The report of the Milk Inspector for the six month§'=

Period ending October llth, 1932; and the Milk Inspector' s rwoort of
Grade "A" Pasteurized milk di stribut ors, Grade "A" raw milk distributors,
and Grade "B" producers; were each read, and President Liddle ordered
that the same be placed on file. f
The report of the Clerk of the Municipal Court, for the
week ending October 17th, 19329 showing criminal fines collected $20.40,.
civil fees received 02060; court costs charged to Olmsted County $4.609
and fines collected due to Olmsted County $10 00; was. read, and President
Liddle referred the same to the City Attorneys
Upon motion by Miller, second by. -Moody, the sum of $10400
was appropriated from the General Fund, and it was ordered that the
said sum be paid to Olmsted County, Minnesota; for local Municipal
Court fines collected due %o Olm'sted County, Vinnesota.
The application of R.:Mi Week/tor soft drink dealer's
license, was read, and upon motion by Miller, second by Amundsen, the
license was grantedi
The following communication was read, and President
Liddle ordered that the same be placed on file:

Re: Temporary Heat during construction of City Hall.
The meter reading for temporary heat used during the con-
struction of the City Hall Buildings up to the day that the plaster
bonding was started was 1429400 lbs; on January 25th, 1932v
Heat was required during this time in order that the pipe
lines which were later to be concealed behind furring tile, could be
tested under water pressure and that the water which would be left in
the traps would not freeze*
The Secretary of the Utility Board, Mr: Lentfer; has com-
puted the cost of the steam used during this period as $147AO; which
should be paid by the City to the Utility Board, since the Schwartz Co:
was not concerned with having heat during this period of time.
The Schwartz Company st art ed plastering on February 4t h"
1932 at which time the meter reading was 298,000 lbs. The cost of steam
used to this date was $258.46. The Schwartz Co. paid for steam used

after this date at a rate agreed upon by the Utility Board.
If the Schwartz Company is to be charged for the use of steam
from -the time that the plaster. bonding was started until actual plastering was
commenced then the chwartz Company is to be charged the sum of 1111408 (the
difference between 725%48 and 147 40 )
At the meeting of the Council which I attended when this was
discussed, it was decided that the matter be referred to the City Attorney,
Mr, Spillane.
The subject of Heat is mentioned in the Lathing and Plastering
'specifications under paragraph 129 page 46: 1
"Adequate temporary heat will be provided .by the General
Contractor for the proper execution of the work under this contracts"
Plaster bonding is mentioned under the same specifications
paragraph 3 page 44: ,
"Plaster shall be applied after 24 hours and within one week
after the walls have been coated with plaster bond."
Mr1i Schwartz contends that the plaster bonding sub -contractor
came to the job too early and applied the material on the ceilings before the
Schwartz Company was ready to follow up with his plastering sub -contractor.

Alderman Dallman introduced the following resolution, which was
"Be it resolved by the Common Council of the City of Roehestere
That the sum of $510,049 be and the said sum is hereby appro-
priated from the General Fund of said City and ordered paid to Theodore 0.
Johnson, Jeborah $. Fairchild, Elizabeth Fairchild, Donald Johnson and Allen
Johnson as payment in ful of moneys due them on account of the condemnation of a
part of Broadway Street South as the said lands are described in the proceedings
of the commissioners relative thereto.
The Mayor and City Clerk are hereby authorized and directed
to draw a warrant for said sum upon the City Treasurer in accordance -herewith,
and cause said payment 'to be made *
Upon motion by Norton, second b.# Amundsen, than the said resol-
ution be adopted as read, and all, voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted:
Alderman Miller introduced the following resolution; which was
read:
"Be it resolved by the, Common Council of the City of Rochester;
Minneso":
That the sum of $530:00 be and the said sum is hereby appro-
priated from the General Fund of said City and ordered paid to Patk Improvement
Fund, as reimbursement for labor, materials, etc., expended from the Park
Improvement Fund in the improvement of Slatterly Park, per sworn billing made
by Wm. Enke, Secretary of the Board of Park Commissioners October 20th, 19324
The Mayor and City Clerk are hereby authorized and directed to
draw a warrant for said sum upon the City Treasurer in accordance herewith, and
cause said payment to be made4"
Upon motion by Moody, second by Norton, that the said resol-
ution be adopted as read, and all voting in favor thereof, President Liddle de-
clared the said resolution duly passed and adopted:
Alderman Amundsen introduced the following resolution, which vas
read:.

" Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of $258%48 be and the said sum is hereby
ePProPriated from the New City Hall ,Funcl of said City and ordered paid
to the City of Rochester t;team Heating Department, for steam heat
furnished G. Schwartz & Company general contrattor on the construction
of the new City Hall, of which 4258 48 $1471W is paid as being the
City of Rochester's share 'of the said account, 14 ea for the 142,400
Pound reading at January 25th, 1932, when plaster bonding was commenced;
and $111i108 is G. Schwartz & Company's share for the charges from January
25th, to February 4th,. 1932, when plastering was commenced, which last
mentioned amount has been deducted from the final settlement with the
said contractor
The Mayor and City Clerk are hereby authorized and dir-
ected to draw a warrant for said sum upon the City Treasurer in accord-
ance herewith, and cause said payment to be made:
Upon motion by Moody; second by Norton; that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted,
Alderman Moody introduced the following resolution, which
was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of $36802 be and the said sum is hereby
appropriated from the New City Hall Fund of said City and ordered paid
to G. Schwartz & Company$ -as final payment on general contract for
construction of a new City Hall, being 048019= less $111408 which last
mentioned amount is deducted as the G. Schwartz & Company share of the
$258s48 account at the City of Rochester Steam Heating Department for
steam heat furnished up to February 4,th, 19329 the City of Rochester
assuming the cost of steam heat up to January 25th, 1932s the date at
which plaster bonding was, started, the meter reading at that time being
142,9400 pounds.
The Mayor and City Clerk are hereby authorized and directed
to draw a warrant for said sum upon the City Treasurer in accordance
herewith, and.cause said payment to be made"
Upon motion by Amundsen, second by Moody, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution ,duly passed and adopted.
Alderman Hicks came in at this time and took his Chair
The balance of the evening was devoted to preparation
of the, budget for the 1932 Tax Levy:
Upon motion by Moody, second by Norton, the Common
