HomeMy WebLinkAbout06-03-1932795 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota., held in the Council Chambers, in the City Hall, in said City, at 7:30 o'clock P.M., on June 3rd,19 32. MSeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absent: None. The call for the special meeting was read; said meeting being called for the purpose of considering the local distribution of natural and manufactured gas, and any other business that the said Common Council might deem proper. i Dr. H: S. Plummer presented and read an approved agreement between the Interstate Power Company and the Minnesota Northern Natural Gas Company, in which the lessee, the Minnesota Northern Natural Gas Company, agrees to pay to the lessor, the Interstate Posner Company, the following as rental for their distribution system, running over a period of five years: "(1) The sum of Eighteen Thousand Eight Hundred (189800) Dollars per year of twelve months, payable in equal monthly installments on the last day of each month throughout the term of said leasing; (2) To pay all general taxes (including those for the year 1932) at any time bgreafter lawfully levied or assessed upon or*against the leased properties as and when the same shall become due and payable; but it is expressly agreed that in event of the termination of said leasing prior to the first day of in any year, Lessee shall not be required to pay the general taxes for the yeas in which such termination shall occur. It is further expressly understood and agreed that all special taxes and special assessments upon the leased properties shall be payable and punctually paid by Lessor. By "special taxes" is meant taxes which resemble special assessments and are deemed to result in benefit to property sub- ject thereto. (3) To set up as a Maintenance, Depreciation and Improvement Fund or reserve (to be known as a "Maintenance and Depreciation Fund"), thirteen (13) per centum of the gross earnings in each year of twelve months, from Lessee's operation of the leased properties (but not from properties which constitute the separate property of Lessee hereunder), less and after deducting from said thirteen (13) per cent. the maintenance expendi- tures of Lessee in such year for repairs and maintenance charged as a part of operating expenses. A. Fitzgerald and Henry S. Blink, talked for municipal ownership of the local gas distribution system, while Rev. A.R. Zick opposed municipal ownership. At 9:45 P.M., on this date, motion by Miller, second by Moody, carried that recess be taken for discussion of the gas question, and at 10:15 o'clock P.M., the Common Council again convened and were called to order by President Liddlp)ell members being present. Upon motion by Miller, second by Norton, the City Clerk was instructed to request of the Charter Commission that they propose an amendment to the Charter of the City of Roc ester, Minnesota, that will allow the use of surplus profits from the operation of local municipally owned public utilities for any local municipal improvement or any local governmental purpose. Upon motion by Hicks, second by Amunds6n,' the Chair:.vas requested to appoint.a Committee for the dedication of the new City Hall at some date in the latter part of June, 1932 , A report from the Sanitary Inspector relative to orders for sewer connections, and as to clean-up notices served, was read and President Liddle ordered that the same be placed on file. The report of the Clerk of the Municipal Court, for the week ending May 30th919329 showing criminal fines collected $33+00, civil fees received $4:359 court costs charged to Olmsted County $5659 and fines collected due to 01set6d County $31559 was read, and President Liddle referred the same to the City Attorney. Upon motion by Miller, second by Moody, the sum of $3055 was appropriated from the General Fund and it was ordered that the said sum be -,:,,.I pgid to Olmsted County, Minnesota, for local Municipal Court fines collected due to Olmsted County. 797 [ The annual report of the City Clerk, for the fiscal year ending March 31, 1932, was laid before the Common Council, and President Liddle ordered that the same be placed on filei The application of W. F. Daly, for a drivers license, was read, and upon motion -by Moody, second by Dallman, license was granted. The applications of Geo. L. O'Brien, Mrs. Marie Stortz, and John Burke, for soft drink dealer licenses, were read, and upon motion by Dallman, second by Amundsen, licenses were granted. Upon motion by Hicks, second by Amundsen, Henry C. Lindberg, was appointed Custodian of the.ngw City Hall for the balance of the ensuing official year, effective as of June 1st ,1932 Upon motion by Norton, second by Moody, 0. E. McCoy, was appointed City Weighmaster, for the balance of the ensuing official year, effective as of June lst,1932. The following appointment of special policemen was read, and President Liddle ordered that the same be placed on file: "Rochester, Minnesota, May 24th, 1932. Upon motion by Miller, second by Amundsen, the Ctty Clerk was instructed to bill School District No.8 $10.64 as their share in the cost of the printing of the City Clerk's annual report; in that three pages of school district 'financial data was included in the said annual report. Upon motion by Hicks, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Norton introduced a resolution authorizing the Pubs is Utility Board to enter into contract with the Olmsted County Oil Company for the furnishing of transformer oil in accordance with their above quoted request, and fixing the amount of the bond to be given by the said contractor at the sum of $6354009 which was read. Upon motion,by Miller, ssoond by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted Alderman Amundsen introduced a resolution authorizing the Board of Park Commissioners to enter into contract with Feller Brothers, for the construction of a dam in Slatterly Park across Bear Creek for the sum of $1487.00 9 and fixing the eAounV...ok-:the bond to be given by the said bontractor at the sum of $1487409 which Iwas read: Upon motion by Hicks, second by Amundsen, that the said resolutionbe adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. r 9 :�j Alderman Moody introduced a resolution appropriating $236 74 from the Street end Alley Fund and ordering payment made �to the Purington Paving Brick Company for 7000 2 * No. 1 Paving brick, shipped in Q car No.1027509 which was read: Upon motion by Moody, second by ?dicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and ado ted. Alderman Dallman introduced a resolution appropriating $225,450 from the Park Improvement- Fund and ordering payment made to the American Bitumuls Company for 1W gallons of Bitumuls HX, which was read. Upon motion by Amundsen, second by Flicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed abd adopted4 Alderman Dallman,introduced a resolution appropriating $884 77 from the Park Improvement Pund and ordering payment made to.the Mayo Trust Fund for payroll for labor during the week ending May 27th,19329 which was read. Upon •mot ion by Miller, second by Moody, that the said resolution be adopted as reads and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution appropriating $251.96 from the Park Improvement Fund and ordering payment made to Morrison Electric Company for two Sampson Amplifiers, tubes, labor,etc., which was ready Upon motion by Moody, second by Norton, that the said resolution be adoptedas read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman -Hicks introducied a resolution appropriating $2530-40 from the Park Improvement Fund and ordering payment made to the Jewell Nursery Company for the furnishing of shrubbery, etc., which was read: Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. * Alderman Hicks introduced a resolution appropriating $246.54 from the Park Improvement rand and ordering payment made to the Rochester Egg i& Poultry Company for Vigora, golf grass seed, etc:; which was read Upon motion by Norton, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President iLiddle declared the said resolution duly passed and adopted. 803 U 1 r Upon motion by Hicks, second by Dallmz, the City Engineer was author- y izeJ to secure the necessary labor and materials and replank the Second Avenue ' Northwest bridge over Cascade Creek. j Upon motion by Norton, second by Hicks, the Common Council adjourned!
