HomeMy WebLinkAbout03-28-1932659' Minutes of an adjourned' regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the second floor of the Chamber of Commerce building, in said City, at 7130 o' click P.M., on March 28th,1932. Meeting called to order by President Liddle. Roll Call. Present: Liddle, Dallman, Hicks, Miller, Moog. Absent: Amundsen, Vihstadt. Upon motion by Dallman, decond by Moody, ,the Minutes of the meetings held on March 7th, 19329 March 9th, 1932, and March 21st, 1932, were each approved. President Liddle announced this as the time and place fixed for a hearing'on the construction of a sanitary sewer in Third Street Northeast, from the State Sewer 63 feet east of the east line of Fifteenth Avenue Northeast, to a point 44 feet west of the east line of Morningside Addition, a distance of 257 feet, and asked if there was any person present who wished to be heard relative to thisimprove- went sanitary sewer. There was no person present who wished to be heard regarding the said This being the time and place fixed for the openin" of proposals for the construction of the above described sanitary sewer, the following bids were opened and read; Maass & McAndrew Company, Inc.: 8" pipe sewer $.73 .,)er ft., G" on 8" Y's %Iv".80 each, one manhole 050 00; Martin Paulson: 8" pipe sewer $-85 per ft., 6" on 8" Yl s $1.00 each, one manhole $50.009 loose rock excavation $,3.00 per cubic yard, solid rock $6.00. President Liddle referred the above quoted bids to the City Engineer for tabulation and recommendations. Alderman Vihstadt came in at this time and took hia Chair. President Liddle announced this as being the time and place fixed for hearing on the sprinkling or treating of streets, avenues, and alleys of said City during the season of 1932, and asked if there was any person present who wished to be heard relative thereto. There was no person present who wished to be heard concerning the said sprinkling or treating, but a remonstrance of the property owners concerned against the flushing of the alley in Block 45 in Original Plat, was read, and President Liddle ordered that the same be placedon file. Alderman Amundsen came in at this time and took his Chair. � this being the time and place .fixed for the opening of proposals for the furnishing of 180 tons to 300 tons of calcium chloride, F.O.B. Rochester, Minnesota, freight paid, the following proposals were opened and read; Botsford Lumber Company N127.90 per ton, : 0 days net or less '$.21 per .ton cas discount if paid j in 10 days, and the Rochester Ice & Fuel Company, Dodge Lumber & Fuel Company, Fullerton Lumber Company and the Columbia Alkali Corporation, each made the same 1 660 proposals, The Texas Company bid $27.64 per ton, freight paid. to P.ochester, Minnesota. President Liddle referred the said six c)roPosals fcr furnishing of calcium chloride to the Street and Alley Committee and the City Engineer for tabulation and recommendations. Upon motion by Miller, second by.Moody, addendas numbers 1, 2 and 3, prepared by John McG.Miller, Architect,.for the new City Hall steel filing, tables, etc*, plans and specifications, were adopted as a part of the said plans and specifications. This being the time and place fixed far the opening of proposals for the furnishing and installation of steel filing, steel counters, steel tables, steel desks, etc., the following proposals were openedand read: H. S. Adams $10069.599 F. J. Paine Co. $11110.669 Don Milne $11984.03, Luger Buur Furniture Co. %$13101.81, Schmidt Printing Company $13369.54, Quality Print Shop 015635.009 Globe Furniture Company $15756.00. This being the time and place fixed for the opening of proposals for the furnishing and installation of wood furniture in the new City Hall building, exclusive of the Municipal Court room and Council Chambers, the following proposals were opened and read: Schmidt Printing Company, after omitting Counters $6664,609 R. S. Adams $6921.859 Whiting Press v$8672.75, Williams & Carr $$8992,81, F.tJ. Paine Company $9290.159 .Rubenstein Furniture Company. $9389.44,,-.&Leh of the last mentioned five bids being a total after omission of. counters. The bids of the Czolden Rule, Andy's Merchandise Exchange and the Now England Furniture and Carpet Com ary were not considered as they were not proposals io furnish the complete schedule of items. PresidInt Liddle referred each of the above proposals for the furnishing of -steel equipment, etc., and wood furniture,to the architect for his tabulation and recommendation. President Liddle referred the proposals of the Golden Rule, Andy's Merchandise Exchange, and the New England Furniture and Carpet Company to the architect for his consideration. Upon motion by Miller, second by Hicks, further action on the purchase of the said steel equipment and wood furniture was adjourned and continued to 4:00 o'clock P.14. , March 7 0th,1932. The following recommendation from the Street and Alley Committee annd the City Engineer, relative to the purchase of calcium chloride was read, and President Liddle ordered that the same be placed on file: ` i "Rochester, Minn. March.289 1932 TheoHonorable' Mayor &,,.City Council, Ro ch est er, Minnesota Gentlemen: - Supplementing our communication on natural gas filed with you on March ;?l, we wish toadvise that the proposed rated submitted at that time are such that we shall be obliged to take a severe loss on. our operations for several years and until such time as increased sale of gas for house heating and in0ustrial purposes will have materially increased.. We, therefore, ask that this rate scL:Ledule be riven a trial for one year and at the end. of such period t.h.e economic sit- uation relating to the cost of distribution be reviewed and examined by a committee .of the city council with our engineers, and. if it can be shown that the rate has provided an unreasonable return on a reasonable investment in plant and property, newessary for proper distribution of natural gas in Rochester, then we shall agree to a reduction in .rates such that the return will be reasonable. We furtherdiore agree that in no event will, we ask for ,n increase in rates, but will accept our losses until such time as we can increase our sales of natural gas to the point where a reasonable return on a reasonable investment will be realized% Yours very truly, INTERSTATE POWER COMPANY By S:N.Jotdan- - District Manager " Alderman Amundsen introduced a resolution accepting the above mentioned proposal of the Botsford Lumber Company for the furnishing of 180 tons to 300 tons of calcium chloride and fixing the amount of the bond to he given by the said contractor at the sum of 08370,00, which was read. Upon motion by Moody,. second by.Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed end adopted. Alderman Vihstadt introduced a resolution accepting the proposal of Meuse & McAndrew Company, for the construction of the above described sanitary sewer in Third Street Northeast, and fixing the amount of the bond to be given by the said contractor at the sum of $3204V00, which was weed. Upon motion by Vihstadt , second by Moody, ,that the said reelution be adopted, as read, and all voting in favor .thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Amundsen, second by Vihstadt, it was ordered that the certified checks of the unsuccessful bidders for the furnishing of calcium chloride and for the construction of the above described sanitary sewer be returned to them. The following reports from the architect in regard to the proposals for furnishing steel equipment and wood furniture, were each read, and President Liddle ordered that the same be placed on file: " JOHN MCG. Respectfully submitted John McG.Miller " Balance sheet, income statements, etc., of the Public Utility Depaut- ments, prepared by the Secretary of the Public Utility Board, as of'February 29th, 1932, were laid before the Common Council,: and President Liddle ordered that the same be placed on file; the said income statements showing a net profit in the Light Department for the month of February,19329"of $19254.55, and for the eleven months of this fiscal year of $136181.02, a net profit it the Water Department for February,1932, of 125940513, and a net profit in the Water Department for the eleven months of this fiscal year of $34,852.84, and a net profit in the Steam Heating Department, for February,1932, of $1384.34, an a net profit in the steam heating department for the eleven months of $3635.60. The report of the Building and Electrical Inspector for the month of February919321, showing $22.00scollected as building inspection fees, and 19.00 collected as electrical inspection fees, was read, and President Liddle referred the same to the Finance Committee. The report of the Clerk of the Municipal Court for the week endin;� March 14th,1932, showing criminal fines collected $1 120.00, civil fees received $4.359 and court costs charged to Olmsted County $13.90) for the week ending March 21st,1932, showing -criminal fines collected $24.75, civil fees received $5.20, and .fines collected and remitted direct to State Treasurer $29.65; and for the week ending March 28th,1932, showing criminal fines collected $17.80, civil fees received $4.359 court costs charged to Olmsted County $3.40, fines collected and remitted direct to State Treasurer $110.00, and Olmsted County"Municipal Court fees for February919329collected in the amount of $47,059 were each read, and President Liddle referred the same to the City Attorney. President Liddle referred the matter of employing C.M. Boutelle as Superintendent of the Dump at Fifth Street Northeast and - Silver Creek, to the Street and Alley Committees and The General Inspection Bureau fire protection report on the City of Rochester, Minnesota, covering their investigations of conditions in this City, made during October and November,1931, was laid before the Common Council, and President Liddle mrdered:"that thec�same be placed on file. each read: The following applications for public dance permits were Otto Van Wey, for the Woodman Hall, April 7th,1932; Elk's Drum Corps, for the Masonic Temple, April 5th,1932; Ambrose Campion for the Woodman Hall, Mareb 30t•h.,1932; L.A.Fellows, for the Armory, March 26th,1932, and March 26t4 1932, and April 2nd, 7th and 9th91932. 665 i The application of George F. Fordham, doing business as Fordham Electric Company, for an eledttidians license, was read,'and upon motion by Dallman, second by moody, license was granted to -date from March llth,1932. The electrician's -license bond of George'. Fordham, doing business as the Fordham Electric Company, with the Fidelity & Casualty Company as surety thereon in the amount of $19000.06, was read, and upon motion by Miller, second by ; Amundsen, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. The application of Charles L. Wells, for license to connect with sewers and drains,was read, and upon motion by Miller,.second by Dallman, license ' i was granted. The license bond of Charles L. Wells, covering his license to connect with sewers and drains, with the National Surety Comp any'aa surety thereon in the amount of $1,000o001 was read, and upon motion by Vihstadt, second by Amundsen, the said surety was accepted, the said bond4was approved; and it was ordered that the same be placed on file. .A.petition asking that a sanita3y sewer be constructed and a water main laid in Eleventh Street Southeast, , from the sewer lift station to the Chicago Great Western Railroad Company tracks, was read, and upon motion by Hicks, second by D6611man, the said petition was referred to the Sewer Committee and the Water Committee. i The ,applicationsof O.E.McCoy, Wm. F. •Risto, John C. Birumm, M. B. j Fuller, Arthur Mitchel, Albeit S. Chance, Geo. H. ,Parker, and F. W. Mahoney, for I appointment as Custian of the new City Hall, were read, and President Liddle ordered I that the same be placed on file. A communication from Roland L. Bond, supplementing his application for! appointment as Custodian of the City Hall, as to his service in the World War, and a resolution from the Whitlock -Sonnenberg -Post No.1215,Veter.ns of Foreign Wars, -asking for consideration of the Veteran's Preferance Law in filling the office of Custodian of the City Hall, were each read, and President Liddle ordered that the same be placed on file. - Inventories of the library equipment, City Justice and Municipal Court offices, City Clerk's office, election equipment, and Fire Department E equipment, were read, and upon motion by Vihstadt, second by Moody, it was ordered that the City Clerk adjust his equipment records accordingly. The following copies of resolutions passed and adopted by the Public ! Warranty deed given by Christopher Graham and Blanche B. Graham, his wife, to the City of Rochester, Minnesota, transferring title of lands for opening an extension of Ninth Place Southeast, between First Avenue Southeast and the Chicago Great Western Railroad Co. right of way, was read, and upon motion by Dallman, second by Moody, the said warranty deed was accepted, and it was ordered that the same be placed on record. Upon motion by Miller, second by Vihtadt, the Street and Alley Committee and the City Engineer were instructed to confer with the Highway Department officials with reference to the opening of the above mentioned extension of Ninth Place Southeast, between First Avenue Southr- east and the new Trunk Highway No.59. The following request for authority was read, and President Liddle" ordered that the same be placed on file: "DEPARTMENT OF PARTS Rochester, Minnesota To the Honorable Mayor and Common Council of the City of Rochester. Having duly kdvertised for the purchase of one, 12 Ton Truck. (Notice for bids attached.) The Park Commissioners have decided that the bid of Ellis Motor Company for the sum of $790.50 net being best suited. We therefore ask your,Honorable Body permission to enter into contract with the Ellis Motor Company for the purchase of the above named truck. The following communication vies read, and President Liddle ordered that the sane be placed on file: "Kansas City, Missouri March 129 1932 Mr. A. F. Wri ght City Clerk Rochester, Minn.ecsota Dear Mr. Wright: Mayor Reiter requested the writer .to advise the council as to what our fee would be on any work which the City might propose to do in the way of sewer improvements. I This has been taken up with Mr. CcDonnell and we wish to advise that our regular fee for preparing plans and specifications, attending'letting of contracts and making final inspection of completed improvements together with consulting services during construction would be 5°, of the actual cost of such improvements. We would advise that any improvement on the sewage treatment plant which may be contemplated be handled in this manner, however, if the City,'desires, the City Engineer could make surveys and plans for the sewers using our report as a basis, and we will furnish consulting services -for this part of the work for 2% of the actual- cost of the- improve- ment. These consulting services would include -general direction of the sur- veys and plans and our criticism and approval .of the City Engineer's final plans and specifications. Mathews. �i The following copies of resolutions passed and adopted by the Commissioners of the Sinking Fund, were read, and upon motion by Miller, second by Amundsen, the actions set forth therein were approved, and it was ordered that the said copies of resolutions be placed on file: "WHEREAS, It is necessary that the Sinking Fund Investments for the purchase of or the building of .a new City Hall be turned into cash at this time and placed in the Fund through which the City Hall construction costs are paid, and i WHEREAS, The Public Utility Board of the City of Rochester, Minnesota, having heretofore been authorized by the Common Council of said City to make an appropriation from the Public Utility Fund of said City to the Sinking Fund of said City sufficient to purchase the said City Hall Sinking Fund Investments and thereby make zn addition of the same to the Sinking Fund Investments for Electric Light Plant Extensinns, and ' WHEREAS, The said Pu )lic Utility Board have expressed themselves i as being agreeable to such purchase, SO THEREFORE, Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the City Hall Sinking Fund Investments. be sold to the Public Utility 'Fund of said City as an addition to the Sinking Fund Investments for Electric Light Plant Extensions at the par value thereof plus accrued interest to date of delivery thereof, and the City Treasurer of said City is hereby authorized and directed to turn over the said City Hall Sinking Fund Investments to Sinking Fund Investments for Electric Light P1 nt Extensions at the time of the payment into the City Treasury of the said par value and accrued interest. Alderman Miller introduced an ordinance re rulating traffic, the op. -.ration and parking of vehicles, the use of streets for driveway entrances, and designating arterial highways in the City of Rochester, MinnesotaL, which was given its first reading. Alderman Dallman asked that provi.sinn be made for restricting the weight of loads on Fourteenth Street Northwest between Third Avenue Northwest and Eleventh Avenue Northwest, and President Liddle referred the matter to the City Engineer. President Liddle referred the matter of the purchase of a siren for the Chevrolet automobile in use of the Police Department to the Police Com,nittee, 1 with power to act.
