10 -- --,� _-_ -- ------------------- Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Counell Chambers, in the City Hall, iA said City, at 7:30 o'clock P.M., on September 19th, f = 19 32. Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman , Hicks, Miller, Moody. Absent: Norton. i Upon motion by Dallman, second by Moody, the minutes of the meetings held on August 29th91932, .and September 6th919329 were each approved. This being the time and place fixed for the opening of proposals for the furnishing of all labor, materials, equipment, etc., necessary for the construction of a combination I -beau and concrete deck t bridge over Bear Creek, on Fourth Street Southeast, the following proposals were opened and read: L. M. Feller: Lump sum price of $20,870.00, $24.00 per cu* yd. for extra concrete in place, $.04 per pound for extra reinforcing steel in place, $.04g per pound for extra structural steel in place, $.60 per foot for extra timber piling in place; G. Schwartz & Co.: Lump sum price of $229450.001, $18.00 per cubic yard for extra concrete in place, $03 per pound for extra reinforcing steel in place, $.03�- per pouted for extra structural steel in place, $.70 per foot for extra timber piling in place; Bland Engineering Company: Lump sum price of $24,9804000, $21.00 per cu. yd. for extra concrete in place, $005 per pound for extra { reinforcing steel in place, $.08 per poulLd for extra structural steel in ! place, $.60 per foot for extra timber piling in place. President Liddle referred the above proposals to the Street & Alley Committee and the City Engineer for tabulation and recommenda- tions. Alderman Norton came in at this time and took his Chair. Members of the Rochester Township Board asked that they be considered when arrangements are made for the disposal of the oldBear Creek Bridge, and upon motion by Hicks, second by Amundsen, the Street & Alley Committee, and the City Engineer were authorized to dispose of this i bridge* j The City Clerk presented and read the following i veto by the Mayor on the resolution passed and adopted by the Common Council of said City September 6th919329 accepting the proposal of the i Mack -International Motor Truck Corporation for the furnishing of one type i 95 Quadruple Bombination rotary pumps booster, ladder, hose body and engine, 0 and equipment, for the sum of $14,250.00, and asked that record be made of the fact that on September 7th91932; Mayor Julius J. Reiter signed and placed his approval on the said resolution; that on September 8th he came to the office of the City Clerk and asked to take this resolution for the purpose of making a study as to whether or not the Mack-- equipment could comply with the specifi cationp; and that on September 10th9l9329 he returned the said resolution to the City Clerk and removed his signature therefroa�by scratching through it with ink, and left with the said City Clerk his vetot above mentioned: "CITY OF ROCHESTER, MINNESOTA Julius J. Reiter Mayor September 9, 1932. To the Honorable C#4uncil of Rochester, Minnesota. Gentlemen:- I hereby return the resolution past by your honorable body regarding the "Mack International Motor Truck Corporation" unsigned for the following reasons:- 1. From information gained from you discussions I find that this truck fails to meet the specifications of the truck advertised for. 2. We have in the past invariably refused to purchase articles failing to meet specifications and it is my thought that it is poor policy to break this unwritten rule. 3. If the Council desire to purchase a truck other than one of the Big Three, the specifications should be so -written that all who desire may bid. 40 As between the bid accepted by the Council and the bid made by the "Buffalo Company" it is my belief that the Buffalo Comparq's offer came nearer to meeting the specifications than those of the "Mack Company" and the offer was $1700.00 less. 5. The fire committee after investigating voted two to one in favor of the "Buffalo Truck" and it seemes to me that this recommendation should have been taken as it would have saved the city $1700,00. 6. On the committee considering this matter were appointed City Attorney Spillane and Fire thief Ginther to act with the aldermen. I do not believe that these appointed city officials should have the ri'ght to vote on a committee such as this or on�.-any :other committee having city business in hand. The duty of the City Attorney was to pass upon the legality of these bids and at this point his lawful power ceased; Mr. Ginthers duty was to give expert opinion upon the efficiency of the trucks and here his legal power ceased. Neither of these men had a right to vote or to use influence intended to turn the opinion of the alderman. The respodsibility of making selection was entirely with the alderman. 7. Therefore I recommend that you readvertise for bids on fire trucks and that the specificationsbe broad enough to take in all trucks on the market and if you are going to• make a purchase outside the standard big three you will undoubtedly be able to save the city several thousand dollars as compared with the bid you accepted. " �1 President Liddle put the motion that shall the said reso- lution accepting the proposal of the Mack -International Motor Truck Corporation be adopted niotwithstanding the Mayor's veto, and called for the vote, which was: ayes: Dallman, Hicks, Norton. Nays: Amundsen, Miller, Moody; President Liddle not voting because if his vote would have been a favorable vote it would not have made a total of the five sevenths required for passage over the Mayor's veto. Upon notion by Hicks, second by Moody, it was ordered that the certified chick which accompanied the Mack -International Motor Truck Corporation proposal , be returned to them. The following report relative to proposals for bridge construction was read, and President Liddle ordered that the same be placed on file: Sept. 199 1932 Hon. " The valance sheet, income statements, etc., of the Public Utility Departments, prepared by the Secretary of the Public Utility Board as of August 31st91932, were laid before the Common Council, and President Liddle ordered that the same be placed on file; the said income statements showing a net profit in the .Light Department for the month of August919321 I 0 a of $4964.80, and for the five months of this fiscal year of $47,550.99, and a net profit in the Water Department for August,1932, of $2442.10, and for the five months of this fiscal year of -912,599.35, with no income statement submitted as to the operation of the Steam Heating Department. 1 The report of the Clerk of the Municipal Court, for the week ending September 5th91932, showing cridinal fines collected $37900 9 civil fees received $2.35, and court costs charged to Olmsted County $25.75, was read, and President Liddle referred the same to the City Attorney. The City Engineer's trial balance for August,19321, was laid -before the Common Council, and President Liddle ordered that the same be placed on file. The report of the Health Officer for the City Farm, for the month of August,1932, showing receipts in the amount of $1789.469 disbursements in the amount of $1334,34, and a $135069 balance on hand,arene read, and President Liddle ordered that the same be placed on file. General Balance sheet, trial balance, Fund statement, statement of unexpended budget approptiations,ete., of the City of Rochester, Minnesota, prepared by the City Clerk as of August 31st,19329 was laid before the Common Council, and President Liddle ordered that the same be placed on file. Communications from the Minnesota Department of Health, Division of Sanitation, and from Dr. D. C. Lochead, being a report on the milk sanitation status of Rochester, Minnesota, May 16th,1932, to May 20th, 1932, were each read, and President Liddle ordered that the same be placed on file. The applications of Charles A. Van Campen for a public dance permit r at the Masonic Temple September 22nd,19321, and of Company C. 205th, Inf. Minnesota National Guard, for public dance permit at the National Guard Armory, September 24th, 1932, and October 1st, ; 9th, and 15th,1932 , were each read. The applications of C. E. Hamilton, and Carl A. Theel, for soft drink dealer licenses, were read, and upon motion by Dallman, second by Hicks, licenses were granted. The applicationsof Peter Griffin, R. C. Burke, Mrs, Wm. Holland, and Mrs. Verla DeWitz, for solicitor's licenses, were each read, and upon motion by Hicks, second by Miller, licenses- were granted. A petition,signed ay nine residents of that locality, asking that a foot bridge be constructed across Cascade Creek on Ninth Avenue Northwest, was read, and President Liddle referred the same to the Street & Alley Committee, and the City Engineer. Alderman Amundsen introduced a resolution accepting the proposal of F L.M. Feller, for the construction of a o - � combination I-beam and concrete deck bridge over Bear Creek on Fourth Street Southeast, and fixing the amount of the surety bond to be given by the said contractor at the sum of $219000000, which was read. Upon motion by Miller, second by Hicks, that the said resolution be 11adopted as read,and all voting in favor thereof, President Liddle declared the said j;resolution duly passed and adopted. 20 t� Upon motion by Moody, second by Norton, it was ordered that the certified , checks of the Bland Engineering Company and of G. Schwart z & Company,the unsuccessful bidders for the construction of the said bridge be returned to them. Upon motion by Hicks, second by Moody, the Mayor and City Clerk vfere authorized and directed to draw warrants upon the Bridge Fund for the return of the $15.00 each due the Bland Engineering Company and L. H. Sault upon the return of the plans- and specifications which they have for the above mentioned bridge. was read: Alderman Norton introduced the following resolution, which "WHEREAS, A transfer within the Fire Protection Fund of said City, in the amount of $5,000.009 has heretofore been made, creating funds to apply on the purchase price of a quadruple pumping, booster, ladder and hose body engine and equipment,. for use of the Fire Department of said City, and WHEREAS, A 1931 tax levy was made to realize funds for the same purpose, and WHEREAS, To this date no use for these funds has been made until there is an accumulation in the City Treasury of $9163:449 and WHEREAS, It is deemed for the best interests of the Citizens of the City of Rochester, Minnesota, that the above -mentioned accumulated funds be transferred from the purpose• for which they were levied and accumulated and made to apply for payment of salaries of the personnel of the Fire Department of said City; thereby to reduce the tax levy for the year 1932; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That there is hereby appropriated from Code 6 of the Fire Protection Fund of said City the sum of �9163.44, and it is ordered that the said sum be paid to the Fire Protection Fund, Code 19 of said City, for transfer of the said sun from Funds for the purchase of a quadruple pumping, booster, ladder and hose body engine and equipment to Funds for payment of salaries of the personnel -of -the Fire Department of said City. The Mayor and City Clerk are hereby authorized and directed to draw a warrant upon the City Treasurer and make the said transfer accordingly." A motion by Norton, second by Moody, that the said resolution be adopted as read, carried by the following vote: Ayes: Dallman, Moody, Norton, Liddle. Nays: Amundsen, Hicks, Miller• The claim of LAVera C. Waldron and husband, Robert G. Waldron, $254 00 9 for use of road to gravel pit during 1931, and 1932 (to date in 1932), was read, and upon motion_ by Norton, second by Miller, action thereon.. was deterred until final settlement is made with the TNaldrons. Upon motion by Mllmpn, . s-econd by Moony':, the sum of. $,120.00 was appropriated from the Genetb611F4nd and it was ordered that the said sun be paid to Mrs. Catherine Fritsch, as compensation for the death of Christopher F.Fritsch, during the period s.July 27th., • 1932, to September 6th, 1932, inclusive. 12 Copy of requisition by the Health Officer upon Saint Mary's Hospital, for the isolation of Eugene Nordby, age four and one-half years, living at B26 First Street Northwest, diagnosed to be suffering from poliomyelitis, was read, and President Liddle ordered that the same be placed on file. The appointments by the Mayor of Carlton E. Anderson, as a Special Patrolman during the periods September l0th,1932, to September 16th,19329 and September 17th,1932, to September 23rd,1932, were each read; and President Liddle ordered that the same be placed on file. The followIng:::memorendum was read, and President Liddle ordered that, the same be placed on file: "Rochester Public Library Rochester - Minnesota From minutes of Board, September 2, 1932. A motion was made and seconded that Miss Stevens draw a check on the Transient Fund for $1509 the same to be deposited in the Walter Hurlbut Book Fund. " Upon motion by Dallman, second by Amundsen, the City Clerk was instructed to call upon all department heads for their Proposed -budgets to be included in the 1932 tax levy. The following report was read, and President Liddle ordered that the same be placed on file: " 9-19-32 Hon Gentlemen of the Council The Street and Alley Come and the City Engin beg to report that a foot bridge in 9th Ave. N W over Cascade Creek to properly care for foot passengers will cost about $450.00 This amount may change after we have time to make a sketch of a structure. Miller Be Amundsen Tom Moody C.E.Armstrong, City Engrg" Communications from the Rochester Automobile Club, and from the Good Roads Committee of the Chamber of Commerce, relative to "Thru-City" markers to route the buying traffic off from trunk highway.:, 7 and trunk highway 20, through the center oit the business district and -thel.;extension of white way on Broadway Street South,and a modern installation of white way on Second Street Southwest, were each read, and President Liddle ordered that the same be placed on file. The City Clerk announced the refukal of G.Schwartz & Company to pay for S01.00 for gravel furnished in 1931 by the City Engineer's Department, and upon motion by Norton, second by Miller, the City Clerk was instructed to charge off the 411000 for gravel furnished to G.Schwartz & Company. Upon motion by Hicks, second by Moody, the'City Clerk was instructe4 ! 11 to charge off the $4.00 account against Dr. E. S. Judd for gravel furnished during 1931 by the City Engineer's Departments The following communication was read, and upon notion by Miller, second by Moody, the Mayor and City Clerk were authorized and directed to draw a duplicate warrant mentioned therein and stop payment on the original: Mr.' A. Alderman Dallman introduced a resolution granting public dance permit to Company C. 205th, Inf.-Minnesota National Guard, for the National Guard Armory, September 24th919329 and Octover 1st, 8th, 15th, 1932, and fixing the fee at $12.00, which was read. Upon motion by Dallman, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution: --duly passed and adopted. Alderman Dallman introduced a resolution granting public dance permit to Charles A. Van Campen for the Masonic Temple September 22nd, 1932, and fixing the fee at $3409 which was read. Upon motion by Miller, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Honorable E. J. Pearlove, State Comptroller of the State of Minnesota, be and he is hereby requested to make an examination of the books and records of the City of Rochester, Minnesota, for and during the period April 1st, 1931, to March 31st919329 and Be it further resolved by the said Common Council: That the City Clerk of said City is hereby directed to furnish the said Comptroller with a certi- fied copy of this resolution and make respectful request that this examination be made." Upon motion by Hicks, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $213.16 from the Park Improvement Fund and ordering payment made to the Olmsted County Oil Company for gasoline,ete., furnished, which was read. Alderman Miller introduced the f©llowing resolution, which was read: "WHEREAS, Theodore 0. Johnson, Jebora E:Fairchild, Elizabeth Fairchild, Frances Fairchild, Donald Johnson, and Allen Johnson, have, through their attorneys Allen & Allen of Rochester, Minnesota, refused to.accept the 05000-00 warrant drawn. payable to them on the General Fund of the City of Rochester, Minnesota, August 9th919329.City Clerk's warrant No.24889 and Whereas, The Charter of the City of Rochester, Minnesota, Section 206, provided that on refusal to accept the 'award, the dmount shall be deposited and set up to the credit of the parties entitled thereto; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said warrant No.2488 shall be deposited, and set apart in the City treasury df said City, as a credit to the parties above mentioned, there to be known and carried as the Theodore 0. Johnson, et. al. Fund, to be disbursed upon their claim or "that of their attorneys for it." Alderman Norton introduced a resolution appropriating $914*35 from the Park Imprev-smient`Ifthd and ordering payment made to the Mayo Trust Fund for Payrolls for labor during the period of the weeks ending September 9th,1932, and September 16th91932, which was read. Upon motion by Amundsen, second by Norton, that the said res olution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Norton introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Public Utility Board of said City be and said Board is hereby authorized to enter into contract with L.M.Feller, for all labor, equipment and materials, necessary for the repairs and gunniting of the Hydro -electric power dam, Ter a total sum of $5983.54 based on unit prices for estimated quantities, in accordance with his proposal of September 14th, 1932. The amount of the surety bond to be given by the said contractor is hereby fixed at the sum of 598500." 127 Upon motion by Moody, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the sai resolution duly passed and adopted. President Liddle referred the matter of the purchase of blankets t for use in the City jail to the Purchasing Committee. Upon motion by Hicks, second by Amundsen, the City Engineer was instructed to prepare plans, profiles, specifications and estimate of'cost for the resurfacing with brick of Sixth Street Southwest between the east line of Second Avenue Southwest and the east line of Seventh Avenue Southwest, and for the repair of the curbing on the said part of Sixbh Street Southwest.
