Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton, Absent: None. Upon motion.by Dallman, secoondd by Amundsen, the minutes of the meetings held on April 4th, 1932, April llt h, 1932,/April 14th91932, were each approved. The City Clerk announced that there had been no bids received offering to purchase the $55900040 City of Rochester, Minnesota, 4�% Improvement (New Bity Hall) bonds, offered for sale on this date. j The City Clerk suggested that he be authorized to canvass the local residents and concerns for the sale of this block of bonds, or any part thereof, that might be desired by the purchaser, and upon motion by Hicks, second by Dallman, the City. Clerk was instructed to proceed with the sale of these $559000.00 Improve - anent bonds under the plan he proposed and that no transaction shall be at less than par and accrued Upon.re t . b ' y Hicks, second by Dallman, the .ladies Auxil':_iary of the Veterans of Forei.Qn Wars, and the Ladies Auxiliary of the American Legion, were granted permission to sell poppies on the streets of the City of Rochester, Minnesota,, May 28th,19324 The following request was read, and upon motion by Norton, second by Miller, the Street and Alley Committee, and the City Engineer were authorized to comply with this petition and that the cost thereof be paid from the General Fund: "GARDEN PROJECT SPONSERED BY tlie VETERANS OF FOREIGN WARS The Honorable Mayor and Common Council of Rochester, Dear Sirs: The committee in charge of the above named project have three small tracts donated for garden use, and for which no provision has been made for tilling. It is the feeling of the committee that the city administra- tion would assist in this wortpy cause to the extent of preparing the ground for gardening purposes. The committee desires to conserve all available funds for the purchase of seed, and therefore this appeal for assistance. Priebe asked that arrangements be made requiring a jitney bus stop at the MetropolitAn-Hotel corner, and President Liddle referred his petition to the License Committee. Upon motion by Amundsen, second by Moody, the City Engineer was authorized to purchase document files for his office to be included with. the Luger-Buur Furniture Company steel filing dquipment contract for the new City Hall. Upon motion by Hicks, second by Amundsen, it was ordered that the steel filing equipment, counters and desks,and the wood chairs and other wood furniture for the City Srigsneer's office In the new City Hall, be finished in walnut instead of oak as specified, and that the lobby is benches be finished in walnut instead of oak as' specified. �i Upon motion by Miller, second by Amundsen, the City Engineer j �i was authorized to purchase steel counters Nos. 21-A and 21-B ad bhown on �I addenda No.3 of the specifications for steel counters, steel desks, steel �j tables,etc., for the new City Hall, with formal authority for this purchase 11 to follow by resolution passed and adopted at a later meeting. I Upon motion by Hicks, second by Amundsen, the size of the i i ,I check desks for the Public Utility Board office, the City Clerk's office, 1 1`` and the office of the City Treasurer, were changed from 48" by 24" to 11 48" by 20", and the factory suggestion of cutting in the change machine cut outs in the Public Utility office counter on a slope instead of a square cut out, was approved. Upon motion by Dallman, second by Amundsen, the legs for the banquet tables in the community room in the new City Hall, were changed from wood as specified, to the folding steel legs manufactured by the Song Company of Chicago, Illinois, which change will be at no cost to the City of Rochester. The said salary and compensation shall be paid from the General Fund of said City in semi-monthly installments based on the monthly salary, one-half of the monthly salary and compensation being payable on the sixteenth day -and the balance! thereof on the last day of each calendar month during the ensuing official Year. Be it further resolved by the said Common Council: That all resolutioasn:.and parts of resolutions inconsistant herewith, are hereby repealed. " Dr. Chas., H. Mayo, Health Officer, and Dr. D.. C. Lochead, talked in opposition to the reduction of the Health Officer's salary fdt.,:.thie _official year, and explained the. many services that are furnished by the Mayo Clinic bt ,.no cost to the ;'City of Rochester, at which it was agreed that the Health Officer shall bill the �ICity of Rochester, Minnesota, at :the rate of $41:66 per month for laboratory ;;services furnished by the Mayo Clinic, which arrangement shall be effective as of April llth,19329 and continue to the second Monday in Apri1,1933. i i Upon motion by Hicks, second by Norton, the sum of $125000 was '!appropriated from the General Fund and it was ordered that the said sum be paid to ;,the Rochester Chamber of Commerce to apply on the printing of 5000 City of Rochester 1iillustrated booklets. ;! Upon motion by Hicks, second by Dallman, the Commercial Travelers ssociation Convent ion was ;A granted the use of the Council Chambers in the new City Hall for the morning of June 9th,19329 if the new City Hall building is ready for ;occupancy at that time. 730 u Alderman Norton introduced an -ordinance repealing in its li entirety Ordinande No.41,5 of the City of Rochester, Minnesota, the same being �i i; an ordinance prescribing the wage which shall be paid for skilled, and unskilled, labor on public works by contractors inhere performing such work 1' for the City of Rochester, and by the City, when performing such work not under contract, which was given its first readingi General Balance sheet, -trial balance, fund statement, statement of unexpended budget appropriativns,etc., for the City of Rochester, Minnesota, prepared by the City Clerk, as of March 31st91932, were laid before the Common Council, and President Liddle ordered that the same be placed on filer The report of the Clerk of the Municipal Court for the week ending April 16th,19329 showing criminal fines collected $30.809 civil fees received $4*701, court costs -changed to Olmsted County $25 40, and fines collected -dud temitted direct to State Treasurer *20: 00, and for the week ending April 25th,1932,. showing criminal fines collected $34409 civil fees received $6.25, Olmsted County check for $27 05 received as March 1932 municipal court fees and $22.50 court costs charged to Olmsted County, were each read, and President Liddle referred the same to the City Attorney . The report of the City Engineer for the.month of March, 1932, showing expenditures from the General Fund for labor during that period of $119.15, from the Street and Alley Fund $578.24, from the Sewer Fund $954,409 and from the Hridge Fund $12.10, was read, and President Liddle ordered that the same be placed on file. The application of the Jolly 24 Drill Team, for a public dance peemit at the National Guard Armory, April 28th, 1932, was read. The application of Vile Queen City Camp #1645, Modern Woodmen of America, that the dance permit granted to them for April 6th, 1932, be transferred so that the same may be effective May 6th919329 was 731 read, and upon motion by Dallman, second by Amundsen, such transfer was granted,in that no dance was held on the first. mentioned date* The application of Roy T. D. Espeland will claim $300.00 damages for doctor bills, hospitall, expenses, and loss of services of his wife, by reason of the injury above mentioned, were each read,- and President Liddle referred the same to the City Attorney. Summons in Theo: A. Johnson Jebora E.Fairchil d, Elizabeth Fairchild, i Frances Fairchild, Donald Johnson, and Allen Johnson, plaintiffs, versus the City of Rochester,Hefendant, asking judgment for the possession of the old Central Fire Station site, and the costs and disbursements in connection with the suit, was read, and President Liddle referred the same to the City Attorney. The claim of C. E. Stedman,$3.509 for vulcanizing of an automobile tire claimed to have been damaged by a chunk of flooring from the Fourth Street South east bridge over Bear Creek, wasread,.and President Liddle referred the same to the City Attorney. The following request for appropriation was read and'President Liddle ordered that the same be placed an file: " April 259 1932. Hon. Mayor and Common Council Gentlemen: We beg to request that $5000 40 be appropriated in the Street and Alley Fund, for use of the Street & Allay, Committee. Respectfully, C. H. Armstrong City Engineer. " Estimate by the City Engineer, showing the sum of $1384.50 as being ! due the Botsford Lumber Company for the furnishing of calcium chloride, was read, and President Liddle ordered that the same be placed on file. I , . The county treasurer has informed us that the city of Rochester claims to be the owner. The following communication was read, and the maps mentioned therein were distributed to the bolders`of the sewer survey reports, one of which was reserved for the official file: " Kansas City, Missouri April 15, 1932. Under the regulations promulgated by the., State Board of Health -an such matters, the Board can only give its, approval to plans and specifi0ations when such are properly prepared and submitted to it. We have, however reviewed this report, and do not believe that the con- templated improvements involve any construction work which could not be designed to conform with the requirements of this Department. j Detail plans and specifications of the proposed work, if such are prepared in accordance with the recommendations contained in this report and in compliance with the requirements of this Department, would, in the opinion of the Division of Sanitation, receive favorable c ons i derat ion,i It hould be understood that' the examination and app oval of plans and specifications of a sewerage system by the State Boars of Health are limited to the sanitary features of the system. " The electrician's license bond of the Rochester Electric Company, with the General Indemnity Corporatian of America, as surety thereon in the.am©unt of $1000000 was read, and upon motion by Norton, second by Dallman, the surety thereon was accepted, the said bond was approved, and it .was ordered that the same be placed on file, and the electrician's license bond of the Rochester Electric Company, here- tofore filed covering the current license of that company, with the Commercial Casualty Insurance Company of Newark, New Jersey, was r@leased. The Electrician's license bond of J. P. Huyber, and L.F,Hiss, doing business as the H. & H. Electric Company, with the Aetna Casualty and Surety Company as surety thereon in the amount of $1,000.00, was read, and upon motion by Moody, second by Norton, the said surety was accepted, the said bond was approved, and it was ordered that the same be placed on file. An earnings basis - endorsement showing a total advance preiniwn of "130.5'', ruid a monthly deposit agreement endorsement of 0150.00 public liability and $50.00 property damage,was presented to be attached to policy PUB -A 11305, written by the Hartford'Accident and Indemnity Company covering W.L.Eaton doing business as the Rochester Yellow Cab Company and Red Top Cab Company, and upon motion by Amundsen, second by Moody, these endorsements were accepted, and it was ordered that the same be attached to the policy mentioned, and the earnings basis endd.rsement calling for a minimum premium of $720072 liability and 1203.70 property damage, and the monthly deposit premium agreement endorsement providing for a deposit. premium of $10841 public liability and $30:56 property damage, originally attached to this policy, were released. Alderman Moody introduced a resolution appropriating $4870-50 from the Park Improvement Fund and ordering payment made to Wm. C. Fraser & Son, for 1950 cubic yards of excavation at %1.25 per cubic yard, made at Soldier Field, which was read. !i Upon motion by Amundsen, second by Hicks, that the said i� resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. it i� Alderman,Moody introduced a resolution appropriating �i I) I1$275.00 from the Park Improvement Fund and ordering payment made to G. The Mayor and City Clerk are hereby authorized and directed to draw warrants upon the'City Treasurer in accordance herewith and cause said transfers to be made. " upon motion by Hicks, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Diddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating $97.81. for the transfer of funds to adjust for use of supplies during the period January lst,19329 to March 31st919329 inclusive, which was read. Upon motion by Moody, second by Amundsen, that the said resolution be.adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Norton introduced the following resolution,which was read: "Be ity resolved by the Common Council of the City of Rochester, Minnesota: That Henry K.Armstrong be - employed by said City for the period commencing May 19 1932 and ending Feb. 1, 19339 for the purpose of completing the work heretofore started by his preparing maps for use in the office and under the supervision of the Ci$y Assessor and that as and for compensation for said work he be paid the sum of $150000 per month during said term. The said salary and compensation shall be paid from the General Pund of said City in semi-monthly instalments based on the said monthly salary, one-half thereof being payable on the sixteenth day and the balance thereof on the last day of each calendar month during the said term: Be it further resolved by hhid Common Council. That all resolutions and parts of :resolutions inconsistent herewith axe hereby repealed. " Upon motion by Miller, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 739 16 2 The City Engineer submitted plans, profiles, specifications and I i estimate of cost for the construction of a new, sidewalk around the new City Hall., and for the removal of the old Peale pit and ramps; the estimated cost thereof being $11094734 Alderman Dallman introduced the following resolution, which was read: r "WHEREAS, It is deemed expedient and necessary that a new sidewalk i be constructed around the new City Hall, and that the old scale pit and ramps be removed and WHERrAS, The City Engineer has prepared and submitted plans, profiles, specifications and estimate of cost for the construction of the said new sidewalk and for the removal of the old scale pit and ramps; r SO THEREFORE, Be it resolved by -the Common Council of the City of Rochester, Minnesota: That a new sidewalk be constructed around the new City Hall and that the old scale pit and ramps be removed, that the said plans, profiles and specifications be adopted for the said improvements and that the same be placed on file in the office of the City Clerk of said -City, and that the said estimate of cost be accepted and placed on file in the office of the City Clerk of said City, bne, i Ee it further resolved by the said Common Council: That the City � Clerk of said City be and he is hereby authorized and directed to advertise for sealed proposals for the furnishing of all labor, materials, tools,. e�1uipr:..Pnt , etc:. , necessary for the construction of the said sidewalk and for the removal of the old scale pit and ramps, in accordance with the said plans, profiles and specifications, 1 which sealed bids will be received and opened at a meeting of this Common Council which is to be held in the Council Chambers, in the second floor of the Chamber of Commerce building, in said City, at 7:30 o'clock P.M., on May 9th91932. Each i bid must be accompanied by a certified check upon some reputable bank -drawn payable to the Mayor of .Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which check and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the bidder upon the letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. A surety bond written for the full amount of the contract by a surety company authorized to do business in the State of Minnesota, will be required with the contract. (Personal bonds not to be accepted.) � All proposals must be addressed to Mr.A.P.R'right, City Clerk of Rochester, Minnesota, and shall have endorsed thereon "Proposal for construction of sidewalk around the new City H&11 and removal of scale pit and ramps." Upon motion by Hicks, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution adopting the above mentioned the established i ptefile and abstract at/grade line for that part of Sixth Avenue Southwest between the south line of Ninth Street Southwest and the north line of Eleventh Street Southwest, and ordering that the same be placed on file with the Register of Deeds, which was read. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting; in favor thereof, President Liddle declared the said: resolution duly passed and adopted. i Alderman Miller introduced the fvllowing resolution, which was read: "Be it resolved by the Common Council of the City of Rocheater,Minne- sota: i That the Street & Alley Committee and the City Ehgfneer,ave hereby authorized and instructed to proceed with the work of repairs and maintenance of the paved streets, avenues and alleys. 4 U The maintenance of the earth and gravel streets, avenues and alleys. The repairs and maintenance of the Sanitary Sewers and storm sewers within the City of Rochester, and to employ the necessary labor, and purchase the necessary tools and material to carry on the work as provided in Chapter No.9-Section's 114-122,inclusive." Upon motion by Moody, second by Norton, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution granting public If dance permit to the Jolly 24 Drill Team, for the National Guard Armory ! April 28th91932, and fixing the fee at $5.009 which was read. Upon motion by Dallman, second by Moody, that the said 1 resolution be adopted as read, and all voting in favor thereof, President 11 411 , it Liddle declared the said resolution duly passed and adoptedi Alderman Miller-ABIbed:'that he be permitted to withdraw an ordinance introduced by him regulating traffic, the operation and parking of vehicles, the use_ of streets for drive way entrances, and designating arterial highways, in the City of Rochester, Minnesota, and upon motion by Hicks, second by Moody, and all voting in favor thereof, Alderiwn 111--il.l.er was granted permission to withdraw the said ordinance,,and he accordingly withdrew it: Alderman Moody introduced an ordinance regulating traffic:, the operation andparking of vehicles, the use of streets for driveway entran- ces, and designating arterial highways in the City of Rochester, Minnesota, was given its first xead,ing. Upon motion by Miller, second by Moody, the rules were suspended and the saidordinance was given its second reading: Upon motion by Miller, second by Amundsen, the City Engineer was authorized to use City equipment May 9th, loth, lltr, and 12th,1932, in the City wide clean up, the said days being designated as "Clean-up Dayd". Dr. A. S. Plummer offered a natural gas rate to be put in effect provided that the Minnesota Northern Natural Gas Company will accept a franchise for the distribution of natural-gas In the City of Rochester, Minnesota,- either through their construction of a new distribution system or the use of the present system leased from the Interstate Power Company, either of which arrangements -should carry a feasible plan for acquisition of the propert#es by the City of Rochester at the end of five years, -If the municipality is so inclined at that time; the rate schedule being : $*75 for the first 300 feet or less, $1.50 per thousand cubic feet for the next 1700 feet, $1:30 per thousand cubic feet fen .the next 741 It m 2000 cubic feet, $.90 per thousand cubic feet for the next 6000 cubic feet and %1.50 per thousand cubic feet for the next 90,000 cubic feet. A motion by Amundsen, second by Miller, carried that the Chair appoint a Committee composed of the Mayor, the City Attorney, and Aldermen Hicks, Norton, and Miller for a conference with the Pipe Line Company officials as to wh6ther or not they would accept a franchise tinder the plans and rate suggested by Dr. Plummer, and President Liddle accordingly appointed the - said persons as members Of the committee for that purpose. 1 Upon motion by Miller, second by Moody, the Public Vt.11ity Board were requested to install streetslights, one at the intersection of Tenth Street j Northeast and Second Avenue Northeast, and one at the intersection of Thirteenth i Avenge Southeast and Sixth Street Southeast: i Upon motion by Hicks, second by Norton, the City Engineer was instructed to secure the necessary labor and materials and construct a storm sewer from the intersection of Second Avenue Northeast and Seventh Street Northeast, to the old mill race, at a cost not to exceed $199:00. Jfpon motion by Miller, second by Dallman, the City Engineer was instructed to servo notice upon the owner of Lot 5 in Block 4, in Ireland's First Addition ,that she remove the sidewalk from in front of that property and rebuild it on the proper grade, or the City will do it by City Force Account at her expense.
