Council of the City of Rochester, Minnesota, held in the Council Chembers,
in the City Hall, in said City, at 7:30 o'clock P.M., on August 29th91932.
Meeting called to order by President Liddle.
Roll Call. Present: Lidd-lelt Dallman, Hicks, Miller,
Moody. Absent: Amundsen and Norton; Alderman Amundsen being absent on
account of * broken• ankle.
Upon motion by Moody, -second by Dallman, the minutes of
the meetings held on August lst919321 and August 8th919329 were each
approved.
This being the time and place fixed for the opening of i E
proposals for the furnishing of a quadruple pumping , booster, ladder,
and hose body engine and equipment, for use of the Fire Department of the
City of Rochester, Minnesota, the following proposals were opened and read:

President Liddle referred the above proposals to the Fire
Department Committee, the Fire Chief and the City Attorney, for their
tabulation and recommendations.
Alderman Norton came in at this time and took his Chair.

L. L. Lejune offered to repair the Fourth Street Southeast bridge
ever Bear Creek, for the sum of $400.00, and upon motion by Hidcs, second by Moody,
his offer was referred to the Street & Alley Committee, and the City Engineer.
Rev, W. W. Bunge made complaint about the drainage at the intersec-
tion of Fifteenth Avenue Southwest and Second Street Southwest, especially as to how
it effects the property atSouthwest, andlater in the meeting
the City Engineer offered a plan for the relief, whereby a surface drainage sewer
would be constructed commencing at Kutzky Park and Thirteenth Avenue Northwest, and
running South in Thirteenth Avenue Northwest to Second Street Northwest, and thence
in Second Street Northwest to Sixteenth Avenue Northwest and in Sixteenth Avenue
Northwest Ana:.Southwest, from Second Street Northwest to Second Street Southwest, and
thence in Second Street Southwest to Fifteenth Avenue 'Southwest and possibly
Fourteenth Avenue Southwest, there to pick up the drainage from those dbvenues,*fth
pipe of sufficient size to carry off the surface water from that avea.
Ernest H. Schlitgus, Jr., as Chairman of the Minnesota Highway Compl
Celebration at Rochester, told the Co:.,anon Council°of the plans for this celebration,
which is to be held September 25tt,91932, and asked for the following concessions:
Close Broadway Street South from Fourth Street Southeast and South-
west to Center Street East and West;
Suspend all traffic regulations in favor of visitors;
Grant the Committee all' concession rights for that day;
Allow the registration of visitors to be made in the City Hall lobby;
Grant the sub -committee the use of the community room and kitchen
for that day;
Allow the erection of tti,3 band stand on Second Street Southwest -, in
front of Knowlton's store, which will also' be used for a reviewing stand during the
parade;
Rope off Second Street Southeast between Broadway and the railroad
tracks for a pavement dance;
I Close Third Street Southeast from Broadway to the alley as a location
for a merry-go-round, and close Third Street Southwest from Broadway Street South
to the alley as a location for a Ferris wheel; at which motion by Hicks, second by
Miller, carried that these privileges be granted.;
Earl A. Vine asked that a street light be installed in the alley
in the rear of his residence, and President Liddle referred his request to the
Li?hting Committee with instructions that they make report thereon at the neat
meeting of this Common Council.
A Mr. Wallace, who is constructing a new residence on Second Street
Northwest, between Thirteenth Avenue and Sixteenth Avenue, asked that the Common
Council assist him in getting natural gas service, at -which President Liddle referred
his petition to the Street and Alley Committee.

Upon notion by Miller, second by Hicks, further action on
the proposals for furnishing the quadruple pumping, booster, ladder and
hose body, engine and equipment, was adjourned and continued 4ntil 2;00

Repartment Committee, the Fire Chief, and the City -A.ttorn6y� is in the
hands of the Common Council at that time.

Balance sheet of the Rochester Public Schools, for July,
31 st,19 32, together with a statement of outstanding warrants, and a
statement of bond maturities, was read, and President Liddle ordered that
the same be placed on file*
The report of the Building and Electrical Inspector, for
the month of July91932, showAgg Dullting inspection fees collected in the
amount of $19.00, plumbing inspection fees $9509 and electrical inspec-
tion fees $8.50, was read, and President Liddle ordered that the same
be aat'erred to the Finance Committee.
The report of the Public Utility Departments for the month
of July919321 which shows a profit in the Light Department for that
month of $9451.459 and a net profit in the Light Department for the four
months of this fiscal year of $429586.19, and a net profit in the Water
Department for July919321, of $664.149 and for the four mon�hsof this fiscal
year of $109157.259 was read, and President Liddle ordered that the same
be placed on file.
The report of the Clerk of the $umicipal Court, for the
week ending August 8th919329 showing criminal fines collected $45.00 9
Civil fees received $4 85, court costs charged to Olmsted County $14,670)
for the week ending August 15th919329 showing criminal fines collected
$lino, civil fees received $435, and court costs charged to Olmsted
County of $$30.20; for the week ending August 22nd919329 showing criminal

The following communication was read, and upon motion by Norton,

No.510 and 524, was read, and President Liddle referred the same to the Street &
Alley Committee.
The plumber's license bond of Mengedoth & Popple, with the National
Casualty Company as surety thereon in the amount of $19000:009 was read, and upon
motion by Dallman, second by Moody, the said surety was accepted, the said bond was
approved, and it was ordered that the same be placed on file:
The application of 0. E. McCoy, City Weigbmaster, for a vacation
during the period September 6th to 12th,1932,inclusive, was read, and upon motion
by Hicks, second by Moody, the request was granted.
Notice of appeal in Theodore 0. Johnson, eto al.,' vs. the City of
Rochester, Minnesota, was read, and President Liddle referred the same to the City
Attorney.
The appointment by the Mayor of Paul Schmidt as a Special
Policeman at the seven school play grounds, to serve without pay and to hold
office until the second Monday in Apri191933, unless sooner removed, and the
appointment by the Acting Mayor of Joseph J. O'Connell, as a special i
Patrolman August 12th to 18th, 19321, inclusive, and the appointment by the
Mayor of Carlton E. Anderson, as a Special Patrolman August 13th, to
August 19th91932, inclusive; the appointment by the Mayor of Joseph J.
O'Connell, and Carlton E. Anderson, as Special Patrolmen August 19th, to i
25th91932, inclusive; and the appointment by the Mayor of Joseph J. O'Connell

Communications from the Van Dorn Iron Works Company relative
to the unpaid balance on -contract for the furnishing and installation of jail
equipment in the new City Hall, was read, and President Liddle referred the
same to the Public Grounds Co®ittee.
The City Clerk presented the $897,55 check of Burt W.
Eaton, #xeeutor, drawn payable to the City of Rochester, Minnesota, for the
cost of the Public Examiner's audit of the books and records of Geo. Healy
Estate, and upon motion by Hicks, second by Norton, the said $897.55 was
accepted into the General Fund of said City in payment of the items mentioned.
The following communication was read, and President Liddle
refereed the questionnaire ffientioned to John S. Reed, Resident Identification
Card Inspector, with request that he make reply to the same:

We wrote you in the fall of 19319 and information you
gave us at that time was of considerable value in determining what
employment conditions would be during the winter of 1931-1932 in
the State of Minnesota.
It is my desire that the next legislature be fully advised
as to employment conditions in the state as a whole and What assistance i,
if any, may reasonably be expected the various localities will require
during the winter months of 1932-1933.

Accompanying this letter is a questionnaire, which I as asking that
you fill out and return to me as soon as the information desired can be obtained.
Will you confer with such groups or individuals who in your judgment are compe-
tent to assist you in compiling data that will aid you in answering the ques-
tions asked theredn3
It is important that the requested information be returned to me within
the next thirty days. I sincerely hope that you will co-operate with me in this
endeavor to secure an accurate estimate of the effect unemployment conditions will
have in this state during' the coming winter.
As indicated, the information you give as will not be used in any way
to embarrass you personally, your community* or the persons whom you may be
interested in assisting.

The following communication was read, and President Liddle ordered
that the same be placed on file:

Dear Sirs
On July 30 Mr. R. K. Johnson inspected the building on the
southwest corner of First Avenue and Third Street, Rochester, which he
was informed was deeded to the city of Rochester through a will of one
of its citizens.
In this building there is a hydraulic elevator which runs from
the basement to the second floor. It was at the basement landing at the
time of the inspeotion.. The enclosure around this elevator on the first
and second floors has sliding - doors that can be opened from the outside.
The elevator apparently is not used a great deal. We, therefore, recom-
mended that these elevator doors be locked shut.
Throughout the state there have been several accidents that
happened in just this way. These accidents are generally very serious
as well as very costly. That is why this department issued that recommenda-
tion.
If it is impossible for the people in Rochester to find this
elevator, someone from this department will be in your city before the
end of the wee'_. They will show you where the elevator is.

The City Clerk mentioned the fact that the description and the
contract for deed wit# Otto W. Riess, relative to lands for Silver Lake'reservoir,
are, upon the information of Henry K. Armstrong,' incorrect, and President Liddle
referred the subject to the City Engineer, with instructions that he prepare a
proper description for the correction of the contract for deed.
The following receipt was read, and President Liddle ordered that
the same be placed on file:

After a di scussiop of the subject, motion by Hi ck s, second
by Horton, carried that in the compilation of 1932 costs for sprinkling
and treating of streets and avenues, the City Clerk Shall total the April,
May,Jurie; July, August and September costs, and use one sixth of the
amount as the estimated cost for octobe r919324
The City Clerk presented a plat drawn by H. K. Armstrong,
which is for the future record as to the center line of the Mill "race: run-
aing Northeasterly across Block 102 in Willson's Addition, in that 4the
same is being filled upland President Liddle ordered that the same be
placed on file.

The charter commission of the City of Rochester, at its
meeting held in the Council Chambers, in the City Fall of said
City lest evening, voted not to submit the proposed amendmentvoo
Sections 151 and 154 of the City Charter of said City to
the ters
of said City for the reason that the office of the Attorney General
of the State of Minnesota has ruled that said proposed amendment
to Section 1549 if adopted, by the voters, would be unconstitutional.
That being the case, the commission felt that it would
not be advisable to submit the same:
The commission, however, felt that it had no objection
to submitting the proposed amendment to section 151 but did not
deem it advissbl a to submit the same to the voters at ti-is time
because there is no immediate necessity for the same. The
Commission thought that there might be some other amendments to be
submitted to the voters within the next three years and that the
proposed thus save the city theent to section 51 could be expense of aoted specialnat the electionsaate
time and th present.

The following emergency sAthorization was read, and
President Liddle ordered that the same be placed on file:

Public Utility Board and
City Engineer,

Gentlemen:
I an informed that considerable equipment is necessary immediately
at the gravel pit on the Henry Grassle farm northwest of the city if the
city is to obtain ,any gravel there this year end that damage would be
caused to the public interest if it were necessary to take the time to
advertise for bids for the equipment. I also understand that the Public
Utility Board has on hand about $300.00 worth of equipment which can be
uded at the pit. Therefore Ander the provisions of Section 284 of the City
Charter, I authorize the Public Utility Board and the City Engineer to go
into the open market and purchase the necessary equipment and employ the
necessary labor for the installation of necessary poles, wires, motors,
starters and transformers all of the said equipment to cost approximately
$1250.00 .

were authorized and directed to execute a lease with the Chicago North Western
Railway Company for railroad lands fdr use as a pumping station for the eondmneor
line intake at the light 'plant.
The claim of the Fisher Company $81*40, for labor and materials
refinishing furniture in various City Hall offices, vas read, and President Liddle
referred the -same to the Architect, Mr, Peter P. Bross.

Company, showing the sum of $898.80 as being due the said contractor on the
furnishing of steel furniture for the new City Hall offices, was read, and

Alderman Miller intro,!nced the following resolution, which was read:
WHEREAS, At the time of the levying of the 1931 general taxes
for the City of Rochester, Minnesota, no provision was made for the payment of
the maturity December 1st, 1932, of $169000.00 City of Rochester 4 Sewage Disposal
Plant Bonds, and 05000.00 City of Rochester, Minnesota, 42-% Improvement Bonds (New
Central Fire Station) which action was taken with the intention that these maturities
would be paid from profits from the operation of the local municipally owned public
utilities and
w.gEREAS, There are profits from the operation of the local municipal
owned public utilities which are over and above the needs for depreciation reserve,
extension, payment of public utility bonds, etc., and
WHEREAS, It is deemed for the best interest of the citizens of the
City of Rochester, Minnesota, that an appropriation of $21,000.00 to meet the
above mentioned bond maturities be made from public utility funds;
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the Public Utility Board of said City be and the said Board is
hereby authorised to appropriate $219000.00 from the Public Utility Fund for payment
the Sinking Fund of said City, for payment of the December lst,19321 maturity of
$59000.00 City of Rochester, Minnesota, 4�% Improvement bonds (New Central Fire
Station), dated February 1st ,19 0, and numbered 69 79 80 9, and 10; and $16,000.00
City of Rochester, Minnesota, 4, Sewage Disposal Plant Bonds, numbered 109 to 124
inclusive, dated September lst91924."

.Alderman Moody introduced a resolution appropriating $1109.60 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund,for
payrolls for labor during the weeksending August 26th91932, and August 19th91932,
which was read.

adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $485.10 from

the Sewer Fund and ordering payment made to the City of Rochester, Light Department,
,for power furnished at the Sewage Disposal Plant, in accordance with the billing of
August 15th,1932 , which was read.
Upon iAotion by Miller, second by Moody, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Miller introduced a resolution appropriating $2250-27 from t
General Fund an4 ordering payment made to the City of Rochester, Water Department,
water furnished for street flushing and sprinkling, which was read.
Upon motion by Hicks, second by Moody, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.

$897055 from the General Rind and ordering payment made to the Treasurer of
the State of Minnesota, for cost and expense of the examination of the
books and records of Burt W. Eaton, as executor of the George Healy Estate,
their draft No.63353, dated January 8th,19321 which was read.
Upon motion by'Noody, second by Hicks, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Alderman Hicks,introduced the following resolution, which -
was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of $3521005 is hereby appropriated and paid to
the Co -Operative Oil Company, for gasoline, and kerosene, furnished during
the period July 12th,19329, to August 8th,1932,inclusive, $1.80 thereof to
be from the Sewer Fand, $213.53 thereof to be from the General Fund, and
$137.72 thereof to be from the Street and ,Alley Fund.
The Mayor and City Clerk are hereby authorized and directed
to draw warrants upon the City Treasurer and make payment accordingly."
Upon motion by Miller, second by Norton, that the said
resolution be adopted as read, and all voting in favor thereof, President

Alderman Hicks, introduced a resolution appropriating
$898,80 from the New City Hall $and and orderin,7 payment made to the Metal
Office Furniture Company, as assignee of the Luger-Buur Furniture Company,
as payment of balance on contract for the furnishing of steel furniture for
the new City Hall,offices, which was read.

Alderman Norton introduced a resolution appropriating $392 -2 7
from the New City Hall Fund and ordering payment made to the Fisher Company,
assignee of the Schmidt Printing Company, as balance due on contract for the
furnishing of wood furniture for. the City Hall offices, which was read.
Upon motion by Hicks, second by .filler, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
Upon motion by Hicks, second by Miller, the City Engineer
was instructed to disregard instructions given at the council meeting held
August 20th,1932, relative to the preparation of plans, profiles and
specifications and estimate of cost for three different types of bridges
over Bear Creek on Fourth Street Southeast, and instead, submit plans,
