade for the siphon section of this sewer 111 proiect, were each read, and President Liddle ordered that the same be placed on file. The City Clerk reported that No right of way had been submitted for the above mentioned sanitary sewer and the opening of bids for the construction of this dower were held up until later in the meeting to arrange that all property owners concerned give their consent for the construction of this sewer across their propertys The specifications for the electric fixtures for the new City Hall were discussed. H. P StrehIDow, bidding with the Rochester Electric Company, stated that these specifications are open fo rall bidders and do not restrict proposals to any certain line of fixtures or glassware.-.. as some of the 'local electricians have claimed, which was confirmed by Geo L.-Mortison IF �' ,'of the Electric Supply Company, J: A. Peterson of the Peterson Electric ompapy, and L A. Kepp of the L4 A. Kepp Electric Company. John P.Adyber of' the H & H4 Electric Company, L. C. Fordhen or himself, Ray Mrachek for the A. H. Foster Electric Company, Goo. ordham for the Queen City Electric Company, and Herbert Fordham for the H. Foster Electric Company, each insistil.. that the specifications under iscussion required a bid on anly one type of fixtures and glassware, and hat the maximum fixed for investment in so called special fixtures was laced at such a high figure that it left a possibility for a bidder to ake advantage of that limit by padding his profit to a point quite, near he maximum with the expectation that his bid might get by in the selec- ion of thAt division of the fixture list, and each of the last mentioned 609 speakers asked that the City of Rochester prepare a sketch in detail for these so-called special fixtures in order that each 'fitture manufacturer through their retailer, would have'to bid on the same equipment instead of each manufacturer submitting a detail sketch for the special fixtures that he proposes to furnish, and leavin the selection in the result to the Common Council*' 1 G . M. Orr, of the G. M. Orr & Comp&zW of Minneapolis, the fizm that , prepared these specifications stated that if the City of Rochester prepared fixture sketches for this installation the cost would be in the neighborhood of $500.00 as against what so far has most the City of Rochester nothing, and he estimated that the added cost of fixtures proposed under the special requirement made by these ; city drawn specifications would add at least $2000.00 to the job because of the fact that none of the factories would have the dies or moulds for the fixtures and glass- ware that the city plan might require. i This being the time and place fixed for the opening of proposals for , the furnishing and installgt-ion of the above mentioned electric fixtures, the bid of f� I H. F. Strehlow, of St. Paul, Minnesota, bidding through the Rochester Electric ' Company, the bid of the Electric Supply Company, the bid of the Peterson Electric Company, and the bid of the Le A. Kepp Electric Compsy, were laid before the Common n �r Council. � a A motion by Vihstadt, second by Moody, that the said bids be rejectedf � and that they be returned unopened, and that the architect be instructed to draw 3 plans and specifications in accordance with the suggestions of the opposition to the existing specifications, lost by the following vote: Ayes: Amundsen, Moody, Vihstadtoil f � i Nays: Dallman, Hicks, Miller, Liddle. A motion by '_licks, second by Vihstadt, that the said bids be rejected and be returned to the bidders unopened, carried by the following vote: Ayes: Amundsen, Dallman, Hicks t Moody, Vihstadt, Nays: Miller. j A motion by Hicks, second by Amundsen, carried by all voting in favor thereof, that the architect be requested to submit estimate of cost for drawing of plans and specifications for fixtures, for consideration at the next adjourned meeting of this Common Council. This being the time and place fixed for the opening of proposals for the construction of a trunk line sanitary sewer cutover from the center of the inter-' section of Tenth Street Northwest and the west north and south alley in Northern I Addition 'and running west on the center line of Tenth Street Northwest,if extended , in a straight line to the center of Sixth Avenue Northwest, in Manley's Addition, 1 thence south 77 feet along the center line of Sixth Avenue Northwest to the center of •7 Tenth Street Northwest, in Manley's Addition, and there being a question about the . right of way for this sewer, motion by Hicks, second by Dallman, carried by all voting in favor thereof, that the opening of the bids of DeGraff Wolff, C.G.Fraser j and'Feller Brothers, be; adjourned to 7:30 o'clock P.I., February 16th,1932. Matt Fitzpatrick asked for use of the Council Chambers for open forum discussions of public questions, and upon motion by Vihstadt, second by Hicks, such use was granted when these chambers are not in other use. A communication from the Briaschi-Minutt Company,Inc. , of of St. Paul, Minnesota, Bub -contractors for the plastering and terrazza work on the new City Hall, concerning the employing of special men who are not residents of the city of Rochester, Minnesota, was, read, and President. Liddle ordered that the same be placed on file and that Q. Schwartz & Company, #eneral contractors on the new City Hhll,be requested to be before this Common Council, at a meeting thereof to be held February 16th,1932, at which time the granting of exceptions as to these special men will be discussed. The report of the City Weighmaster for the month of January, 1932, showing $32:40 collected .for weighing fees was read, and President Liddle referred the same to the Finance' Committee. The report of the Health Officer for the City Farm for the month of January91932, showing receipts in the amount of $2242.50, disburse- ments in the amount of $2347.09, and an overdraft of $46..36, was read, and President Liddle ordered that the same be placed on file. The City Engineer's trial balance of disbursements in his and department during -,his fiscal year, to/including January ,1932 , was iead, and President Liddle ordered that the same be placed on file. The report of the City Treasurer for the month ending January 31,1932, showing $266010.67 as being on hand at that time, was read, and President Liddle ordered that the same be placed on file. The report of the Clerk of the Municipal Court, for the week ending February 8th919 2 , showing criminal fines collected $13.40 , civil fees received ,$.25 court costs char'ged to Olmsted County $190601, and fines collected dnd paid direct to State Treasurer $100.00,; and for tyre week ending February 15th91932, showing criminal fines collected $3.009 -civil, fees received OL9.-35, and 'court costs charged to Olmsted County '$4.75, were each read, and President Liddle referred the Name to the ffity Attorney. IJ The annual report of the City Engineer for the year Aeginning I February 1st, 1931, and ending Jarivary 29th,19329 was submitted, and President Liddle i, ordered that the same be placed on file. The report of the Milk Inspector for the month of January,1932, was read, and President Liddle oredered that the 'same be placed on file. The following request for refund was read, and upon motion by Dallman; second by Amundsen, 110.00 was appropriated from the General Fund fat refund of I licenserfee paid for the dates mentioned, thereby cancelling the permit for dances on those dates; "Feb. 15, 1932. Hain. " the following applications for public dance permits were read: Camp 1645 M.W.A. for the Woodman Hall, February 22nd,1932; Milt.on, J. Bowron for the Woodman Hall, February 17th,1932; L. A. Fellows, for the Armory, February 20th,and 27th, 1932, and March 5th, 1932; _ Otto Van Wey, for the Woodman Hall, February 18th,1932. The application of. Louis Co Precht, for soft drink dealers license at No.39 Fourth Street Southeast, was read, and upon motion by Dallma n, second by Moody, license was granted. The following copy of resolution passed and adopted by the Public Utility Board was read, and President Liddle ordered that the same be placed on file: "Whereas, the Public Utility Board of the City of Rochester, Minnesota did on February 12th 1932 hold a meeting and allowed certain bills, passed 1 certain resolutions and motions, and Whereas, February 12th,1932 was a legal holiday such action therefore' was not legal, THEREFORE, be it and it is here'!:;y resolved by the said Board that all resolutions and motions as adopted on that date be on this date confirmed and ratified by the said.Board and that all bills allowed on that day be allowed as of this date and be it further resolved that the Secretary of the Board be and is hereby authorized and directedito change the date on all proceedings of the meeting of February 12th 1932 to February 15th,1932." !� The appointment by the Mayor of Carlton E. Anderson as a Special Patrolman, February 3rd, 1932, to February 9th,19329inclusive, and February loth, to 15th,19329inclusive, were each read, and President Liddle ordered that the same be placed on file. i i I Upon motion by Vihstadt, second by Dallman, the Mayor and City Clerk were authorized and directed to sign a release in favor of Dr. We C.M%QCarty, and Wm. C. MacCarty, for $70014 damage claim against him for the cost of replacing an i i 0 electric light, pole in Mayo Park, after his automobile had collided with and broke off one of the poles there. A communication from,Captain R. M. Graen, extending an invitation to the Mayor and Members of, the Common Council, that they be guer.ts of Company C. 205th, Inf. M.N.G., at the annual banquet of the organization on February 17th,1932, was read, and upon motion by Hicks, se se^^nd by Vihstadt, the invitation was accepted wit4 thanks. The applicationsof R. J. Thompson, Olia Fjerstad, Raymond Eastlee and Joe Schuster, for appointment as janitor of the New Xity Hall, were reads and President Liddle ordered that the same be placed on file. The following estimates by John McG.Miller, architect, for the new City Hall, were read, and President Liddle ordered that the same be placed on file: Estimate No.3 in favor of the Van Dorn Iron Works of Cleveland, Ohio, $39030'78, on contract for furnishing and installation of jail equipment; Estimate No.4 in favor of the L. A. Kepp Electric Company, "�579.60, on contract for electric wiring of, t1ae new City Hall. Upon motion by Hicks, second by ]Vihstadt, the Mayor -and city Clerk were authorized and directed tc execute a bill,, -Of sale in favor of the Tri-State Telephone & Telegraph Company, transferring the ownership of 17 poles on Broadway Street North, for the sum of $75.00. Upon motion by Hicks, second by Dallman, the City Clerk was instructed to call on the department heads for inventories of supplies and equipment under their charge as of February 29th,197 -2. The claim of the City of Rochester Steam heating Depart- ment $126.00, for heating of the City Hall, in accordance with arrange- ments made at a special meeting of this Common Council, held on January 15th, 1932, was read, and President Liddle ordered -that the said claim be laid on the table for further consideration. The claim of the East.Side Hospital for hospital room 5 days December 16th, to 21st, 1932, at $3.50 per day $17.50, and drugs 01.25, furnished to Louis Koepke of 929 First Street Southwest, was read, er_d upon motion by ?Ticks, secondby Moody, the City Clerk was instructed to communicate with the firm operating this hospital -and state that the City of Rochester has no liability in connection with this account and that the same should be presented to the Board of County Commissioners if this person is unable to pay the account. Alderman Hicks, introduced a' res olut ion granting public (dance permit to Otto Van Wey, •for the Woodman Hall, Februar, l0th91932, and fixing the fee at $5000, which was read. I Upon motion by Moody, second*by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution granting public dance permit to Camp 1645 Modern Woodman of American, for the Woodman Hall February 22nd, 1932, and fixing the fee at 95.00, which was read. Upon motion by Dallmon, second, by Hicks, that the said resolution be adopted as read, amd all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 61.5 r A1dPrman Amundsen introduced a resolution granting public dance permit; to Milton J. Bowron for the Woodman Hall .February 17th,19329 and fixing the fee at $5,00, which was read. Upon motion by Dallman, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. , Alderman Moody introduced a resolution appropriating; S1875.00 from the General Fund and ordering payment made to Earns 9 McDonnell Engineering Company of Kansas C*:ty, Missouri, as the balance on contract for survey and appraisement of local r-as manufacturing and gas distribution system, which was read. Upon motion by Hicks, second by Amundsen, that the said resolution be i adopted as read, and all voting in favor thereof, President Liddle declared the said ; resolution duly passed and adopted. Alderman Vihstadt introduced a resolution appropriating $579.60 from the New City Hall Fund and ordering payment made to L. A. Kepp Electric Company, as estimate No.4 on contract for electric wiring of new City Hall, which was read. ; Upon motion by Dallman, second by Moody, that the said resolution be ! 1 1 adopted as read, and all voting in favor thereof, President Liddle declared the said n resolution duly passed and adopted. .r Alderman Moody introduced a resolution appropriating$3903*78 from the new City Hall Fund and ordering payment made to the Van Dorn Iron Works$ -of Cleveland'; Ohio, as estimate No.31on contract for the furnishing and installation of jail equipment in the new City,Hall, which was read. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Vihstadt introduced a resolution appropriating $244.90 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for pwyrolls for labor during the week ending February 12th,19321, which was read. Upon motion by Vihstadt, second by Amundsen, that the said resolution; be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution appropriating various amounts from various funds for the transfer of supplies used between funds, which was read. i Upon motion by Miller,.second by Moody, that the said resolution be i acopted as read, and all voting in favor thereof, President Liddle declared the said i resolution duly passed and adopted. Upon motion by Dallman, second by Amundsen, the M�-Iyor and City Clerk were authorized and directed to draw warrants in payment of the refunds for return ofj electric fixture plan deposits. Upon.motion by Hicks, second by Amundsen, R. J. Clay, of the General Fire Proofing Company wad authorized to make a survey and plan for filing equipment needs in the new City Hall building at no extra cost to the City of Rochester, Minne-j sota. 616" Upon motion by Picks, second by Amundsen, request ,was made of the Mayor that he issue emergency authorization to the Board of Park ++I Commissioners covering thetearing down of the old mill and the rebuilding of it as a tool house in Soldier Field. j' Upon motion by Hicks, second by Dallma.n, the Common Council adjourned to 7: 30 o' clOdk P.M. , o8 February 16th,1932 .
