HomeMy WebLinkAbout09-26-1932P - Minutes of an adjourned regular meeting of the Coon GCouncil of the City of Rochester, Minnesota, held in the Council Chambers, fi I in the City Hall,in said City, at 7:30 o'clock P.M., on September 26th, 1932. meeting called to order by President Liddle" Roll Call: Present: Liddle, Amundsen, DTellman, Hicks, Miller, Moody, Norton. Absent: None. Upon motion by Dallman, second by Moody, the minutes, of the meeting held on September 19th919329 were approved. The report of the Clerk of the Municipal Court for the week ending September 12th91932 , showing criminal fines collected $236000 9 and court costs charged to Olmsted'County $7,25; and for the week ending September 19th919321, showing criminal fines collected $24420, civil fees. received $9059 court costs charged to Olmsted County, $3.609 and fines collected and remitted direct to the State Treasurer $.1000009 were ,each, separately read,and President Liddle referred the same to the City Attorney. The report of the Building, Electrical and Plumbing Inspector, for the month of August,1932, showing building inspection fees collected $26*009 electrical inspection fees $10 25, and plumbing inspection fees received $16,009 was read, and President Liddle referred the same to the Finance Committee. The application of Gi L4 Fellows, for a public dance permit at the Woodman Hall for September 28th919329 and October 5th and 12th,1932, was read. The following applications for Permits to place slid maintain signs, were each read, and upon motion by Hicks, second by Amundsen, f f permits were granted to each of the applicants: Olmsted County Oil Co. (3) , i John Cooper Company,'ome Bakery, Vincent Millinery, Dr. C. R. Graham, Paschke Hotel, Earl Irish (2) , Olaf Dalsbo, Garden House,Botsford Lumber Co. , Metropolitan Hotel, (2) , J. A: Leif erman (2) , West Motor Company (2) , Dodge Lumber & Biel Co., Mengedoth & Popple, Olmsted County Bank, Dorman Hotel, Warren Yates. The appointment by the Mpyor of Carlton E: Anderson, as a Special Patrolman September 24th,1932, to September 30th,1932,inclusive, was read, and President Liddle ordered that the same be placed on file. The following assignment was read, and in that c onn ect ion the City Clerk submitted as a matter of record, copy of Municipal Court records on his disclosure in garnishment made against James Dewey, the sai d copy of disclosure being quoted as follows: 1_29 " Rochester, Minnesota. Spillane, the sum of thirty-three 433.00) Dollars, which is the balance of the unearned public dance license fee heretofore paid to said City by me on the llt h day of July, 1932. Circumstances over which I had no control made it impossible for meto conduct all of the thirteen dances orij*inally planned and I was able to hold only two of them* Consequently I respectfully request that you kindly pay over to Janes T. " Upon motion by Norton, second by Amundsen, the above assignment made by James Dewey in favor of James T..Spillane, was accepted, and the appropriati for refundnent was granted, and $33.00 was appropriated from the General Fund for payment to James T. Spillane, as Assignee of James Dewey, for refundment of $ 3.00 each for bleven dance;:permit dates, which were not used. The claim of Herman Dornack, $3.00, for labor cleaning six flush valves, in the City Hall building, was read, and President Liddle referred the same t, the architect, Mr. Peter P. Bross. The following communication was read, and President Liddle referred the same to the Architeet, Mr., Peter P. Bross: "G. Schwartz & Company General Contractors Rochester, Minn. Sept. 23, 1932 Mr. A. F. Wright,, City Clerk Rochester, Minn. Dear Sir: Our contract on the City Hall Building provides that final payment shall be due and payable thirty days after completion of the work and acceptance by the Common Council. This building was accepted on May 23rd,1932, and the balance in full was due us three months ago. Yours very truly, G. Schwartz & Company GS:MC By G S of President Liddle referred the matter of steel frame work for bunks in the so-called tramp room in the City Hall basement, to the Police Committee' and the Chief of Police, 41:th request that the Mayor serve on the Committee for consideration of this purctDase. The following notice relative to Trunk Highway No.59 was read, and President Liddle ordered that the same be placed on file: " Dist 12 No. 19 STATE' OF MINNESOTA DEPARTMENT OF HIGHWAYS Notice of Release of Temporary Trunk Highway. To A. F. Wright, City Clerk, Rochester, Minn, You are hereby notified that Trunk Highway No. 59 which has been on a temporary location between So.Broadway and 2nd Street in Rochester and StetartVille has been finally located by Order No.7159- 7163 As (a part of) the final locktibn is other than the location of the temporary trunk highway, the' portion of such temporary location which is not included in the final location will revert to the county, or subdivision thereof, originally charged with the care thereof, on Sept. 21, 1932, ut thich time the final location will be opened to traffic. (This :notice to be sent to the County Auditor, Count Highway Engineer, and - to the governing body of the local municipality4� The following communication from the County Auditor was read, and upon motion by Hicks, second by Amundsen, the sum of $93.61 was appropriated from the Sewer Fund for the delinquent sewer and interest assessment mentioned, and $38.42 was appropriated from the General Fund for the delinquent sprinkling assessments mentioned, both to be payable to John J. Wright City Clerk Rochester, Minnesota' Dear Mr. Wright: Ithen the State of Minnesota condemned property for the belt line in the City of Rochester, the whole of several lots and parcels of land were taken and the taxes for the years 1930 and 1931 have not been paid and arw now delinquent. The following copy of resolution passed and adopted by the Commissioners of the Sinking Fund was read, and upon motion by Moody, second by Miller, the action set forth therein was approved and it was ordered that the said copy of resolution be placed on file: "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of ;$4136.98 be appropriated from the Sinking Fund of said City and paid to the. Firs National Bank of Rochester,, M- Inne.sota, for $4,000.00 State of Minnesota 4- Rural Credit Bonds, maturin;? December lst,19391, at 102.18 to yield 3090%9 less/8, purchased from the First Securities Corpora- tion of St. Paul, Minneso A9000*00 , and forwarded through the said First National Bank of Rochester, Minnesota, the eof being principal on the said bonds, $82.20 premium on the said bonds, and 54.78 accrued interest June lst91932, to September 27th91932. This. appropriation is made $3061,65 from Sinking Fund Code 239 $4--1.07 from Code 24, 1020.55 from Code 259 and $13071 from Code 26." A communication from the City of Milwaukee Committee on Taxation and Financial Problems, relative to the issuance of national currency to municipalities on the pledge of their bonds, was read, and President Liddle ordered that the same be placed on file. Estimate by the City Engineer in favor of the Botsford Lumber Company, showing the sum of 01770077 as being due the caid contractor for the furnishing of 1279 sax of calcium chloride, at $27.90 per ton, less $.21 per ton discount, was read, and President Liddle ordered that the same be placed on file. The claim of A. G. Van Gemert, $64.509 for "4 Ave S. W. -Repairing sewer lift" was presented to the Common Council and their attention called to the fact that the said claim was not itemized as to materials and labor, and upon motion by Moody, second by Norton, ,an appropriation of 064.50 was made from the Sewer Fund for payment to A. G. Van Gemert. The Mayor's proposed budget for the 1932 tax levy, totaling 132,300.0( gover1ng;isp6tation of ,thq Police Department in said City for the. tax period June is ', 1933 to May 31st ,1934, was read, and President Liddle ordered that the same be plac d on file. Upon motion by Norton, second by Dallman, the City Engineer' was instructed to prellare plans, profiles and specifications for the surface drainage sewer project to relieve the drainage situation at Fourteenth Avenue Southwest and Fifteenth Avenue Southwest, ^.nd the City Engineer stated that his proposed route for this improvement was along the south siAde of the ternis courts to Sixteenth Avenue Northwest, and thence on Sixteenth Avenue Northwest and Southwest to Second Street Southwest, and thence east to Fourteenth Avenue Southwest. Upon motion by Hicks, second by Amundsen, the City Clerk and the City Attorney were instructed to draw Proceedings for the issuance of $159000.00 4�% bonds with maturity December lst,1933, the proceeds om:`• which will be used for the repaving of and repairing of curbing on Sixth Street Southwest between the east line of Second Avenue Southwest and the east line of Seventh Avenue Southwest, which issuance of bonds will be under the provisions of the 1927 Session laws, whereby second class cities are empowered to issue bonds for such purposes. The City Engineer submitted, plans, profiles, specifications and estimate of cost for the said repaving and repairing of curbing on a if part of Sixth Street Southwest, his estimate of cost being done by day labor 412,704,0109 and if done by contract $14,3580-82. Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, It is deemed expedient and necessary that Sixth Street Southwest, between the East line of Second Avenue Southwest and the East line of Seventh Avenue -Southwest be repaved with No.l 2" vitrified paving •brick and that the curbing on the said part of Sixth 'Street South- west be repaired, and . WHEREAS, The City Engineer has prepared and submitted plans, profiles, specifications end estimate of cost for the said repaving and repairing of curbing; SO THEREFORE, Be it resolved by theCommon Council of the City of Rochester, Minnesota: That the said repaving and repairing of curbing on the said part of Sixth Street Southwest be made and done, theft the said plans, pro- files and specifications be adopted as and for the said repaving and repairing of curbing, that the same be placed on fi1e4 in the office of the City Clerk in said City, that the said estimate of cost be accepted and that the same be placed on file in the office of the City Clerk of said City, .and , Be it further resolved by the said Common Council: That the City Clerk of said City be and he is hereby authorizedand directed to advertise for sealed proposals for the furnishing of all labor, materials, equipment,etc., necessary for the repaving with No. 1 2�" vitrified paving brick of Sixth Street Southwest between the east line of Second Avenue Southwest 'amd the east line of Seventh Avenue Southwest, and for the repairing of curbing on the,said part of Sixth Street Southwest, which sealed bids will be received and opened at a meeting of this Common Council, which is to be held in the Council Chambers, in the City Hall, in said City, at 7:30 o'clock P.M., on October 6th,1932. Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which check and the amount of money.specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the bidder upon the letting of the contract to him shall Fail to enter into' the contract so let; the said Common Council reserving the right to reject any and all bids. -33 A surety bond written for the full amount of the contract by a surety company author zed to do business in the State of 1innesota, will be required with the contract. tPersonal bonds not to be accepted.) All proposals must be addressed to Mr. A...F: Wright Cit Clerk of Rochester, Minnesota, and shall have endorsed thereon "Proposal for V e repaving of and repairing of curbing on Sixth Street Southwest.' " Upon motion by Hicks, second by Amundsen, that the said resolution be adoptedas read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The following claims were read, and upon motion by Hitks, second by Amundsen, the same were allowed and the Mayor and City Clerk were authorized and directed to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: Acme Chemical Company $162.02, G. Alderman Miller introduced the following resolution, which was read: "Be it resolved b;f the Common Council of the City of Rochester, Minnesota: That the Public Utility Board of said City be and the said Board is hereby authorized and directed to enter into contract with L. A. Kepp Uantracting Company for the furnishing of all labor, materials, equipment,etc., necessary for the install_ition of ornamental lightin system on Broadway Street North together with the necessary underground duck sys em, for said lighting system, and additional underground to the alley,which ornamental lighting system shall consist of Union Metal standards with General Electric tops, at a lump sum price of $12809.00. The amount of the bond to be given by the said contractor is hereby fixed at the sum of 4512809.00. Upon motion by Miller, second by Dallman, that the said resolution be adopted as read, and all voting in favor thereof, except Aldermen Moody and Norton, who voted "Nay", President Liddle declared the said resolution duly passed andadopte Alderman Moody introduced the following reso lutionswhich was read: "WHEREAS, The Public Utility Board of the City of Rochester., Minnesota, have heretofore made arrangements for the rental of offices in the New City Hall in said City at $91,000.00 per year, or $750.00 par month, and WHEREAS, It is deemed for the best interests of the citizens of the City of Rochester, Minnesota, that the said $$99000.00 rental be placedin the Sinkin Funds of said City for the payment of City of Rochester 4*% Improvement Bonds New City Hall) , and WHEREAS under the provisions of the ordinance passed and adopted in the proceedings for the issuance of the said Improvement Bonds a condition is set up that the funds for th paayymment of the maturity December 1st ,1933, shall. be in the City Treasury otherwise h9,000.00 shall be levied in the 1932 levy for that purpose; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: t34 That the Public Utility Board of said City be and the said Board is hereby authorized and directed to appropriate 09900040 from the Public Utility Fund of said City for paymf*tto the Sinking Fund of said City, being for Pity Hall office rental, noon June'Sth,1933, to noon June Sth,19 34, which 9,000.00 shall, as in this resolution specified be then use for the payment of the December lst,11933 maturity of City o� Rochester 4 % Improvement Bonds (New City Hall) . Upon motion by Hicks, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating $17701077 from the General Fund and ordering payment made to Botsford Lumber Company for 1279 sax calcium chloride furnished under contract, which was read. I Upon motion by Millers second by Amundsen, that .the said resolution be -adopted as read, and all -voting in favor thereof, President • II Biddle declared the said resolution di.ily passed and adopted. Alderman Dallman introduced a resolution appropriating $130.66 from the Street and Alley Fund, $265019 from the &eneral Fund, n,nd 0.67 from the Sewer Fund, and ordering payment made to Skelly Oil Company for gasoline furnished during the period Aue*ust 16th,1932, to September 16th, 1932, which was read. Upon motion by Hicks, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President- Liddle declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution granting- public dance permit to G. L. Fellows, .for the Woodman Hall September 2eth,1932, and October 5th and 12th,1932, and fixing the fee at $9.00, which was read.. Upon motion by Moody, second by Amundsen, that the said resolution be adopted as read, andall voting in favor thereof, President •Liddle declared the said resolution duly passed and adopted. Upon motion by Miller, second by Amundsen, the City Clerk was authorized to provide for the printing of an additional 300 City Government booklets at the same price as the original order of 300. adjourned.
