Minutes of au;:adjourned regular meeting of the Common
Council of the City of Rochester, Minnesota, held in the Council Chambers,
in the second floor of the Chamber of Commerce building in said City, at
7: 30 o'clock P.M., on March 9th,1932.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, D-11man, Nicks,
Miller, Moody, Vihstadt. Absent: None.
This being the time and place fixed for further action on
the proposals to furnish andinstall electric fixtures in the new City Hall,
a motion by Ricks, second by Amundsen carried that the City Clerk draw a
resolution accepting the proposal of Paul Plantz and E, J. Nietz, doing
business as the Nortrside Electric Company;
The following tabulation of proposals for the furnishing
and installption of electric fixtures, was read, and President Liddle
ordered that the same be placed on file:

Alderman Amundsen introduced the following resolution, which was read:

"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the bid and proposal of Paul Plantz and E. J. Nietz, doing busi-
ness as the Yorthside Electric Company, for the furnishing of all labor, materials,
d quipment, tools, etc., necessary for the furnishing and installation of electric
fixtures in the new City Hall building in said City, in accordance with the plans
and specifications for the same which are now on file in the office of the City
Clerk of said City, viz:
"EL7,CTRIC FIXTURE INSTALL1,TION: We propose to furnish all labor, material and
apparatus for the Electric Fixture Installation using items as specified for the
main base bid, far the sum of Three Thousand Nine Hundred Sixty Five Dollars and
ten cents ($3965.10)"
be and the said bid and proposal'is hereby accepted. 1
The amount of .the bond to be given by the said contractor is hereby
fixed at the sum 'of $3970.00. "
Upon motion by Hicks, second by Amundsen, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the:aaid
resolution duly passed and adopted.
The following tabulation of proposals to furnish furniture for the
Council Chambers and the Municipal Court room in the new City Hall, was read, and
President Liddle ordered that the same be placed on'file:

This: being the time and place fixed for further action on the proposals

City Hall, motion by Miller, second by Vihstadt, carried that the City Clerk be
instructed to draw a resolution accepting the proposal of Schmidt Printing Company,
for the furnishing of the said furniture.

Alderman Moody introduced the following resolution, which
was read:

the furnishing of furniture for the Council Chambers,and Municipal Court

wood furniture and fixture installation for the new City Hall at

Rochester, Minnesota, the undersigned proposes to furnish all labor

and material as called for in the plans and specifications including
all platforms, risers, aldermens' descs, bailiff's desk, chairs, court
tile flooring 3/16" thick
room benches, rails and gates. Also rubber
to be selected by the architect and linoleum tops for the above groups,
which shall also be selected by the architect. All uphol•:3tered chairs
to be upholstered in top grain leather of Eagle Ottowa or equal, color
to be selected by architect. All marble base to be furnished and

installed complete. Bar table and cuspidors to be furnished as per
plans and specifications approved by architect.

�f February,1932, sho*ing $23.25 collected as Plumbing inspection fees, was
read, and President Liddle ordered that the sa.i;e be placed on file.
Upon motion by Vihstadt, second by Dallman, the sum of
$23.25 was appropriated from the General Fund and it was ordered that the
said sum be paid to Don E. Postier, as payment of services as Plumbing
IIInspector during February919321 in accordance with resolution passed

The applications of L. A. Fellows for public dance permit at the Nation-,
al Guard Armory, March 12th, 17th, and. 19th919321, and the application of Roland
Jacobsen, for a public dance permit at the Masonic Temple March 17th,1932, were
each read. i

The application of J. C. Adams, for transfer of taxicab license No.21
now covering a Graham Paige' 5 p&sserigsr Sedan, to cover a 7 passenger Buick Sedan,
was read; and upon motion by Vihstadt, second by Hicks, transfer was granted.

A $$149.81 check from the Franklin Heating Station as'21cents per
thousand cubic feet of natural gas used during February91932 (29,962,000. cubic

feet) was laid before the Common Council, and upon motion by--Vihstadt, second
i
by Amundsen, the City Treasurer was instructed to accept the said $149.81 into
the General Fund of the City Treasury•

The appointment by the Mayor of Carlton E. Anderson, as Special
i
Patrolman for the period March 8th,1932, to March 14th,1932,inclusive, was i
read, and President Liddle ordered that the same be placed on file.

Inventory by the Building & Electrical Inspector of equipment under
his charge was read, and President Liddle ordered that the - same _be placed on file,

and that the City Clerk adjust his equipment records accordingly.

That W. R. Liddle is hereby declared to be elected to the office of
Alderman at Large of said City at the Charter Election held on March 8t h, 19329 to
hold office for two years and until his successor is elected and qualified;

That Carl G. Schwarz is hereby declared to be elected to the office of
!, City Treasurer of the City of Rochester, Minnesota, at the Charter Election held
jMarch 8th, 1932, to hold office for one year and until his successor is elected and
qualified;
That J. W. Anderson is hereby declared to be elected to the office of
City Justice of said City at the Charter Election held on March 8th,1932, to hold

That W. A. Moore is hereby declared to be elected to the
office of School Commissioner of the Third Ward of said City at the Charter
Election held March Bth,19329 to hold office for two years and until his
successor is elected and qualified;
Be it further resolved by the said Common Council:
That the number of persons present and voting at the said
Charter Election, held on March 8tb, 1932, was 22559 of which 1129 voted in
favor of the above mentioned proposed amendment for Section 1.76 as now
amended, and 986 voted against the said amendment and. that there were
140 blank ballots as shown by the returns of the said election as above set
forth;
Be it further resolved by the said Common Council:
That the whole number of persor}s present and voting at the
said Charter Election was 22559 and that it required 1.353 votes, or 60
per cent of those who voted at the said Charter Election to ratify the said
amendment and that there were not more than three -fifths (3/5) of the total
number of votes In favor of the adoption and ratification of the said pro-
posed amendment end that the said amendment did nett receive the necessary
three -fifths 13/5) of the said total votes and therefore was not ratified
and adopted by the voters at the said Charter Election and therefore did not
carry and is not made a part of the Charter of the City of Rochester, Minne-
sota. "
Upon motion by Hicks, second by Moody, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.

Alderman Moody introduced the following resolution, which

"Be itresolved by the Common Council of the City of Rochester,
Minnesota:
That the City Clerk of said City be and he is hereby authorized and
directed to advertise for proposals for the doing of all of the official printing and
advertising for, the City of Rochester, Minnesota, during the official year commencing
i April (4th, 1932, as required and provided for in Sections 126 and 127 of the Charter
; of the City of Rochester, Minnesota, said bids to be received and opened by the
Common' Council of said City at a meeting thereof to be held in the Council Chambers,
in the secondfloor in the Chamber of Commerce building, in said City at 2:00 o'clock
�!P.M., on kpril �4th, 1932; the said Common Council reserving the right to reject any
!I and all bids.
Upon motion by Moody, second by Dallman, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Miller introduced theefoll6*ing resolution, ahich was read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the City Clerk of said City be and he is hereby authorized and
directed to advertise for proposals for being designated as a City Depository under
and in accordance with the provisions of Section 47 to 54, inclusive, and Sections
166 to 177, inclusive, of the Charter of said City_, which are relative thereto, the
said Cormnon Council reserving the right to reject any and all bids.

Upon motion by Hicks, second by Vihstadt, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Dallman introduced a resolution granting public dance permit
to L. A. Fellowe.for the National Guard Armory, March 12th, 17th, and 19th, 1932, and;
fixing the fee at $$15*00, which was read.
Upon motion by Vihstadt, second by Moody, that the said resolution be!
adopted as read, and all voting in favor thereof, President Liddle declared the said_
resolution duly passed and adopted.
Alderman Dallman introduced a resolution granting public dance permit:

to Roland. Jacobsen, for the Masonic temple, March 17th,1932, and fixing the fee at

$540, which was read.
Upon motion by Hicks, second by Amundsen, that the said resolution be:,
adopted as read, and all voting in favor thereof.', President Liddle declared the said

resolution duly passed and adopted.

The City Engineer submitted specifications and estimate of cost for the
1932 sprinkling or treating of btreets, avenues and alleys; the same bein;.� accompanied
by the following communication relative:
"March 1, 1932
Hon. Mayor and Common Council
Gentlemen:
T herewith submit specifications for sprinkling and treating
j of streets, avenues and alleys for the year 1932- and estimate the cost
I'
to be $159369.33.
Note: there has been added to the 1931 program, the following
streets, avenues and alleys:
Alley through Block No.82 Mill Reservation.
6th Street Southwest, Broadway to 2nd Avenue Southwest.
Broadway Street South, 4th Street to 6th Street South.
14th Street Northeast, Broadway to Section line eest.
6th Avenue Southwest, part from 200 ft. north of lltr. St.
to llth Street Southwest.
The streets, avenues and alleys herein tabulated represent
67.11% of all streets, avenues and alleys.
The average cost per mile for tT:!.e 1931 season was $374.31
per mile of $15058.79. Should you decide to sprinkle or treat all
city streets and pay for same from general taxation, the cost would
amount to $2243:3.34, or $7377.55 over and above the costs for 1931,
thus adding 022436.34 to general taxation.

Upon motion by Nicks, second by Dallman, the sprinkling
rate per front foot for the 1932 season, was fixed at the same rate as
used for 19289 1929, 1930 ,and 1931.
Alderman Dallman introduced a resolution designating
streets, avenues and alleys and parts of streets avenues and alleys to be
sprinkled with water or treated with calcium chloride or other approved
dust preventive, and fixing a rate per front foot for the service, with
the balance to be paid from general" taxation, and fixing hearing thereon
for 7:30 o'clock P.M., March 28th,1932, which was Y�?sd.
Upon motion by hicks, second by Amundsen, that the said
resolutionbe adopted as read, and all voting in favor'thereof, President
Liddle declared the said resolution duly passed and adopted.
The following report by the City TAtt`orneY was read and
President Liddle ordered that the name be placed on file:

In my opinion the resolution granting permission to
The Minnesota Northern Natural Gas- Company to lay a main along
Eleventh Avenue Northwest from its main to the plant of the
Rochester Bread Company complies with the wishes of the Co;;.mon
Council as previously expressed regarding the granting of similar
permits.

All parts of resolutions inconsistent with the provisions of this

Upon motion by Hicks, second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
John MCG.Miller, Architect, submitted plans, profiles, specifica-
tions and estimate of cost for the furnishing and installation of steel filing,
steel counters, steel tables, steel desks, etc., for use in the new City Hall build+!
ing.
Alderman Hicks introduced the following resolution, which was read:
"WHEREAS, It is deemed ex
pedient and necessary that steel filing',
steel counters, steel tables, and steel desks, etc., for use in the new City Hall
building, be purchased and installed,
W'FIERE'AS, John McG.Miller, architect, has prepared and submitted
plans and specifications and estimate of cost for the said purchase and installa-
tion,
. SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the said steel filing, steel counters, steel desks, and steel
tables, etc., be purchased and that the said plans and specifications be adopted
for the said purchase and installation and that the same be placed on file in the
office of the City Clerk of said City, and that the said estimate of cost be
accepted and placed on file in the.office of the City Clerk of said City, and
Be it further resolved by the said Common Council% That the City
Clerk of said City be and he is hereby authorized and directed to advertise for
sealed proposals for the furnishinE and installation of the said steel filing,
steel counters, steel tables and steel desks, in accordance with the plans and
specifications for'the same, which sealed proposals will be received and opened at
a meeting of this Common Council, which is to be held at 7:30 u'clock P.M., on
March 28th,1932, in the Council. Chamber;, in the second floor of the Chamber of
Commerce building in said City. '
Each'bid must be accompanied by a certified check upon some repu-
table bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per
cent .of the amount of the bid, which check and the amount of money specified therein
shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the'
bidder upon the letting of tie contract to him shall fail to enter into the contract
so let; the said Common Council reserving the right to reject any and all bids.
A surety bond written for the full amount of the contract
by a surety company authorized to do business in the State of Minnesota,
will be required with the contract. (Personal bonds not to be accepted.)
All proposals must be addressed to Mr. A. F. Wright, City
Clerk of Rochester, Minnesota, and shall have endorsed thereon "Proposal
for the furnishing of steel. filing and furniture for the new City Hall
building."
Those who desire to have a set of these plans and spedi-
fications for use outside of. the City glerkis Office will be required to
make a deposit with the City Clerk of 10000 for the set, with a: refund
of ,$5.00 for the return of the same in good condition, the difference of
$6.00 to go to the architect. for the cost of blue printing, etc."
Upon motion by Miller, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution dilly passed and adopted.

specifications, and estimate of cost for the furnishing of wood furniture
for the new City Hall, exclusive of the Council Chambers and Municipal
Court room.
Alderman Dallman introduced the following resolution, wbich
was read:
"WLTI'RF,A►S, It is deemed expedient ^.nd necessary that wood
furniture for the new City Hall building, exclusive of Council Chambers
and Municipal Court Room, be purchased, and
WHEREAS, John MCG.Miller, architect, has prepared and
submitted plans and specifications and estimate of cost for the said
furniture,
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, Minnesota:
That the said furniture be purchased and that the said
plans and specifications be adopted for the said purchase and that the
same be placed on file in the office of the City Clerk of said City, and
that the said estimate of cost be accepted and placed on file in the
office of the City Clerk of said -City, and
Be it further resolved by the said'Common'Council: That
the City Clerk of said City be and he is hereby authorized and directed to

Upon motion by Moody, second by Hicks, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passe d and adopted.
Alderman Hicks introduced the following resolution, which was read:
"Whereas, The Rochester Bread Company wishes to use natural gas and
to that end desires the City of Rochester to grant to Minnesota Northern Natural
Gas Company the right to icy a main along and under Eleventh Avenue Northwest from
its main in Fifth Street Northwest to the plant of paid Bread Company:
Now, therefore, be it, and it hereby is, resolved by the Common
Council of the City of Rochester, that the Minnesota Northern Natural Gas Company
be, and it hereby is, granted the right to lay a main along and under Eleventh Avenue
Northwest from its main in Fifth Street Northwest to the plant of The Rochester
Bread Company at 300 Eleventh,. Avenue Northwest, and to own, maintain and operate
such gas main for the period .of ten years and to furnish natural gas through the '
same to said plant of The Rochester Bread Company for operation of its plant and
to no other person, partnership, association or corporation, except with the written
permission of the Common Council:
Be it further resolved thatthe rights acquired hereunder shall not
be assignable except to the city of Rochester, and that they are granted expressly
subject to the right of said city to acquire, own and operate said pipe line and to
charge and collect a rate fixed by said city for gas delivered to said plant in the
event that it shall undertake the general distribution of natural gas;
Be it further resolved that by the -laying of the said lines the
Minnesota Northern Natural Gas Company hereby accepts all of -the terms and conditions
of this resolution and specifically gaives any and all objections to the terms and j
conditions hereof." 1
A motion by Amundsen, second by Hicks, that the said resolution be
adopted as read, lost by the following vote: Ayes: Amundsen, Hicks. Nays: Dallman,
Miller, Moody, Vihstadt.
Upon motion.by Amundsen, second by Miller, the City Engineer was
authorized to employ Login Graham as a mechanic for another month on the $160.00
per month basis.
Upon motion by Vihstadt, second by Miller, the City Engineer was
authorised to expend not more than $200.00 for cleaning of the sludge beds at the
sewage disposal Plant.
Upon motion by Vihstadt, second by Moody, the Common Council adjourned,
to 7:30 o'clock P.M., on March 28th,1932. ,
