R:?r. .s 1 Minutes of an adjourned regular meeting of the Common Council in the Council Chambers. ;he City of Rochester, Minnesota, held,/in the City Hall, in said City at 7:30 '.M. , on June 15th,1932% of o' eLo ck Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Lorton,, Absent: None. Upon motion by Amundsen, second by Hicks, the minutes of themeetings seld on May 23rd,19329 and June 3rd919321 were each approved. President Liddle announced thisas being the time and place fixed" for hearing on the construction of a sanitary sewer in Eleventh Street Southeast, between the manhole at the sewage lift station and a point 190 feet west of the west line of First Avenue Southeast, and the laying of a water main in the said part of Eleventh Street Southeast, and asked if there was any person present who wished to be heard concerning these improvements. There was no person present who wished to be heard concerning the said sanitary sewer or the said water main. The .following committee rei',ort ".Vis read, and President Liddle ordered that the same be placed on files "T,he undersigned members of the Committee appointed by the Rochester City Council to investigate and make recommendations respecting the Natural Gas question', herewith recommend as follows: 1. That the Minnesota Northern Natural Gas Company be given the right to build and operate a gas distribution system in the City of Rochester, with the City having the right at end of three (3) years' to take over such distribution system at cost less depreciation. 2. If, at end of the three year period the City fails to take over the system, the ri rht to operate shall be thereby extended automatically two (2) years and thereafter extended for two (2) year periods so long as City fails to take over system, not to exceed fifteen (15) years from date of grant. 3. The rate schedule prepared and recommended by Dr. H. S. Plummer shall be placed in effect as a maximum rate schedule, said schedule being as follows: First 300 Cu. Ft. - $.75 ' Next 1700 " " - $1.50 per 19000 per month " 2000 " " -$1. 30 " 2000 " " - .e0 " 4000 " " 60 4. All bills for material and labor on above distribution system shall pass through hands of City officials in order that cost of system may be fully known. 5. That if City of Rochester desires that all or any part of the present Interstate Power Company distribution system be used in place of new construction by the Minnesota Northern Natural Gas ('ompany, said Company agrees to use the same or such part theriof as requested by the City, upon condition that the City determine and fix what price shall be paid the Interstate. 6. In all construction wo xk the Pipeline Company is to use local .labor except in the ,key positions. a 7. The books of. the Minnesota Northern Natural Gas Company in instance of the operation of the distribution system at Rochester shall be open at reasonable times for inspection by City Officials for verifications as to actual earnings. " Upon motion by Miller, second by Amundsen, the above quoted recommendations relative to natural gas distribution were approved. 4 The report of the Milk Inspector for the period *pril llth,1932, to June 111932, was read., and President Liddle ordered that the same be placed on file. The report of the City Weighmaster, for the month of May, 1932, showing weighing fees collected in the amount of ' 3.60, was read, and President Liddle referred the same to the Finance Committee. The City Rngineer's trial balance rdr May919329 was laid before the Common Council, and President Liddle ordered that the same be placed on file. The report of the Health Officer for the City Farm for the month of May,19321 showing receipts in the amount of $1725.90, $1540.86 disbursements, and a balance on hand in the amount of $;123.43, «ss read, and President Liddle ordered that the same be placed on file. The report of the City Treasurer for the month ending May 31, 1932, showing; $293882.63 as being on hand, was read, and President Liddle ordered that the same be placed on file. The report of the Clerk of the N'Tunicipal Court for the week ending June 6th,1932, showing criminal fines collected $27.00, civil fees received $2.70, and court costs charged to Olmsted County �10.35; c,nd for the week ending June 139 1932, showing criminal fines collected $66.20 , civil fees received $4070, court costs charged to Olmsted County $17.30, and fine collected and remitted direct Vo the State Treasurer $2540, were each read, and President Liddle referred the -same to the City Attorney. The applicat ionsQf Mrs. F.R.Mastenbrook, Milford Week, and Ernest A. Fitting, for soft drink dealer licenses, were read, and upon motion by Moody, second by Amundsen, licenses were granted. The following application,�for appointment was read, and upon motion by Hicks, second by Dallman, John S. Reed, was appointed Resident Identification Card Inspector for the balance of the current official year: "Rochester, Minn -,June 15,1932 Ron.Meyor and Common Council, City of Rochester, . Minn* - Gentlemen: I hereby.make application for appointment as Resident Identifi- cation Card Inspector during the balance of the current official year. Respectfully submitted, John S. Reed. " John S. Reed asked for an -amendment to the ordinance providing for resident identification cards which will require that a person must be a qualified voter before receiving one and President Liddle reref erred Mr. Reed' s request to the City Attorney. The following communication was read, and upon motion by Milldr, second by Moody, the City Treasurer was authorized and directed to accept the $400.00 mentioned into the N. ew City Hall Fund: " Rochester, Minnesota, June 10, 1932 To the Mayor and Common Council Rochester, Minn. Gentlemen: I am enclosing a check from Herman Dornack in the amount of four hundred dollars, which is intended as a reimbursement to the City for overpayment on the last Estimate. This error was due to a mistake in addition on the part of the Architect who made out the certificate. Respectfully yours, P. P. Bross Architect. " The City Clej-lk reported the receipt of $101.97 from the Franklin Heating Station for -2 cent per thousand cubic feet of natural gas used during May,1932. Bross: Rochester, Minnesota, June 15th,19'% Honorable Mayor and -Common Council, City of Rochester, Minnesota. Gentlemen: I respectfully submit the following items in regard to the New City Hall building for your consideration: 3 $2. N South main door pinches on top; 1 glass broken light in Council Chambers; Urinal broke mens toilet on second floor; Electric light switch plate missing in Mayor's office, and switch plugs in the wall; Trap on City steam line not working properly, in that we get some of the condensation back or pressure especially when we are on float control; Toilet in women's toilet on first floor not working properly - either not enough water or too much water. Glass broken in light fixture at south side of main entrance, and window glass broken in Judge's office. Respectfully ,submitted, Henry C. Lindberg Custodian of the City Fall." The request from Henry C. Lindberg,Custodian of the City Hall,for authority to purchase waste baskets, waste cans, wringer tanks and a laundry basket, was read, and upon motion by Hicks, second by Moody, the Purchasing Committee were authorised to purchase the items requested. The following communication and accomparWing proposed amendment WerWleaj3h .read, and upon motion by Miller, second by Nicks, the City Clerk was instructed to notify the Charter Commission that the proposed amendment is satisfactory to the Common Council and in addition the City Clerk was instructed to request that they provide for amendment to. Section 151 so that it will specifically provide thatthe City of Rochester, Minnesota, may construct or purchase its gas manufacturing or distribution plant or system: "Rochester, Minnesota June 15, 1932 Mr. A. F. Wright, City Clerk of the City of Rochester, Minnesota Dear Sirs At the meeting of the Charter Commission held last night it was voted that the proposed amendment herewith enclosed be submitted to the City Council of said City and that they be requested to obtain the opinion of the City Attorney as to its legality before the Charter Commission takes final action on the same. "PROPOSED AMENDMENT TO THE CITY CHARTER - Section 154, Said board. is hereby vested with power to make and enforce such by-laws, rules and regulations as may be necessary to .carry into effect the object and intent of this charter, and to cause all such by-laws, rules and regulations to be entered in a book kept for that purpose, and signed �by the President and Secretary, which, when so entered and signed, shall be open at all times for inspection and shall be evidence in any court. Said Board shall fix and maintain the rents and rates for all utilities furnished by it, so that the Public Utility Fun( of the city s' all, so far as possible, in each fiscal year, be sufficient toydefray the cost of the opera tion, maintenance and extension of the public utility plants and to pay all bonds and the interest on all bonds of the city which have been or shall be issued on account of any extension of said plants, and to maintain a reasonable reserve fund for use at any time in making repairs and extensions, with full power to increase said rates sufficiently to create a profit which may be used for any governmental improvement or any other governmental purpose, pro- viding five -sevenths of the Common Council shall approve said increase. " The official bond of Louis J. 01-aude,as Chief of Police, with the Fidelity & Casualty Comparq of New York, as surety thereon in the amount of !"1,000.00 was read, and upon motion by Moody, second by Norton, the said surety was accepted, the said bond was approved,and it was ordered that the same be placed on file. . Upon motion by Miller, second by Dallman, request was made of the Police Department, that arrangements be made for turning on the exterior City Hall lighting at dark each day and for turning them off at eleven o'clock P. M. daily, all voting in favor thereof except Alderson Hicks and Norton, who voted "Nay". Upon motion by Hicks, second by Miller, a vote of thanks was extended to 0. E. McCoy, for the flag donated by him for use on the new City Hall building. The following copies of resolutions passed and adopted by the Commissioners of the Sinking Fund were each read, and upon motion by Miller, second by Dallman, the actions set forth therein, were approved, and it was ordered that the said copies of resolutions be placed on file: "Be it resolved by the Commissioners of the Sinking Fund of the City of,Rochester, Minnesota:. " The remonstrance of Charles L. Weed, A. R. Nelson, Erland Johnson, and Mrs. J. H. Kelly,against the order of the Sanitary Inspector, that they make sanitary sewer connections for their homes, was read, and President Liddle referred the same to the Health Department. The following communication was read, and President Liddle ordered that the same be placed on .file: 7 " Rochester, Minn. June 15, 1932 Honorable Mayor and Common Council, City of Rochester, Minnesota I, the undersigned, do hereWith request the approval of the Honorable Mayor and Common Council of the City of Rochester for painting the residence numbers on the vertical side of the curbing facing the street or -avenue in direct line with the door of the residence. The numbers will be stenciled in black on a 6 x 14 inches whine base. The numbers are to be 6 inches high, so as to afford easy visibility. The work will be neat and attractive. A fee of 25 cents will be charged each property owner or tenant giving his consent. Reiter Rochester, Minnesota Dear Mr. Mayor: The attention of the Mayo Clinic has been called to the need of an emergency police ambulance for the City of Rochester. We understand that the City now has the necessary garage facilities in the Police garage. The Mayo Clinic, therefore, offers as a gift to the City of Rochester its Sayers & Scoville ambulance (motor #6J271--serial #12933) for an emergency police ambulance. The Clinic will continue to maintain its own ambulances and will be prepared to make all but emergency police calls, as in the past. This proposal is made upon the understanding that both the City and the Dlinic will co-operate in the use of ambulances in the event of emergency. Alderman Dallman introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of -Rochester, Minnesota: That the sum Of $320005 be appropriated and paid to the Rochester Bus Line Company, for gasoline and kerosene purchased"during the period April 30th, 19329 to May 18th, 1932, inclusive; $134085 thereof to be from the General Fund, ,11.43 thereof to be from the Sewer Fund and ',,$183.77' thereof to be from the Street and Alley Fund. The Mayor and City Clerk of said City are hereby authorized and directed to draw warrants upon the City Treasurer and make payments accordingly." Aldermen Moody introduced a resolution ordering plans, profiles, speci- fications and estimate of cost for the construction of a sanitary server in Eleventh Street Southeast, between the manhole at the sewage lift 'station and a point 190 feet west of the west line of First Avenue Southeast, and the laying of a water main ; in the said part of Eleventh Street Southeast, ordering that the said improvements be made and done and that the cost thereof be paid for by special assessments i levied as provided by lawwhich was read. The City Engineer submitted plans, profiles, specifications and estimate of cost for the above described sanitary sewer and water main, the estimate of cost thereof being 411799.60 for the sanitary sewer and $1156.60 for the water main. The City Engineer submitted specifications and estimate of cost for the I furnishing and installation of a gravel screening, and • crushing plant at the so -caller Grassle gravel pit, the estimated cost thereof being $5320.00. Alderman Miller introduced the following resolution, which was read: i "WHEREAS, It is deemed expedient and necessary that a gravel screening j and crushing plant be purchased and erected at the so-called Grassle Gravel Pit in the Southeast _T of Section 99 Township 107 North of Range 149 West, and WHEREAS, The City Engineer has prepared and submitted specifications and estimate of cost for the said furnishing and erection of a gravel screening and crushing plant at the location mentioned; SO THEREFORE, Be it resolved by the Common Council of the City of E i Rochester, Minnesota: d That the said gravel screening and crushing plant be purchased and I� erectedan that the specifications above mentioned be adopted for the said furnish- ing and erection of a gravel screening and crushing plant, and that the same be placed on file in the office of the City Clerk of said City, and that the said estimate of cost be accepted and. placed on file in the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of said City be and he is hereby authorized and directed to advertise for proposals for the furnishing and erection of the said ?ravel screening and crushing plant at the location mentioned, which sealed proposals will be received and opened at a meeting of this Common Council, which is to be held at 7:30 o'clock P.M., on June 29th, 1932. Each bid must be accompan- ied by a certified check upon some reputable bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, whicb check and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the bidder upon the letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. "A surety bond written for the full amount of the contract by a surety company authorized to do business in the State of Minnesota, will be required with the contract: (Personal bonds not to be accepted.) All proposals must be addressed to A. n. Wri8ht, City Clerk of Rochester, Minnesota, and shall. have 'endorsed thereon `Proposal for the furnishing and brection of a gravel screening and crushing Plant..'
