Upon motion by Moody; second by Norton, that the said resolution be adopted as read, and all voting in favor thereof, President r Diddle °declared the said resolution duly .passed and 'adopted. • - Alderman Dallman Introduced a resolution granting public dance permit to Eastern Star Girls Club for the Masonic Templet October r 159 1932, and fixing a fee of $3000, mbich was read 139 Upon motion by Dallman, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof] President Liddle declared the said resolution duly passed and adopted: Alderman Miller introduced the following resolution; which was read: "Be it resolved by -the Common -Council of the City of Roches- ter, Minnesota: That the Public Utility Board of said City is hereby author- ized to enter into contract with the L. A. Kopp Contracting Company for the furnishing of all labor, equipment, materials, etc., necessary, except street lighting standards and the glassware, for the furnishing and in- stallation of ornamental lighting on Second Street Southwest from Second Avenue to Eleventh Avenue, for the sum of $6055400 The amount of the bond to be given by the said contractor is hereby fixed at the sum of $6055j00V" Upon notion by Miller, second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, except Alder- men Moody and Norton$- who voted "Nay% President Liddle declared the said resolution duly passed ,and adopted4 Alderman Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Public Utility Board of said City is hereby author- ized_ to' enter into contract with John A. Clark Electric Company for the furnish ing and installation of Elesco Street lighting, standards and g1dss ware for the ornamental lighting of 'Second Street. Southwest- from Second Avenue to Eleventh Avenue for the sum of $54021-647i The amount of the bond to be given by the said contractor is hereby fixe4 at the sum of $54050016" A motion by Hicks, second by Amundsen, that the said resoluvo tion be adopted as read, lost by the following vote: Ayes: Amundsen, Hicks$ Nays:" Dallman, Miller; Moody, .Norton Alderman Miller introduced the following resolution, which was read: "Be it resolved by the Compton Council of the City of Rooke-atee d Minnesota: That the Public Utility Board of said City be and the said Board is hereby authorized and directed to enter into contract with G. Schwartz & Company for the furnishing of all labor, materials, etc., necessary for the furnishing and applying, in accordance with the speoificatons, of approximately 1706 square feet of 1" T*MOB Lai.nated &acoustical tile to thb ceilings of the Public Utility Department offices in the City Hill, for the sum of 0670600, The amount of: .the bond to be given by the said Contractor is hereby fixed at the sum of $670i00." Upon motion by Miller, second by Moody, that the said resolu- tion be. adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Moody introduced the following resolution, which was read: WHEREAS; Through error in the sidewalk grade given by the City - Engineer's Department, or through error of the sidewalk contractor in not lay- 1 i.ngg this sidewalk- according to the City Engineer's grade, the sidewalk for 12I2 Sixth Avenue Southeast, was laid on a line approximately one foot at bo ve the p raper grade; and i 'WHEREAS* Order of this Common Council has heretofore been ' imade that this sidewalk constructed and laid in error be removed and that 'a new one be constructed and laid at the expense of the City of Rochester; ,Minnesota, and WHEREAS; C� C.. Pagenhart, has removed the said sidewalk which was constructed and laid in errors and constructed it and laid the new sidewalk on the proper grades under Job 16829 at a cost of $37069 which was paid to him from the Street and Alley Fund, Code* 6s by action of this Common Council at a meeting, held September 19ths 1932; SO THERE�'bRE* Be, it resolved by the Common Council of the City of Rochester, Minnesota: That the suety of $37.06 is hereby appropriated from the Street and Alley Fluid Code 1, and it is ordered that the said sum be paid to the Street and Alley Fund Code 6 * to rpimburse the said Code 6 for the I�expenditure made for the removal and new construction of the said sidewalk thereby placing the expense correcting it upon general taxation The Mpyor and City Clerk are hereby authorized and dir-- lected to draw a warrant upon the City Treasurer and make payment accord- ingly." f . Upon motion by Millers second by Amundsen, that the said resolution be adopted as read, and all voting in..favor thereof s President addle declared the said resolution duly passed and adopted4 Aldexuan Moody introduced the following resolution* which was reads "WHEREAS* The City Engineer of the City of Rochester, innesota has caused to be repaired, .cinder and in accordance with the pro- visions of Section 249 and 257, inclusive, of the Charter of the City of Rochester, Minnesota* sidewalks in the said City* and has filed with the City Clerk of said City a report of the cost of sn#ch sidewalk repairs in each case with a description of the lot or parcel of land abutting upon each sidewalk on which such repairs have been made, which said report is now on file in the office of the City Clerk of said City as aforesaid4 NOW T-FREFORE* Be it resolved by the said Common Council of said City of Rochester, Minnesota: That said Common Council will meet at 7:30 o'clock P.M4 * on October 24th, 1932, in the Council Chambers, •in the City ?Hall in said City, and will then and there levy assessments for the cost and expense of making the above mentioned repairs against the respective properties d lots benefited and abutting upon the sidewalk upon which said repairs have been made, according to the provisions of Section 253 of the Charter of the City of Rochester, Minnesota# determining the mode of such assess- i. f . ent for such repairs as aforesaid. Be it further resolved by said Common Council: That each E and all of the assessments so made by suit .Common Council pursuant to said Section 253 will be made by said Common Council unless sufficient cause e shown to the contrary and that objections to any particular assessment ust be filed with the City Clerk of said City one day, before the time i erein set forth. The City Engineer's proposed Budget for the 1932 tax levy was rebd, and President Liddle ordered that the same Pe placed on filed The following report of Qosts for Sprinkling, Flushing, and Treating of Streets raring the 1932 Season, was read, and President Liddle oriered that title same be placed on file: s "October 39 1932. Honorable Mayor and Common Council. City of Rochester, Minnesota: 1 Gentlemen: I respectfully report that the disbursements for sprin$lin& flushing, and furnishing and spreading calcium chloride(actual disbursements to this date) during the period April 19 1932, to September 309 19321, in- clusive, were $13;496d13, to which should be added $268442 for bills con- tracted during that period and e�inin unpaid at this date, making a total of $14,214v55, to which ahoulA .fie 4Q04& $2369409, as being estimate of the costs for the month of October, 1932 which basis is used pursuant to in- structions given at a meeting of the Common Council, held August 29, 19329 which then increases the total to $150583464 with further addition of $2432 40 as being the depreciation of sprinkling and flushing equipment during the sprinkling season of 19329 which basis is used in accordance with the decision made at a meeting of the Common Council, held August 20, 19329 which addition of depreciation charges added to the totals above .set forth makes the total of the 1932 sprinkling, flushing and treating to be $19016"31 The bills above mentioned as remaining unpaid and totaling $268042 are as follows* Rochester Cylinder Grinding Works $ i500 It. Upon motion by Amundsen, second by Dallman9 that the said resolution be adopted as read, and all vowing in favor thereof, President Liddle eclared the said, resolution duly passed and adopted. Alderman Amundsen introduced a resolution levying special ssessments for the sprinkling of the Alley running North and South between looks 10 and 19 in Original Plat and 10 and 19 in Moe and Olds Addition, and he Alley running North and South across Blocks 9, 239 329 37, and 46 in Origr nal Plat and Block 9 in Willsonis Addition, during the season of the year, , which was read. Upon motion by Dallman, second by Hicks, that the said r solution be adopted as read, and all voting in favor thereof, President,Liddle leelared the said resolution duly passed and adopted. Upon motion by Hicks, second by Amundsen, it was ordered that he resolution levying special assessments for. the sprinkling of Twelfth Street outheast, between Third Avenue and Eighth Avenue, be cancelled, as there was no sprinkling done on that part of Twelfth Street during 19320 The City Clerk presented a statement showing the total of the labove mentioned sprinkling assessment resolutions to be $129173.639 and President Liddle ordered that the same be placed on file. Upon motion by Hicks, second by Moody; the Mayor and City Clerk were authorized and directed to execute a bill of sale in favor of Rochester (Township covering the sale to them of the old Bear Creek bridge at $125:00d Upon motion by Hicks, second by Moody, the City Clerk was author ized and directed to notify the local Tax Relief Organizations that they each should appoint a committee to meet with the Finance Committee of the Common Council:; October llth, 1932, for consideration of the Finance Committee Budget land that they should arrange for these committees to attend the Common Council meeting, October 17th, 19329 which meeting will be devoted to Budget preparation (for the 1932 Tax Levy. Upon motion by Norton, second by Moody, the Street and Alley (Committee, were instructed to investigate the further need of John J. Kerr's services as Field Engineer in connection with the construction of the local natural gas distribution system. d Upon motion by Moody, second by Miller, the City Engineer was authorized and directed to make the necessary change in the Fourth Street South- east sewer manhole, as it is wffedted by the new Bear Creek Bridge ,construction. President Liddle referred the matter of a street light at the intersection of Trunk Highway 7 and Trunk Highway 20, and the installation of a (street .light at the north end of Thirteenth Avenue Northwest, to the Lighting IlCommittee.
