Roll Call. .Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absont: None. Upon motion by Dallman, second by Amundsen, the minutes of, the meeting held on May 9th,1932, were approved. President Liddle announced this as the,time and place.fixed for a hearing on and the levying of special assessments for the cost.and expense of the construction of a sanitary sewer in Third Street Northeast from the State Sewer 63 feet east of the east line of Fifteenth Avenue Northeast, to a point 44 feet West of the East line of MOrningside Addition, a distance of.257 feet, and asked i''f there was any person .present who wished to be heard concerning this improvement. 4 There was no person present who wished to be heard relative to this - r sanitary sewer* b i The following report of costs was read, and President Liddle ordered that the same be placed on file: " May 23, 1932. Wright City Clerk. i Alderman Dallman introduced a resolution levying special assessments for the construction of the above described.sanitary sewer in a part of Third Street ; Northeast , which was read. Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed.and adopted. Proposals for the furnishing and installation of blinds for the new City Fall windows were opened and rsad; the said proposals being as follows: 7i �18 Hanson Hardware Company: $750.00 for chain lift -channel blinds, made by the Mackin Venetian Blind Company, being 44 blinds 4' x 716, 5 blinds 6' x 11169 2 blinds 4' x 11'69 with alternate No.l of 160.00 if 3 blinds 4' x 11' 6 are added, and alternate No.2 of '$13.25 for each additional blind 4' x 7' 6; Hanson Hardware Company: $554.00 base bid for free hang,ing blinds, mfg. by the Venetian Blind ComparV, $45.00 for &ltiernate No.l and .19.90 for alternate No.2; C. F. Wilson Corporation, .alternate No.l .952.46 9 Alternate No.2 $110,40 � President Liddle referred the above proposals for the furnishing and installation of blinds,to the architect for tabulation and recommendat ion. • The City Engineer's trial balance for April 1932, was presented and President Liddle ordered that the same be placed on file. Balance sheet income statements, etc., of the Public Utility Departments, Ftepored by the Secretary of the Public Utility Board, as of April 30tb_,19329 was Jaid •before the Common Council, and President Liddle ordered that the same be placed on file; the said income statements showing a net profit in the Light Department for the month of April, 1932, of $11815.51, a net loss in the Water Department for that month of $1527.14 and a net profit in the Steam Heating Department for that month of $1326.03. The report of the Health Officer for the City Farm for.the month of April, 19329 showing receipts in the amount of $1001.749 disburse- ments of $930.51, and an overdraft of,$61.61, was read, and President Liddle ordered that the same be placed on file. The report of the.City Weighmaster, for the month of April, 1932, showing receipts for weighing in the amount of $10.10, was read, and President Liddle! referred the same to the Finance Committee. i The report of the Clerk of the Municipal Court for the weekending May 16th,19329 showing driminal fines collected $312400, civil fees received $.50, i and court costs charged to Olmsted 19ounty $12.40, and for the week ending May 23rd, 1932, showing criminal fines collected $72.90, civil fees received $8.95, municipal i court fees charged against Olmsted County, for Apri1,1932, were received in the amount of $78.90, court costs charged to Olmsted County $6.70, and fines collected and remitted direct to the State Treasurer $10.009 were each read, and President Liddle referred the same to the City Attorney. The Apri1,19329 report' of the Building, Electrical and Plumbing Inspector, showing $50000 building inspection fees collected o$15.50 electrical inspection fees collected and $30.25 plumbing inspection fees collected, was read, and President Liddle referred the same to the Finance Committee. I The following applidations for licenses to sell soft drinks were read, and upon motion by Hicks, second by Amundsen, licenses were granted to the following persons: Caryl W. Boyer, Leonard Lilleskov, Mrs.Frank M.Potratz, Cosie Eppard, Anna Ebenhoh, Wm. F. Klee. The application of the American Legion Drum Corps, for a public dance permit at the Armory, May 24th919329 was read. i 780 The application of R. S. Bay, for anl6le:ctricien's license as re%rl., and i.iy on ;-lotion by Dallman, second'by Moody, license was granted. ' The application of Lloyd Lester Bennett, for a plumber's I! license, was read, and upon motion by Hicks, second by Miller, license was 11 granted; all voting in favor thereof except Alderman' Dallman, who voted "Nay". The application of Arnold L. Brown for a driver's license, was read, and upon motion by Miller, second by Moody, license was granted. The following copy of resolution passed and adopted by the Public Utility Board, was read, and President Liddle ordered that the same be placed on file: "WHEREAS, funds available from the General Fund for Street Lighting purposes are not sufficient to pay for said lighting at the current rate of three (3�) cents per kilo�•at hour, and Whereas, said Street Lighting accounts are delinquent appr6ximately $10,000.00, therefor, Be it resolved by the Public Utility Board of the City of Rochester that, for a period of one year beginning April 1st„ 19329 a charge to the said City for Street Lighting purposes shall be two (2�) cents per kilowat hour, and �} Be it further -resolved that the Common Council of the said City of Rochester authorize said change in rate." An invitation by the City Clerk of Red ;Ting, Minnesota, that delegates from the City of Rochester, Minnesota, attend the convention of the League of Minnesota Municipalities, to be held there June 8th, 9th, and loth, 1932, was read, and President Liddle ordered that the same be placed on file. 781 A petition from Otto Haling, that an extention of Tenth Street be made and ! �. to connect with Ninth -Street Southeast,/from there to Broadway Street South over the new Ninth Street Southeast opening, was read, and President Liddle referred the same to the Street and Alley Committee, and the City Engineer. The plumber's license bond of Lloyd Lester Bennett, with the New Amster- dam Casualty Company as surety thereon in the amount of $19000.00 was read, and upon motion by Miller, second by Moody, the said surety was accepted, the said bond was approved and it was ordered that the said bond be placed on file. The blectrician's license bond of R. S. Bay, with the General Indemnity Corporation of America as surety thereon in the amount of ,$1,000.00 was read, and i upon.motion by Moody, second by.Dallman, the said surety was accepted, the said bond) ! was approved and it was ordered that the same be placed on file. The following applications for permits to place and maintain signs, were each read, and upon motion by Dallman, second by Amundsen, permits were granted to each of the persons hnd firms named: F. J. Paine (2), Edw. Hoffman, Purity Diner, � Amundsen Paint Shop, Lee Ying Laundry, Dunlop Tire Co -,John Hilk er, G. A, Lewis, Inc., Rommel Hotel (2). Blakely & Kennedy (2), Jefferson Transportation Co., Kersten Furs, Poster Mrachek Electric Co., Hotel Bikown, M. C. Lawler, Henry Blickle, Pioneer Service Station, Northland Service'Garage, Pratzke Brothers Hdwe., Joy Bros., Nelson Motor Sales Co.(3), Postier & Kruger (2). The application of H. M. Persons, operator at the sewage disposal plant, for a vacation from June 3*d;. 1932, to June 13th919329 was read, and upon motion by Hicks, second by Dallman, the said vacation was granted, provided that this .period is agreeable to the City Engineer. The following communication from the City Engineer was read, and upon motion by Hicks, second by Dallman, the request was granted with the provision that the City Engineer inform this Common Council of the vacation period taken by i any of the employees mentioned, so that proper record thereof may be made: Ii " May 20, 1932. ` Honorable Common Council, Rochester, Minn. Gentlemen: The City Engineer and the City Engineer's staff, consisting of 1st assistant City Engineer, City Engineer's Private Secretary, three opera- tors at the City Sewage Treatment plant respectfully ask for a vacation of ten days during the year 1932 and that the said vacation may be effective at such time or times as may best -suit the conditions ir3 the Department of the City Tngineer and the convenience of the employees. This request is made at this time for the reason that some of the parties interested wish to split up their vacation period and do not wish to use the entire ten day period at any one time. Respectfully, ' C. H. Armstrong City Engineer." �8Z The following communication was read, and President Liddle ordered that the same be placed on file: "FEDERAL RADIO CoAoflISSION Washington, D.C.. Mr. A. F. Wright, City Clerk, Rochest er,'Minnesots. Dear Sir% May 14, 19320 This will acknowledge your letter of May 10, 19329 together with a resolution adopted by the Common Council of the City of Rochester, Minnesota, petitioning the Commission to favorably consider the application of Radio Station WRHM for renewal of its license and full time _-operation on 125.0 kilocycles. This application Was designated by the Commission for a hearing and will be heard May 19,1932. You may be sure that the decision of the Commission will be predicated upon the testimony adduced at that hearing. Xery truly yours, James W. Bald.-rin Secretary. " The following communication was read, and President Liddle ordered that the same be placed on file: "Rochester, Minn. The City Officials Rochester, Minnesota. We shall remember with pride the honors you bestowed on our dear husband and father. We shall also remember your expressions of sympathy -in our days of sorrow. Katherine M. Miller and Children. " The following assignment was read, and upon motion by Hicks, second by Amundsen, the same was accepted, and the Mayor and City Clerk were authorized to execute the same on the part of the City of Roches- ter, Minnesota: "Rochester, Minnesota May 59 1932 City of Rochester, , Rochester, Minnesota Gent lemen: You are hereby ordered and authorized to pay over to Metal" Office Furniture Company of Grand Rapids, Michigan any and all sums of money now due or to become due the undersigned under and in accordance with the provisions of our bid, proposal and contract with the City of Rochester, Minnesota dated April 59 1932 for the furnishing of steel cabinets, steel counters, steel tables and steel desks in the new City Hall Building. The said payments are to be made by you as, when'and if the same become payable under the terms of the said contract and to be charged against the balance due us under the said contract and also under any amounts due us for additional shipments made to you for use in the new City Hall Building. 7835 (Beal of Luger-Buur Furniture Company) Luber-Buur Furniture Company By F. Anderson,as a Special Pat rolman,during the period May 14th, to May 20tb.,1932, and May 21st, to May 27th, i 1932, inclusive; and the appointment by the Mayor of C. B. Hanscom,as a Special Patrolman during; the period May 21st,1932, to May 27t h,,1932,inclusive, were each read,; and President Liddle ordered that the same be placed on file. Another communication from the Van Dorn Iron Works Comp any, relative to the unpaid balance on contract for furnishing and installation of jail equipment in the Aew City Hall, was read, and President Liddle ordered that the same be placed on file. Upon motion by Hicks, second by Amundsen, $6.00 was appropriated from the New City Hall Fund and it was ordered that the sathd sum be paid to the First National Bank of Rochester, Minnesota, for sight draft charges on $6,000.00 City Hall i bonds forwarded to the Winona National & Savinger.:Hank, which $6.00 sight draft charges were refused by the Winona National & Savings Bank. The following report and recommendation from the architect of the new City Hall building, was read, and President Liddle ordered that the same be placed on file: "To the Mayor and Common Council Rochester , Minnesota. . S - Gentlemen: Having compiled the bids from the various firms who quoted on Venetian blinds for the City Hall building, we find that the Monarch Johnson Co. of Mpls., quoting on a Bostwick Godell make of blind, were the low bidders with a figure of 519.00 for 51 Victoria Blinds as stated in the base bid in the specification. If this figure is used we recommend that six additional blinds be purchased for north windows in the Utility Board room, and in the Council Committee Room. at a cost of $8.80 each. If a steel guide type of blind is desired, we recommend the chain lift s-°yle manufactured by the Mackin Vehetian Blind Comparr at a cost of %'11F750.00 for the 51 blinds and $13.25 for -each blind. " Upon motion by Hicks, second by Moody, the proposal of Hanson Hardware Company, $750.00 base bid, `for furnishing chain lift venetian blinds, was accepted, i and an additional six blinds were purchased at $13,25 each, and the Mayor was requested to issue an emergency authorization for the purchase price of these blinds. The followinLD g .communication from the neiv City Hall architect was read, 1 i and President Liddle ordered that the same be placed on file: i i " May 239 1932 T,o the Mayor and Common Council Rochester, Minnesota. G ent l em en: The general contractor of the City Hall building, G. Schwartz and Co., has completed his work on the building and has complied with the terms of the plans and and specifications in every detail. We recommend that the building be accepted by the Council so that the general contractor may cancel his builders risk insurance t}-,is week. Respectfully submitted Peter P. Bross. " Upon motion by Hicks, second by Dallman, the City Engineer was authorized and directed to secure the necessary labor and materials and construct a cement concrete approach to the new City Hall garage at his earliest convenience. The following communication, accompanying the blueprints mentioned, was read, and President Liddle referred the same to the Street & Alley Committee, the City Engineer, and the Superintendent of the Electric Light Plant: "The Tri-State Telephone & Telegraph Company Rochester, Minn., May 139 19320 Rochester Common Council, Rochester, Minnesota. Gentlemen: Attached please. find two Drints of Estimate #-34709' Aerial Cable Construction in alley east of Broadway and removal of plant on north Broadway and First Avenue N.E. as proposed by the Tri-State Telephone & Telegraph Company. This estimate, if approved by you, will remove most of the poles and aerial cable fran North Broadway a$d First Avenue N.E. and will use the east side of the alley between Broadway and First Avenue N.E. for.our cable construction. If permission is given to proceed with proposed construction, kindly return one print approved. Yours truly, E. J. Gates, Wire Chief: " Alderman Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the work of the G* Schwartz & Company, General Contract- ors for the New City Hall Building in the City of Rochester, Minnesota, be and the same is hereby accepted by said Common Council as done and constructed according to the plans and specifications therefor." 785 I Upon motion by Amundsen, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said i resolution duly passed and adopted. The following communication was read and President Liddle ordered that the same be placed on file: " Box 204 Proctor, Minn. 'r May 20, 1932. i To the Honorable .Members of the Common Council, ' Rochester, Minnesota. 1 Gentlemen: A short time ago' I offered my services as a sanitary i engineer at the sewage treatment plat for the summer months for the purpose of determining the most efficient methods and rates of application of chlorine for the control of odor and the concentra- tion of activated sludge. Other improvements on the plant were also to be effected in connection with this work. Since that time I have been offered other positions which up to the present time I have refrained from accepting. However, due to the fact that no action was taken on the proposed work at Rochester, I have found it necessary to accept one of these positions which is more to my professional and monetary advantage. It is with regret that I will leave the work at Rochester and it is my sincere hope that a chlorinator will be purchased and that further work will be continued towards the ,much needed improvements which have been previously outlined. " The City Engineer submitted specifications and estimate of cost for the furnishing and installation of an automatic control solution feed vacuum i chlorinator, -with a 340 pound liquid chlorine capacity for 24 hours, the estimated cost thereof being $27000009 and the estimated cost of operation being $270.80 per month. The matter of the purchase and installation of a chlorinator was discussed and upon motion by Hicks, second by Amundsen, the subigect was referred back to the Sewer Coiinittee and the City Engineer for their further consideration. The following communication was read, and upon motion by Miller, second .by Moody, the Chairman of the Public Grounds Committee and the City At,tdrney, were authorized to represent the interests of the City of Rochester, Minnesota , in the administration, etc., of the bequests mentioned therin: "Christensen & Ronken Attorneys at Law Rochester, Minn. Mayor Julius J. Reiter, Rochester., Minnesota Dear Sir: May 19th.9 1932 8 I am en6losing a copy of the Last will and testament of Frank E. Williams, Deceased. For your information I will state that Mr. William::, in his lifetime, erected the monument referred to by him in the second clause of his will. I am further informed that Miss Jennie Johndrow, mentioned in the fifth clause of his will, died before he did, without leaving issue, so that no payment will be required by reason of these two bequests. This leaves $7000 in bequests to relatives to be paid and of course, the funeral bills and administration expenses. The balance of the estate all goes to the City of Rochester, under the seventh clause of the will: Er. Williams owned a 5/8 interest. in the property just across the street south from the City hall, commonly known as the Williams property. There is a small mortgage on it. He also owned the old Williams homestead on Fifth Street Southwest, which has been converted into an apartment house and he had a small home adjoining the Christian Church, on Fourth Street Southwest. This will, will be offered for probate without dalay. I should _ like to have this matter called to the attention of the City Council and would appreciate it if some member of the City Council or of the Park Board or other city official should be appointed for the purposes of conferring with me in regard to the estate, as matters will come up from time to time in which the city will be principally interested and I should have some one to consult with during theprocess of the settlement of the estate. May 21,1932 To the Honorable Mayor and City Council: We , the undersigned petitioners, ask your honorable body to give a permit to the Natural Gas company to cross Eleventh Avenue, north of the Bread Factory, so that we will have gas for cooking and heating. Myle Haimnond, tenant for the new house that is just being completed. . Myle Hammond. Fred A. Benz. I am the owner of the property that M. Hammond is moving into June 1st, 1932. A communication from Burns & McDonnell Engineering Company, to the Gas Committee of this Common Council, showing the saving "gate" that would be made in local municipal gas distribution if the/rate was $.,,.40 per thousand instead of $.45, was read, and President Liddle ordered that the same be placed on file. The following committee report was read, and President Liddle ordered that the same be placed on file: Honorable Common Council, City of Rochester, Minnesota. "Rochester Minnesota. May 23ra, 1932. 787 Gentlemen: I Your committee appointed to investigate the matter of the leasing of the Interstate Power Company properties by the Minnesota Northern Natural Gas Company for the purpose of distributing natural gas in the City of Rochester for the coming five years reports as follows: That it has had a large number of conferences with Dr.H.S, Plummer, Burns & McDonnell Engineers and the Minnesota Northern Natural Gas Company relative to a possible working out of such an arrangement, but to date that it has not been able to reach a point where the inter- state Power Company and the Minnesota Northern Natural Gas Company find it advantagedus to submit a proposition for a leasing of the Interstate properties for that purpose. ,Your committee has endeavored, with the able assistance of Dr. Plummer, to come to some agreement in such form that it could be submitted to your body for your consideration, but to date all of our efforts have been without success. We feel that both the Interstate Power Company and the Minnesota Northern Natural Gas Company have had sufficient time in which to submit a proposition and due solely to the fact that a further conference is now in progress to that end we feel that we should have one more week in which to make our final report.- In the event nothing is submitted to us within that time we recommend that the Common Council of this city meet on the 31st day of May, 1932 for the purpose of taking immediate steps leading to a municipal ownership, construction and distribution of natural gas i in this city. Gentlemen: i Your committee appointed to investigate and'report on the advisability of publishing the minutes of the meetings of the Common Council report and recommend as follows: i That for economical reasons and due to the fact that a majority o-'the residents of this city do not read the minutes, it is for the best interests of the city that the.# be not published. Honorable Common Council, City of Rochester, Minnesota, Gentlemen: The matter of the total in amount of collateral .deposited by The First National Bank and The Union National Bank to secure city funds having been referred to me for a report on the present day market values of the bonds listed, the following is submitted: According to its listing as filed with the Common Council on April llth, 1932, The First National Bank shows the total amount of collate a as dep sit d to be of the value of Two hundred and twenty thousan� 1 220900$.001 dollars. According to the information in my hands the same bonds as listed at that time now have a total approximate market value of One hundred ninety-four thousand eight hundred and twelve ($194,812.00) dollars, as of May 20th,1932, or a difference in the two values of Twenty-five thousand one hundred eighty-eight ($259188,00) dollars. 11 According to its listing as filed with the Common Council i; on April llth,1932, The Union National Bank shows the total amount of !' collateral as deposited to be of the value of Fifty-five thousand ($55,000.00) dollars. The information I have is that the same bonds now have a total approximate market value of Forty-three thousand eight hundred forty-eight ($43,84800) dollars, as of May 2oth,1932, or a difference'.in the two values of Eleven thousand one hundred i' fifty-two ($119152.00) dollars: 'Se6tion 1973-19 Masons 1927 Minnesota Statutes provides in part: "The total in amount of such collateral computed at its market value shall be at least ten per cent more than the limit of deposit which would be permitted if a corporate or personal surety bond was furnished" and"0i no time shall the Treasurer maintain a deposit in any depository against collateral in excess of ninety per cent of the market value thereof." Mayor and Common Council Gentlemen: The Street & Alley Committee and the City Engineer beg to recommend that the bill for repairs to the automobile, owned by Roy Goodenough, be not allowed. Mr. Goodenough collided with one City Dodge Truck on Third Avenue Southeast while the city truck was engaged in the work of repaving asphalt concrete pavement. The City Engineer's Department having placed red flags in Third Avenue Southeast at points both north and south of points where city truck was engaged. Boliou, Novotney and Wilke state that they were working on the avenue and that Goodenough was driving at a high rate of apppd. Atdersan An=dsen introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $137500 be and the said sum is hereby appropriated from the General Fund of said City and ordered paSd to Burns & :McDonnell Engineering Company of Kansas City, Missouri, as balance due on contract for survey of local sewer system and comprehensive plan for improvements and extension for the same. ' Alderman Moody introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Public Utility Board of said City be and the said Board is hereby authorized to charge 2 cents per kilowat hour for electricity used for street lighting purposes beginning as of April 1st, 19329 and for one year from that date only. " Upon motion by Miller, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said; i resolution duly passed and adopted. Upon notion by Hicks, second by Miller, the Purchasing Committee were authorized to purchase toilet and lavatory supplies for the new City Hall. Upon motion by Miller, second by Moody, the City Attorney was authorized to attend to the closing of a contract with Henry Grassle for furnishing of gravel at S.10 per cubic yard, with a minimum of $500.00 to be purchased each year during the life of a ten year contract. 7 V9 The following communication was read, and upon motion by Norton, second by Miller, the City Engineer was granted permission to accept the appointment mentioned therein; all voting in favor thereof - except Aldermen Dallman and Hicks, who voted "Nay": " May 23, 1932. Common Council Gentlemen: ,The undersigned, having been named by the �Ionorable Samuel Wilson, Chief Justice of the Supreme Court, to serve on the unoffidial commission to investigate matters pertaining to the Highway Department Paving Costs, as affecting contracts awarded during the month of November 19319 beg your honorable body to express your opinion, and either approve or disapprove the appointment.
