Mesting.called to order by President Liddle. Roll Call. Present: ;Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absent: None. Upon motion by Dallman, second by Amundsen, the minutes of the meetings held on June 29th91932, July 5th,1932, July 8th91932, July llth,1932 , and July 25th91932 , were each approved: W. G. Holets asked for a =eduction in the local license fee for auctioneer licenses, and President Liddle referred his request to the License Committee, with Instructions that they make report thereon at the meeting of this C- on Council, which is to be held on August 8Uh,1932. Wm. T. Fogarty, representing the local gasoline and oil dealers, asked for an amendment to the recently adopted ordinance licensing storage tanks, curb props, etc., that will either eliminate or reduce the fee for license, and President Liddle referred his plea to a Committee composed of the Street and Alley Committee, the City Attorney, and the Chief of the Fire Department. Ana& Ebenhoh was before the Common Council in a remonstrance against the recen�:order to the City Engineer compelling the sidewalk in fron,t of her property, which was not constructed on the proper grade line, be torn out and rebuilt at her expense, and upon motion by Norton, second by Moody, the Street and Alley Committee were authorized to arrange for the reconstruction of this sidewalk at City of Rochester, Minnesota, expense. The report of the Clerk of the Municipal Court for the week ending July 25th91932, showing criminal fines collected $207 00, civil fees received $485, and court costs charged to Olmsted County $11.06, was read, and President Liddle referred the same to the City Attorney: made The following report on the results of gas tests/was read, and President Liddle ordered that the same be placed on file; "Results of Gas Tests for month of July and August 1,1932. " 673 The applications of Mrs• Robert Merz, R. W. McCroskey, S. L. Hawley, and Frederick A. Guyse, for soft drink dealer licenses, were each read, and upon motion by Norton, second by Moody, licenses..were granted. The applications of Peter J. Brown, L H. Gauthier and William W. Green, for plumber's licenses, were each read, and upon motion by Norton, second by Amundsenq licenses were granted. The application of A. G. Berndt, for a public dance permit at the Woodman Hall August 6th, 13th, 20th and 27th91932, and September 3rd,1932 , was read. The quotation of the Home Furniture Company, offering to furnish lockers for the Police Department at 0124-50 each less $2.50 each allowance for the old lockers, and the quotation of F. J. Paine Company, offering to furnish fifteen (15) lockers for the Police Department at a total of $195#159 less $30.00 allowance for the twelve old lockers, were each read, and President Liddle ordered that the samebb placed on file Copies of notice of release of temporary trunk highways,made by the Commissioner of Highways, relative to Trunk Highway.: No:20 and Trunk Highway No.7, were each read, and President Liddle ordered that the same be placed on file: The following communication was read, and President Liddle ordered that the same be placed on file: "Burt W. Eat on Attorney at Law Rochester, Minn. July 26,1932. Mr., A. F. Wright, City Clerk, City. Dear Sir: Mr. Eaton is at home ill. As soon as he is able to come to his office he will take up the matter referred to in yours of the 25th instant. Very respectfully, E.A.Graff Secretary." The quotation of the Northland Oil Company offering to furnish gasoline at 10,32 cents per gallon at the Grassle gravel pit, was read, and President Liddle ordered that the same be placed on file. The appointment by the Mayor of Seseph J. O'Connell, as a Special Patrolman for duty July 29th,1932, to August Uh,1932,inclusive, was read, and President Liddle ordered that the same be placed on filei A copy of a communication from the Van Dorn Iron Works Company addres Mr. Peter P. Bross, Architect, relative to the jail equipment installation in the new City Hall, was read and President Liddle ordered that'the same be placed on file. The Common Council took recesh for inspection of the disputed items in connection with the jail equipment installation,which have held up the architect's final estimate in favor of the contractorp,due to extra work claimed by the plumbing and heating contractor, and upon their return to'regular session, motion by Dallman, second by Moody,carried that ithe ,architects be instructed to certify the plumbing and heating contractor's extras occasioned by unworkable I jail equipment plans, for City o2 Rochester, Minnesota, payment. led tc The following plumber's license bonds were each read and upon motion by Dallrmans second by hsundsen, the sureties thereon were. accepted, the bonds were approved, and it was ordered that the same be placed on file: William W. Green, with -the New York Casualty Company as $19000.00 surety; L. H. Gauthier with the Fidelity and Casualty Company of New York as $1,000.00 surety; Peter J. Brown with the Commercial Casualty Insurance Company as $1,000:00 surety. The report of the Milk Inspector for the month of July 1932 was read, and President Liddle ordered that the same be placed on file. The following request for vacation was read, and upon motion by Hicks, second by Dallman, it was granted: "fig. lst .' 32 To tare Honorable` Council, Gentlemen: - May I ask at this time your permission to take the regularly alleted vacation time during the last few days of September and fore part of Octobert By Sept 25th I will have my work well in hand so that time off will not interfere ;with the regular work: - Respectfully, Manfred H. " The request of the City Engineer that $29000400 be appropriated from the General Fund for useof the Street and Alley Committee, and that $29000.00 be appropriated, from the Sewer Fund for use of the Sewer Committee, was read, and President Liddle ordered that the same be placed on file* The following coplea'of resolutions passed and adopted by the Public Utility Board, were each read, and �Presideat-:Liddle ordered that the same be placed on file: "Be it and it is hereby resolved by the Public Utility 1. Common Qouncil of the said City be and is herdby requested to authorize the said Board to enter into a contract with the general Electric Supply Corporation for thb '! furnishing of 80-35ft.8" top poles in accordance with Western Red Cedar Assru revised specifications with guaranteed penetration at a price of $8.10 each FOB Cars Rochester, Minneota-said Company being the lowest bidder and if the total contract price being SIX HUNDRED AND FORTY EIGHT DOLLARS." "Be it and -it is hereby resolved by the Public Utility Board of the City of Rechester, Minnesota, that the City Steam Rate be established as follows, effective immediately: First 509000 lb- $1.00 per M. lb. Next 1009000 lb- -90 per M. lb Excess $.80 per M.lb Less 10% discount if paid within ten days: e it and it is hereby further resolved that the Honorable Common Ckuncij oft a said City be and is hereby requested to authorize said rate: " "B8 IT AND IT IS HEREBY RESOLVED By the Public Utility, Board of the City of Rochester, Minnesota, that a WATER HEATING RATE be and is hereby added to the existingg rates of the .Public Utility Board and covered by the follpwing description, said rste to be effective immediately: WATER HEATING AVATT,ARTT,TTY: Water heaters: The heater to have a tank capacity of not less than 50 gallons and the heating capacity not to exceed the ratio of 1000 watts per 50 gallons of tank capacity. Heater to be 220 V. RATE: Direct Line Meter - 1.661 per K.W.H. Prompt Payment - Discount 10% in 10 days. Minimum Charge - $100 per meter. ySEFCTAL TERUS AND CONDITIONS: 1. Energy for water heating service shall be furnished through a separate meter and no other appliance shall be connected to this meter. 2. The meter and control devices, which automatically restrict the supply of current to the heater during certain hours, will be furnished by the city. 3 The supply of energy to the heater will be restrict ed to off-peak load periods, aggregating not more than 5 hours per day: 4. The Customer to furnish cabinet box approved by the City Wired for installation of the meter and control devicesi 5. WATER HEATER DEFINED: A storage water heater is defined as a heater having s heat insulated tank rwith volume of not less than 50 gallons per 1000 watts of heating element* Connected loads of more than 5 K.W. shall not be connected to this service without written permission of the City, and BE IT FURTHER RESOLVED BY the said Board that the Honorable Common Council of the said City be hereby requested to authorize the said rate:" Upon motion by Hicks, second by Miller, the sum of $3:81 was appro- priated from the New City Hall Fund and it was ordered that the samebe paid to the Street and Alley Fund for the cost of sidewalk repairs in front of Elizabeth Stebbins'(China Hall) property. Upon motion by Moody, second by Hicks, the City Engineer was instruct( to prepare a profile of levels for a sanitary sewer in Twelfth Street Southeast between Eighth Avenue and Ninth Avenue, and in Ninth Avenue Southeast between Twelfti Street and Fourteenth Street. The following applications for permits to place and maintain signs, each read, and upon motion by Dallman, second by 'Amundsen, permits were granted to each of them: G. R. Hicks Rochester, Minnesota Dear Mr. Hicks: You will remember that about the end of April the City Council appropriated $19000.00 to help finance the. City Hog Farm in its collection and disposal of city garbage: This amount together with some items of income has enabled us to carry ,on this service satidfactory to date which covered a longer period than I had expected. It is necessary again for us to request financial assistance from the Council. Also the present is a good time of the year to secure feeders which will be finished pork late in the. fall when prices will likely be good and we believe this can be done to advantage now. Therefore I respectfully request that arrangements be made to make available to the Hog Fare fund $11,000.00. Yours respectfully, D. Co Lochead M.D." An estimate prepared by the City Engineer. in favor of C.G.Fraser dhpwthg the seat of $27820,98 as being due the said contractor for the construction of a sanitary sewer and the laying of a water main in part of Eleventh Street Southeast, was read, and President Liddle ordered that the same be placed on file. The following estimatesprepared by the architect in favor of the contractors on the new City Hall building, and equipment, were each read, and President Liddle ordered that the same be placed on file: The Fischer Company as assignee of the Scheidt Printing Comparq, final estimate $505.00 for Council Room and Municipal Court Room furniture; Hanson Hardware Companyfinal estimate $82.95 for bale -nee due on Venetian blinds; Woodhouse Brothers, final estimate $125.00 on ventilating system contract; ' John McG.Mil1ee Estate, final payment $1730.19 ,for architect services $1705.199and rewriting electric fixture specifications $25.00 ; G. Schwartz & Company, $134477 extras; A . A. Kepp Electric Company $179.95 extras; Herman Dornack, extras 0168.48 net, being extras $1894073 less $31 25 credit for omitting grease trap in coriunity kitchen sink; 71 building. Herman Dornack $150.00 for water meter used in the New City Hall The following emergency authorization given by the Mayor was read, and President Liddle ordered that the same be placed on file: "Rochester, Minnesota. August first, 1932. Mr. , C: E. Ginther, Chief of Fire Depantment, Rochester, Minnesota. Dear Sir: Under and in accordance with the provisions of Section 284 of the Charter of the City of Rochester and in order that there may be no delay or damage to.the public interest I hereby authorize you tt• go into the open market and purchase seventeen Fire Alarm boxes and to exchange seventeen of the more obsolete types now in use in this city as part payment for the seventeen new boxes at a maximum cost, exclusive of the trade in value of the old boxes, of not to exceed $1734000. i Very truly yours, Julius J. Reiter Mayor of the City of Rochester, Minnesota " Upon motion by Hicks, second by Amundsen, the City Attorney was instructed to draft an ordinance to prohibit the construction of any more bulk gasoline storage tanks, or the rebuilding of the present tanks,within the City limits, without the consent of the Common Council as to the location of new construction or the rebuilding of the present ones. The following communication was read, and President Liddle ordered that the same be placed on file: " Kansas City, Missouri July 15, 1932 Hon. Julius Reiter Rochester, Minnesota Dear Mayor Reiter: We are today sending Mr. Hicks the report covering the writer's visit of June 21st to 25th together with bill for our services on that trip. Inas- much as we were late in getting that report to the committee, we prepared the map.of the report to show the mains and regulator stations as decided upon by the writer and the engineers of the natural gas company 'at the time of the last visit, July ,7th to 9th. The improvements then as shown on the map accompanying the report to the Natural Gas Committee have our approval. We are enclosing bill for our services on the last trip. We regret that we were not chose to serve you in the final stages of your natural gas program. We had hoped to be permitted to fdllow through with you on the supervision of this new utility to the end that the road would be kept clear for eventual city ownership. The city has brought this natural gas matter to a successful conclusion and is certainly to be commended for having led the way to this happy solution of the whole problem. The plans for the rehabilitation of the present distribution system, as devised by ourselves and the company's engineers, will give you a very good system - well proportioned, low in cost and with a minimum of inconvenience to the consumers and the public in general. There remains then the supervision of construction an this distribution system work. We hope the city will see fit to appoint a competent supervisor to inspect materials and workmanship and keep accurate records of the work as it goes In, Competent supervision will go a long way toward continuing the confidence of the public in the project. B d Nor should the supervision of operation be overlooked. We had f in mind that this service would include checking of extensions to the di st ribut ion system, general advice to the city on re- cords and accounts and, at the end of the year, a report to the city on the results of operation. Such procedure will serve to preserve the confidence of the public and the general harmony that has prevailed between the company and the city. P,. Hatcher, 2 days, July 7th and 8th,19321, $100.00, and his hotel and traveling expenses $600,73, in accordance with the above quoted communica- tion from the said companyi The application of E. T. Connolly for a plumbers license, was read, and upon motion by Dallman, second by Moody, license was granted. The plumber's license bond of E. T. Connolly• with the Fidelity & Casualty Company of Now 'Kork as surety thereon in the amount of $1,000.001, was read, and upon notion by Moody, second by Hicks, the said surety was accepted, the said bond was a•Vroved, 9nd It was ordered that the same be placed on file. The 17alance hheet, income statements, etc., of the Public, Utility Departments, prepared by the Secretary of the Public Utility Board, ( as of June 30th919329 were laid before the Common Council, and President ILiddle ordered that the same be placed on file} said income statements showing a net profit in the Light Department for June 1932, of $9,394.689 and a net profit in the said Department for the three months of this fiscal i year of $33134.749 and a net profit in the Water Department for June919329 of 11$7,587.67, and for the three months of this fiscal year $9493.119 with ,no report of the Steam Reatin Department revenue. . Alderman Miller introduced a resolution fixing 2:00 o'clocin P-M-9 September 6th,,1932, as the time for a hearing on and the levying of special assess- ments for the construction of a sanitary sewer and the laying of a water main in Eleventh Street Southeast, between the manhole at the sewage lift station and a point 190 feet west of the west line of First Avenue Southeast, which was read. Upon motion by Hidcs, second by Dallman, that the said resolution be adopted as read, -and all voting in favor thereof, ]President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced the following resolution, which was read: • "WHEREAS, There is need in the City Farm Fund for money to continue the operation of the City Farm, and WHEREAS, It is deemed necessary that a transfer of fluids be made from the btdget division of the General Fund which is for Public Health purposes; .SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota; That the sun of $1900000 is hereby temporarilly transferred from the General Fund, Code 49 to the City Farm Fund of said City. The Mayor and City Clerk are hereby authorized and directed to draw warrants' upon the City Treasurer and make the transfer accordingly." Upon motion by Moody, second by Amundsen, that the said resolution be adopted as read, and ail voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. alderman Amundsen introduced a resolution granting public dance permit to A. G. Berndt for the Woodman Hall, August 6th, 13th, 20th, 27th, 1932, and September 3rd919329 and fixing the fee at $1540, which was read. Upon notion by Norton, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared t', a said resolution duly passed and adopted. Alderman Amundsen introduced a resolution authorizing the Public Utility Board to establish water heating rates in accordance with the above quoted resolution t;.r; ' asking for that authority, which was read. Upon motion by Miller, second by Moody, that the *said reso- lution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced siresolution authorizing the te Public Utility Board to establis%heaatting rates in accordance with their above quoted resolution asking for that authority, which was read. Upon notion by Apaddsen, second by Norton, that the said L resolution be adopted. as read, and all voting in favor thereof, President ILiddle declared the said.resolution duly passed and adopted. Alderman Hicks introduced a resolution authorizing the .Public Utility Board to enter into contract with the General Electric Supply Corporation for the furnishing of 80 35 foot 8" top Western Red Cedar poles, in accordance with the above quoted resolution asking for that authority, which was read. Upon motion by billman, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President iddle declared the said resolution duly passed and adopted. Alderman Norton introduced a resolution appropriat ing 11$179 -95 from the New City Hall Fund and ordering payment made to L.A.Kepp (Electric Company for extras on electric wiring contract, which was readii Upon motion by Norton, second by Amundsen, that the said irresolution be adopted as read, and all voting in favor thereof, President i ddle declared the said resolution dilly passed and adopted. Alderman Norton introduced a resolution appropriating 1730,19 from the New City Hall Fund and ordering payment made to the dtate of John McG. Miller, for balance on architect's services connected th the planning and construction of a new City Hall $1705.19, and 2540 for rewriting electric fixture specifications, which was read. '5 , Upon motion by Norton, second by Moody, that the said resolution be adopted as read, and allvoting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Norton introduced the foll®wing resolution, which was read: "Be it resolved by the Comion Council of the City of Rochester, Minnesota: That, the sun of $134*77 be and the said sum is hereby appropriated iron the New City Hall Fund of paid City and ordered paid to G. Schwartz & Company, as extras on General Contract for construction of the New City Hall, being $9003 as net cost of Terrazza panels in landing; $53.98 for fire proof door in garage, making a class "A" opening, and $71.78 rock and concrete excavations for area windows. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sun upon the City Treasurer in accordance herewith, and cause said payment to be made. " Upon motion by Moody, second by Amundsen, that the said resolution be adopted as read; and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $82:95 from the New City Hall Fund and'orderina payment made to the Hanson Hardware Company as balance on contract for the furnishing and installation of Venetian blinds for the new City Hall, which was read. Upon motion by Hicks, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $505000 from the New City Hall Fund and ordering payment made to the Fischer Company, as assignee of the Schmidt Printing Company, for balance due on wood furniture for the Council Chamber and Municipal Court Room, which was read. Upon motion by Dallman, second by Amundsen, that thesaid resolutionbe adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted] Alderman Moody introduced a resolution appropriating $12500 from the New City Hall Fund and ordering p"iient made to Woodhouse Brothers, for balance on contract for furnishing and installation of ventilating system in the 'new City Hall, which was read. Upon motion by Amundsen, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced the following resolution,which was read: "Be it resolved by the Comaon Council of the City ofRochester, Minnesota: That the sun of $158.46 be and the saidsum is hereby appropriated from the New City Hall Fund of said City and ordered paid to Herman Dornaek,. as extras on plumbing and heating contract for the New City Hall, being $30.00 for labor and material installing two floor drains in women's cell room on second floor; $70.00 fo installinf of slop sink in Patrolmen's room; $44945 for installing sink in Milk Inspector s office; $16.77 for roughing in Milk Inspector's room; and $28.51 for labor covering pipe, plumber's helper, fond plumber, less credit of $31.25 for omitt- ing grease trap in Community Poon kitchen: it The Mayor and City Clerk are hereby authorized and directPd.to draw a warrant.for said sum upon the City Treasurer in accordance ixerewith, and cause said payment to be made." Upon motion by Moody, second by Norton, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating U50 40 from the New City Hall Fund and ordering payment made to the City of Rochester, Water Department, for a water meter for the new City Hall, which is charged to the account of Herman Dornack, which was read. Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Norton introduced a resolution appropriating $271.66 from the General Fund and ordering payment made to Burns & McDonnell Engineering Company for engineering services of M. P. Hatcher in connection with natural gas matters, four days, June 21st to 24th91932,inclusive, at $60.00 per day $200.009 plus $71.68 hotel and traveling expenses, wb1ch was read. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating 06664#95 from the Park Improvement Fund and ordering payment made to.the Mayo Trust Fund, for payroll for labor during the period of the week ending July 29th,19329 which was read. Upon motion by Amundsen, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President i Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced a resolution appropriating $2762.98 from the Permanent Improvement Revolving Fund and ordering payment made to C. G. Fraser, for construction of a sanitary sewer and the laying of a water main in part of Eleventh Street Southeast, under JW- No.16869which was read. Upon motion by Moody, second by Hicks, that the said reso- lution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution appropriating $2000.00 from the General Fund end $2000•.00 from the Sewer fund, both for use of the Street -and Alley Committee of said City, which was read. Upon motion by Hicks,'second by Moody.,that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed andadopted. 7 7 f The .following recommendation of the License Committee was reads and a motion by Norton, second by Miller, that the same be laid on the table for future consideration, lost by the following vote: Dallman, Hicks. Moody: Honorable Common Council, City of Rochester, Minnesota. Gentlemen: Ayes: Miller, Norton. Nays: Amundsen, "Rochester, Minnesota, August 1st, 1932. The application of Publix Theatres Corporation for refunding to it of the sum of $300.00 as license fee heretofore paid to the City of Rochester by it for the year of 1932-33 having been referred to the undersi ned committee it is recommended that the said refund in said sum of 1300.00 be made. Informal instructions were given to; the City Clerk that he prepare a resolution appropriating $300.00 td the Rochester Amusement Company refunding the current license fees for the Chateau Theatre, the Empress Theatre, and the Lawler Theatre, for action thereon at the next meeting of this Common Council. Upon motion by Hicks, second by Miller, the matter of ventilation for the vault of the Police Department offices, and the purchase of tires for the Chevrolet automobile in use of the Police Department, was referred to the Police Department C&=ittee, with power to act. Upon motion by Hicks, second by Amundsen, the City Engineer was instructed to clean up the team shed location and sell or junk the obsolete equip- ment stored there. Upon motion by Moody, second by Hicks, the City Engineer was authorized to the effect that any obsolete equipment,etc., stored In the City Warehouse, that the Park Board can use, be turned over to them for their use.
