City of Rochester, Minnesota, held in the Council Chambers, in the second floor of
the Chamber of Commerce Building, in said City, at 7:30 o'clock P.M., on February
24th,1932.
Meeting balled to order by President Liddle. j
Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller,
Moody, Vihstadt. Absent: None, '
Upon motion by Vihstadt,.second by Amundsen, the minutes of the
meet ingsheld on February 15th,19329 and February 16th,19329.were each approved.
Balance sheet, income statements, etc:, of the Public Utility VOPS t-
ments, prepared by the Secretary of the Public Utility Board, as of January 3191932,
were laid before the Common Council; the said income statements showing a net profit'
in the Licht Department for the month of January,19329 of $18612.36, and a net
profit in the Tight Department for the tftemonthe of this fiscal year of $116926.47;
a net loss in the Water Department for the month of January, 1932, of $3434-e3,
!! leaving a net profit for the ten months of this fiscal year of $32258,26; and a

net profit in the Steam Heating Department for the month of January,19329 of $873:419
and a total net profit for the ten months of this fiscal year of $24511626.
President Liddle ordered that the above reports be placed on file.
�j The report of the Building and Electrical Inspector for the month of!
j January,1932, sho:wan{- $20.00 building inspection fees and $9.50 Electrical Inspection
fees collected, was read, and President Liddle referred the same to the Finance
Committee.
General Balance sheet, trial balance, fund statement, statement of
unexpended budget appropriations, etc., prepared by the City Clerk, as of January j
31st ,1932 , were laid before the Common Council, and President Liddle ordered that
the same be placed on file.
The application of Milton J. Bowron for a dance permit at the I
Woodman Hall, February 24th,1932, was read.
The applicationsof V. C. Nashold, James McNally, Fred C.Mielke,
and James Masek, for appointment as janitor or caretaker of the new City Mall, were

each read, and President Liddle ordered that the same be placed on file.
A communication from Morris B. Lambie, Executive Secretary of.the j
League of Minnesota Municipalities, askirig.'for delegates from this city to the
Minnesota Tax Conference at Minneapolis, Minnesota,, March loth and 11th,1932, was
read, a,id a motion by Vihstadt, second by Dallman, carried that as many of the
Common Council as can attend do so as delegates from the City of Rochester,
Minnesota.

The City Clerk reported service upon him as to the City of Rochester,

new City Mall, was read, and Presidnt Liddle ordered that the same be placed

but assume no responsibility for any damages or in,lu.rles to any
Property or persons on account of the use of the said:.building
for the aforesaid purpose.

A notification of the official designation effective
February 25th,19329 of Trunk '"ighway No.20 between Rochester,Mifinesota, and
Marion, Minnesota, was read, and President Liddle ordered that the same be
placed on file.
President Liddle referred the matter of the condemnation
of what rights the P. F. Johnson heirs may have to the old central fire
station location to the Street and Alley Committee, the City Engineer -.and
the City Attorney.
President Liddle referred the matter of the repairs to the
floors of the bridges on Fourth• Street Southeast over the Zumbro River and
over Bear Creek to the Street an'd Alley Committee, andnthe City Engineer
for, report thereon at the meeting of this Common Council, which is to be
held March 7th,1932.
Upon motion by Miller, second by Moody, tt.ie City Engineer
and such members of the Common Council as may be able to get away, were
authorized to attend the State,. Society of Engineers convention in the
Twin Cities February 25th and 26th,1932,
Upon motion by Hicks, second by Amundsen, the sum of
$$64.80 was appropriated from the Street and Alley Fund and paid to
Neil D. Adams for repairs to autompbijo after damages due to driving intc an
open storm sewer inlet at the intersection of Seventh Street Southwest and
Eighth Avenue Southwest.
The following communication was read, and upon motion by
Moody, second by Dallman, the vacation mentioned therein was granted:

from February 25th, to February 29th, inclusive, to complete the
ten day vacation due for the year 1931-32.

The City Engineer submitted his recommended route for the
Broadway trunk line sewer, for the Third Street and Third Avenue Southeast relief
line, and for the southwest sewage lift station cutover, with request that the
same be placed on file at this time and thus preclude any charges of plagiarism as
to his use of data from the report of Burns & McDonnell Engineering;Company on
their survey of the local sewer system and recommendations for its improvement, and
President Liddle ordered that the same be placed on file. j

A communication from the City Engineer asking that the attached
report made by Hans B. Stromberg, Fellow in Sanitary Engineering, Mayo Foundation,
on the 1931 operation of the sewage disposal plant, be filed as a part of the City
Engineer's annual report recently submitted, was read,and Presidentbiddle ordered
that the said St•romberg report be placed on file as a part of the City Engineer's

report.
The following communication was read, and upon motion by Vihstadt,

second by Amundsen, the jail keys mentioned therein were placed in the custody of i
the City Clerk?

Gentlemen:
The installation of the steel jail equipment has been
completed. The keys to all doors have been handed to me by the
C.W.Olson Company of Minneapolis There are three keys to each
group of doors.
I wish to keep one key to each group of doors until
the building is completed so that the several contractors may
use them. Two keys of each group should be placed in the City
Clerk's Vault: I
I am placing the keys listed below in the hands of
the City Clerk.

Alderman Vihstadt introduced a resolution fixing 2:00

Upon motion by Hicks, second by Moody, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted..
Alderman Moody introduced the following reso lution,which
as read:
",BE IT RESOLVED, by the Common Council of the City of
;;Rochester, Minnesota that the sum of Five hundred ($500:00) Dollars by
land the same is hereby authorized to be expended from the Street and
i!Alley Fund for the use of the City Engineer and the Street and Alley
';Committee for the purpose of overhauling the Nos: 1 and 2 Russell graders."
Upon motion by Moody, second by Vihstadt, that the said
solution be adopted as read, and all voting in favor thereof, President
iddle declared the said resolution duly passed and adopted.
Alderman Moody introduced the following resolution; which
was read:
"BE IT RESOLVED, by the Common Council of
the City of
Rochester,
Minnesota that

Upon motion by Miller, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted..
Alderman Hicks introduced a resolution granting public
dance permit to Milton J. Bowron, for the Woodman Hall, February 24th,1932,
and fixing the fee at $500, which was read.
Upon motion by Dallman, second by Vihstadt, that the said
resolution be adopted as read, and all voting in favor thereof, President
,Liddle declared the said resolution duly passed and adopted.
Alderman Amundsen introdu-ced the following resolution,
which was read:
"WHEREAS, it has been reported to the Common Council of
the City of Rochester, Minnesota that the records, engineer's reports and
valuations an file in the office of the Railroad and Warehouse Commission
of the State of Minnesota relative to the properties of the Tri-State
Telephone and Telegraph Company in the City of Rochester, Minnesota conclu-
sively prove that for many years past the Tri-State Telephone Company, in

the operation of its telephone business in said City, has been charging and collect-
ing improper, unreasonable and illegal rates from the subscribers for the service i
rendered in said city, and
WHEREAS, it has come to the knowledge of the said Common Council that
the Railroad and Warehouse Commission now is, and for many hears past has been,
fully aware of said condition and in conferences with officials of the City of
Rochester has signified its intention to make all necessary surveys .for the purpose
of correcting the -rate schedule now in force in said city, and
WHEREAS, through the medium of the press, the said Common Council has
learned that it is now the intention of the Commission to confine its survey only to
the City of St. Paul and notto make a survey of the City of Rochester, and
WHEREAS, the excessive and unreasonable rates as now being charged by
the Tti-Staid T616phOK6 Caidpsff in the City of Rochester constitute a continuing
and unnecessary burden upon the telephone subscribers and has created a condition
that can be remedied only by appropriate action on the part of the Commission, and
WHEREAS, such action has been frequeibtly requested by the City of
Rochester and no actionof any kind has been taken by the said Commission leading
to a reduction in the telephone rates in the City of Rochester. i
THEREFORE, Be it and it is hereby resolved 'by the Common Council of the
City of Rochester, Minnesota: i
Tgat, on behalf of the City of Rochester and the telephone subscribers
in said City, the said Common Council demand that the Railroad and'Warehouse
ji Commission of the State of Minnesota upon its own motion institute immediate and
appropriate action to remedy the condition at present existing in the City of
I! Rochester, Minnesota. i
Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby directed to mail
to the said Commission a certified copy of this resolution and at the time of
mailing the said copy to request the said Commission to ackzlowledge receipt of tame
and advise the Common Council of the City of Rochester as to the a proximate date
of commencement. of such action as the commission is able to take. E
Upon motion by Amundsen, second by Dallman, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted. i
Alderman Dallman introduced an ordinance providing for the appointment
by the Mayor of Special Policemen to act as School Police, and prescribing their
powers, authority and duties, which was given its first reading.

Alderman. Dallman introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Ro ch ester, Minnesota:
That the following is a tabulated statement of the number
of the votes cast for each person at the Primary Election held on the 23rd
day of February, A. D. 1932, in the City 'of Rochester, as determined by
said Common Council on the canvass of the returns of the said Primary Elec-
Ition made the 24th day of February, 1932, amd that the said tabulated
statement is hereby declared to show the results of the said Primary

John McG..Miller, Architect, submitted..plans, specifications and
estimate of cost for electric fixtures to be used in the new City Hall; the said
estimate of cost being $4000.00.
Alderman Amundsen introduced the following resolution, which was
read:
"WHEREAS, -It is deemed expedient and necessary that the electric
fixtures for the new City Hall building be purchased and installed, and
VAHEREAS, John McG.Miller,- architect, and'G. M. Orr & Company, consult-
ing an ineers, have prepared and submitted plans and specifications for and estimate
of cost for the said electric fixtures and installation;
go THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the. said electric fixtures be purchased and installed and that
the said plans and specifications be adopted for the said purchase and installation
and that the same be placed on file in the office of the City Clerk of said City,
and that the said estimate of cost be accepted and placed on file in the office of
the City Clerk of said City, and '
Be it further resolved by the said Common Council: That the City
Clerk of said City be and he is hereby authorized and directed to advertise for
sealed proposals for the furnishing and installation of the said electric fixtures
in accordance with the plans and specifications for the same, which sealed proposals
will be received and opened at a meeting of this Common Council which is to be held
at 2:00 o'clock P.M., on March 7th, 1932, in the•Couneil Chambers, in the second
floor of the Chamber of Commerce building in said City.
Each bid must be accompanied by. a certified check upon some reputable
bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per cent of
the amount of the bid, which check and the amount of money specified therein shall
be forfeited to the City of Rochester, rinnesota, as liquidateddamages if the bidder
upon the letting of the contract to him shall fail to enter into the contract so let;
the said Common Council reserving the right to reject any and all bids.
A surety bond written for the full amount of the contract by a surety
company authorized to dobusiness in the State of Minnesota, will be required with the
contrast: (Personal bonds not to be accepted.)
All proposals must be addressed to Mr. A. F. Wright, City Clerk of
Rochester, Minnesota, and shall have endorsed thereon "Proposal for the furnishing
it and installation of electric fixtures in the new City Hall:"
Bidders may have access to plans, @Ad specifications which are on
file at the following places;

Those who desire to have a set of these plans and specifications for
use outside of the above mentioned offices, will be required to make a' deposit
with the City Clerk of $104W00 for the set, with a refund of 0700 for the return of
the same in good condition, the difference of $3.00 to go to the architect for the
cost of blue printing, etc. "
Upon motion by Miller, second by Moody, that the, said resolution be
adopted as read, and all voting in favor thereof, President Diddle declared the said
resolution duly passed and adopted.
R• E. McDonnell, of Burns & McDonnell Engineering Company,
submitted their report on the survey of the local sewer system and their
recommendations for improvement and further extensions, and President
Liddle ordered that the same be placed on file for fua:t�ire consideration.
John McG.Miller, architect, submitted plans, specifications
and estimate of cost for wood furniture to furnish the Council Chambers and
Municipal Court room in the new City Hall; the said estimate of cost being
$ 4500.00 .

Alderman Moody introduced the followiing resolution,which
"WHEREAS, It is deemed expedient and. necessary that furni-
ture for the Council Chambers in the new City Hall building be purchased,
and
WHrREAS, John McG.miller, Architect, has prepared and
submitted plans and specifications 'and estimate of cost for the said
furniture,
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, Minnesota: , ,

plans and specifications be adopted for the said purchase and that the same
be placed on file in the office of the City Clerk of said City, and that
the said estimate of cost be accepted and placed on file in the office of

Be it further resolved by the said Co-I-mon Council: That
the City Clerk of said City be andhe is hereby authorized and directed to
advertise for sealed proposals for the furnishing of the said furniture in
accordance with the plans and specifications for the same, which sealed
proposals will be received and opened at a meeting of this Common Council,
which is to be held at 2:00 o'clock P.M., on March 7th,1932, in the Council
Chambers, in the second floor of the Chamber of Commerce building in said
City.

tions for use outside of the City Clerk's office—oill be required'to make a
deposit with the City Clerk of $10.00 for the set, with a refund of $7.00
for the return of the same in good condition, the difference of "3.00 to
go to the architect for the cost of blue printing, etc. "
Upon motion by Moody, second by Dallman, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Upon the suggestion of Alderman Miller, motion by Miller, second by

Amundsen,carried that the City Clerk request of the Health Officer that his
Department cause the chamber maids at the Edward Rotel to stop dusting their
floor brushes, brooms and dust rags out of the west windows of this hotel and
allnwin the dust, etc., from their tools to fall upon the pedestrians using the
sidewalk along the west side of this hotel, and, also that the Health Department
attempt to control the coal dust which the Dodge Lumber & Fuel Company spread into
the atmosphere around the intersection of Second Street Northeast and First Avenue
Northeast, through the use of their coal unloading machinery, wherein the coal is
hoisted to a distribution track which is 40 or 50 feet above the F7round and then at
reachinu its destination is dropped to the storage pile vrith consequent dust
particles deposited over the whole neighborhood.
Upon motion by Hicks, second by Amundsen, the Common Council adjourned:
