Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absent: None. i President Liddle announced this as being the time and place fixed for hearing on the report of the Commissioners in the condemnation and taking 6t lands for a street in Broadway Street South, and asked if I there was any person present who'vIehed to be heard relative to the Commissioners report, etc.; the said lands being described: A piece of land described by metes and bounds as follows: Commencing at w point in the Center of the Street known as Broadway in the City of Rochester, in said I County, Seventy-six (76) feet South of the South line of College Street I i (Now Fourth Street Southwest) in said City, and running thence West parallel with the south line of said College Street (now Fourth Street Southwest) Twenty five (26) feet, thence south parallel with the West Line of Broadway Fifty Six (56) feet, thence East parallel with the South Line of said College Street (now Fourth Street Southwest) Twenty Five (25) feet, thence North along the center line of said Broadway Street, to the place of beginning. The following written objection to the said Commissioners award was read, and President Liddle ordered that the same be placed on file: "To the Common Council of the City of 8ochester, Minnesota: Now comes Theodore 0: Johnson, Jebors E. Fairchild, Eliza- bath Fairchild, Frances Fairchild, Donald Johnson and Allen Johnson, owners of that tract of land in the City of Rochester, Olmsted County, Minnesota, described as follows: A piece of land described by notes and bounds) Commencing at a point in the Center of the Street known as Broadway in the City of Rochester, Seventy-six (76) feet South of the South Line of Fourth Street Southwest, running thence best Twenty -Five (25) feats thence South Fifty-six (56) feet, thence East Twenty-five (25) feet, thence North Fifty-six (56) feet to the place of beginning. They object to the report of C. F. Olson, Johm J. Cook and Otto W. Riess, Commissioners, appointed by you in proceedings to condemn said land for. the reason that the sun of Five Hundred Dollars ($500.) by them foundto be the value of said land, is not the.full and true reasonable value of said land and is an inadequate award of damages for the taking thereof. Said ob- jectors are informed by many witness and believe that the true market value of said real estate is not less than Five Thousand Dollars($5000.) . Dated August 49 1932. Cooke, and Otto W. Riess, the Commissioners appointed on June 29th,1932, in and by resolution of the Common. Council of the City of Rochester, Minnesota, to view the lands and premises and to assess the damages occasioned bT the condemnation and taking -by said City of Rochester, Minnesota, for use of said City as a public highway, thereon and thereat, the lands described in said resolution of appointment, being, to -wit: A piece of land described by metes and bounds as follewet Co!hmencing at a point in the center of the Street known as Broadway in the City of Rochester in said County, Seventy six (76) feet south of the south line of College Street lnow Fourth Street Southwest) in said City, and running thence West parallel with t'!�;e South Line of said College Street (now Fourth Street Southwest)Twenty Five (25) feet, thence South parallel with the West Lire of Broadway Fifty six (56) feet thence East parallel with the South Line of said College Street (now Fourth Street Southwest) Tw%nty Five (25) feet, thence North along the center line of said Broadway Street, to the place of beginning, in the City of Rochester, Olmsted County, Minnesota, and WHEREAS, The City Clerk on July 23rd, 1932, did publish a notice to all persons interested in said lands, in the Rochester Post -Bulletin the official newspaper of said City, to the effect that said report and award of damages had been made and filed as aforesaid and unless written objections were made thereto by persons interested in said lands, the said report and award'of damages would be c:uiXirmed by the Common Council of amid City ofRochester, Minnesota, at a meeting of the said Common Council, to be held et .7:30.:o'clock.PM.-, on° August 8th,1932, at the Council Chambers, in the City Hall, in said City; and the said notice was published in the said newspaper for at least ten (10) days prior to the date of said meeting head on August 8th,'1932, and WHEREAS, The said Common Council duly met at said time and place and heard and duly considered all objections offered and interposed by persons interested in the said lands and duly considered the said report and the award of damages therein made by the said Commissioners; and WHEREAS, Written objection has been made to the report of the Commissioners and the award of damages made by the said Commissioners, and the same has been duly considered by this Common Council, and NOW '.t'FiEREFORE, Be it and it is hereby resolved by the Common Councib of the City of Rochester, Minnesota. That the report of said Commissioners made and filed as aforesaid and the award of damages therein contained rind set forth be, and the same are hereby in all things confirmed, the said award of damages being to Theodore 0. JOhnson, Jebors E. Fairchild, Elizabeth Fairchild, Frances Fairchild, Donald Johnson, and Allen Johnson, a total sum of $50040, and Be it further resolved by the said Common Council: That there is hereby appropriated from the General Fund of said City, the sum of $5000009 for payment to Theodore 0. Johnson, Jebora E. Fairchild, Elizabeth Fairchild, Frances Fairchild, Donald Johnson, and Allen Johnson, for the condemnation and taking of a Piece of land described by metes and bounds as follows: Commencing at a point in the center of the Street known as Broadway in the City of Rochester, in said County, Seventy-six (76) feet South of the South line of College Street (now Fourth Street Southwest) in said City, and running thence west parallel with the South line of said College Street (now Fourth Street Southwest) Twenty Five (26) feet, thence South parallel with the West Line of Broadway Fifty Six (56) feet, thence East parallel with the South Line of said College Street (now Fourth Street Southwest) Twenty Five (25) Feet, thence North along the center line of said Broadway Street, to the place of beginning, in the City of, Rochester, Olmsted County, Minnesota, and Be it further resolved by the said Common Council: That there is hereby appropriated from the General Fund of said City the sum of $ 30.00 for payment to said Commissioners for their services in the said natter, being $10.00 each, and the Mayor and City Clerk of said are hereby authorized and directed to draw warrants upon the City Treasurer for the said sums and cause payments to be made to the persons above mentioned and to the said Commissioners." Upon notion by Miller, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Rev. Im. K. Naseth asked that the so-called Witherstine property be turned over to the Advisory Board of the Community Chest for Public welfare purposes, and followed his oral request with the following written request, which was read: "Rochester, Minnesota August 8, 1932. To the Honorable Mayor & Common Council of the City of Rochester, Minnesota Gentlemen: The Advisory Board of the Community Chest of Rochester respectfully requests that it be given, for one year, the use, for welfare purposes, of the building at 305 Third Avenue Southwest. The Advisory Board will, in case this request is granted, assume responsibility for the building, the facilities of which will without prejuidice or charge, be made available to agencies, private or public, that partici ate in the Community Chest or wish to cooperate with it in r21ef end welfare work. Respectfully yours, Wm. K. Naeseth WKN-ba Chairman of the Advisory Board." Upon motion by Hicks, second by Amundsen, the Advisory Board of the Community Chest of the City of Rochester, Minnesota, .was granted the use of the so-called Witherstine Property, in accordance with their above quoted request. Theodore Farak made complaint about the condition of the Sixth Street Southwest paving and curbing but no definite action was taken thereon. Dyer H. Campbell read the following c comnunicat ion` before the Common Council,,and President Liddle ordered that the same be placed � r on file: "Chamber of Commerce Building Rochester, Minn. August 891932 The Honorable Mayor and Common Council of the City of -Rochester Gentlemen:-, The joint committee of the Chamber of Commerce and the Olmsted County Business Men's Association appointed to study Ordinance No.4479 regulating and licensing the use, handling, storage and sale of flammable liquids, held a meeting today, Rand a good deal of discussion was held relative to the effect of the enforcement of this ordinance upon business in Rochester. 2t w%s felt that this matter was of such importance that the committee respectfully requests that any attempt to enforce this ordinance be deferred a short time, allowing this gf'oup time for furthet study and consideration. It is with the thought of being helpful to your body, and of safeguarding the welfare of. business that this request is being made. " MM • The report of the Clerk of the Municipal Court for the week ending August 31919329. showing criminal fines collected $22.40, civil fees received $6.70, $42.70 received from Olmsted County for June,19329 Municipal Court fees, $50-50 court costs charged to Olmsted County, and $10,00 fine collected and remitted direct to the State Treasurer, was read, and President Liddle referred the some to the City Attorney. The July,19329 report of the City weighmaster, showing $8.00 collect for weighing fees, was read, and President Liddle referred the same to the Finance Committee. The report of the City Treasurer for the month of July919329 showing $354191:11 as being on hand at the ending of that month was read, and President Liddle ordered that the same be placed on file. The City Engineer's Department trial balance for July91932, was laid before the Common Council, and President Liddle ordered that the same be placed on file. The report of the City Engineer for the month of July,1932, showing expenditures from the General Fund for labor in the amount of $701.10 , from the Street and Alley rand $1257.959 from the Sewer, Fund $562.259 and from the Bridge Fund $19.50,' was read, and President Liddle ordered that the same be placed on file. The report of the Health Officer for the City Farm for the month of July, 19329 showing receipts $517.36, disbursements $687.37, and an overdraft at the ending of that month of $319 A3, was read, and President Liddle ordered that the same be placed on file. + A copy of the balance sheet of Independent School District N0.89 showing statements of school accounts for the period August 1919319 to July 31st, 19329inclusive, was read, and President Liddle ordered that the same be placed on file. The application of John C. Adams, and Oscar C. Schmidt, for soft drink dealer licenses, were each read, and upon motion by Hicks, second by Amundsen, licenses were granted. The applications of the Sanitary Company, L. F. Milostan, Rochester Plumbing and Heating ComparW, and Herman Dornack, for plumber's licenses, were read, and upon motion by Dallman, second by Moody, licenses were granted. The following plumber's license,bonds were read, and upon motion by Moody, second by Dallman, the sureties thereon were accepted, the said bonds were approved, and it was ordered that the same be placed on file: The Sanitary Company, with the Aetna Casualty &,:Surety Company as surety for $19000.00; I I ' L. F. Milostan, with the National Casualty Company as surety in the amount of $1,000.00; Rochester Plumbing & Heating Company with the National Casualty & Surety Company as surety in the amount of $1,000.00; it Herman Dornack, with the American Surety Company of New York, as surety thereon in the amount of $1,000.00. A petition asking that Sixth Avenue Southeast, from Tenth Street Southeast to Eleventh Street,Southeast be sprinkled ortrested during the balance of the 1932 sprinkling season, was read, and upon motion by Hicks, second by Moody, the petition was granted,and the City Engineer was' instructed to secure the necessary labor and materials and comply with the petition. The following copy of resolution passed and adopted by the Public Utility Board, was read, and President Liddle ordered that the same be placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Hon. Common Council of the said Vity be and is hereby requested to authorize the said Board to enter into a contract with the Rochester Plumbing and Heating Company for the furnishing of; (1) One COCHRANE F'F'�ED WATER HEATED as per bid submitted for said heater. (2) Piping,fittings,valves,insulation,surge tank and supporting steel as. per bid. (3) One DELAVAL BOILER FEED PUMP and base as per bid submitted for said pump. (4) One WESTINGHOUSE TURBINE DRIVE for boiler feed pump as per bid sub- mitted for said turbine drive. (5) One DELAVAL AUXILIARY PUMP AND MOTOR as per bid on same. (6) The necessary labor and supervision for the installation of'all equipment and material bid upon. (7) Any additional materials and labor required to make a complete installation in accordance with specifications and with the bid of the said Rochester Plumbing and Heating Company; for the lump sum price of EIGHTEEN THOUSAND ONE HUNDRED AND THIRTY DOLLARS AND FIFTY CENTS ($18913050) said price being for the -delivery of all equip- ment FOB Rochester, Minnesota and erected wid the said company being the Ilowest responsible bidder." The following copy of resolution passed and adopted by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota, was read, and upon notion by Moody, second by Hicks, the action set forth therein was approved anal it was ordered that the said copy of resolution be placed on file: "Be it resolved by the Commissioners of the Sinking Fund of the City of , Ro ch ester, Minnesota: That the sum of $115180-30 be appropriated from the Sinking Fund and paid to the First National Bank of Rochester, Minnesota, for $119000.0 0 State of Minnesota, 4,% Highway Bonds maturing June lst,1947, the said bonds having been purchased from the First Securities Corporation of St. Paul, Minnesota, and forwarded through the said First National Bank; $119000.00 thereof to be for principal on the said bonds, $429.99 thereof to be for premium on the said bonds to yield 3490%, and $88.31 thereof to be for accrued interest on the said bonds, June 1st 919329 to August 9th,1932,inclusive . The said appropriation is made from the budget divisions as follows: No.5 $1039*09, No.7 $8.039 No.23 $6234.54, No.24 f 48.18, No.25 $2078.18, No.26 $16.059 No.29 $2078.169 No.30 $16.05." The following coimaunication was read,, and the; motion by not Norton that the plan, specifications, etc., be/released, received no second: 8 "City of Rochester, Minnesota Department of Public Utilities August 89 1932 The Honorable Common Council City of Rochester, Minnesota Gentlemen: .The Public Utility Board has on this date passed a motion requesting that you allow the Power Engineering Company of Minneapolis, Minn. to use the plans, specifications, and blue prints of the Power Dam for their use in investigating the disintegrating of the Dam and the repair thereof; said plans, specifications, and blue prints to be returned upon the completion of the said work.: RespeeWully submitted, l►. Miller, second by Amundsen, the ,City Clark. -was. instructed to release the above mentioned plans, specifications, etc., of the Public Utility Board; all voting in favor thereof except Alderman Norton, who voted "Nay". Theel for gravel furnished the City of_ Rochester, during the year 1932: Owing to the fact that it was. impossible to determine the amount ta':cen daily from the Theel Pit and the County Pit, the two pits lying side by side, the total haul has been credited to the County Pit in our daily records. Upon motion by Hicks, second by Dallman, the Mayor was requested to issue an emergency authorization for the cost and expense of providing electric power for the operation of the machinery at the so-called Grassle Gravel Pit; The following proposal was read,"and upon motion by Moody, second by Miller, it was accepted: "TO THE HONORABLE COMMON COUNCIL OF THE CITY OF ROCHESTER.&MINNESOTA The Olmstet County Power Company offers to furnish electric durrent for use at its new gravel pit on the Grassle,farm for the sum of three and one-half (* cents per kilowatthour net, Federal Tax, if any, to be added. This offer is made upon the following terms and conditions: 9 The city shall build the line at its ova costs and expense from our present line to said gravel pit and is to be the owner of the extension when completed: The city shall furnish.the step-down transformer and the meter. The extension line to be built according to the specifica- tions of the -Olmsted County Power Company and shall be supplied with such switches as will permit this extension to be out off during the winter months when it' is not in use, and during the period that the city does not care to use the gravel pit. The Olmsted County Power Company reserves the right to repair the line, but the city shall pay the actual outlay for such service. The above offer is made upon the further condition that the City of Rochester hereafter sells electric current to said Olmsted .County Power Company at the same rate as prevailed during the year 1931, or the equiva- lent thereof. 85 Dated August 8, 1932. " The City Engineer submitted, a comparative statement of gasoline p ower costs as against elec#ric power costs, for the operation of the machinery at so-called Grassle gravel pit , and President Liddle ordered that the same be placed an file. President Liddle,at this time,excused Alderman Hicks,who left the Council Chambers. The following agreement executed by the Wm_ H. Ziegler Company was read, and President Liddle ordered that the same be placed on file: "Agreement in connection with, and governing the terms of payment, in the matter of contract between the Wm. Ziegler Company and the City of Rochester, Minnesota, for furnishing to the City of Rochester, one Gravel Crushing and Screening Plant and erecting same. It being admitted that there is at this time a contract in force, said contract being drawl contrary to the preirisions included in the specifications for furnishing of the said plant, which said specifications clearly provide for payment an the following terms. Viz: One thousand ($1000.0 dollars to be paid upon acceptance by the City, Arse -Half (�) of the remainder $0 be paid July 1st, 1933, One-half (-�) of the remainder to be paid December 1st, 1933, .Now therefore, be it agreed and understood that the terms of pay- ment shall be, and are, as above written; and that the payment of the whole amount of the cost of 'the plant will not be demanded upon delivery of the plant, as is now provided for in the present contract.". Chair. Alderman Hicks returned to the Council Chambers and again took his Alderman Dallman introduced the following resolution, which was prepared pursuant.to informal order given to the City Clerk at the meeting held Au�nnst 11 1932, but no action was taken thereon: "WHEREAS, The Rochester Amusement Company have made request for the refundment of $300.00 as a return of the notion picture license fees an licenses No.659 66, and 679 covering the Chateau Theatre, the Lawler Theatre and the Empress, Theatre, for the period between the first Monday in May,19329 and the first Monday in May, 1933s as a contribution for keeping the La#ler Theatre and the Empress Theatre open for business; business conditions having made it necessary to close the Chateau Theatre June 18th,1932; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: y That the sum of $300.00 is hereby appropriated from the General Fund and it is ordered that the said sun be paid to the Rochester Amusement Company for the refundment of the license fees for the period mentioned on the theatres above named. I The Mayor and City Clerk are hereby authorized and directed to draw a warrant upon the City Treasurer and make payment accordingly." Alderman Dallman introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $86.54 be and the said sun is hereby appropriated from the General Fund of said City and ordered paid to Rochester Amusement Company as refundment of unearned license fee on motion picture license No:659 heretofore issued covering the Chateau Theatre for the period the first Monday in May91932, to 7 86 I the first . Manday in May, 19339 in that due t9 business conditions the Chateau Theatre was closed June 18th,1932. The Mayor and. City Clerk are hereby authorized and directed to -draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made." Upon motion by Norton, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The following communication was read, and President Liddle ordered that the same be placed on file: "13th Floor Builders Exchange Building St. Paul, Minnesota August 59 1932 City of Rochester Rochester, Minnesota Gentlemen: We understand that you have a gravel plant arA will sell gravel which passes Minnesota State Highway Specifications Will you please quote us a price on sand and on gravel F.O.B.Austin, Minnesota or f.o.b, your plant for Bridge No.5228 requiring 500 yards sand and 1000 yards gravel. O'Connell as a Special Patrolman August 5th to llth,1932, inclusive, was read, and President Liddle ordered that the same be placed on file. The following communication was read, and President Liddle ordered that the same be placed on file: " Department of Labor and Industry INDUSTRIAL COMMISSION OF MIN14ESOTA 612 Bremer Arcade Saint Paul August 19 1932. Mr. A. F. Wright, City Clerk City of Rochester Rochester, Minn: Gentlemen: I On July 30919329 our inspector, Mr; R. K. Johnson inspected the premises at lot Ave: and 3rd St. S.W., Rochester, and we are submitting recommendations for improving conditions ' as follows: Doors for hydraulic elevator should be locked when not in use: In order that the above recommendations may be taken care of speedily, and accidents reduced to a minimum in our State, they should be complied with, within thirty days, and this office notified when they are completed. Smith Chief, Division of Accident Prevention: 87 , A communication from the Van Dorn Iron Works Company relative to the architect's final acceptance of the jail equipment installation in the new City Hall, was read, and President Liddle ordered 'that .the , same be placed on file. The City Clerk reported the receipt of $89:53 as - cent per thousand on 17906000 cu. ft. curie Peet /of 'natural gas used at the Franklin Heating Station, during July,1932. Upon motion by Worton, second by Moody, the matter of who shall pay the Public Examiner costs for the examination of the books and records in the matter of the George Healy will,, was referred to the City Attorney for his report thereon. Upon notion by Hicks, second by Dallman, the sum of $80:00 was appropriated from the General Fund and it was ordered that the said sum be paid to Mrs. Catherine Fritsch as compensation for the death of Mr. Christopher Fritsch during the period June 29th,19329 to July 26th,1932, inclusive. The following communication was read,aad President Liddle ordered t the same beplaced on file: " Grand Rapids, Mich. August 3, 1932 ,Mr: A. F. Wright, City ' Clerk, City Hall, Rochester, Minn. Dear Sir: Our Mr. Ohland has written us advising us that the braaze rail on the top of the swinging gates wk4ch we furnished in connection with your county }rave tarnished badly from usage. We are very sorry to learn of this situation. The specifications of the architect called for bronze rail. It has been our�r xperienee that regardless of the type of bronze used, on a swinging gate, it is impossible to prevent it from tarnishing. Being touched by hands seems to tarnish bronze regardless of any other condition. The only way to take care of this bronze properly would be to remove it and have it replated, and then to each day have the janitor keep it cleaned with a metal polish. ' Wherever we have an opportunity, we are designating a gate which can be covered with an application of a rubber moulded shape or piece of bakelite to prevent this tarnishing condition on bronze. Hunting Manager of Sales " The following report relative to gravel pit equipment was read, and upon motion by Miller, second by Amundsen, the City Engineer was authorized to purchase the cables and pulleys mentioned therein and that he rent the drag line complete without power at $70.00 per month to apply on the purchase price of $700400: "August 89 1932 Hon. Alderman Dallman introduced the following resolution, which was read: "WHEREAS, It is deemed expedient and necessary for the best interests of the City of Rochester, Minnesota, that supervision be made of the construction of the natural gas distribution system, and 1HEREAS, John J. Kerr has made a proposal agreeing to act as field engineer in the preparation of a construction plan and profile as the work progresses, showing the exact location of the pipe line, together whth the elevation of the same, location of gates, fittings, etc., for the sum of $175*00 per month; S0 THEREFORE, Be it resolved by the Comnion Council of the City of Rochester, Minnesota: That John J. Kerr be employed as Field Engineer :for the purposes above set forth effective as of August Znd, 1932, a-C a salary of $ 175.00 per month, which employment shallcontinue at the pleasure of this Common Council, and during his term of employment the said salary shall be paid in semi-monthly installments on the 16th day of each month and on the last day of each month, from the General Fund of said City, while he is retained as such Field Engineer; the Mayor and City Clerk being hereby authorized and.directed to draw warrants upon the City Treasurer and make pay- ment of the said salary as it may become due. " Upon motion by Hicks, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Hicks introduced a resolution authorizing the Public Utility Board to enter into contract with the Rochester Plumbing and Heating Company, in accordance with the request' set forth in the above quoted resolution, and fixing the amount of the bond to be given by the said contractor at the sum of $1891350009 which Was read. Upon motion by Moody, second by dicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle.declared the said resolution duly passed and adopted. Alderman Amundsen introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: _. That the sun of $338.63 be appropriated and paid to the Standard Oil Company for gasoline furnished during the period June 15th91932, to July 6th,1932, inclusive; $1.69 thereof to be from the Sewer Fund, $168.17 from the General Fund, and $168.77 from the Street and Alley Fundo The Mayor and City Clerk are hereby authorized and directed to draw warrants upon the City Treasurer and make payment accordingly." Upon motion by Amundsen, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Norton introduced a resolution appropriating $567.11 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for payrolls for labor during the period of the week ending August 5th,19329 which was read. Upon motion by Norton, second by ?Ticks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $401.06 from the General Fund and ordering payment made to the Rochester Post Bulletin, for official publications and printing during July919321, which was read. Upon motion by Miller, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution appropriating $ 350.00 from the Fire Protection Fund and ordering payment made to the Northern Pump Company of Minneapolis, Minnesota, for the furnishing of one 300 gallon Northern rotary pump for use on the International Combination truck, which was read. Upon motion by Amundsen, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced the following resolution,which was read: "WHEREAS, The Contract for the furnishing and installation of a gravel crushing and screening plant does not exactly agree with the specifications for the same, and WHEREAS, The Wm. 8 Ziegler Company have executed an agreement that qualifies the difference between the said contract and the said specifications; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said agreement be and the same is hereby made a part of the said contract for the furnishing and installation of a gravel crushing and screening plant, thereby making it conform to the specifications; said agreement being quoted as follows: f.l V 'An agreement in connection with, and governing the terms of payment, in the matter of contract between the Wm.'Ziegler Company and the City of Rochester, Minnesota, for furnishing to the City of Rochester, one Gravel Crushing and Screening Plant and erecting same. It being admitted that there is at this time a contract in force, said contract being drawn contrary to the provisions included in the specifications for furnishing of the said plant, which said specifications clearly provide for payment on the following terms: Viz: One thousand 01000.00) dollars to be paid upon acceptance by the City, One-half (-�) of the remainder to be paid July 1st, 19339 one-half (-) of the remainder to be paid December 1st, 1233. So therefore, be it agreed .and understood that the terms of payment shall be, and are, as above written; and. that the payment of the whole amount of the cost of the plant hill not be demanded upon delivery of the plant, as is r%ow provided for in the present contract." Specifications and estimate of cost for the furnishing of a quadruple pumping, booster, ladder and hose body engine and equipment, for use of the Fire Department of said City, was laid before the Common Council, said estimate of cost being 013,500.00. Alderman biller introduced the following resolution, which was read: "WHEREAS, It is deemed expedient and necessary that a quadruple pumping, booster, ladder and hose body engine and equipment be purchased for use of the Fire Department of the City of Rochester, Minnesota, and WHEREAS, Specifications and estimate of cost have been prepared and submitted for the furnishing of :the said engine and equipment; SO THEREFORE, Be it resolved by the Common -Council of the City of Rochester, Minnesota: That the said quadruple pumping, booster, ladder, and hose body engine and equipment be purchased for use of the Fire Department of said City, and that the said specifications be adopted for the furnishing of the said engine and equipment, and that the same be placed on file in the office of the City Clerk of said City, and that the said estimate of cost be accepted and placed on file in the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of , said City be and he is hereby authorized and directed to advertise for sealed proposals for the furnishing of the said engine and equipment, which proposals will be received and opened at a public meeting of the Common -Council of the City of Rochester, Minnesota, which is to be held in this Council Chambers in the City Hall, in said City, at 7:30 o'clock PX., on August 29th,1^32. Each bid must be , .accompanied by a certified check upon some reputable bank drawn payable to the Mayor o f .
