HomeMy WebLinkAbout04-04-1932Minutes of a' regular•meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the second floor of the Chamber ,of Commerce Building, in said City, at 9:00 o'clock P.M., on April 4th,1932. Meeting called to order by President Liddle. Roll Call. Present: Li --'Ale, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absent: None.. Alderman Dallman introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said dommon Council of the City of Ro diester, Minnesota, hereby adopts the following rules and regulations for the order of business of said Common Council: 1.Roll Call. Tht Poll call of the Common Council shall be had and taken in its alphabetical order according to the names of the members, except that the name of the President of the Common Council shall be called only at the first roll call of each meeting and then after that, at that md'eting, only in the case of a tie vote when his name shall be called and vote taken after the expression of each of the other members of said Common Council. 2. Reading and approval of the minutes of the p receeding meeting. 3. At first meeting the appointment of officers and Committees. 4. Public Hearings. 5. Reading of petitions and communications. 6. Report of committees. All reports of committees shall hereafter be made inwriting, unless ordered otherwise by said Common Council. 7. Unfinished business. S. Resolutions and ordinances. 9. Bills and claims. 10.Adjournment. " Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as, read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The application of A. F. Wright, for appointment as City Clerk was read. Upon motion by Hicks, second by Moody, A. F. Wright, was duly appointed City Clerk for the ensuing official yearo The application of James T. Spillane for appointment as City Attorney was read. Upon motion by Moody, second by Dallman, James T. Spillane was duly appointed City Attorney for the ensuing official year. The application of Charles H. Armstrong for appointment as City Engineer was read. The applicationsvdf Manfred H. Waldron and George J. Anderson, for appointment as Milk Inspector, were each read. ' Upon motion by Moody, second by Hicks, Manfred H. Waldron was duly appointed Milk Inspector for the ensuing official year. The application of George F. Strifert and John F. Brennan for appointment as ]unitary Inspector, were each read. Upon motion by Dallman, second by Moody, Geo. F. SVrifert was duly appointed Sanitary Inspector for the ensuing -official year. The application of Loretta Matzke for appointment as Health Office Stenographer was read. Upon motion by Hicks, second by Amundsen, Loretta Matzke was duly appointed Health Office Stenographer for the ensuing; official year. The application of Jose Bosley for appointment as Visiting Nurse was read. Upon motion by Miller, second by Moody, Jove Bosley was duly appointed Visiting Nurse during the ensuing official year. The application of Helen M. Parker for appointment .as Caretaker of the Witherstine Property was read. Upon motion by Hicks, second by Dallman,-the appo tntment of a Caretaker of the Witherstine Property was postponed t,o.' a futiure:rdate, i.e. when the new -City Hall is ready for ,occupancy. The applications of H. L. Shellin, George X. Alexander, A.J.$annon, Charles Hesley, Alvin E: B enike, John Kelly,'Henry Alexander and Don E. Postier, for appointment as BUildinr,Electrical and Plumbing Inspector were each read. Upon motion by Hicks, second by Moody, Don R. Postier was duly appointed Building, Electrical and Plumbing Inspector .for the ensuing official year. The applications of Frank Rasmussen, Luther Slawson, Louie Ba,nick, Rudy Jauret, Carl F.Kuehn, and 3. J. Matulys, for appointment as Custodian of the City Hall, were each read, as was a list of local business men recommending the appointment of M.B.Fuller for this pcsition. The applications of George Kelly and O.r.McCoy, for appointment as City Wei;hmaster, were each read. Upon motion by Dicks, second by Dallman, the appointment of a City Weighmaster and the appointment of a Custodian of the City F.all, was f-)'R 9 adjourned to a later date, i.e. to the opening of the new City Hall. The application of Wm. R. Jones, for appointment as City Scavenger and City Dog Catcher was read. Upon motion by Dallman, second by Amundsen, Wm. R. Jones war, duly appointed City Scavenger for the ensuing official year. Upon motion by Dallman, second by Amundsen, Wm. R. Jones was duly appointed City Dog Catcher during the ensuing official year. The applicationsof Taylor C. Cutshall, H. W. Herric!�, W.E.Mitchell, and Max 0. - Hoppe, for appointment as Assistant Superintendent of the Dumping Grounds, were each read. t The following appointments by the City Engineer were read, and a motion by Amundsen, second by Miller, that the same be approved, lost by the followi vote: Ayes: Amundsen, Miller. Stewart. Private Secretary, Anna M. Drews. Chief Operator at Disposal Plant, John J. Cook. Assistant Operator at Disposal P1 mt. FI.M.Person_;;. Armstrong as Second Assietant;City Engineer carried by all voting in favor thereof. Honorable Common Council City of Rochester, Minnesota Gentlemen: Subject to your confirmation, I hereby appoint Roger L.J.Kennedy as a Park Commissioner of the .First Ward and James 11. The following change of official title was read, and upon motion by Miller, second by Moody, the same was approved: "Rochester, Minnesota, April 4, 1932. Honorable Mayor and Common Council City of Rochester, Minnesota. Gentlemen: Subject to your approval, I report the following changes in official duties and titles in the personnel of the Fire Department of said City,effective on the second Monday in April,1932: Wilbert McHenry and Chi s.F.Shields from Drivers and Caretakers of Steamer to Drivers of International Combination Track. 6911 Respectfully submitted, C. E. Ginther i Chief of the Fire Dept. Dan Mack en R. C.Ranfranz Earl A. Vine " I Upon motion by Dallman, second by Tdiller, Robert C. Ranfranz was appointed as a member of the Firemen's Civil Service Commission for the three years ending on the second Monday in April, 1935, President Liddle referred the matter of a contract and lease with Mrs. LaVera Waldron for gravel pit road privilege and for the furnishing of gravel, to the Street and Alley Committee and the City Engineer and the City Attorney, and requested that the Mayor serve with this Committee. This being the time and place fixed for the opening; of proposals for the doing of the official publication and printing during the ensuing official year, the following proposal was opened and read: "Roch'estbr-Winnesota April 49 1932 Honorable Common Council, City of Rochester, Minnesota 'Gentlemen: In accordance with the advertisement for bids for city printing inserted by the City Clerk, The Post -Bulletin Co., Rochester, Minn., hereby proposes to do all the printing and publishing for the City of Rochester in the Rochester Post -Bulletin, a legal newspaper, at the rate allowed by the statutes of the State of Minnesota for legal advertising. It is further agreed, that if the minutes of the Council are published as heretofore, a discount of 15 per cent will be allowed on all publications. It is further agreed that all publications so desired will be printed in the body type of the newspaper. A bond accompanies this proposal. Respectfully submitted, POST-kBULLETIN CO. G.S.Witherstine. " As Section 126 of the Charter of the City of Rochester, Minnesota, prohibits the acceptance of a proposal that calls for more than 50 per cent of the legal rate for publications, it was agreed that the Rochester Post -Bulletin should be designated as the official newspaper but that no contract be made with them as to the publication costs, leaving them to bill the City of Rochester under the price bid for such legal notices,etc, as may be published. Alderman Dallman introduced the following resolution,which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Rochester Post -Bulletin be and the said newspaper is hereby designated as the official newspaper of the City of Rochester, Minnesota, for and during the ensuing official year. " rM A 0 692 i i i �^ Upon motion by D&llman, second by Flicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. This being the time and place fixed for the opening of proposals for being desie�aated t6s City Depositories for City of Rochester funds, the proposals of the First National Bank, The Olmsted County Bank & Trust Company, the Union National Bank, and the Rochester Loan & Trust Company, were each opened and read; each of them being an offer identical with this quotation: "We will pay on open check account at the rate of one half of one per cent (1/2%) per annum. We will pay on certificates of deposit for not less than six months time at the rate of two per cent per annum, but if withdrawn before six months, at the rate of one-half of one per cent per annum. We will pay on savings accounts for not less than six months time, a# the rate of two per cent per annum, but on amounts withdrawn before six months, at the rate of one half of one per cent per-annum. The First National Bank offered to qualift as a depository for °l200,000.00, the Olmsted County Bank dnd Trust Company for $25000.00, the Union National Bank as $50,000.009 and the Rochester Loan & Trust Company as �=,000.00. The official bond of the Rochester Post T;ulletin.as official! newspaper, with the Fidelity u Casualty Company of New York as surety thereon in the amount o f 1,000.00 . was real. , and upon motion by Hicks, second by Amundsen, the surety thereon was accepted, the said bond was approved, and it was ordered that the said bond be placed on file. Alderman Hicks introduced a resolution designating the First National Bank of Rochester, Minnesota, as a depository for 1'200,000.009 in accordance with their proposal dated March 28th919329 which was read. Upon motion by Amundsen, second by Miller, thaV'the said resolution he adopted as -read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution designating the Olmsted County Bank and Trust Company of Rochester, Minnesota, as a City depository for $259000.00 in accordance with its proposal dated March 3.1st, 1932, which was read. Upon motion by Dallman, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution 'designating the Union National Bank of Rochester, Minnesota, as a depository for 850 9000,00 in accordance with its proposal dated April•lst919329 which was ready Upon motion by Moody, second by Norton, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 9 i Alderman Norton introduced a resolution designating the Rochester Loan & Trust Company of Rochester, Minnesota, as a depository for $ 50 9000.00 in accordance with their proposal dated March 29th,19329 which was read. Upon motion by Hicks; second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The monthly report of the City Treasurer for March 31st919329 showing $$2929565.21 as being on hand, and the annual report of the City Treasurer for the year ending March 31st919320 showing receipts of $193519616*519 and disbursements of $19295,249.491, during that period, were each read, and President Liddle ordered that the same be placed on file: The report of the Plumbing Inspector for the month o f March,1932, showing fees collected in the amount of $26.00, was Bead, and President Liddle ordered that the same be placed on file. Upon motion by Nicks, , second by Amundsen, the sum of $26.00 was appropriated from the General Fund and it was ordered that the said sum be paid to Don E. Postier for extra services as Plumbing Inspector during March,1932, in accordance with resolution passed and adopted July 6th,1931. The report of the City Weighmaster for the month of March9l9329showing 018,50 collected as weighing fees, Maas read, and President Liddle referred the Same to the Finance Committee. The report of the Clerk of the Municipal p Court for the week ending April 4t.q,19321, showing; criminal fines collected $47.40, civil fees received 09.40, court costs charged to Olmsted County $3.359 and fine collected and remitted direct to the State Treasurer 35000, was read, and President Liddle � I referred the same to the City Attorney. The report of the Secretary of the Board of Park Commissioners covering the Park Revenue Fund, and the Mayo Trust Fund, for the year ending i March 31st,193w, was read, and President Liddle ordered that the same be placed on file. i Upon motion by Miller, second by Moody, the City Clerk was authorized and directed to prepare for the publication of 4500 copies of an annual report from his office, which authority shall extend to the employing of the necessary extra stenographic services. j Upon motion by Hicks, second by Dallman, the City Clerk was authorized i and directed to publish 500 copies of City Government Booklets. Upon motion by Miller, second by Amundsen, the City Clerk was instructed) to demand that cash, cashier:ts check, or certified check shall hereafter accompany all applications for licenses. Upon motion by Hicks, second by Amundsen,the license fee for bowling alleys was fixed at $5400 per alley per year. 0f'4 The applications of Gus Mehos, Emanuel Kostakes, Carl Culver, Morey Kitzman, Philip Payne and Bobby Payne, and Sam Sternberg, for sgft drink dealer licenses, were each read, and upon motion by Dicks, second by Dallman, licenses were granted. A communication from the Elk's Drum Corps, asking that the period covered by carnival license Nc.13 be changed from June 6th to llth, 1932,inelusive, to June 13th to 16-ti.�,11932,ir_clusive, was read, and upon motion by Miller, second by Dallman, such chcnge of dates was granters.. The application of Chamberlain Brothers for license to operate two pop corn and peanut wagons, one at the northeast corner of the �I �I intersection of Broadway Street South and Second Street Southeast, and one i at the Northwest corner o..' the intersection of Broadway Street South an I First Street Southwest, was read, and upon motion by Norton, second by Moody, license was granted,at a fee of $300.00 per year for the two wagons. The application of Gus Mehos for license covering five pool tables at No.4 Broadway Street Borth, and of Emanuel Kostakes for license covering seven pool tables at No.116 Broadway Street South, were each read, li and upon motion by Moody, second by Amundsen, licenses were granted. �I The application of L. Buss and F.R4.Tho*nas that a sidewalk be constructed along the west side of Eighth ,Avenue Northwest from Seventh j Street to Ninth Street, and on the north side of Ninth Street Northwest from Eighth Avenue to Ninth Avenue, was read, and President Liddle referred Ithe same to the Street and Alley Committee, and the, City Engineer. 945 .The electrician's license bond of L. A. Kepp, doing business as L.A.Kepp Electric Company, with the Fidelity & Casualty Company as surety thereon in the amount of $ 1,000.009was read, and upon motion by Moody,second by Dallman, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. An.opinion by the Attorney General as to the legal disposition of abdumulated profits derived from the sale of electricity, was read, and President Liddle ordered that the same be placed on file. The following communications were read, and President Liddle ordered that the same be placed on file: 'Warch 159 1932 Honorable City Counsel, Rochester, Minnesota Gentlemen: We the members of the Plummers and Steam Fitters local number 656.of Rochester, at a regular meeting of March 14th, went on record in favor of the Labor Commissioner of Rochester in handling all working cards and said Labor Commissioner to receive what ever salary that the City Clerk now receives for same. As the Labor Commissioner now receives nothing for his labor or time lost, add he now and has done most of the work connected with this ordinance. Estimate No.7 prepared by the architect,in favor of Herman Dornack on contract for plumbing and heating installation in the new City Hall, showing the sum of $819.00 as being due the said contractor, and estimate No.5 prepared by the architect, in :t."avor of the Van Dorn Iron Works Company, showing the sum of $400.00 on contract for installation of jail equipment in new City Hall, as being due the s .id contractor/, were each read, and President Liddle ordered that III 9 696" u the same be placed on file. Upon motion by Dicks, second by Dallman, the sum of $80.00 was appropriated from the General Fund and it was ordered that the said sum be paid to Mrs. Catherine Fritsch, as compensation for the death of Christopher Fritsch during -the period March 2nd,1932, to March 29th,1932, inclusive. The following report of the Finance Committee was read and President Liddle ordered that the same be placed on file, and a.l-so ordered that the reports of the City Weighmaster mentioned therein be placed on file: "Rochester,Minn. Gentlemen: i We have examined the records and accounts of the I !i City Weighmaster for the period August 21st 91931 to April 1st, 1932 and find same to'be correct. " Upon motion by Amundsen, second by Filler, the City Clerk was authorized to arrange for the furnishing of a book case for his offict at a cost of $50.90, and the City Engineer was authorized to arrange for the furnishing of a drafting table for his office at a, cost of $67.50, both to come as extras on the City Hall steel equipment contract. An ordinance to amend an ordinance entitled"An Ordinance red -elating the operation and rates of fare'of taxicabs and automobiles for carrying passengers for h1re with a seating capacity of not to exceed seven persons, within the City of Rochester", was given its Viird and final. reading. - - Upon motion by Miller, second by Moody, that the said ordinance be adopted as read, and all votinp- in favor thereof, President Liddle declared the said ordinance duly passed and adopted. An ordinance providing for the licensing, conducting and regulation of auction sales within the City of Rochester, ivas given its third and final reading. Upon motion by Moody, second by Hicks, that the said ordinance be adopted as read, and c,11 voting in` favor thereof, President Liddle declared the said resolution duly passed and adopted. An Ordinance providing for the appointment by the Mayor of special policemen to act as school police and prescribing their powers, i 697 L authority and duties, was given its third and final reading. Upon motion by Norton, second by Moody, that the said ordinance be i adopted as read, and all voting in favor thereof, President Liddle declared the said . i ordinance duly passed and adopted. ' An ordinance regulating traffic, the operation and parking of vehicles,: the use of streets for driveway entrances, and designating arterial highways in the I 1 City of Rochester, Minnesota, was given its second reading. I , Alderman Dallman introduced the following resolution, which was read: "RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OP FIFTY-FIVE THOUSAND DOLLARS ($559000.00) CITY OF ROCHESTER IMPROVE- MENT BONDS AUTHORIZED BY THE VOTERS THEREOF APRIL 21st, 1931, AND AUTHOR- IZING THE EXECUTION AND DELIVERY OF THE SAID BONDS., I Bb it resolved by the Common Council of the City of Rochester, Minnesota, as follows: I Section 1. It is deemed to be necessary and for the best interests of this City, that there shall be, at this time, issued and sold fifty-five thousand dollars ($55000.00) par value, being fifty-five (55) bonds of one thousand dollars (41000 XO) each,of one hundred eighty thousand dollars ($1609000.00) Improvement bonds, authorized by the voters thereof April 21st, 1931, being City of Rochester, i Minnesota, four and one -quarter (4 %) per cent Improvement bonds,' all bearing the date' of May. lst,. 1931, and that the City Clerk be and he is hereby authorized and directed to publish notice of the meeting of this Common Council of the City of Rochester, Minnesota, which is hereby fixed and directed to be held in the Council Chambers, in the second floor of the Chamber of Commerce building, in said City, on I the 25th day of April, 1932, at 7:30 o'clock P.11.9 for the purpose of opening and i considering; bids for the said bonds, in the Rochester Post -Bulletin, the legal ' newspa er piblished and printed in said City, and the official newspaper thereof, in which the said,notice shall be published as required by law. Section 2. That the fifty-five (55) 17onds of said issue be offered for` sale and issued at this time shall be the City of Rochester, Minnesota, four and one-; quarter (44%) per cent Improvement Bonds dated May 1st, 1931, and becoming due in their numerical order as follows: two (2) thereof on December 1st in each of the ;dear:; 19329 1933, and 19349 three thereof on December lst in the years 1935, 19369 19379 19359 19399 19409 19419 19429 19439 19449 19459 19469 19479 19439 1949, 1990, and one thereof on December lst,in 1951, with exception as to maturity of those of 1941 to 1951,inclusive, in that the ,principal on those shall be optional as to pay- ment on any interest date after December 1st, 1940, and prior to maturity; all matured and -past due interest coupons to and including December lst91931, -to be detached from each of the said bonds and cancelled, and further that the said bonds shall be' substantially in the form adopted by this Common Council on the fourth (4th)j day of May, A. D.1931. Section 34 Upon the sale of the above merxtioned fifty-five thousand dollars ($55,000000) Improvement bonds, the Mayor and City Clerk of said City, are hereby, authorized.and directed to execute the said bonds, and the City Treasurer of said City is hereby authorized and directed to deliver the said bonds to the purchaser thereof upon the payment into the City Treasury of the full amount of the purchase price. Alderman Miller introduced a resolution appropriating ' 400.OD from the New City Hall Fund and ordering payment made to the Van Company Dorn Iron Works/ as Estimate No-5 on contract for furnishing, and installation of jail equipment for the new City Hall, which was read. Alderman Amundsen introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the salary and compensation of the City Assessor of the City of Rochester, Minnesota, and the Deputy Assessor of said City, the same' to cover the salary and compensation of both the Assessor and such deputies as may be appointed by the Assessor upon the approval of the Common Council of. said City, be and the same is hereby fixed and allowed at the total sum of ""5300.00 per year for said officers; said salary and compensation to be $491.66 per month for each of the months of April, Kay.and Tune, 1932, and $425.00 per month for each of the months of July, 1932, to March 1933,inalu-- sive. The Mayor and City Clerk of said City are hereby authorized and directed "to draw warrants upon the City Treasurer and malTe payments accordingly. Alderman Hicks introduced a resolution fixing the salary of the City Engineer's Private Secretary at the sum of 0108.00 per month during the ensuing official year, and prescribing her duties, which was read. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Da.11ma.n introduced a resolution fixing the salary of the City Clerk's Stenographer at the sum of $135*00 -per month during the ensuing official year and prescribing her duties, which was.read. 03 Upon motion by Amundsen, second by Ricks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the City Scavenger of said City, during the ensuing official year, shall be allowed to charge not to exceed`6.00 per cubic yard for the first yard removed in the cleaning of vaults and cesspools, and<�,4.00 for the next cubic yard, and each additional yard removed, and the minimum charge allowed to be made for each vaiAlt or cesspool is hereby fixed to be $ 2.00.
